SEWAGE FACILITIES ACT
PLAN APPROVAL


Plan approval granted under the Pennsylvania Sewage Facilities Act (35 P. S. §§ 750.1--750.20).

   Northcentral Regional Office: Department of Environmental Protection, Water Management Program Manager, 208 West Third Street, Suite 101, Williamsport, PA 17701-6448, (717) 327-0530.

   Location: Hamilton Township, Tioga County.

   Project Description: The approved update calls for construction of a new 60,000 gpd sewage treatment plant and gravity sewers to serve the Village of Morris Run. Primary financing of this project will be with the Rural Development/Rural Utilities Service program. Also approved is an extension of the sanitary sewers from Blossburg Borough to serve the Cummings Mill area of the township. There are 36 EDUs in this part of the project and primary funding will be through the PENNVEST program.

   The Department's review of the sewage facilities update has not identified any significant negative environmental impacts from these projects.

LAND RECYCLING AND ENVIRONMENTAL REMEDIATION

The following final reports were submitted under the Land Recycling and Environmental Remediation Standards Act (35 P. S. §§ 6026.101--6026.908).

   Provisions of Chapter 3 of the Land Recycling and Environmental Remediation Standards Act (act) require the Department of Environmental Protection (Department) to publish in the Pennsylvania Bulletin a notice of submission of any final reports. A final report is submitted to document cleanup of a release of a regulated substance at a site to one of the act's remediation standards. A final report provides a description of the site investigation to characterize the nature and extent of contaminants in environmental media, the basis for selecting the environmental media of concern, documentation supporting the selection of residential or nonresidential exposure factors, a description of the remediation performed, and summaries of sampling methodology and analytical results which demonstrate that the remediation has attained the cleanup standard selected.

   For further information concerning the final report, please contact the Environmental Cleanup Program in the Department's Regional Office under which the notice of receipt of a final report appears. If information concerning a final report is required in an alternative form, contact the community relations coordinator at the appropriate Regional Office listed. A permit authorizing the utilization of paper sludge as an alternative daily cover material, a change in the Stage 3A liner tie-in detail and approval to utilize waste tires as select waste above the protective cover material at this municipal waste landfill, located in Williams Township, Northampton County. The permit was issued in the Regional Office on September 8, 1997.

   The Department of Environmental Protection has taken the following actions on previously received permit applications, requests for Environmental Assessment approval, and requests for Water Quality Certification under section 401 of the Federal Water Pollution Control Act (33 U.S.C.A. § 1341(a)).

   Any person aggrieved by this action may appeal, under section 4 of the Environmental Hearing Board Act (35 P. S. § 7514) and 2 Pa.C.S. §§ 501--508 and 701--704 (relating to the Administrative Agency Law), to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, P. O. Appeals must be filed with the Environmental Hearing Board within 30 days of receipt of written notice of this action unless the appropriate statute provides a different time period. To construct and maintain a bridge having a span of 25 feet and an underclearance of 5 feet across the channel of Raccoon Creek at a point along Route 17 approximately 7,300 feet west of Donnally Mills (Mexico, PA Quadrangle N: 1.4 inches; W: 1.6 inches) in Tuscarora Township, Perry County. This permit was issued under section 105.13(e) Small Projects. This permit also includes 401 Water Quality Certification.

   E67-585.  Encroachment. PA Fish & Boat Commission, Thomas Snyder, 450 Robinson Lane, Bellefonte, PA 16823. To construct and maintain (2) 12 feet wide by 30 feet long concrete launching ramps, an 18 feet wide by 168 feet long precast concrete block loading area and a 175 feet by 320 feet parking area within the floodway of the Susquehanna River adjacent to an existing access facility located 0.25 mile north of Broadway Street on River Street (Middletown, PA Quadrangle N: 6.2 inches; W: 17.2 inches) in Newberry Township, York County. This permit was issued under section 105.13(e) Small Projects. This permit also includes 401 Water Quality Certification.

   Northcentral Region, Water Management--Soils and Waterways, F. Alan Sever, Chief, 208 West Third St., Williamsport, PA 17701.

   Permit No. E17-309.  Encroachment. Pa. Dept. of Transportation, 1924-30 Daisy St., Clearfield, PA 16930. To repair, operate and maintain a single span bridge that carries SR 2007-226, Seg. 0110, Offset 0357 across Beaver Run. The proposed work shall consist of removing the existing superstructure and constructing a composite prestressed concrete spread box beam superstructure that will maintain the existing span of 33.6 feet, minimum underclearance of 6.5 feet and skew of 60 degrees. The project is located along the western right-of-way of SR 0053 approximately 400 feet west of the intersection of SR 2007 and SR 053 (Houtzdale, PA Quadrangle N: 14.2 inches; W: 12.8 inches) in Woodward Township, Clearfield County. This permit was issued under section 105.13(e) Small Projects. This permit also includes 401 Water Quality Certification.

   Permit No. E41-408.  Encroachment. Williamsport Sanitary Authority, 253 West 4th St., Williamsport, PA 17701. To repair, operate and maintain an existing stream enclosure to carry 16 city streets across Grafius Run and to abandon an existing structure and to construct, operate and maintain a 20 inch sanitary sewer linie to convey municipal wastewater across Grafius Run. The work shall consist of repairing the existing 10.0 feet × 10.0 feet concrete box culvert that encloses Grafius Run with a 3,750.0 linear section and installing a 20 inch diameter ductile iron pipe across Grafius Run. The project is located approximately 500.0 feet west of the intersection of Elmira Street and Hawthorne St. (Cogan Station, PA Quadrangle N: 0.20 inch; W: 1.6 inches) in the City of Williamsport, Lycoming County. This permit was issued under section 105.13(e) Small Projects. This permit also includes 401 Water Quality Certification.

WATER ALLOCATIONS


Actions taken under the act of June 24, 1939 (P. L. 842, No. 365) (32 P. S. §§ 631--641) relating to the acquisition of rights to divert waters of the Commonwealth.

   WA 05-496A.  Water allocation. Evitts Creek Water Company, Bedford County. The applicant was granted the right to withdraw a combined total of 15.0 mgd, based on a yearly average, from Lake Gordon and Lake Koon on Evitts Creek, Bedford County. The maximum combined withdrawal from Lake Gordon and Lake Koon shall not exceed 18.0 mgd.

   WA 36-1005.  Water Allocation. West Earl Water Authority, Lancaster County. The applicant was granted the right to purchase 500,000 gpd, based on a 30-day average, from the City of Lancaster.


SPECIAL NOTICES

   Environmental Hearing Board, Docket No. 95-246-MG, November 6, 1996 Remand Order, in the case of Fontaine, Scott and Berks County v. DEP and Waste Management Disposal Services of PA. For further information, contact Ronald Furlan, Regional Manager, Waste Management Program, Southeast Regional Office, Conshohocken, PA. On November 6, 1996, the Environmental Hearing Board granted summary judgment to Berks County with respect to the County's contention that they were not given proper notice of, or opportunity to comment on, the application leading to the Department's issuance on October 2, 1995 of a waste permit for the Pottstown Landfill Eastern Expansion, Permit No. 100549. In December 1996, the Department and the permittee commenced the notice and comment procedures for Berks County and Douglass Township (Berks) under the remand order. Comments were received from Berks County Commissioners and Berks County Planning Commission. No comments were received from Douglass Township (Berks). Comments were also entertained from the public during a public hearing held on April 23, 1997. All pertinent comments received have been duly considered and written responses prepared. On September 15, 1997, copies of the Department's written responses to their comments were forwarded to Berks County Commissioners and Berks County Planning Commission. The Department believes that it has fulfilled its obligations under the remand order contained in EHB Docket No. 95-246-MG.

   Money-Back Guarantee Permit Review Program

   The Money-Back Guarantee Permit Review Program, established August 23, 1995, by Governor's Executive Order 1995-5, establishes clear timelines for the processing of certain Department of Environmental Protection (DEP) Permits. Should DEP fail to meet a published processing time, the Department will automatically return the permit fee to the applicant.

   A.  101655.  York Waste Disposal Inc., Concord Recycling (P. O. Box 1401, York, PA 17405). Under the provisions of the Governor's Executive Order, and Money Back Guarantee Program, the applicant, DEP and the host municipality have negotiated an application review timeline. The end date for a decision on the application for Concord Recycling is on or before November 15, 1997. The application was received by the Southcentral Regional Office on December 20, 1996.
