PUBLIC WATER SUPPLY PERMITS The Department has taken the following actions on applications received under the Pennsylvania Safe Drinking Water Act (35 P.S. §§ 721.1—721.17) for the construction, substantial modification or operation of a public water system.
Persons aggrieved by an action may appeal that action to the Environmental Hearing Board (Board) under section 4 of the Environmental Hearing Board Act and 2 Pa.C.S. §§ 501—508 and 701—704. The appeal should be sent to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, 400 Market Street, P.O. Box 8457, Harrisburg, PA 17105-8457, (717) 787-3483. TDD users may contact the Board through the Pennsylvania AT&T Relay Service, (800) 654-5984. Appeals must be filed with the Board within 30 days of publication of this notice in the Pennsylvania Bulletin unless the appropriate statute provides a different time period. Copies of the appeal form and the Board's rules of practice and procedure may be obtained from the Board. The appeal form and the Board's rules of practice and procedure are also available in Braille or on audiotape from the Secretary to the Board at (717) 787-3483. This paragraph does not, in and of itself, create a right of appeal beyond that permitted by applicable statutes and decisional law.
For individuals who wish to challenge an action, the appeal must reach the Board within 30 days. A lawyer is not needed to file an appeal with the Board.

The project is known as the Fermanagh Township Act 537 Sewage Facilities Plan 2018 (DEP Code No. C1-34904-ACT). The plan provides for the extension of public sewer to the areas of the Township delineated in Appendix 4 of the Plan as area 1, 2 and 4 within five years of this Act 537 Plan approval. A low-pressure collection system will be constructed to serve these residents. All flow will be conveyed to the Twin Boroughs Sanitary Authority's (TBSA) Wastewater Treatment Plant. Existing agreements are in place that reserve adequate capacity for the treatment of the proposed flows from Fermanagh Township to the TBSA facility in Mifflin Borough. The proposed wastewater treatment collection system will be owned by Fermanagh Township, and operated and maintained by TBSA through a lease agreement. The Plan also provides for the development and implementation of an on-lot sewage disposal system (OLDS) management program with a three-year inspection and pumping cycle to begin in 2019. The Department's review of the sewage facilities update revision has not identified any significant environmental impacts resulting from this proposal. Any required NPDES Permits or WQM Permits must be obtained in the name of the municipality or authority, as appropriate.
LAND RECYCLING AND ENVIRONMENTAL REMEDIATION

PREAMBLE 2
The following plans and reports were submitted under the Land Recycling and Environmental Remediation Standards Act (35 P.S. §§ 6026.101—6026.907).
Provisions of Sections 301—308 of the Land Recycling and Environmental Remediation Standards Act (act) (35 P.S. §§ 6026.301—6026.308) require the Department to publish in the Pennsylvania Bulletin a notice of submission of plans and reports. A final report is submitted to document cleanup of a release of a regulated substance at a site to one of the act's remediation standards. A final report provides a description of the site investigation to characterize the nature and extent of contaminants in environmental media, the basis for selecting the environmental media of concern, documentation supporting the selection of residential or nonresidential exposure factors, a description of the remediation performed and summaries of sampling analytical results which demonstrate that remediation has attained the cleanup standard selected. Submission of plans and reports, other than the final report, will also be published in the Pennsylvania Bulletin. These include the remedial investigation report, risk assessment report and cleanup plan for a site-specific standard remediation. A remedial investigation report includes conclusions from the site investigation; concentration of regulated substances in environmental media; benefits of reuse of the property; and, in some circumstances, a fate and transport analysis. If required, a risk assessment report describes potential adverse effects caused by the presence of regulated substances. If required, a cleanup plan evaluates the abilities of potential remedies to achieve remedy requirements.

A work plan for conducting a baseline remedial investigation is required by the act for compliance with selection of a special industrial area remediation. The baseline remedial investigation, based on the work plan, is compiled into the baseline environmental report to establish a reference point to show existing contamination, describe proposed remediation to be done and include a description of existing or potential public benefits of the use or reuse of the property. The Department may approve or disapprove plans and reports submitted. This notice provides the Department's decision and, if relevant, the basis for disapproval.

General Permit No. WMGR052 Base. The Department of Environmental Protection (Department) has issued a permit modification to General Permit No. WMGR052 (WMGR052). The previously effective version of WMGR052, issued March 5, 2016, authorized the beneficial use of low permeability cementitious (LPC) material, a mixture of lime, flue gas desulfurization (FGD) sludge, and coal ash from coal-fired power plants. The term ''LPC material'' was revised to ''stabilized FGD material'' in this modified WMGR052. Stabilized FGD material is defined in modified WMGR052 as a mixture of lime, FGD and coal ash. FGD may include one, or a combination of, the following: Gypsum, non-oxidized FGD sludge or dry FGD residue.
A person that proposes to process, by mixing of approved materials, to produce stabilized FGD material for beneficial use in mine reclamation by operating under the terms and conditions of modified WMGR052 after the date of permit issuance must apply for and obtain a ''Determination of Applicability'' (DOA) from the appropriate Department Regional Office having jurisdiction over the processing or beneficial use facility (see list attached to the general permit) prior to commencing authorized activities under WMGR052. A completed application on forms available from the Department must be submitted to the appropriate Department Regional Office.
Persons intending to beneficially use stabilized FGD material for mine reclamation activities must first obtain a mining permit or revision to a mining permit or to execute a reclamation contract with the Department for the use of the stabilized FGD material in the reclamation of the site. The suitability of the stabilized FGD material for beneficial use, including a review of the existing groundwater and surface water quality and flow, along with an evaluation of the separation between the area where stabilized FGD material will be placed and the seasonal high groundwater to prevent contact between the stabilized FGD material and groundwater or saturated soil, will be evaluated at each site where it is proposed to be beneficially used as part of the reclamation activities. Use of the stabilized FGD material on an active mine site must also comply with the existing mining regulations that include a demonstration that use or placement of the stabilized FGD material will not cause pollution or potential pollution of surface water and groundwater or result in a violation of air quality standards for fugitive dust. In addition to obtaining a mining permit or revision to a mining permit or to execute a reclamation contract with the Department for use of the stabilized FGD material, a person that proposes to beneficially use stabilized FGD material in mine reclamation activities by operating under the terms and conditions of modified WMGR052 after the date of permit issuance must apply for and obtain a ''Determination of Applicability'' (DOA) from the appropriate Department Regional Office having jurisdiction over the processing or beneficial use facility (see list attached to the general permit) prior to commencing authorized activities under WMGR052.
The Department has made a number of modifications to the general permit to:
1. Expand the scope of the General Permit No. WMGR052 to authorize the beneficial use of stabilized FGD material in reclamation of both coal mining activity sites and abandoned mine lands, provided that the reclamation activities are conducted in accordance with 25 Pa. Code §§ 290.104—290.105, and one of the following:
a. A mining permit or a revised mining permit issued for a coal mining activity site that specifically identifies the source of the stabilized FGD material, or
b. A reclamation contract with the Department for use at abandoned mine lands that specifically identifies the source of the stabilized FGD material.
2. Improve the requirements for characterization of waste materials prior to processing and beneficial use, site preparation prior to beneficial use, storage of stabilized FGD material, placement and compaction of stabilized FGD material, and groundwater monitoring.
3. Improve coordination between the Department's waste management and mining programs regarding the approval and use of stabilized FGD material at coal mining activity sites or abandoned mine lands.
4. Increase public notice and opportunity for public comment.
The Department published proposed modification to WMGR052 in the Pennsylvania Bulletin on June 10, 2017 and held a 60-day public comment period. Public comments were considered and addressed in the comment and responses document prepared for this general permit. Code § 127.449(i), this PA Bulletin Notice is for de minimis emissions increases of 0.52 TPY NOx; 0.43 TPY CO; 0.04 TPY PM10; and 0.03 TPY VOC resulting from the recent construction of a bake booth that is equipped with a natural gas-fired dryer having a maximum rated heat input capacity of 1.2 MMBtu/hr for the hardening of adhesives at its facility located in Conewago Township, Adams County. This is the first de minimis emissions increase event at the facility during the term of the current operating permit.

03-00133: Penn Mag Inc/Adrian (719 Tarrtown Road, Adrian, PA 16210) on November 21, 2018 received a conditioned approval for a de minimis emission increase at a facility located in East Franklin Township, Armstrong County, in accordance with 25 Pa. Code § 127.449. The project consists of the installation and operation of a cement transfer system, four (4) cement storage silos, and associated air cleaning devices. The total de minimus emission increases (in tons per year) are as follows: PM10/PM2.5—0.14 ton per year. The emission increases from all pollutants resulting from the individual, as well as the aggregate, changes do not exceed those levels listed under 25 Pa. Code § 127.449 and qualify as de minimus. The permit will include monitoring, recordkeeping and work practice requirements designed to keep the facility within all applicable air quality requirements.
