[Saturday, December 29, 2018]Under section 2002 of The Administrative Code of 1929 (71 P.S. § 512) establishing the Department of Transportation (Department), a Level 2 Categorical Exclusion Evaluation and an associated Individual Section 4(f) document, which also serves as the Section 2002 Evaluation, required by section 2002(a)(15) (71 P.S. § 512(a)(15)) have been developed for the SR 0228, Section 29B project, in Adams and Middlesex Townships, Butler County.
The Federal Highway Administration and the Department are planning roadway and intersection improvements approaching and at the SR 0228 (Mars-Crider Road) and SR 3007 (Three Degree Road) intersection.
The proposed project will impact three Section 4(f) properties: the George Ebert House; the Mars Home for Youth; and the Mars Area School District Athletic Field. Approximately, 3.2 acres of right-of-way (ROW) acquisition and 1.4 acres of temporary construction easement are needed from the Mars Home for Youth including demolition of the Maintenance Residence. Approximately, 0.31 acre of ROW and 0.09 acre of temporary construction easement will be acquired from the George Ebert House. While no ROW is needed from the Mars Area School District Athletic Field, a temporary construction easement totaling 0.41 acre is necessary.
There is no Section 4(f) use to the Mars Areas School District Baseball Fields, the Mars Area School District Athletic Courts, Galletta's Winter Haven, the Mars Area School District Softball Fields or the William Hays Farm.
Based upon studies, there is no feasible and prudent alternative to the proposed action. Mitigation measures will be taken to minimize harm as stipulated in the Level-2 CEE, the Individual Section 4(f) Evaluation document and the associated Memorandum of Agreement. The approved documents are available in the CE/EA Expert System.
The environmental, economic, social and other effects of the proposed project, as enumerated in section 2002 of The Administrative Code of 1929, have been considered. It has been concluded that: 1) there is no feasible and prudent alternative to the use of the Section 2002 resources; and 2) the project is planned to minimize harm to the Section 2002 resources.
