Actions on applications filed under the Dam Safety and Encroachments Act (32 P. S. §§ 693.1--693.27) and section 302 of the Flood Plain Management Act (32 P. S. § 679.302) and sections 5 and 402 of the act of June 22, 1937 (P. L. 1987, No. 394) (35 P. S. §§ 691.5 and 691.402) and notice of final action for certification under section 401 of the Federal Water Pollution Control Act (33 U.S.C.A. § 1341(a)) (Note: Permits issued for Small Projects do not include 401 Certification, unless specifically stated in the description).

Permits Issued and Actions on 401 Certifications:

   Southeast Regional Office: Program Manager, Water Management Program, Lee Park, Suite 6010, 555 North Lane, Conshohocken, PA 19428.

   E15-496.  Encroachment. Valley Township, 890 West Lincoln Highway, P. O. Box 467, Coatesville, PA 19320. To remove the existing bridge and to construct and maintain immediately upstream a precast concrete box beam bridge having a 63-foot span, a 27-foot width, and an underclearance of 13.5-feet across the west branch of the Brandywine Creek (TSF-MF). The site is located approximately 2,000 feet south of S. R. 30 and 1,500 feet west of PA Route 82 at Valley Station Road (Coatesville, PA Quadrangle N: 21.5 inches; W: 10.75 inches) in Valley Township, Chester County. Work also includes the construction of a temporary causeway consisting of six 60-inch CMP culverts which are backfilled with clean R-7 stone.

   E46-706.  Encroachment. Pennsylvania American Water Company, Norristown Division, 196 West Johnson Highway, Norristown, PA 19401. To expand, maintain and make improvements to the existing Norristown Water Treatment Plant located between Washington Street and the Schuylkill River just east of the Route 202 Schuylkill River overpass (Norristown, PA Quadrangle N: 20.5 inches; W: 1,375 inches) in Norristown Borough, Upper Merion Township and West Norriton Townships, Montgomery County. The project will include 1) rehabilitation and maintenance of an existing intake structure in the South Channel of the Schuylkill River south of Barbadoes Island; 2) installation and maintenance of two parallel 36 inch diameter, 1,500 feet long raw water intake mains from the existing intake structure across the north and south channels of the Schuylkill River, wetlands and Barbadoes Island to the Norristown Water Treatment Plant. Additionally two 8-inch diameter chemical feed conduits will be installed in the common pipe line trench; 3) removal of most of the existing treatment facilities within 100 year floodplain of the Schuylkill River, between Washington Street and the Schuylkill River just east of the Route 202 overpass; 4) construction and maintenance of stormwater outfall channel in wetlands; 5) construction of a temporary access road along the shore line of the River and Barbadoes Island. The submerged Land License Agreement has been approved for the project.

   E46-714.  Encroachment. Dougherty Brothers, 631 Penn Avenue, Ardsley, PA 19038. To relocate an unnamed tributary to Towamencin Creek (TSF) and to place fill material in 0.01 acre of an adjacent wetlands (PFOIA) associated with the construction of a road crossing which will provide an access to the proposed Dougherty Brothers 7-lot residential subdivision. This stream relocation consists of the modification and an extension of an existing 60-foot long, 24-inch diameter C.M.P. culvert which conveys this tributary beneath the intersection of Morris Road and the proposed Wentz Church Way. Work will include the removal of 54 linear feet of the existing culvert, and replacement with an approximately 225 foot long 36-inch diameter C.P.P. stream enclosure, having a concrete endwall and a 15-foot long rip-rap energy dissipater at the end. This site is located near the intersection of Wentz Church Road (T398) and Morris Road (T362) (Lansdale, PA Quadrangle N: 17.9 inches; W: 13.2 inches) in Towamencin Township, Montgomery County.

   E51-144.  Encroachment. Colonial Pipeline Company, 945 East Paces Ferry Road, P. O. Box 18855, Atlanta, GA 31126-0855. To temporarily disturb 0.34 acre of Exceptional Value (EV), Palustrine open water/emergent mixed wetlands during the construction of one 10-inch underground pipeline that carries refined petroleum products. Temporarily disturbed wetlands will be restored to preexisting conditions following construction. The project is located at the Philadelphia International Airport, approximately 500 feet east of Hog Island Road, just east of the Enterprise Avenue Landfill (Philadelphia, PA-NJ Quadrangle N: 1.25 inches; W: 12.0 inches) in the City and County of Philadelphia.

   E15-507.  Encroachment. Chester County Commissioners, Chester County Courthouse, 2nd and High Streets, West Chester, PA 19380. To rehabilitate and maintain an existing single span covered timber bridge by performing the following activities:

   1.  Replacing the deteriorated floor system with steel I-beams including concrete beam seats and an open steel grid to support the timber plank wearing surface.

   2.  Replacing siding and roofing for the bridge shed.

   3.  Repairing and repointing the stone masonry abutments and wingwalls.

   4.  Placement of riprap protection at the right abutment.

   This covered bridge (County Bridge No. 28) has a clear span of 102 feet and a minimal underclearance of 12.67 feet, and is located across Big Elk Creek on Kings Row Road (Oxford, PA Quadrangle N: 1.15 inches; W: 5.25 inches) in New London and Elk Townships, Chester County. This permit was issued under section 105.13(e) ''Small Projects''. This permit also includes 401 Water Quality Certification.

   E15-494.  Encroachment. Ardmore Associates, II, 1235 Westlakes Drive, Suite 425, Berwyn, PA 19312. To construct and maintain an 8-foot × 4-foot precast reinforced concrete twin box culvert, 30 feet in length, in and along an unnamed tributary to Valley Creek (Exceptional Value Watershed) to provide an access road to a proposed inspection station. This project also includes the installation of an 8-inch diameter P.V.C. sanitary sewer pipe across and under the bed of this tributary. The site is located on the east side of Lee Boulevard, near Spring Mill Road in the Main Line Industrial Park (Malvern, PA Quadrangle N: 12.5 inches; W: 7.3 inches) located in East Whiteland Township, Chester County.

   E39-295.  Encroachment. Pennsylvania Power and Light Company, 2 North Ninth Street, Allentown, PA 18101-1179. To temporarily place fill in 0.12 acre of wetlands to utilize an existing access for the upgrade of an existing electric transmission line. The project is located approximately 0.28 mile north east of S. R. 2029 and S. R. 2027 (East Greenville, PA Quadrangle N: 14.8 inches; W: 0.6 inch) in Lower Milford Township, Lehigh County.

   E39-303.  Encroachment. City of Allentown, 435 Hamilton Street, Allentown, PA 18101-1699. To remove the existing structure and to construct and maintain a 21-inch and a 24-inch diameter R.C.P. stormwater outfall structure along the left bank of Cedar Creek. The project is located immediately south of the intersection of Turner Street and Parkway Boulevard (Allentown West, PA Quadrangle N: 17.1 inches; W: 1.0 inch) in the City of Allentown, Lehigh County.

   Environmental Assessment Approvals and Action on 401 Certifications

   EA10-005NW.  Environmental assessment. U. S. Department of Natural Resource Conservation Service, 602 Evans City Road, Suite 102, Butler, PA 16001. To redirect a mine discharge into a created settling pond (approximately 0.5 acre in size) and then into a created wetland (approximately 0.25 acre in size) to allow for mine discharge treatment prior to discharge into Slippery Rock Creek (CWF). Project is located in State Game Lands No. 95 approximately 2,000 feet west of the Village of Argentine (Hilliards, PA Quadrangle N: 17.5 inches; W: 10.0 inches) located in Washington Township, Butler County.


Notice of Final Action on Request for Certification under Section 401 of the Federal Water Pollution Control Act

   Except as otherwise noted below, the Department of Environmental Protection, under § 401(a) of the Federal Clean Water Act (33 U.S.C.A. § 1341(a)) certifies that the construction and operation herein described will comply with the applicable provisions of sections 301--303, 306 and 307 of that act, and that the construction will not violate applicable Federal and State water quality standards, provided the following requirements are met:

   Final or proposed action on certain other Certification requests for projects which require both a Dam Safety and Encroachments Permit and either a U. S. Army Corps of Engineers individual permit or a Nationwide permit 14, 18 or 26 will be published with Actions of Applications filed under the Dam Safety and Encroachments Act (32 P. S. §§ 693.1--693.27).

   These actions of the Department may be appealable to the Environmental Hearing Board, 101 South Second Street, Suites 3-5, Harrisburg, PA 17101 (717) 787-3483, by any aggrieved person under section 4 of the Environmental Hearing Board Act (35 P. S. § 7514) and 2 Pa.C.S. §§ 501--508 and 701--704 (relating to the Administrative Agency Law). Appeals must be filed with the Environmental Hearing Board within 30 days of receipt of written notice of this action unless the appropriate statute provides a different time period. Copies of the appeal form and the regulations governing practice and procedure before the Board may be obtained from the Board. This paragraph does not, in and of itself, create any right of appeal beyond that permitted by applicable statutes and decisional law.

   Location: Erie Harbor, Erie County.

   Project Description: The U. S. Army Corps of Engineers has requested a Section 401 State Water Quality Certification for the discharge of dredged material from the lakeward portion of the Federal navigation channels of Erie Harbor at the existing open-lake site. An estimated total of 125,000 cubic yards of material will be dredged and discharged. The purpose of the project is to maintain sufficient depth for deep-draft commercial vessels.

   Final Action on Request: Certification granted.
