REASONABLY AVAILABLE CONTROL TECHNOLOGY
(RACT) The Department of Environmental Protection (Department) will hold a public hearing on October 22, 1997, at 10 a.m. in the Monongahela Room, located at 400 Waterfront Drive, Pittsburgh, PA 15222.
The hearing is for the Department to take testimony concerning the Reasonably Available Control Technology (RACT) proposal submitted by Anchor Glass Container for Plant #5 located in Connellsville, Fayette County, PA.
The proposed approval is for the immediate implementation of manual control of air-to-fuel ratios on Furnaces #1, #2 and #3 for a 15 percent reduction in NOx emissions. Additionally, Anchor shall install Combustion Staging on Furnaces #1 and #2 by May 31, 1998, to reduce NOx emissions for these sources by approximately 50%.
RACT for all sources at this facility will include their operation and maintenance in accordance with manufacturer's recommendations, and accepted air pollution control practices.

Proposed Revision to the State Implementation Plan for Oxides of Nitrogen and Volatile Organic Compounds and Notice of Public Hearing
On December 19, 1996, the Department of Environmental Protection conducted a public hearing to solicit comments on a proposed nitrogen oxides Reasonably Available Control Technology (RACT) determination and proposed operating permit issuance for various combustion sources (boilers, and the like) owned and operated by The Magee Carpet Company in the Town of Bloomsburg, Columbia County. The Department subsequently issued an operating permit, identified as OP-19-0001, to The Magee Carpet Company for these sources on January 22, 1997 and, on July 7, 1997, transferred the respective operating permit to a successor, Magee Rieter Automotive Systems.
Magee found that it was unable to meet the nitrogen oxides emission limit established in operating permit OP-19-0001 for one of its combustion sources, a 60 million BTU per hour anthracite coal and carpet scrap pellet-fired traveling grate boiler identified as boiler #4, and further determined that this failure was due to an erroneous estimation of the boiler's nitrogen oxides emission potential at the time of the RACT plan and operating permit application submission.
Magee has now identified the boiler's true nitrogen oxides emission potential and has provided the Department with a revised RACT analysis for the respective boiler. After evaluating this information, the Department has made a preliminary determination that the proposed revisions should be approved.
The revised nitrogen oxides emission limits and annual coal/carpet scrap pellet usage limitation to which the Department has preliminarily determined boiler #4 should be subject to are .55 pounds of nitrogen oxides per million BTU of heat input, 57.8 tons of nitrogen oxides per 12 consecutive month period and 9,150 tons of coal and carpet scrap pellets burned per 12 consecutive month period.
If approved, the revised nitrogen oxides emission limits and coal/carpet scrap pellet usage limitation will be incorporated into a revised operating permit and submitted to the United States Environmental Protection Agency as a revision to Pennsylvania State Implementation Plan.
One public hearing will be held for the purpose of receiving comments on the proposed revised operating permit and the proposed SIP revision. The hearing will be held on November 5, 1997 at 1 p.m. at the DEP Northcentral Regional Office, 208 West Third Street, Suite 101, Williamsport, PA. The public is invited to comment on the proposal. Persons interested in commenting are invited to appear at the public hearing.
Persons wishing to present testimony at the hearing should contact Daniel Spadoni at (717) 327-3659 at least 1 week in advance of the hearing to reserve a time to present testimony. Oral testimony will be limited to a maximum of 10 minutes per individual and two written copies of the oral testimony are requested. APPLICATIONS TO CONDUCT COAL AND NONCOAL ACTIVITIES
MINING ACTIVITY APPLICATIONS Applications under the Surface Mining Conservation and Reclamation Act (52 P. S. §§ 1396.1--1396.19a); the Noncoal Surface Mining Conservation and Reclamation Act (52 P. S. §§ 3301--3326); The Clean Streams Law (35 P. S. §§ 691.1--691.1001); the Coal Refuse Disposal Control Act (52 P. S. §§ 30.51--30.66); The Bituminous Mine Subsidence and Land Conservation Act (52 P. S. §§ 1406.1--1406.21). Mining activity permits issued in response to such applications will also address the applicable permitting requirements of the following statutes: the Air Pollution Control Act (35 P. S. §§ 4001--4015); the Dam Safety and Encroachments Act (32 P. S. §§ 693.1--693.27); and the Solid Waste Management Act (35 P. S. §§ 6018.101--6018.1003).
The following permit applications to conduct mining activities have been received by the Department of Environmental Protection (Department). A copy of the application is available for inspection at the District mining office indicated above each application. Where a 401 water quality certification is needed for any aspect of a particular proposed mining activity, the submittal of the permit application will serve as the request for such certification.
Written comments or objections, or requests for informal conferences on applications, may be submitted by any person or any officer or head of any Federal, State or local government agency or authority to the Department at the same address within 30 days of this publication, or within 30 days after the last publication of the applicant's newspaper advertisement, as provided by 25 Pa. Code §§ 77.121--77.123 and 86.31--86.34 (relating to public notices of filing of permit applications, opportunity for comment, and informal conferences).
Where any of the mining activities listed below will have discharges of wastewater to streams, the Department will incorporate NPDES permits into the mining activity permits issued in response to these applications. The NPDES permits will contain, at a minimum, technology-based effluent limitations (as described in the Department's regulations--25 Pa. Code §§ 77.522, 87.102, 88.92, 88.187, 88.242, 89.52 and 90.102) for iron, manganese, suspended solids, settleable solids, alkalinity and pH. In addition to the above, more restrictive effluent limitations, restrictions on discharge volume or restrictions on the extent of mining which may occur will be incorporated into a mining activity permit when necessary for compliance with water quality standards (in accordance with 25 Pa. Code Chapters 93 and 95). Persons or agencies which have requested review of the NPDES permit requirements for a particular mining activity within the above-mentioned public comment period will be provided with a 30-day period to review and submit comments on those requirements.
Written comments or objections should contain the name, address and telephone number of persons submitting comments or objections; application number; and a statement of sufficient detail to inform the Department on the basis of comment or objection and relevant facts upon which it is based. Requests for an informal conference must contain the name, address and telephone number of requestor; application number; a brief summary of the issues to be raised by the requestor at the conference; and a statement whether the requestor desires to have the conference conducted in the locality of the proposed mining activities.

1. To modify an existing stream enclosure used to convey this stream beneath Swarthmore Avenue by removing approximately 80 linear feet of the upstream end of enclosure, and attaching 220 linear feet, twin 46-inch by 36-inch CSP enclosure.
2. To relocate aforementioned stream channel upstream of the modified enclosure and excavate approximately 140 linear feet of the 100-year floodway to accommodate construction of the proposed stormwater management facility. A request for an Environmental Assessment for on-stream non-jurisdictional dam is included as a part of this application.
3. To install and maintain 260 linear feet of 66-inch CSP stream enclosure upstream of aforementioned stormwater management facility to convey flow beneath the proposed access road impacting 0.04 acres of adjacent wetland (PFO).
The site is located at 649 Swarthmore Avenue (Lansdowne, PA Quadrangle N: 4.9 inches; W: 12.0 inches) in Springfield Township, Delaware County.
E23-365. Encroachment. The Boeing Company, P. O. Box 16858, MS# P25-62, Philadelphia, PA 19142-0858. To construct, operate and maintain a boat launching ramp and adjacent pedestrian access pier situated along the northern bank of the Delaware River (WWF,MF) at the point of confluence with Crum Creek (WWF). The ramp will facilitate access for small watercraft used for spill response activities. The structure will be constructed primarily from treated pine lumber and welded steel components supported by four steel posts embedded into two concrete footings. The project site is located at the southwestern corner of the Boeing Company property, immediately south of the exit on SR 291 (Bridgeport, NJ-PA Quadrangle N: 19.5 inches; W: 9.9 inches) in Ridley Township, Delaware County.

To widen the existing Chesterfield Lane which will be used as an access road to Somerset Subdivision. The proposed work will impact a total area of 0.17 acre of wetlands (PEM). This site is located at the intersection of Hollow Road and Chesterfield Lane (Malvern, PA Quadrangle N: 14.5 inches; W: 9.00 inches) in Charlestown Township, Chester County.
E23-245A. Encroachment. Kimberly Clark Tissue Company, Front Street & Avenue of the States, Chester, PA 19013. To amend permit E23-245 to include the operation and maintenance of a steel pile supported high deck structure which will replace a collapsed timber pile supported low deck structure having approximately the same dimensions along the Delaware River (WWF-MF). The proposed work will increase the elevation of the low deck structure by approximately 5.0 feet to match the surrounding high deck structures on the existing pier. A steel sheet pile retaining wall will be placed between the new and existing high deck structures to contain existing earth fill. This work is associated with the Market Street Pier Project on the Kimberly Clark Tissue Company Property (Bridgeport, PA-NJ USGS Quadrangle N: 16.9 inches; W: 15.3 inches) located approximately 800 feet east of the confluence of the Chester Creek and the Delaware River.

To excavate in wetlands, within the drainage basin of Little Wapwallopen Creek (high quality coal water fishery), for the purpose of constructing two swales to convey stormwater drainage from highway culverts, through a pasture impacting approximately 0.37 acre of wetlands; and to maintain fill placed in approximately 0.11 acre of wetlands for the purpose of expanding a parking area to the south of Precision Tool & Machine, Inc.
