FEDERAL WATER POLLUTION CONTROL ACT, SECTION 401

   The following permit applications and requests for Environmental Assessment approval and requests for Water Quality Certification have been received by the Department of Environmental Protection (Department). Section 401 of the Federal Water Pollution Control Act (FWPCA) (33 U.S.C.A. § 1341(a)), requires the state to certify that the involved projects will not violate the applicable provisions of sections 301--303, 306 and 307 of the FWPCA (33 U.S.C.A. §§ 1311--1313, 1316 and 1317) as well as relevant state requirements. Initial requests for 401 Water Quality Certification will be published concurrently with the permit application. Persons objecting to approval of a request for certification under section 401 or to the issuance of a Dam Permit or Water Obstruction and Encroachment Permit, or the approval of an Environmental Assessment must submit comments, suggestions or objections within 30 days of the date of this notice as well as any questions to the office noted before the application. Comments should contain the name, address and telephone number of the person commenting, identification of the certification request to which the comments or objections are addressed and a concise statement of comments, objections or suggestions including the relevant facts upon which they are based.

   The Department may conduct a fact-finding hearing or an informal conference in response to comments if deemed necessary. Each individual will be notified, in writing, of the time and place of a scheduled hearing or conference concerning the certification request to which the comment, objection or suggestion relates. Maps, drawings and other data pertinent to the certification request are available for inspection between of 8 a.m. and 4 p.m. on each working day at the office noted before the application.

WATER OBSTRUCTIONS AND ENCROACHMENTS

   Northeast Region:  Water Management Program Manager, 2 Public Square, Wilkes-Barre, PA 18711-0790.

   E52-183. Westfall Township Municipal Authority, P. O. Box 235, Matamoras, PA 18336, in Westfall Township, Pike County, U. S. Army Corps of Engineers, Philadelphia District.

   To remove the existing outfall structure at the edge of bank and to construct and maintain a submerged effluent diffuser outfall in the Delaware River (WWF), extending approximately 150 feet from the edge of the bank. The outfall will consist of a dual 12-inch DIP effluent lines, encased in concrete, with flow discharged via four diffuser openings. The outfall will be constructed using either:  (1) a temporary causeway and adjoining dewatered work cells, using gravel-filled sandbags; or (2) a portadam cofferdam. The temporary measures will extend approximately 200 feet from the bank and will occupy approximately 0.4 acre. The project is part of a wastewater treatment plant upgrade and expansion project and is located on the south side of SR 6/209, near the interchange of SR 0084 and SR 6/209 (Port Jervis South, NY-NJ-PA Quadrangle N:  18.5 inches; W:  12.5 inches).

   E13-136. Vacation Charters, Ltd., P. O. Box 592, One Lake Drive, Lake Harmony, PA 18624-0592, in Kidder Township, Carbon County, U. S. Army Corps of Engineers, Philadelphia District.

   To construct and maintain an outfall channel in the floodway of a tributary to Black Creek (HQ-CWF). The project is located approximately 1,500 feet west of the intersection of SR 0940 and the on-ramp to the Turnpike Northeast Extension (Hickory Run, PA Quadrangle N:  12.6 inches; W:  11.5 inches).

   E07-367:  R & K Creekside Farm, R. D. 2, Box 120A, Williamsburg, PA 16693 in Huston Township, Blair County, ACOE Baltimore District.

   To relocate and maintain 645 feet of stream channel averaging 7 1/2 feet in width and to construct and maintain a 51-inch by 66-inch arch culvert in the channel of an intermittent stream which is an unnamed tributary to Piney Creek (HQ-CWF) at a point along Route 866 (Franktown, PA Quadrangle N:  4.8 inches; W:  3.8 inches) for the purpose of providing access to an existing farm in Huston Township, Blair County. The project proposes to directly affect through relocation 645 linear feet of stream and 1.72 acres of floodway. This project description was published incorrectly as E06-367 at 33 Pa.B. 1269 (March 8, 2003).

   E34-108:  Department of Transportation, District 2-0, 1924-30 Daisy Street, P. O. Box 342, Clearfield, PA in Fermanagh Township, Juniata County, ACOE Baltimore District.

   To remove the existing bridge and then to construct and maintain a bridge with a span of 35.95 feet with an underclearance of 5.25 feet over Horning Run (CWF) on SR 1006, Section A02, Segment 0020, offset 0019 located about 3 miles north of Mifflintown Borough (Mifflintown, PA Quadrangle N:  20.5 inches; W:  5.0 inches) in Fermanagh Township, Juniata County.

   E38-139:  Department of Transportation, District 8-0, 2140 Herr Street, Harrisburg, PA 17103 in Union and Swatara Townships, Lebanon County, ACOE Baltimore District.

   To maintain a two span bridge of 123 feet each span on a 70 degree skew with a minimum average underclearance of 9.8 feet across Swatara Creek (WWF) on SR 1022, Section 001, Segment 0020, offset 2811 of de minimis wetland located about 1.2 miles north of the Village of Lickdale (Indiantown Gap, PA Quadrangle N:  16.85 inches; W:  0.85 inch) in Union and Swatara Townships, Lebanon County. The applicant will provide 0.01 acre of replacement wetland onsite.

   E44-118:  Department of Transportation, District 2-0, 1924-30 Daisy Street, Clearfield, PA 16830 in Menno Township, Mifflin County, ACOE Baltimore District.

   To remove the existing bridge and then to construct and maintain a 12-foot by 6.5-foot concrete box culvert at the channel of an unnamed tributary to Saddler Creek (TSF) on SR 0655, Section A02, Segment 0030, Offset 0006, located in Allensville Village (Allensville, PA Quadrangle N:  6.55 inches; W:  9.2 inches) in Menno Township, Mifflin County.

   E44-119:  Department of Transportation, District 2-0, 1924-30 Daisy Street, Clearfield, PA 16830 in Derry Township, Mifflin County, ACOE Baltimore District,

   To remove the existing bridge and to construct and to maintain a box culvert with a normal span of 23 feet with an underclearance of 5.5 feet at the channel of an unnamed tributary to Buck Run (TSF) on SR 4013, Section A02, Segment 0170, offset 0829 located about 1.5 miles west of Burnham Borough (Lewistown, PA Quadrangle N:  21.8 inches; W:  13.5 inches) in Derry Township, Mifflin County.

   E21-350:  Triple Crown Corporation, 5351 Jaycee Avenue, Harrisburg, PA, 17112 in Silver Spring Township, Cumberland County, ACOE Baltimore District.

   To construct and maintain two trapezoidal floodway channels to improve drainage and reduce floodway/floodplain limits through the site. Also, install and maintain three culverts, one 50 foot long 49-inch by 33-inch corrugated metal pipe, one 60 foot long 49-inch by 33-inch corrugated metal pipe and two 10 foot by 3 foot twin concrete box culverts. All are within a UNT to the Conodoguinet Creek (WWF), located on the north side of the U. S. Route 11 (Carlisle Pike) 1/2 mile west of the Ridge Road intersection (Mechanicsburg, PA Quadrangle N:  19.6 inches; W:  14.0 inches) in Silver Spring Township, Cumberland County.

   E22-456:  PPL Electric Utilities Corporation, GENN-4, 2 North Ninth Street, Allentown, PA 18101 in Lower Paxton and West Hanover Townships, Dauphin County, ACOE Baltimore District.

   To install and maintain seven aerial single pole electric line crossings including:  twocrossings over Beaver Creek (WWF), one crossing over a UNT to Beaver Creek (WWF), two crossings over a UNT to Beaver Creek (WWF) and its adjacent wetlands and two wetland crossings, all of which are waiverable under section 105.12(a)(3). Also, installation and maintenance of six access roads, of which three are regulated by GP-7, to cross wetlands with a total wetland impact of 0.25 acre. The project is located along Route 39 and then parallels the Piketown Road crossing U. S. Route 22 and Interstate 81 (Harrisburg East, PA Quadrangle N:  18.4 inches; W:  2.5 inches) in Lower Paxton and West Hanover Townships, Dauphin County.

   E31-187:  Juniata Valley School District, R. R.1 P. O. Box 318, Alexandria, PA 16611-0318 in Porter Township, Huntingdon County, ACOE Baltimore District.

   To rehabilitate and maintain a 725-foot reach of a perennial, unnamed tributary to the Frankstown Branch of the Juniata River (WWF) located directly behind the Juniata Valley High School (Alexandria, PA Quadrangle N:  11.1 inches; W:  10.65 inches) in Porter Township, Huntingdon County. The project will involve the excavation of pools, the placement of stone and cross vanes for riffle creation, the removal of a small island within the channel and floodway excavation and grading.

   E05-309:  Old Bedford Village, Inc., 220 Sawblade Road, Bedford, PA 15522 in Bedford Township, Bedford County, ACOE Baltimore District.

   To construct and maintain a temporary crossing and to rehabilitate an existing covered bridge across the channel of the Raystown Branch of the Juniata River (TSF) at a point approximately 3,500 feet downstream of Route 220 (Bedford, PA Quadrangle N:  7.3 inches; W:  1.1 inches) to provide access to Old Bedford Village in Bedford Township, Bedford County.

   E07-369:  Borough of Duncansville, 1146 3rd Avenue, P. O. Box 308, Duncansville, PA 16635 in the Borough of Duncansville, Blair County, ACOE Baltimore District.

   To remove the existing abutments and concrete bridge deck having a clear span of 10 feet, an average rise of 5.7 feet and an instream length of 20 feet and to construct and maintain concrete a box culvert having a clear span of 10 feet, a rise of 6 feet and an instream length of 38 feet at a point along 14th Street within an unnamed tributary to Gillians Run (CWF) (Hollidaysburg, PA Quadrangle N:  9.1 inches; W:  8.9 inches) in the Borough of Duncansville, Blair County.

   E36-756:  Paradise Sportsmen's Association, 339 South Belmont Road, Paradise, PA 17652 in Salisbury Township, Lancaster County, ACOE Baltimore District.

   To construct and maintain a stream restoration project (approximately 2,950 feet) within Pequea Creek (HQ, CWF) for the purposes of:  stream bank stabilization, improved sediment transport, establishment of riparian buffers and improved aquatic habitat while implementing a natural stream channel design approach consisting of the following construction activities:  channel relocation, stream and floodway excavation and filling, installation of rock vanes, cross vanes and J-hooks, riprap, root wad and log spur placement, beginning at a point just south of the intersection of Wanner and Jacobs Roads (Honey Brook, PA Quadrangle N:  9.5 inches; W:  11.1 inches) in Salisbury Township, Lancaster County.

   E67-735:  Turnpike Commission, P. O. Box 67676, Harrisburg, PA 17106 in Fairview Township, York County and Steelton and Highspire Boroughs, Swatara and Lower Swatara Townships, Dauphin County, ACOE Baltimore District.

   To construct and maintain the eastbound and westbound bridges of the Pennsylvania Turnpike (I-76) across the Susquehanna River (WWF) with a total length of 5,910 feet and then to demolish the existing bridge; to extend the length of the existing culvert by 103 feet long at the channel of Laurel Run (WWF) and to fill in .004 acre of wetland to rehabilitate I-76 from Milepost 245.72 to Interchange 19 (Steelton, PA Quadrangle N:  14.6 inches; W:  7.6 inches and N:  16.15 inches; W:  6.25 inches respectively) in Fairview Township, York County and in Steelton and Highspire Boroughs, Swatara and Lower Swatara Townships, Dauphin County. Project proposes .004 acre of de minimis wetland impact with no replacement required.

   Northwest Region:  Water Management Program Manager, 230 Chestnut Street, Meadville, PA 16335-3481.

   E25-666, Technica Development Corporation for Presque Isle Downs, Inc., 4800 Tramarlac Lane, Erie, PA 16505-1360. Presque Isle Downs Horseracing Facility, in Summitt Township, Erie County, ACOE Pittsburgh District (42°, 4`20" North; 80°, 1`, 48" West).

   To conduct the following activities associated with construction of the Presque Isle Downs horseracing facility south of I-90 east of SR 97:

   1.  To fill a total of 8.61 acres of 24 nonexceptional value wetland areas. Project includes the creation of a total of 10.56 acres of replacement wetlands at five areas within the project site.

   2.  To construct and maintain a prefabricated steel truss bridge having three 116.67-foot spans and a maximum underclearance of 23 feet across Walnut Creek (WWF-MF) approximately 3,000 feet upstream of SR 97.

   3.  To construct and maintain a prefabricated steel truss bridge having two 125-foot spans and a maximum underclearance of 15 feet across Walnut Creek approximately 4,800 feet upstream of SR 97.

   4.  To impact a total of approximately 11,808 feet of tributaries to Walnut Creek and elimination of approximately 12.1 acres of floodplain storage as a result of grading and fills associated with site construction, stormwater detention and wetland replacement. Approximately 1,576 feet of new open channel will be created near the north end of the site as part of the relocation of a tributary to Walnut Creek, restoration of approximately 1.79 acres of previously impacted floodplain of Walnut Creek, excavation to provide 11.8 acres of additional floodplain storage and construction of stream bank enhancement at nine locations along Walnut Creek.

   5.  To construct and maintain a 350-foot long reinforced concrete box stream enclosure having two 12-foot wide by 6-foot high waterway openings in the relocated tributary to Walnut Creek approximately 780 feet upstream of its mouth.

   6.  To construct and maintain a 249-foot long reinforced concrete box stream enclosure having two 12-foot wide by 6-foot high waterway openings in the relocated tributary to Walnut Creek approximately 175 feet downstream of the existing railroad line.

   7.  To modify and maintain the existing 50-foot long, 60-inch diameter steel culvert in a tributary to Walnut Creek on Footemill Road approximately 750 feet north of Robison Road.

   8.  To construct and maintain five stormwater outfalls to Walnut Creek and adjoining wetlands.

   9.  To fill an approximately 0.58 acre manmade pond at the northern end of the site.

   10.  To install and maintain sanitary sewer and water lines across Walnut Creek attached to the northern bridge.

   11.  To install and maintain a sanitary sewer line across a tributary to Walnut Creek on the southern end of the site.

ENVIRONMENTAL ASSESSMENTS

   Southcentral Region:  Water Management Program Manager, 909 Elmerton Avenue, Harrisburg, PA 17110.

   EA36-006. Lancaster County Conservation District, 1383 Arcadia Rd., Rm. 6, Lancaster, PA 17601, in East Hempfield, Lancaster County, ACOE Baltimore District.

   To construct and maintain a stream restoration project consisting of bank regrading, placement of rock vanes, log vanes, root wads, in-stream boulders, riparian plantings and streambank fencing, all for the purpose of enhancing bank stability and improving aquatic habitat within a 0.7 mile section of Swarr Run (TSF) beginning downstream of the SR 722 bridge (Lancaster, PA Quadrangle N:  15.1 inches; W:  0.9 inch) in East Hempfield Township, Lancaster County.

   The Department of Environmental Protection has taken the following actions on previously received permit applications and requests for plan approval.

   Persons aggrieved by an action may appeal, under section 4 of the Environmental Hearing Board Act (35 P. S. § 7514) and 2 Pa.C.S. §§ 501--508 and 701--704 (relating to the Administrative Agency Law), to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, 400 Market Street, P. O. Box 8457, Harrisburg, PA 17105-8457, (717) 787-3483. TDD users may contact the Environmental Hearing Board (Board) through the Pennsylvania Relay Service, (800) 654-5984. Appeals must be filed with the Board within 30 days of publication of this notice in the Pennsylvania Bulletin, unless the appropriate statute provides a different time period.    Description of Proposed Action/Activity:  Renewal of NPDES permit.

   NPDES Permit No. PA0040932, Sewage, Northwestern Lehigh School District, 6493 Route 309, New Tripoli, PA 18066. This proposed facility is located in Weisenberg Township, Lehigh County and discharge to tributary to Lyon Creek.

   Description of Proposed Action/Activity:  Renewal of NPDES Permit.

   NPDES Permit No. PA0064254, Sewage, West Mahanoy Township (Village of Lost Creek), 190 Pennsylvania Avenue, Shenandoah Heights, PA 17976. This proposed facility is located in West Mahanoy Township, Schuylkill County and discharges to Shenandoah Creek.

   Description of Proposed Action/Activity:  Issuance of NPDES permit.

   NPDES Permit No. PA0026000, Sewage, City of Allentown, 112 Union Street, Allentown, PA 18102-4912. This proposed facility is located in the City of Allentown, Lehigh County and discharges to the Lehigh River.

   Description of Proposed Action/Activity:  Renewal of NPDES Permit.

   NPDES Permit No. PA0061646, Industrial Waste, Pennsylvania American Water Company, 20 East Union Street, Wilkes-Barre, PA 18701. This proposed facility is located in Roaring Brook Township, Lackawanna County.

   Description of Proposed Action/Activity:  Renewal of NPDES Permit to discharge treated industrial waste to Stafford Meadow Brook.

   NPDES Permit No. PAS902202, Industrial Waste, Lehigh County Pretreatment Facility, 7676 Industrial Boulevard, Allentown, PA 18106. This proposed facility is located in Upper Macungie Township, Lehigh County and discharge to Little Lehigh Creek.

   Description of Proposed Action/Activity:  Issuance of individual NPDES Permit for stormwater discharge.

   NPDES Permit No. PAS202206, Industrial Waste, Aurora Equipment Co., 220 Main Street, Tatamy, PA 18088. This proposed facility is located in Tatamy Borough, Northampton County.

   Description of Proposed Action/Activity:  Renewal of individual NPDES Permit for stormwater to Bushkill Creek.

   WQM Permit No. 5203401, Sewerage, Lake Adventure Community Associations, Inc., 5000 Lake Adventure, Milford, PA 18337. This proposed facility is located in Dingman Township, Pike County.

   Description of Proposed Activity:  Replacement of existing sewers in Sections 2 and 3.

   WQM Permit No. 4002402, Sewerage, Suburban Wastewater Company, 762 West Lancaster Avenue, Bryn Mawr, PA 19010-3489. This proposed facility is located in White Haven Borough, Luzerne County.

   Description of Proposed Action:  Rerating of the existing permitted White Haven Wastewater Treatment Plant from 340,000 gpd to 450,000 gpd.

   NPDES Permit No. PA0031968, Sewage, Sam Corbin, Youth Forestry Camp 3, R. D. 1, Box 175, James Creek, PA 16657. This proposed facility is located in Todd Township, Huntingdon County.

   Description of Proposed Action/Activity:  Authorization to discharge to UNT Great Trough Creek in Watershed 11-D.

   NPDES Permit No. PA0082279, Sewage, Spring Creek Joint Sewer Authority, P. O. Box 373, Three Springs, PA 17264. This proposed facility is located in Clay Township, Huntingdon County.

   Description of Proposed Action/Activity:  Authorization to discharge to Three Springs Creek in Watershed 12-C.

   WQM Permit No. 2103401, Sewerage, Timothy R. Brenneman, 522 Highland Court, Carlisle, PA 17013. This proposed facility is located in North Middleton Township, Cumberland County.

   Description of Proposed Action/Activity:  Construction of sewage treatment plant to serve their single family residence.

   WQM Permit No. 0102406, Sewerage, Conrad Youse, Lutheran Camping Corporation of Central Pennsylvania, P. O. Box 459, Arendtsville, PA 17303-0459. This proposed facility is located in Menallen Township, Adams County.

   Description of Proposed Action/Activity:  Expansion of existing primary and secondary infiltration lagoons. Both lagoons will be lined with 60 mil HDPE liner. A new chlorine contact tank and wet well will be installed and new spray irrigation piping will be installed to route effluent to a 4.1 acre sprayfield site adjacent to Nawakwa Road to serve Camp Nawakwa.

   Northcentral Region:  Water Management Program Manager, 208 West Third Street, Williamsport, PA 17701.

   NPDES Permit No. PA0228621, Sewage, SIC 4952, Smithfield Township Authority, R. R. 2, Box 189, Columbia Cross Roads, PA 16914. This proposed facility will be located in Smithfield Township, Bradford County.

   Description of Proposed Activity:  The applicant has applied for an NPDES permit for the discharge of treated municipal wastewater from a proposed 60,000 gallon per day extended aeration wastewater treatment plant. The system will be owned and operated by the Smithfield Township Authority and will provide sanitary sewer collection and treatment for the area in and around the unincorporated Village of East Smithfield. The discharge of treated effluent will be to Tomjack Creek (TSF).

   WQM Permit No. 0802403, Sewerage, Smithfield Township Authority, R. R. 2, Box 189, Columbia Cross Roads, PA 16914. This proposed facility will be located in Smithfield Township, Bradford County.

   Description of Proposed Action/Activity:  A permit was issued for the construction and operation of a conventional gravity/low-pressure conveyance system (including a new pump station) and a new 60,000 gpd extended aeration wastewater treatment plant. The system will be owned and operated by the Smithfield Township Authority and will provide sanitary sewer collection and treatment for the area in and around the unincorporated Village of East Smithfield.

   WQM Permit No. 1403201, Industrial Waste 0921, Fish and Boat Commission, Bellefonte Fish Culture Station, 1150 Spring Creek Road, Bellefonte, PA 16823-8458. This existing facility is located in Benner Township, Centre County.

   Description of Proposed Action/Activity:  A WQM permit was issued to construct and operate an off-line aerated sludge storage tank for the hatchery wastewater treatment system. The sludge storage tank will be used to store sludge pumped from the clarifier during times when it cannot be applied to agricultural fields.

   NPDES Permit No. PA0115215, Industrial Waste SIC 4231, Lucas Trucking Corp., R. D. 5, Box 151, Jersey Shore, PA 17740. This existing facility is located in Piatt Township, Lycoming County.

   Description of Proposed Action/Activity:  Renewal of NPDES Permit to discharge 0.00072 MGD to unnamed tributary of West Branch Susquehanna River.

   The following NPDES Individual Permits for Discharges of Stormwater Associated with Construction Activities have been issued.

   Persons aggrieved by an action may appeal, under section 4 of the Environmental Hearing Board Act (35 P. S. § 7514) and 2 Pa.C.S. §§ 501--508 and 701--704 (relating to the Administrative Agency Law), to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, 400 Market Street, P. O. Box 8457, Harrisburg, PA 17105-8457, (717) 787-3483. TDD users may contact the Environmental Hearing Board (Board) through the Pennsylvania Relay Service, (800) 654-5984. Appeals must be filed with the Board within 30 days of publication of this notice in the Pennsylvania Bulletin, unless the appropriate statute provides a different time period. Copies of the appeal form and the Board's rules of practice and procedure may be obtained from the Board. The appeal form and the Board's rules of practice and procedure are also available in Braille or on audiotape from the Secretary to the Board at (717) 787-3483.
