NATIONAL POLLUTION DISCHARGE ELIMINATION SYSTEM (NPDES) PERMITS
NPDES APPLICATIONS
PART I PERMITS Under the Federal Clean Water Act and The Clean Streams Law, the following parties have applied for an NPDES permit or to renew their current permit to discharge controlled wastewaters into the waters of this Commonwealth or to conduct other activities required by the NPDES permit. For renewal applications listed in Section I, the Department of Environmental Protection (Department) has made a tentative determination to reissue these permits for 5 years subject to effluent limitations and monitoring and reporting requirements in their current permits, with appropriate and necessary updated requirements to reflect new and changed regulations and other requirements. For new permit applications, renewal application with major changes or applications for permits not waived by the EPA, the Department, based upon preliminary reviews, also made a tentative determination of proposed effluent limitations and other terms and conditions for the permit applications listed in Section II. These determinations are published as proposed actions for comments prior to taking final actions.
Unless indicated otherwise, the EPA Region III Administrator has waived the right to review or object to this proposed permit action under the waiver provision 40 CFR 123.24(d).
Persons wishing to comment on the proposed permit are invited to submit a statement, to the office noted before the application, within 30 days from the date of this public notice. Comments received within this 30-day comment period will be considered in the formulation of the final determinations regarding this application. The comments should include the name, address and telephone number of the writer and a concise statement to inform the Department of the exact basis of a comment and the relevant facts upon which it is based. A public hearing may be held if the responsible office considers the public response significant. Following the comment period, the Department's Water Management Program Manager will make a final determination regarding these applications. Notice of this final determination will be published in the Pennsylvania Bulletin at which time this determination may be appealed to the Environmental Hearing Board.
The renewal application, including proposed effluent limitations and special conditions, is available on file. For new permit applications, information submitted with the applications is available on file. The information may be inspected and arrangements made for copying at the office indicated before the application.

Southcentral Region: Water Management Program Manager, 909 Elmerton Avenue, Harrisburg, PA 17110, (717) 705-4707.PA0246972, CAFO, Weiler Farms Partnership (Weiler Farms No. 3), 350 East Mill Avenue, Myerstown, PA 17067. Weiler Farms Partnership has submitted an application for an individual NPDES permit for a proposed CAFO known as Weiler Farms No. 3, Box 4418, Ridge Road, Jonestown, Union Township, Lebanon County.
The CAFO is situated near Trout Run in Watershed 7-D, which is classified for WWF. The CAFO is designed to maintain an animal population of approximately 817.2 AEUs consisting of 6,600 wean to finish swine. The animals will be housed in three swine finishing floors. Manure will be stored in three below house manure pits. The total capacity of the manure storage facilities will be 1.54 million gallons. Prior to operation of the manure storage facilities, the design engineer will be required to submit certification that the facilities were constructed in accordance with appropriate Pennsylvania Technical Guide Standards. A release or discharge to waters of this Commonwealth under normal operating conditions is not expected. Normal operating conditions are defined as conditions below a 25-year, 24-hour storm event.
The Department has conducted administrative and technical reviews of the application. Based on the preliminary review and application of lawful standards and regulations, the Department has made a tentative determination to issue an NPDES permit for the operation subject to the terms and conditions and monitoring and reporting requirements specified in the permit.
The permit application and draft permit are on file at the Southcentral Regional Office of the Department. Individuals may make an appointment to review the files by calling the File Review Coordinator at (717) 705-4732.

Description of activity: Renewal of an NPDES permit for existing discharge of treated sewage.
The receiving stream, Alloway Creek, is in Watershed 13-D and classified for WWF, water supply and recreation and fish consumption. The nearest downstream public water supply intake for Frederick, MD is located on the Monocacy River, approximately 41 miles downstream. The discharge is not expected to affect the water supply.

PA0246808, CAFO, Clair Hurst (Clair Hurst Farm), 788 Kingpen Road, Kirkwood, PA 17536. Clair Hurst has submitted an application for an individual NPDES permit for an existing CAFO known as Swine and Dairy, 788 Kingpen Road, Little Britain Township, Lancaster County.
The CAFO is situated near an unnamed tributary to West Branch Octoraro Creek in Watershed 7-K, which is classified for HQ, CWF and MF. The CAFO is designed to maintain an animal population of approximately 507 AEUs consisting of 3,600 finishing pigs and 95 dairy cows. The animals will be housed in a finishing barn and dairy barn. Manure is collected and stored under the finishing barn and in an earthen lagoon next to the dairy barn. The total capacity of the manure storage facilities is 1.735 million gallons. A release or discharge to waters of this Commonwealth under normal operating conditions is not expected. Normal operating conditions are defined as conditions below a 25-year, 24-hour storm event.
The Department has conducted administrative and technical reviews of the application.
