Notice of Settlement Under the Hazardous Sites Cleanup Act

Industrial Solvents and Chemical Company
Newberry Township, York County

   The Department of Environmental Protection (Department), under the authority of the Hazardous Sites Cleanup Act (HSCA) (35 P. S. §§ 6020.101--6020.1305), has entered into a proposed consent order and agreement with a group of Potentially Responsible Parties (the PRP Group) regarding work to be performed at the Industrial Solvents and Chemical Company (ISCC) site. The ISCC site is a 9-acre parcel of land in Newberry Township, York County, adjacent to Interstate 83. The surrounding area is primarily rural, although residential, commercial and industrial developments are located within a close vicinity of the site. A number of private residential wells have been contaminated by hazardous substances migrating from the ISCC site.

   ISCC was involved in the reprocessing of used solvents. Because of violations of hazardous waste requirements, the Department on July 6, 1989, terminated ISCC's authority to operate a hazardous waste treatment and storage facility. The site was abandoned in 1990 when ISCC declared bankruptcy. A total of 996 parties potentially responsible for the hazardous substances located at the ISCC site were identified by the Department.

   Because of the threat to human health and the environment posed by the ISCC site, the site was placed on the Pennsylvania Priority List for Remedial Response on October 26, 1991. The Department and a group of approximately 136 cooperating Potentially Responsible Parties have conducted a number of interim actions at the site to address the release or threat of release of hazardous substances. To date, the Department has incurred costs of approximately $3 million to implement and/or oversee these interim actions. A final remedial action for the groundwater and soil at the ISCC site will be selected by the Department and implemented in the future.

   Under the terms of the proposed consent order and agreement, the PRP Group will provide connection to a public water supply to certain parcels with impacted groundwater. The work to be performed will comply with the Statement of Decision signed by the Department on May 23, 1996 (see 25 Pa.B. 5779 (December 16, 1995)).

   This notice is provided under section 1113 of HSCA (35 P. S. § 6020.1113). This section provides that the settlement will become final upon the filing of the Department's response to any significant written comments. The proposed consent order and agreement that contains the specific terms of the settlement is available for public review and comment. The proposed consent order and agreement can be examined from 8 a.m. to 4 p.m. at the Department's office at One Ararat Boulevard, Harrisburg, PA 17110, by contacting Barbara Faletti at (717) 657-4592. A public comment period on the proposed consent order and agreement will extend for 60 days from today's date. Persons may submit written comments regarding the proposed consent order and agreement to the Department by January 9, 1997, by submitting them to Barbara Faletti at the above address.

No Cost Government Financed Reclamation Contracts Issued

   The Ebensburg District Mining Office for the Department of Environmental Protection awarded a No Cost Government Financed Reclamation Contract to PBS Coals, Inc. on October 16, 1996, that will result in the removal and reclamation of 6.3 acres of coal refuse in Shade Township Somerset County, receiving stream Coal Run to Dark Shade Creek and unnamed tributary to Coal Run, application received November 27, 1995. Under the terms of the contract no reprocessing of the coal refuse may take place and no coal refuse materials may be returned to the site once removed. The contract requires total reclamation and revegetation of the project area. This project was made possible under a new program developed by DEP which allows for expedited removal and reclamation of old coal refuse piles which are generally eyesores as well as major sources of siltation and pollution to the streams of the Commonwealth.

   The Department of Environmental Protection (Department) has taken the following actions on previously received permit applications, requests for Environmental Assessment Approval, and requests for Water Quality Certification under section 401 of the Federal Water Pollution Control Act (33 U.S.C.A. § 1341(a)).

To remove an existing 36-inch diameter pipe and to construct and maintain approximately 166 foot long box culvert; to relocate and maintain the channel of an unnamed tributary to R. B. Juniata River and to place fill material in 0.37 acre of wetland in order to construct an additional warehouse located immediately downstream of U. S. 30 culvert (Bedford, PA Quadrangle N: 7.85 inches; N: 3.7 inches) in Bedford Township, Bedford County.    E07-256.  Encroachment. Greenfield Township Municipal Authority, Nancy L. Hileman, R. R. 1, Box 948, Claysburg, PA 16625. To construct and maintain the renovation, rehabilitation and expansion of an existing wastewater treatment plant which requires the placement of fill in the floodway of the Frankstown Branch of the Juniata River and a deminimus area of associated wetlands located on the east side of Bedford Street at its intersection with SR 3008 (Roaring Springs, PA Quadrangle N: 10.9 inches; W: 9.7 inches) in Greenfield Township, Blair County. This permit was issued under section 105.13(e) ''Small Projects.'' This permit also includes 401 Water Quality Certification.

   E28-237.  Encroachment. Russell S. Funk, Franklin County, 9829 Circle Drive, Chambersburg, PA 17201. To remove the existing structure and to construct and maintain a new bridge with proper alignment across Wilson Run having a clear span of 17 feet with an under clearance of 4 feet to provide continued access to the Funk's home located in Franklin Furnace Village (St. Thomas, PA Quadrangle N: 15.5 inches; W: 11.1 inches) in St. Thomas Township, Franklin County. This permit was issued under section 105.13(e) ''Small Projects.'' This permit also includes 401 Water Quality Certification.

   E38-113.  Encroachment. Louis Hurst, 530 West Trout Run Road, Ephrata, PA 17522. To construct and maintain two laminated wood pedestrian bridges, the upper footbridge having a 140-foot clear span with a 9.5-foot underclearance, and the lower footbridge having a 80-foot clear span with a 9-foot underclearance, both being across a tributary to Tulpehocken Creek. An 8-inch water line and a 12-inch diameter sanitary sewer line will be constructed and maintained across wetlands adjacent to and require three crossings of a tributary to Tulpehocken Creek, located along the east property line. Two roads will be constructed using three 76-inch × 48-inch R. C. pipe arch culverts at the first and three 60-inch × 38-inch R. C. pipe arch culverts for the second roadway across the tributary channel. A hiking trail/boardwalk with two observation decks connected by four 45-foot span footbridges are to be constructed within 0.096 acre of wetland at the Arborgate residential subdivision located along the south side of East Kercher Avenue (Bethel, PA Quadrangle N: 23 inches; W: 12 inches) in Jackson Township, Lebanon County. The permittee is required to provide 0.096 acre of replacement wetlands.

To place and maintain limestone into approximately 1,400 linear feet of Coal Run for the purpose of treating acid mine drainage and improving the water quality.    E63-414.  Encroachment. William and Stella Kirk, 40 Mingo Church Road, Finleyville, PA 15332. To extend and maintain the existing 24-inch diameter culvert with a 24-inch culvert approximately 100 feet in length in an unnamed tributary to Peters Creek for the purpose of improving applicant's property. The project is located on the west side of Mingo Church Road (LR 62042) approximately 1,500 feet southeast from the intersection of Mingo Church Road and LR 62014 (Hackett, PA Quadrangle N: 21.3 inches; W: 4.6 inches) in Nottingham Township, Washington County. The crossing shall consist of an ACMP culvert that has a span of 11.45 feet, rise of 7.25 feet and a length of 40.0 feet.    ID No. 101605.  Eagle Environmental, L. P., 11 New Street, Englewood Cliffs, NJ 07632, located in Washington Township, Jefferson County. The permit to construct and operate a municipal waste landfill, known as the Happy Landing Landfill, was suspended by the Regional Office on September 25, 1996. The permit was suspended based on the Revocation of Soil & Waterway Permit #E33-171, to construct and maintain arch culverts and to fill and replace wetland areas. Several wetlands within the permit boundary have been reclassified as exceptional value wetlands under 25 Pa. Code § 105.17.
