Horse Positives—Judges'/Stewards' List; Ineligibility to Race

 The State Horse Racing Commission (Commission) provides notice that on August 31, 2017, it issued an Order adopting specific procedures relating to horses that have tested ''positive'' for a Class 1, 2 or 3 drug or medication or other foreign substance. This Order was adopted under the authority of 3 Pa.C.S. § 9311(h) (relating to State Horse Racing Commission), under Administrative Doc. No. 2017-10.

 Class 1 and 2 drugs have been determined by the Association of Racing Commissioners International, the National body of racing officials that has developed model rules and standards for racing, to have no generally accepted therapeutic use in a racing horse and to have a high potential to affect the outcome of a race. Class 3 drugs may or may not have an accepted therapeutic use in a racing horse, but have the potential to affect the performance of a racing horse and the outcome of a race.

 The general purpose of the Order is to: (1) ensure the health and safety of the racing horse; (2) maintain the integrity of racing by imposing fair and equitable oversight of medication/drug penalties; and (3) prevent the circumvention of those penalties as applied to the racing horse. This purpose is common to all other regulations and orders of the Commission addressing mediation/drug penalties, including those regulations and orders issued under the statutory authority previously cited.

 In summary, the Order calls for a horse that tests ''positive'' for a prohibited substance to be placed on the Judges' List (for Standardbred racing) or the Stewards' List (for Thoroughbred racing), making the horse ineligible to race for 90 days if the horse tests ''positive'' for a Class 1 or 2 drug and 30 days if it tests ''positive'' for a Class 3 drug or other foreign substance.
