Actions on applications under the Surface Mining Conservation and Reclamation Act (52 P. S. §§ 1396.1--1396.19a); the Noncoal Surface Mining Conservation and Reclamation Act (52 P. S. §§ 3301--3326); The Clean Streams Law (35 P. S. §§ 691.1--691.1001); the Coal Refuse Disposal Control Act (52 P. S. §§ 30.51--30.66); and The Bituminous Mine Subsidence and Land Conservation Act (52 P. S. §§ 1406.1--1406.21).    To place fill in 0.30 acre of PEM wetlands for the purpose of expanding the outdoor storage area of an existing business. A portion of the proposed fill (approximately 150 linear feet, with an average depth of 0.5 foot) is within the floodway along the right bank of a tributary to the Lackawaxen River (HQ-CWF). The permittee is required to provide for 0.30 acre of replacement wetlands by participating in the Pennsylvania Wetland Replacement Project. The project is along the east side of SR 0191, approximately 0.1 mile south of the intersection of SR 0191 and T-484 (Shady Lane) (Honesdale, PA Quadrangle N:  8.5 inches; W:  0.0 inch) (Subbasin: 1B).

   To construct and maintain an 18-foot long, 9-foot 7-inch by 4-foot 1-inch aluminum box culvert across a tributary to Silkmans Swamp Run (HQ-CWF) for the purpose of harvesting timber. The project is on State Game Lands No. 310, approximately 2,400 feet southwest of the intersection of SR 3032 and T 372 (Lake Ariel, PA Quadrangle N: 11.55 inches; W: 5.95 inches) (Subbasin: 1C).

   To construct and maintain: (1) a 4-foot wide pedestrian footbridge to completely span the channel of Thompson Creek (CWF); and (2) a 4-foot wide pedestrian footbridge to completely span the channel of Reservoir Hollow Run (CWF), both tributaries to the Conodoguinet Creek, for the purpose of connecting a trail around the proposed Township park, at a point on the west side of Hershey Road (T-316) just north of the Hershey Road (T-316) and Airport Road (LR 21050) intersection and just west of the Southampton Township Municipal Building (Walnut Bottom, PA Quadrangle N: 9.65 inches; W: 14.85 inches) in Southampton Township, Cumberland County.

   E21-361:  Cumberland-Franklin Joint Municipal Authority, 715 Municipal Drive, Shippensburg, PA 17257 in Shippensburg Township, Cumberland County, ACOE Baltimore District.

   To install and maintain a ten-inch diameter PVC gravity sanitary sewer line with Reno Mattress gabions for scour protection across Burd Run (CWF), for the purpose of connecting the existing sewer main in Shippensburg Mobile Estates to the trunk line on the west side of Burd Run to discontinue use of the aging sewage pumping station (9A). The site is approximately 500 feet upstream of the US Route 11 bridge (Shippensburg, PA Quadrangle N: 10.8 inches; W: 1.3 inches) in Shippensburg Township, Cumberland County.

   E67-753:  Hopewell Township Supervisors, P. O. Box 429, Stewartstown, PA 17762 in Hopewell Township, York County, ACOE Baltimore District.

   To resolve a violation by constructing and maintaining: (1) a 48-inch by 40.75-foot long corrugated plastic pipe with a 12-inch depression; (2) a 48-inch by 41.10-foot corrugated plastic pipe with a 12-inch depression and 45 linear feet of riprap protection on the downstream left bank (looking upstream); and (3) a 30-inch by 40-foot long corrugated plastic pipe with a 6-inch depression in a tributary to Ebaughs Creek (CWF) on Shaw Road (Stewartstown, PA Quadrangle N: 1.8 inches; W: 17.5 inches) in Hopewell Township, York County.

   E28-314:  Texas Eastern Transmission, L. P., 5400 Westheimer Court, Houston, TX 77056 in Ayr Township, Fulton County and Peters Township, Franklin County, ACOE Baltimore District.

   To replace a 24-inch natural gas transmission by constructing and maintaining a 36-inch natural gas transmission line under Buck Run and two unnamed tributaries to Buck Run (HQ-CWF-MF), an unnamed tributary to West Branch of the Conococheague Creek (TSF-MF), several ephemeral drains and six wetlands. The project begins in Fulton County and ends in Peters Township, Franklin County (McConnellsburg, PA Quadrangle N: 7.0 inches; W: 11.5 inches), Peters Township, Franklin County. The pipeline will temporarily impact 1.05 acres of palustrine emergent and scrub/shrub EV wetlands (0.931 acre PEM and 0.121 acre PSS).

Castagnari building in Ross Township, Allegheny County, Pittsburgh ACOE District (Glenshaw, PA Quadrangle N: 2.3 inches; W: 17.1 inches) (Latitude: 40° 30` 46" and Longitude: 79° 59` 53"). To construct and maintain a 15,000 square foot building on the left bank within the floodway of Girty's Run (WWF). The building is approximately 250 feet long. This project also includes construction of a stormwater outfall to the same stream. The building will be on the south side of Babcock Boulevard, approximately 0.5 mile east of its intersection with McKnight Road.

   E04-298.  Alrich Construction Conway, 2684 Ridge Road Extension, Baden, PA 15005. Valley Brook Plan of Lots culvert and wetland fill in Economy Borough, Beaver County, Pittsburgh ACOE District (Baden, PA Quadrangle N: 7.3 inches; W: 4.8 inches) (Latitude: 40° 39` 56" and Longitude: 8° 09` 37"). To construct and maintain a 72.0-foot long con-span concrete culvert having a span of 12.0 feet with an underclearance of 3.0 feet in an unnamed tributary to North Fork Big Sewickley Creek (WWF), to place and maintain fill in a de minimis area of wetlands and to relocate and maintain approximately 160.0 feet of the channel of the stream for the purpose of constructing the Valley Brook Plan of Lots. The project is just east from the intersection of Parkhill Road and Valley Brook Drive. It will impact a de minimis area of wetlands and 200.0 linear feet of stream channel.

   EA1109-001.  Department of Environmental Protection, Bureau of Abandoned Mine Reclamation, Cambria Office, 286 Industrial Park Rd., Ebensburg, PA 15931. Abandoned Mine Land Reclamation Project in Barr Township, Cambria County, Baltimore ACOE District (Colver Quadrangle N: 21.62 inches; W: 1.62 inches). The applicant proposes to remove an abandoned 17.4-acre refuse pile adjacent to the West Branch Susquehanna River. The project will include encroachment along 1,700 feet of stream channel during removal of refuse from the floodplain. The project will encroach upon 1,700 feet of the West Branch Susquehanna River. The project will restore a 50-foot floodplain along 1,700 feet of the West Branch Susquehanna River. Completion of the project will also stop the ongoing discharge of refuse into the river and stop the production and subsequent discharge of acid mine drainage from the site into the river.

Proposed Permit Transfers for Facilities

   The Department of Environmental Protection (Department) proposes to transfer certain permits, licenses and approvals previously issued to various water utility companies with the current Department database client name of Philadelphia Suburban Water Company or Pennsylvania Suburban Water Company to Aqua Pennsylvania, Inc.    Persons wishing to comment on the proposed permit transfers are invited to submit comments to the relevant contact person within 30 days from the date of this public notice.

   Comments received within this 30-day period will be considered in the formulation of the final determination regarding the proposed transfers. Comments should include the name, address and telephone number of the writer and a concise statement to inform the Department of the exact basis of the comment and the relevant facts upon which it is based. A public hearing may be held if the Department considers the public response significant.

   Following the 30-day comment period, the Department will make a final decision concerning the permit, license and approval transfers. Notice of this determination will be published in the Pennsylvania Bulletin at which time the determination may be appealed to the Environmental Hearing Board.
