THE PENNSYLVANIA CLEAN STREAMS LAW AND THE FEDERAL CLEAN WATER ACT

FINAL ACTIONS TAKEN FOR NPDES PERMITS AND WQM PERMITS

 The Department has taken the following actions on previously received applications for new, amended and renewed NPDES and WQM permits, applications for permit waivers and NOIs for coverage under General Permits. This notice of final action is provided in accordance with 25 Pa. Code Chapters 91 and 92a and 40 CFR Part 122, implementing provisions of The Clean Streams Law (35 P.S. §§ 691.1—691.101) and the Federal Clean Water Act (33 U.S.C.A. §§ 1251—1376).

 Sections I—VI contain actions regarding industrial, animal or sewage wastes discharges, discharges to groundwater, and discharges associated with MS4, stormwater associated with construction activities and CAFOs. Section VII contains notices for parties who have submitted NOIs for Coverage under General NPDES Permits. The approval for coverage under these General NPDES Permits is subject to applicable effluent limitations, monitoring, reporting requirements and other conditions in each General Permit. The approval of coverage for land application of sewage sludge or residential septage under applicable general permit is subject to pollutant limitations, pathogen and vector attraction reduction requirements, operational standards, general requirements, management practices and other conditions in the respective permit. The permits and related documents, effluent limitations, permitting requirements and other information are on file and may be inspected and arrangements made for copying at the contact office noted before the action.

 Persons aggrieved by an action may appeal that action to the Environmental Hearing Board (Board) under section 4 of the Environmental Hearing Board Act (35 P.S. § 7514) and 2 Pa.C.S. §§ 501—508 and 701—704 (relating to Administrative Agency Law). The appeal should be sent to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, 400 Market Street, PO Box 8457, Harrisburg, PA 17105-8457, (717) 787-3483. TDD users may contact the Board through the Pennsylvania AT&T Relay Service, (800) 654-5984. Appeals must be filed with the Board within 30 days of publication of this notice in the Pennsylvania Bulletin unless the appropriate statute provides a different time period. Copies of the appeal form and the Board's rules of practice and procedure may be obtained from the Board. The appeal form and the Board's rules of practice and procedure are also available in Braille or on audiotape from the Secretary to the Board at (717) 787-3483. This paragraph does not, in and of itself, create a right of appeal beyond that permitted by applicable statutes and decisional law.

 For individuals who wish to challenge an action, the appeal must reach the Board within 30 days. A lawyer is not needed to file an appeal with the Board.

 Important legal rights are at stake, however, so individuals should contact a lawyer at once. Persons who cannot afford a lawyer may qualify for free pro bono representation. Call the Secretary to the Board at (717) 787-3483 for more information.

 The State Conservation Commission has taken the following actions on previously received applications for nutrient management plans under 3 Pa.C.S. Chapter 5, for agricultural operations that have or anticipate submitting applications for new, amended or renewed NPDES permits or NOIs for coverage under a general permit for CAFOs under 25 Pa. Code Chapter 92a. Plan Description: The plan provides for the construction of a pump station replacing the Penns Valley Area School District (PVASD) plant that will convey sewage in a new force main to be constructed in the PA-45 right of way to the Gregg Township Sewer Authority (GTSA) system. The plan also provides for a new fine screen at the GTSA plant, replacement of the remaining original collection system piping on the PVASD campus, and an expansion in sewage flow at the PVASD property. PVASD is constructing a new gymnasium and football stadium restrooms at the high school which are expected to generate approximately 7,025 gallons per day of additional sewage flow. The projected project cost of approximately $3.02 million is expected to be funded by the Pennsylvania Infrastructure Investment Authority (PennVest), with a backup funding source of bank loan. The submission is consistent with the planning requirements in Chapter 71 of DEP's regulations. No significant environmental or historical impacts were identified in the review of the plan.

HAZARDOUS SITES CLEAN-UP UNDER THE ACT OF
OCTOBER 18, 1988

Public Notice of Proposed Consent Order and Agreement
Strasburg Landfill, Chester County

 The Department of Environmental Protection (''Department''), under the authority of the Pennsylvania Hazardous Sites Cleanup Act (''HSCA''), 35 P.S. § 6020.301, 6020.507, 6020.707, and 1102 has entered into a Consent Order and Agreement (''CO&A'') with Laughton Company, LLC, (''Laughton'') regarding the Strasburg Landfill.

 The Strasburg Landfill Superfund Site (''the Site'') includes a 24-acre inactive landfill located on two parcels totaling 209 acres located to the southeast of Strasburg Road in Newlin Township, Chester County (''the Site''). Various wastes, including but not limited to municipal waste, certain industrial wastes, and sewage treatment sludge were disposed at the Landfill. After the Landfill was improperly closed it was added to the National Priorities List in 1989, due in part to leachate causing surface water and groundwater contamination from volatile organic compounds and heavy metals from former disposal practices. Since 2001, the Department has conducted operation and maintenance (''O&M'') activities at the Site, including periodic monitoring of the groundwater, operation and maintenance of the leachate treatment system, and maintenance of the cap, such as mowing, fence repair, and certain limited landscaping of the cap.

 In 2007 Laughton, purchased the Landfill. Since 2008, Laughton has assisted the Department with certain O&M activities. In connection with its purchase of the Site, Laughton desires to resolve its potential liability to the Department for reimbursement of certain response costs to be incurred at the Site. The Department has determined that it is in the public interest to resolve its claim against Laughton. Consequently, the Department and Laughton have signed the CO&A, in which, in part, Laughton has agreed to pay the Department Three Thousand Dollars ($3,000.00) as its contribution towards the response costs incurred by the Department for the Site, to conduct certain O&M activities at the Site, and to provide the Department with access to the Site. The Department has agreed to provide Laughton with protections against certain future liabilities.

 This notice is provided under Section 1113 of HSCA, 35 P.S. § 6020.1113, which states that, ''settlement shall become final upon the filing of the Department's response to significant written comments.'' The CO&A is available for public review and comment. The CO&A can be examined from 8 a.m. to 4 p.m. at the Department's Southeast Regional Office, located at 2 East Main Street, Norristown, PA 19401, by contacting either Joshua Crooks at (484) 250-5784 or Adam Bram, Esquire at (484) 250-5930. Mr. Crooks and Mr. Bram may also be contacted electronically at jocrooks@pa.gov and abram@pa.gov, respectively. A public comment period on the Agreement will extend for 60 days from today's date.
