ENCROACHMENTS

   The following Dam Safety and Encroachment permit applications, requests for Environmental Assessment approval and requests for water quality certification have been received by the Department of Environmental Protection. Section 401(a) of the Federal Water Pollution Control Act (33 U.S.C.A. § 1341(a)) requires the State to certify that the involved projects will not violate the applicable provisions of 33 U.S.C.A. §§ 1311--1313, 1316 and 1317, as well as relevant State requirements. Initial requests for 401 certification will be published concurrently with the permit application. Persons objecting to approval of a request for certification under section 401 or to the issuance of a Dam Safety or Encroachment Permit or the approval of Environmental Assessments must submit any comments, suggestions or objections within 30 days of the date of this notice as well as any questions to the office noted above the application.

   E03-361.  Encroachment. Fish and Boat Commission, 450 Bellefonte Ln., Bellefonte, PA 16823-9620. To construct and maintain a 20-foot wide, cast-in-place concrete boat launching ramp, a paved parking lot along the river, 6` × 32` treated wood boarding dock, necessary signs and drainage system along the Allegheny River (WWF) for the purpose of developing a public fishing and boating area located near intersection of Allegheny Avenue and SR 1030 (Templeton, PA Quadrangle N: 8.25 inches; W: 12.25 inches) in Pine Township, Armstrong County.

To place and maintain fill in a total of 4.56 acre of wetlands (3.56 acres are PEM and 1.0 is PSS) as part of the development of the Fayette Business Park Development Project located on TR 0510 approximately 0.5 mile east of its intersection with SR 0043 (Smithfield, PA Quadrangle N: 10.9 inches; W: 3.70 inches) in Georges Township, Fayette County.

   E26-236.  Encroachment. Fay-Penn Industrial Development Corp., P. O. Box 2101, Uniontown, PA 15401. To repair, operate and maintain four railroad bridges (324, 327, 328, and 329) at various locations across Redstone Creek (WWF) for the purpose of improving their structural integrity. The structural repair work will also include stabilization, abutment and wingwall scour protection and cleaning of the channel. The project is located in South Union Township and the City of Uniontown, Fayette County.

   E30-176.  Encroachment. Scott R. Cole, 45 Crabapple Dr., Waynesburg, PA 15370. To construct and maintain a 7` × 3` box culvert in Roberts Run to access applicant's property located off T-318 approximately 65 feet north of intersection of SR 218 and T-318 (Oak Forest, PA Quadrangle N: 5.6 inches; W: 12.80 inches) in Wayne Township, Greene County.

   E30-177.  Encroachment. Greene County Commissioners, Greene County Office Building, 93 East High Street, Waynesburg, PA 15370. To remove existing structure and to construct and maintain a bridge with a normal clear span of 80.0 feet and an underclearance of 7.8 feet over North Fork Dunkard Fork of Wheeling Creek (TSF, stocked). The bridge is County Bridge No. 57 on T-356 Station 0+64.78 located just south of intersection of T-356 and SR 3022 (Wind Ridge, PA Quadrangle N: 0.65 inch; W: 7.5 inches) in Richhill Township, Greene County.

   E63-424.  Encroachment. Monongahela Iron & Metal Co., Inc., P. O. Box 250, Monongahela, PA 15063-1401. To construct and maintain a barge transloading facility along the left bank of the Monongahela River (WWF) at River Mile 32.8 (Monongahela, PA Quadrangle N: 12.8 inches; W: 4.8 inches) in Monongahela City, Washington County.

The delta area is not included as part of this project. The project center is located approximately 1,200 feet east of the confluence of the Susquehanna River and Satterlee Creek (Sayre, PA Quadrangle N: 16.0 inches; W: 1.4 inches) in Athens Township, Bradford County. Estimated stream disturbance is 800 feet of Satterlee Creek; stream classification is cold water fisheries.

   E25-544.  Encroachment. Metro Health Center, 252 West 11th Street, Erie, PA 16501. To place fill in a total of 1.22 acres of 7 separate wetland areas (PEM/PSS) for development of a medical office facility, other professional offices, retail facilities and senior living facilities. The project is located directly north of Zimmerly Road, approximately 2,000 feet west of the intersection of I-79 and Interchange Road SR 4012 (Interchange 180) (Erie South, PA Quadrangle N: 12.0 inches; W: 1.0 inch) located in Millcreek Township, Erie County.

   E62-329.  Encroachment. Pennsylvania-American Water Company, 1789 Route 286 South, Indiana, PA 15701-3389. To remove an existing 10-inch potable water line and to place and maintain approximately 1,750 linear feet of 16-inch potable water line in roughly the same location as the existing water line under Brown Run (CWF-TSF) and Allegheny River (WWF, Scenic). The project is located approximately 300 feet upstream of the Glade Bridge (SR Business 0006) in the City of Warren (Clarendon, PA Quadrangle N: 13.5 inches; W: 16.0 inches) located in the City of Warren, Glade Township and Mead Township, Warren County.

   E13-102.  Encroachment. Department of Transportation, District 5-0, 1713 Lehigh Street, Allentown, PA 18103. To repair and maintain the existing reinforced concrete arch bridge having a span of 21.7 feet with an underclearance of approximately 10 feet on a 15 degree skew, to repair a deteriorated structure and widen the bridge 7.8 feet across Sand Spring Run (HQ-CWF). The project, associated with the S. R. 0534, Section 02B, is located at the intersection of S. R. 0534 and Sand Spring Run (Hickory Run, PA Quadrangle N: 9.1 inches; W: 4.7 inches) in Kidder Township, Carbon County (Philadelphia District, Army Corps of Engineers).

   E39-333.  Encroachment. Department of Transportation, District 5-0, 1713 Lehigh Street, Allentown, PA 18103. To maintain the existing 6-span steel I-beam bridge having a total span of 673 feet with an underclearance of 68 feet across the Lehigh River (TSF) and the existing 4-span steel I-beam bridge having a total span of 510 feet with an underclearance of 58 feet across the Lehigh Canal (TSF) (Catasauqua, PA Quadrangle N: 1.3 inches; W: 12.3 inches) and to maintain the existing 6-foot × 6-foot reinforced concrete stream enclosure with work consisting of the construction of a 16.5 foot extension on the upstream side of the existing structure to have a total length of 160 linear feet in a tributary to the Lehigh River (CWF) (Catasauqua, PA Quadrangle N: 2.9 inches; W: 8.7 inches). The project is associated with the S. R. 0022, Section 04M Project and is located at a beginning point immediately west of the intersection of S. R. 0022 and the Lehigh River extending east 10.5 miles in Hanover Township, Lehigh County (Philadelphia District, Army Corps of Engineers).

   E45-318.  Encroachment. Bruno and Palma DeCaro, 1338 East 32nd Street, Brooklyn, NY 11210. To place fill in approximately 0.08 acre of PSO wetlands for the purpose of constructing a single family dwelling and gravel driveway on Lot 23 of Lake Naomi Estates residential subdivision. The project is located on the south side of Tanglewood Drive, approximately 0.2 mile east of its intersection with T642 (Miller Drive) (Pocono Pines, PA Quadrangle N: 20.8 inches; W: 8.9 inches) in Tobyhanna Township, Monroe County (Philadelphia District, Army Corps of Engineers).

   E45-319.  Encroachment. Jerry and Lynn Rosenbloom, 209 Remington Road, Broomall, PA 19008. To place fill in approximately 0.06 acre of PSO wetlands for the purpose of constructing a single family dwelling and gravel driveway on Lot 31 of Lake Naomi Estates residential subdivision. The project is located on the north side of Split Rock Lane, approximately 800 feet southwest of its intersection with Tanglewood Drive (Pocono Pines, PA Quadrangle N: 20.4 inches; W: 9.3 inches) in Tobyhanna Township, Monroe County (Philadelphia District, Army Corps of Engineers).

   E45-320.  Encroachment. Browning and Carolyn Holcombe, 79 Bush Avenue, Greenwich, CT 06830. To place fill in a de minimus area of PSO wetlands less than or equal to 0.05 acre for the purpose of constructing a single family dwelling and gravel driveway on Lot 8 of Lake Naomi Estates residential subdivision. The project is located along the northern shore of Lake Naomi, just south of the intersection of Woodland Avenue and Lakeview Drive (Pocono Pines, PA Quadrangle N: 21.1 inches; W: 10.6 inches) in Tobyhanna Township, Monroe County (Philadelphia District, Army Corps of Engineers).

   E54-230.  Encroachment. Orwigsburg Borough, 209 North Warren Street, P. O. Box 128, Orwigsburg, PA 17961. To remove the existing structure, to construct and maintain a 20 foot × 4 foot precast concrete box culvert in the channel of Mahannon Creek (CWF) and to realign approximately 120 L. F. of a tributary to Mahannon Creek. This project is located along Ridge Road approximately 300 feet west of North Liberty Street (Orwigsburg, PA Quadrangle N: 4.5 inches; W: 14.5 inches) in Orwigsburg Borough, Schuylkill County (Philadelphia District, Army Corps of Engineers).

   E15-538.  Encroachment. Realen Homes, 725 Talamore Drive, Ambler, PA 19002. To perform the following activities associated with construction of Windermere Residential Subdivision (a.k.a. Sbarbaro Tract):

   1.  To construct and maintain the Road ''A'' Crossing consisting of approximately 50 linear feet of 14.0-foot by 6.0-foot reinforced concrete box culvert, associated endwalls, roadway approach fill and to realign approximately 90 feet of upstream watercourse across and along an unnamed tributary to Pickering Creek (HQ-TSF) impacting a total of approximately 0.33 acre of adjacent wetlands (PFO);

   2.  To construct and maintain three utility line crossings adjacent and downstream of the Road ''A'' Crossing;

   The site is located just east of the intersection of Conestoga Road (SR 0401) and Byers Road (SR 1022) (Downingtown USGS Quadrangle N: 15.4 inches; W: 2.0 inches) in West Pikeland Township, Chester County. This permit requires the construction of 0.33 acre of replacement wetlands.

   E09-742.  Encroachment. Boro of Doylestown, 57 West Court Street, Doylestown, PA 18901. To operate and maintain a twin 36-inch corrugated polyethylene pipe culvert which replaced a dilapidated 38-inch by 57-inch arch corrugated metal pipe culvert in and along an unnamed tributary to the Neshaminy Creek (WWF-MF). This site is located on East Street (T-351) approximately 250 feet north of its intersection with East State Street (SR 0202) (Buckingham USGS Quadrangle N: 11.4 inches; W: 16.2 inches) in Doylestown Borough, Bucks County.

   E05-245.  Encroachment. Chestnut Ridge Area Joint Municipal Authority, Larry Fischer, R. D. 1, Box A320, New Paris, PA 1554. To construct and maintain: (1) a wastewater treatment facility within the right bank's 100-year floodplain of Dunning Creek located about 1,900 feet upstream of US 220 bridge; (2) Camp Pleasant wastewater pump station within the left bank's 100-year floodplain of Dunning Creek located about 1 mile north of Spring Meadow Village; (3) Bobs Creek wastewater pump station within the left bank's 100-year floodplain of Bobs Creek located about 1 mile south of Osterburg Village; and, (4) Imler wastewater pump station within the right bank's 100-year floodplain of Scrubgrass Creek located about 1,800 feet south of Imler Village. (The treatment facility is in Bedford, PA Quadrangle N: 18.8 inches; W: 5.0 inches in East St. Clair Township, Bedford County). (The Camp Pleasant and the Bobs Creek wastewater pump stations are in Alum Bank PA Quadrangle N: 8.4 inches; W: 10.95 inches and N: 6.1 inches; W: 4.37 inches respectively in East St. Clair Township, Bedford County). The Imler pump station is in Alum Bank, PA Quadrangle N: 14.05 inches; W: 3.7 inches in King Township, Bedford County.

   E22-364.  Encroachment. Dauphin County Board of Commissioners, Sally Klein, P. O. Box 1295, Harrisburg, PA 17108. To replace an existing structure with a bridge having a clear span of 65.0 feet and an underclearance of 8.17 feet and to fill 0.1 acre of wetlands across the channel of Stony Creek at a point at Singer Lane (T-686) (Halifax, PA Quadrangle N: 0.5 inch; W: 5.13 inches) in Middle Paxton Township, Dauphin County. The wetland impacts are deminimus and no replacement is required.

   E31-139.  Encroachment. Dept. of Transportation, Engineering District 9-0, Alfred Laich, 1620 North Juniata St., Hollidaysburg, PA 16648. To remove an existing bridge and to construct and maintain a prestressed concrete box beam bridge having a clear span of 45.92 feet and an underclearance of about 3.83 feet across Globe Run located on SR 0305, Section 002, about 5 miles of Petersburg Borough (Donation, PA Quadrangle N: 22.1 inches; W: 14.8 inches) in West Township, Blair County.

DAM SAFETY

   The Department of Environmental Protection has taken the following actions on previously received permit applications and requests for plan approval and has issued the following significant orders.

   Any person aggrieved by this action may appeal, under section 4 of the Environmental Hearing Board Act (35 P. S. § 7514) and 2 Pa.C.S. §§ 501--508 and 701--704 (relating to the Administrative Agency Law), to the Environmental Hearing Board, 400 Market Street Floor 2, P. O. Appeals must be filed with the Environmental Hearing Board within 30 days of receipt of written notice of this action unless the appropriate statute provides a different time period. LAND RECYCLING AND ENVIRONMENTAL REMEDIATION

Under Act 2, 1995

Preamble 3

   The following final reports were submitted to the Department of Environmental Protection under the Land Recycling and Environmental Remediation Standards Act (35 P. S. §§ 6026.101--6026.908).

   Provisions of Chapter 3 of the Land Recycling and Environmental Remediation Standards Act (act) require the Department of Environmental Protection to publish in the Pennsylvania Bulletin a notice of submission of any final reports. A final report is submitted to document cleanup of a release of a regulated substance at a site to one of the act's remediation standards. A final report provides a description of the site investigation to characterize the nature and extent of contaminants in environmental media, the basis for selecting the environmental media of concern, documentation supporting the selection of residential or nonresidential exposure factors, a description of the remediation performed, and summaries of sampling methodology and analytical results which demonstrate that the remediation has attained the cleanup standard selected.

   For further information concerning the final report, please contact the Environmental Cleanup Program in the Department of Environmental Protection Regional Office under which the notice of receipt of a final report appears. If information concerning a final report is required in an alternative form, contact the community relations coordinator at the appropriate regional office listed.    The Department has received the following final reports:

   A Plus Printing, City of Altoona, Blair County. A Plus Printing, Inc., Michael A. Colledge, Miriam K. Colledge, and Alex Namey, 500 32nd Street, Altoona, PA 16602, have submitted a Final Report concerning remediation of site soils and groundwater contaminated with naphthalene, benzene, toluene, ethylbenzene, total xylene, m-, p-Xylene, and o-xylene. The report is intended to document remediation of the site to meet the background standard.

   Former Hook-Up, Inc. Facility, Lower Macungie Township, Lehigh County. National Environmental Technologies Corporation, P. O. Box 204, 2840 West Clymer Avenue, Telford, PA has submitted a Final Report (on behalf of its client, Hook-Up, Inc., 1619 Schoeneck Road, Macungie, PA) site soils which became contaminated with kerosene. The report is intended to document remediation of the site to meet the Statewide health standard. A Notice of Intent to Remediate was simultaneously submitted. Please refer to additional Pennsylvania Bulletin notice.

SOLID AND HAZARDOUS WASTE

OPERATE WASTE PROCESSING OR DISPOSAL AREA OR SITE


Permits issued under the Solid Waste Management Act (35 P. S. §§ 6018.101--6018.1003), the Municipal Waste Planning, Recycling and Waste Reduction Act (53 P. S. §§ 4000.101--4000.1904) and regulations to operate solid waste processing or disposal area or site.

   Regional Office: Regional Solid Waste Manager, Lee Park, 555 North Lane, Suite 6010, Conshohocken, PA 19428.

   Permit No. 101069.  Southeastern Chester County Refuse Authority, P. O. Box 221, Kennett Square, PA 19348. This permit was issued for the reconfiguration of the existing northern area of the landfill and the elimination of Sedimentation Basin No. 3. Permit was issued in the Southeast Regional Office on February 21, 1997. London Grove Township (host municipality) submitted technical review comments on the application including an objection to the issuance of a permit. It is believed that technical comments submitted by the Township's consultant were adequately addressed by the applicant. The applicant's response to these technical issues were forwarded to the Township and no further correspondence was received on the matter. The Township's remaining objections to issuance were related to local zoning and land development ordinances. These local issues are not subject to the Department's review and are not cause for denying an application. Permit Condition No. 2 of this modification includes standard language informing the permittee that this permit modification does not supersede, amend or authorize violation of any applicable local law, ordinance or regulation that is not pre-empted by the Pennsylvania Solid Waste Management Act. Application for construction and operation of a waste transfer station in Logan Township, Blair County. Permit issued in the Regional Office February 26, 1997.
