   Where any of the mining activities listed will have discharges of wastewater to streams, the Department will incorporate NPDES permits into the mining activity permits issued in response to these applications. The NPDES permits will contain, at a minimum, technology-based effluent limitations (as described in the Department's regulations--25 Pa. Code §§ 77.522, 87.102, 88.92, 88.187, 88.242, 89.52 and 90.102) for iron, manganese, suspended solids, settleable solids, alkalinity and pH. In addition to the above, more restrictive effluent limitations, restrictions on discharge volume, or restrictions on the extent of mining which may occur will be incorporated into a mining activity permit when necessary for compliance with water quality standards (in accordance with 25 Pa. Code Chapters 93 and 95). Persons or agencies which have requested review of the NPDES permit requirements for a particular mining activity within the above-mentioned public comment period will be provided with a 30-day period to review and submit comments on those requirements.

   Written comments or objections should contain the name, address and telephone number of persons submitting comments or objections; application number; and a statement of sufficient detail to inform the Department on the basis of comment or objection and relevant facts upon which it is based. Requests for an informal conference must contain the name, address and telephone number of requestor; application number; a brief summary of the issues to be raised by the requestor at the conference; and a statement whether the requestor desires to have the conference conducted in the locality of the proposed mining activities.

ENCROACHMENTS

   The following Dam Safety and Encroachment permit applications, requests for Environmental Assessment approval, and requests for water quality certification have been received by the Department of Environmental Protection. Section 401(a) of the Federal Water Pollution Control Act (33 U.S.C.A. § 1341(a)) requires the State to certify that the involved projects will not violate the applicable provisions of 33 U.S.C.A. §§ 1311--1313, 1316 and 1317, as well as relevant State requirements. Initial requests for 401 certification will be published concurrently with the permit application. Persons objecting to approval of a request for certification under section 401 or to the issuance of a Dam Safety or Encroachment Permit or the approval of Environmental Assessments must submit any comments, suggestions or objections within 30 days of the date of this notice as well as any questions to the office noted above the application.

The project is associated with the Penn Forest Dam replacement project and is located approximately 0.26 mile downstream of the Penn Forest Dam (Pohopoco Mountain, PA Quadrangle N:  9.7 inches; W:  8.4 inches) in Penn Forest Township, Carbon County (Philadelphia District, Army Corps of Engineers).

   E35-293. Encroachment. Siniawa VIII, L. P., 760 Scranton-Carbondale Highway, Scranton, PA 18508-9806. To construct and maintain approximately 1,000 linear feet of a 7 foot diameter CMP stream enclosure within a tributary to the Lackawanna River (CWF), locally known as Morgan Grier Creek. The project, associated with the Siniawa Land Development Project, is located at a beginning point along Commerce Boulevard extending 1,000 feet upstream (north end) towards S. R. 0006 (Scranton-Carbondale Highway), (Scranton, PA Quadrangle N:  16.8 inches; W:  1.8 inches) in the Borough of Dickson City, Lackawanna County (Baltimore District, Army Corps of Engineers).

   E35-294. Encroachment. Northeast Real Estate Development, Inc., P. O. Box 128, Waverly, PA 18471. To fill in 0.28 acre of PEM, SS, FO wetlands for the construction of Village Square @ Blakely, a 56 residential lot subdivision. The project is located approximately 0.8 mile east of S. R. 1023 and S. R. 0247 (Olyphant, PA Quadrangle N:  20.1 inches; W:  10.5 inches) in Blakely Borough, Lackawanna County (Philadelphia District, Army Corps of Engineers).

   E39-347. Encroachment. Wegman's Food Markets, 1500 Brooks Avenue, Box 844, Rochester, NY 14692-0844. To fill in 0.43 acre of PEM wetlands for the construction of a proposed retail facility. The project is associated with the Wegman's Food Markets Development, is located on the south side of S. R. 1002 (Tilghman Street) immediately southeast of its intersection with 40th Street (Allentown West, PA Quadrangle N:  16.9 inches; W:  5.9 inches) in the City of Allentown, Lehigh County (Philadelphia District, Army Corps of Engineers).

   E39-348. Encroachment. Fuller Bulk Handling Corporation, 614 Front Street, Catasauqua, PA 18032. To place and maintain a 30 inch diameter PVC outfall structure along the left bank of Lehigh Canal (CWF). The project is located along the left bank of the Lehigh Canal approximately 0.23 mile downstream of the Northampton County/Lehigh County boundary line (Catasauqua, PA Quadrangle N:  5.1 inches; W:  12.2 inches) in Catasauqua Borough, Lehigh County (Philadelphia District, U. S. Army Corps of Engineers).

   E40-490. Encroachment. Heritage Pittston Realty Company Inc., 1 Commerce Road, Pittston, PA 18640. To construct and maintain a stream enclosure of Lidy Creek (CWF) consisting of approximately 210 linear feet of 54-inch CMP, impacting approximately 240 linear feet of the existing channel; and to place fill in a de minimus area of wetlands less than or equal to 0.04 acre, for the purpose of expanding the Berkely Publishing Group facility. The overall project will include several activities to be authorized by general permits. The project is located within the eastern distribution center industrial park, at the east side of Commerce Road, approximately 1.0 mile southeast of Interchange 49 of Interstate 81 (Avoca, PA Quadrangle N:  14.0 inches; W:  13.4 inches) in Pittston Township, Luzerne County (Baltimore District, U. S. To construct and maintain five golf cart bridges across Lousy Run consisting of (1) a 47-foot single span bridge with an underclearance of 6.8 feet (2) a 25-foot single span bridge with a 9-foot underclearance impacting a de minimis area of wetlands equal to 0.02 acre (3) a 30-foot single span bridge with a 7-foot underclearance (4) a 40-foot single span bridge with a 4-foot underclearance (5) a 37-foot single span bridge with a 4-foot underclearance; and, to place fill in the floodway of Rock Creek to construct Greens No. 11 and 14 to be located at The Links of Gettysburg Golf Course located on either side of Mason Dixon Road approximately 1 mile west of SR 0134 near the MD State Line (Taneytown, MD-PA Quadrangle N:  18.1 inches; W:  14.5 inches) in Mount Joy Township, Adams County.

To remove an abandoned structure and to construct and maintain a twin 22-foot span box culvert on 80.81 degree skew with an average underclearance of 4.75 feet in the channel of Wolf Camp Run on T-378 located in Madley Village (Buffalo Mills, PA Quadrangle N:  4.1 inches; W:  6.85 inches) in Londonderry Township, Bedford County.

   E06-511. Encroachment. Longswamp Township, P. O. Box 37, Mertztown, PA 19539. To remove a 47-inch × 71-inch arch culvert in the channel of Sacony Creek at a point at Stone Road (Manatawny, PA Quadrangle N:  16.1 inches; W:  7.5 inches) in Longswamp Township, Berks County.

   E67-622. Encroachment. Glen Rock Sewer Authority, C. Edward Long, P. O. Box 116, Glenn Rock, PA 17327. To construct and maintain additions to the existing Glen Rock Sewer Authority Wastewater Treatment Plant located in the floodplain of the South Branch of the Codorus Creek including part of the administration building, aeration tanks, aerobic digesters and a generator/blower pad. To remove the existing structure and to construct and maintain a cast in place concrete box culvert with a normal span of 17.4 feet and effective underclearance of 5.5 feet in Camp Run located on Cooks Run Road approximately 0.4 mile north of its intersection with Cole Run Road (Keating, PA Quadrangle N:  7.8 inches; W:  7.2 inches) in East Keating Township, Clinton County. Estimated stream disturbance is 160 feet of stream with no wetland impact; stream classification is HQ-CWF.

To construct and maintain two 6 foot diameter by 18-foot long metal pipes in Shamokin Creek located approximately 1 mile east on SR 4026 from its intersection with SR 890 (Trevorton, PA Quadrangle N:  8.5 inches; W:  10.75 inches) in Rockefeller Township, Northumberland County. Stream classification Warm Water Fishery.

To amend Permit No. E04-005T-1 to include the construction and maintenance of an additional 320.0 foot long × 130.0 foot wide barge mooring facility in the channel of and along the right bank of the Ohio River (WWF) for the purpose of expanding the existing facility.    E24-204. Encroachment. City of St. Marys, 808 South St. Michael Street, P. O. Box 1994, St. Marys, PA 15857. To remove an existing cut stone retaining wall and to construct and maintain a 200 foot long con span concrete arch stream enclosure having a span of 24 feet and an underclearance of 10 feet in Elk Creek along Depot Street extending upstream from South St. Michael Street (Saint Marys, PA Quadrangle N:  6.8 inches; W:  8.2 inches) located in the City of St. Marys, Elk County.

   E25-570. Encroachment. PA Department of Transportation, Engineering District 1-0, 1140 Liberty Street, P. O. Box 711, Franklin, PA 16323. To remove the existing structure and to construct and maintain a pre-stressed concrete spread box beam bridge with a single clear span measuring 70 feet and with an underclearance of 6.64 feet on S. R. 0430 across Sixmile Creek (CWF, MF). The project is located on S. R. 0430 approximately 1,800 feet west of the intersection of S. R. 0430 and S. R. 0531 at Owens Corners (Hammett, PA Quadrangle N:  21.2 inches; W:  5.2 inches) located in Harborcreek Township, Erie County.

   E37-118. Encroachment. PA Department of Transportation, Engineering District 11-0, 45 Thoms Run Road, Bridgeville, PA 15017-2853. To remove the existing two span bridge and to construct and maintain a three span bridge with each clear span measuring 113.67 feet with a minimum underclearance of 17.8 feet on S. R. 0108 (Mount Jackson Road) across the Mahoning River (WWF). This project will utilize a single causeway across the Mahoning River (streambank to streambank) to allow for removal of existing piers and creation of new piers. The project is located on S. R. 0108 across the Mahoning River approximately 200 feet west of the intersection of S. R. 0108 and S. R. 0018 (Bessemer PA Quadrangle N:  17.4 inches; W:  1.3 inches) located in the City of New Castle, North Beaver Township and Taylor Township, Lawrence County.

   E42-257. Encroachment, Bradford Township, Allen J. Pingie, Chairperson, 136 Hemlock Street, Bradford, PA 16701. To remove the existing bridge deck and to construct and maintain a timber deck across the existing bridge on T-499 (Clark's Lane) across the West Branch of Tunungwant Creek (HQ-CWF, Wild Trout). The project is located on T-499 (Clarks Lane) across Tunungwant Creek approximately 1,000 feet east of the intersection of T-499 (Clark's Lane) and T-332 (Langmade Lane) (Bradford, PA-NY Quadrangle N:  11.5 inches; W:  7.2 inches) located in Bradford Township, McKean County.

To remove the existing single-span pedestrian bridge across Wolf Creek (CWF Trout Stocked) and to repair existing concrete bridge abutments. The project is located across Wolf Creek approximately 500 feet northeast of the intersection of South Broad Street and East Pine Street in Grove City Borough (Grove City, PA Quadrangle N:  6.5 inches; W:  11.5 inches) located in Grove City Borough, Mercer County.

To remove the existing truss superstructure and to construct and maintain a steel multi-beam with wood deck superstructure on T-306 (Mount Hope Road) across Pine Creek (CWF, Trout Stocked, Wild Trout). ENVIRONMENTAL ASSESSMENT


The following Environmental Assessment and request for Water Quality Certification are being processed under sections 105.12(a)(16) and 105.15(b), restoration activities undertaken and conducted under a restoration plan approved by the Department.

   EA33-003NW. Environmental Assessment. Robert Hedin, Hedin Environmental, 634 Washington Road, Suite 216, Pittsburgh, PA 15228. To place fill in a de minimis area of wetland (0.02 acre) as part of a project to redirect an acid mine discharge (203 gpm average flow) through a 4,000 ton anoxic limestone drain and through two separate constructed wetlands (0.95 acre and 1.3 acres) to provide passive treatment prior to discharge to Beaver Run (HQ-CWF). The project is located in a strip-mined area on the west side of Beaver Run approximately 600 feet southwest of the intersection of S. R. 3022 and Conifer Road in the Village of Conifer (Summerville, PA Quadrangle N:  14.5 inches; W:  2.0 inches) located in Beaver Township, Jefferson County.

DISCHARGE OF CONTROLLED INDUSTRIAL WASTE AND SEWERAGE WASTEWATER

(Part I Permits)

   The Department of Environmental Protection has taken the following actions on previously received permit applications and requests for plan approval and has issued the following significant orders.

   Any person aggrieved by this action may appeal, under section 4 of the Environmental Hearing Board Act (35 P. S. § 7514), and 2 Pa.C.S. §§ 501--508 and 701--704 (relating to the Administrative Agency Law) to the Environmental Hearing Board, 400 Market Street Floor 2, P. O. Box 8457, Harrisburg, PA 17105-8457, (717) 787-3483. Appeals must be filed with the Environmental Hearing Board within 30 days of receipt of written notice of this action unless the appropriate statute provides a different time period. Copies of the appeal form and the Board's rules of practice and procedure may be obtained from the Board. The appeal form and the Board's rules of practice and procedure are also available in Braille or on audio tape from the Secretary to the Board at (717) 787-3483. This paragraph does not, in and of itself, create any right of appeal beyond that permitted by applicable statutes and decisional law.

   WQM Permit 1798403. Sewerage. William and Sandra Harchak, 712 Stone Street, Osceola Mills, PA 16666. Granted permit to discharge from single residence facility, located at Gulich Township, Clearfield County.

   Permit No. 6575412--Amendment No. 2. Industrial waste, Menasha Corporation, P. O. Box M, Yukon, PA 15698. Installation of an aerobic digestion tank at the wastewater treatment plant located in the Township of Sewickley, Westmoreland County to serve the Menash Corporation.

   Permit No. 1197402. Sewerage, Pegasus Sewer Authority, 1296 Clapboard Run Road, Johnstown, PA 15904. Construction of Collector Sewers and Pump Stations located in the Township of Conemaugh, Cambria County to serve the Bon Air and Frankstown Road.

   NPDES Permit No. PA0104141. Sewage. Jay Township Authority, P. O. Box 186, Weedville, PA 15868-0186 is authorized to discharge from a facility located in Jay Township, Elk County to Bennett Branch of Sinnemahoning Creek.

   WQM Permit No. 2498401. Sewage. Jay Township Authority, P. O. Box 186, Weedville, PA 15868-0186. This project is for the construction and operation of a wastewater treatment facility in Jay Township, Elk County.

   WQM Permit No. 4398415. Sewerage. Judy Ammer, SRSTP, 143 Schaffer Road, Mercer, PA 16335. Construction of Judy Ammer SRSTP located in Findley Township, Mercer County.

INDIVIDUAL PERMITS

   The following parties have submitted Notices of Intent (NOIs) for Coverage under (1) General NPDES Permit(s) to discharge wastewater into the surface waters of the Commonwealth. The approval for coverage under these general NPDES permits is subject to applicable effluent limitations, monitoring, reporting requirements and other conditions set forth in the general permit; (2) General Permit(s) for Beneficial Use of Sewage Sludge or Residential Septage by Land Application in Pennsylvania. The approval of coverage for land application of sewage sludge or residential septage under these general permits is subject to pollutant limitations, pathogen and vector attraction reduction requirements, operational standards, general requirements, management practices, and other conditions set forth in the respective general permit. The Department of Environmental Protection approves the following coverages under the specified General Permit.

   The EPA Region III Regional Administrator has waived the right to review or object to this permit action under the waiver provision:  40 CFR 123.24.

   The application and related documents, effluent limitations, permitting requirements, and other information are on file and may be inspected and arrangement made for copying at the contact office noted.
