   The Department of Environmental Protection (Department) has taken the following actions on previously received permit applications and requests for plan approval and has issued the following significant orders.

   Persons aggrieved by this action may appeal, under section 4 of the Environmental Hearing Board Act (35 P. S. § 7514), and 2 Pa.C.S. §§ 501--508 and 701--704 (relating to the Administrative Agency Law), to the Environmental Hearing Board, 400 Market Street, Second Floor, P. O. Box 8457, Harrisburg, PA 17105-8457, (717) 787-3483. Appeals must be filed with the Environmental Hearing Board within 30 days of receipt of written notice of this action unless the appropriate statute provides a different time period. Copies of the appeal form and the Board's rules of practice and procedure may be obtained from the Board. The appeal form and the Board's rules of practice and procedure are also available in braille or on audiotape from the Secretary to the Board at (717) 787-3483. This paragraph does not, in and of itself, create any right of appeal beyond that permitted by applicable statutes and decisional law.

APPROVALS TO USE NPDES AND/OR OTHER GENERAL PERMITS

   The following parties have submitted Notices of Intent (NOIs) for coverage under (1) General NPDES Permit(s) to discharge wastewater into the surface waters of this Commonwealth. The approval for coverage under these general NPDES permits is subject to applicable effluent limitations, monitoring, reporting requirements and other conditions set forth in the general permit; (2) General Permit(s) for Beneficial Use of Sewage Sludge or Residential Septage by Land Application in Pennsylvania. The approval of coverage for land application of sewage sludge or residential septage under these general permits is subject to pollutant limitations, pathogen and vector attraction reduction requirements, operational standards, general requirements, management practices and other conditions set forth in the respective general permit. The Department of Environmental Protection approves the following coverages under the specified General Permit.

   The EPA Region III Regional Administrator has waived the right to review or object to this permit action under the waiver provision: 40 CFR 123.24.

   The application and related documents, effluent limitations, permitting requirements and other information are on file and may be inspected and arrangements made for copying at the contact office noted.

SEWAGE FACILITIES ACT

PLAN APPROVAL


Plan Approval granted under the Pennsylvania Sewage Facilities Act (35 P. S. §§ 750.1--750.20).

   Hazle Township, Luzerne County.

   The Department of Environmental Protection (Department) has completed its review of the Airport Road Act 537 Special Study (Special Study), dated July, 1997 and revised January, 1998 (received by the Department on January 13, 1998), with additional documentation dated October 13, 1997 (received by the Department on October 16, 1997), as prepared by Schumacher Engineering Inc., on behalf of Hazle Township.

   The Department's review has found that the Special Study is now acceptable and hereby grants planning approval.

   The Hazle Township Municipal Authority (Authority), on behalf of Hazle Township, proposes to implement Alternative No. 1 of the Special Study. Alternative No. 1 proposes the construction of a new wastewater collection and conveyance system to serve limited, specific portions of Hazle Township. The areas to be served by the proposed system are limited to those shown on Drawing No. 1 of the Special Study: the Village of Hollywood including the Woodcrest Estates Subdivision and Holly-Lynn Mobile Home Park, properties adjacent to a portion of the Airport Beltway (SR3026) from SR0309 west to the area of the Wal-Mart Super Center, properties adjacent to Old Airport Road (T-470) and Hess Road (T-499) and the Hazleton Municipal Airport. Construction of the proposed system will occur in two phases. Phase 1 will include all areas except for the Old Airport Road and Hazleton Municipal Airport Areas. Phase 2 will include only the Old Airport Road and Hazleton Municipal Airport Areas.

   The wastewater collection and conveyance systems proposed will consist of approximately 13,300 lineal feet of gravity sewer lines and force main along with associated appurtenances. The conveyance system will also include the construction of a 460 gpm wastewater pumping station. The pump station's equipment will be housed in a 45 foot by 25 foot aboveground structure to be constructed along the Airport Beltway. The proposed pump station's force main will discharge its wastewater to an existing manhole located on Liberty Avenue in the Park Crest Subdivision located within Hazle Township. Wastewater will then be conveyed through existing collection and conveyance system lines to the Greater Hazleton Joint Sewer Authority's Wastewater Treatment Facility for treatment and discharge.

   Due to the project's construction, the Authority will abandon the existing Hollywood Pump Station. Wastewater from the Hollywood Collection System will be conveyed to the proposed pump station to be constructed adjacent to the Airport Beltway. The project's construction will also allow for the abandonment of the Holly-Lynn Mobile Home Park's Wastewater Treatment Facility. Several commercial establishments, including Lagana's Corporate Center, Affordable Dentures Inc., Rex TV and Appliance Inc, and the Hazleton Municipal Airport, which currently utilize holding tank facilities as their method of wastewater disposal, will be required to properly abandon their holding tanks and connect to the proposed wastewater collection system.

   The proposed project will be financed through commercial and residential tapping fees, a capital contribution from the Authority's Capital Improvement Fund and a commercial bank loan obtained by the Authority.

   In accordance with the provisions of the Pennsylvania Sewage Facilities Act, 35 P. S. §§ 750.1--750.20(a) (Act 537), and 25 Pa. Code Ch. 71, the Department will hold Hazle Township responsible for the complete and timely implementation of the Special Study's chosen wastewater disposal alternative. Implementation of the Special Study's chosen wastewater disposal alternative must be performed within the time frames indicated in the Special Study's Schedule of Implementation.

   Any additional wastewater-related improvements, additions, deletions or changes outside of those explicitly described in the Special Study must be in compliance with the Department's regulations and be submitted to and approved by the Department in writing.

   This approval covers only the wastewater planning aspects of the proposed construction project as it relates to Hazle Township's Official Sewage Facilities Plan. Before construction of the proposed project may commence, the Authority must obtain a Part II--Water Quality Management Permit from the Department. A copy of the Special Study's approval correspondence must accompany the permit application when it is submitted to the Department's Northeast Regional Office.
