APPLICATIONS RECEIVED UNDER SECTION 401: FEDERAL WATER POLLUTION CONTROL ACT

ENCROACHMENTS

   The following Dam Safety and Encroachment permit applications, requests for Environmental Assessment approval and requests for water quality certification have been received by the Department of Environmental Protection (Department). Section 401(a) of the Federal Water Pollution Control Act (33 U.S.C.A. § 1341(a)) requires the State to certify that the involved projects will not violate the applicable provisions of 33 U.S.C.A. §§ 1311--1313, 1316 and 1317, as well as relevant State requirements. Initial requests for 401 certification will be published concurrently with the permit application. Persons objecting to approval of a request for certification under section 401 or to the issuance of a Dam Safety or Encroachment Permit or the approval of Environmental Assessments must submit comments, suggestions or objections within 30 days of the date of this notice as well as any questions to the office noted above the application.

   E15-577.  Encroachment. PA DOT, 200 Radnor-Chester Rd., St. Davids, PA 19087. To improve, modify and maintain US 202 (SR 0202), Section 400, (Phase II, Section 402) within the existing median and beyond the existing highway edge. The highway width will increase from four lanes to a minimum of six lanes. The limit of this work will begin east of North Valley Road, (Valley Forge, PA Quadrangle N: 10.4 inches; W: 15.6 inches) and will end west of Old Eagle School Road, (Valley Forge, PA Quadrangle N: 14 inches; W: 5.2 inches) in Tredyffrin Township, Chester County. Work will consist of: 1) Modifying an existing crossing of an unnamed tributary to Little Valley Creek (EV) at Station 563 + 50 using retaining walls or head wall modification. 2) Modifying an existing crossing of Crabby Creek tributary to Little Valley Creek (EV) at station 582 + 50 using a retaining wall or head wall modification. 3) Extending an existing 60-inch R.C.P. culvert by installing approximately 25 linear feet of 60-inch R.C.P. culvert to the down stream end left of station 658 + 00, and also to extend an existing 18-inch drainage pipe by installing approximately 20-linear feet of R.C.P. culvert at the downstream end just left of station 660 + 50 in unnamed tributaries to Little Valley Creek (EV) and impacting de minimis 0.024 acre of Exceptional Value wetlands (PFO). 4) Modifying an existing box culvert along Trout Creek at station 696 + 00 utilizing retaining walls or head wall modifications. 5) Modifying an existing box culvert along an unnamed tributary to Trout Creek (WWF) at station 716 + 04 using retaining walls or head wall modifications. 6) Modifying an existing box culvert along an unnamed tributary to Trout Creek (WWF) at station 738 + 55 utilizing retaining walls or head wall modifications. 7) Extend an existing 6.5-foot × 6-foot R. C. box culvert by adding approximately 5 linear feet of 6.5 foot by 6-foot box culvert at the down stream end, at a point left of station 754 + 60 in the vicinity of Bay Colony ramps. Work also includes the improvement and modification to the bed of an unnamed tributary to Trout Creek for approximately 600 linear feet from the aforementioned culvert to the upstream end of the culvert under Swedesford Road.

   E15-580.  Encroachment. PA DOT, 200 Radnor-Chester Rd., St. Davids, PA 19087-5178. To remove an existing bridge and to construct and maintain a 15-foot span by 4.5-foot effective rise concrete box culvert in and along an unnamed tributary to Muddy Run (TSF, MF). This culvert is located on Cream Road (S. R. 3085 Section 40M), at a point approximately 100 feet west of the intersection of Cream Road and Union School Road (Kirkwood, PA Quadrangle N: 14.75 inches; W: 0.45 inch) in Lower Oxford Township, Chester County.

   E15-479.  Encroachment. Judd Builders-Developers, 1750 Walton Road, Blue Bell, PA 19422-0465. To reissue permit No. E15-479 to construct and maintain triple reinforced concrete box culverts having a cell span of 15 feet each and two cells with underclearances of 5.5 feet, and the third with an underclearance of 6.0 feet. This third cell, which receives low stream flows, will be depressed 0.5 foot below the other two cells. This culvert is associated with the construction of the Friendship Lane roadway crossing over a tributary to the East Branch White Clay Creek for the purpose of providing access from Clay Creek Road into the proposed residential Hills of Sullivan Subdivision. This project also includes placement of fill in 0.43 acre of wetlands associated with the construction of Angelica Drive to serve as a combined roadway crossing and stormwater impoundment facility, to construct two 6-foot wide wooden pedestrian bridges for wetland crossings at several locations along a proposed recreational trail, and install a 4-inch supply pipe to storm water basin No. 1. The site is located at a point approximately 800 feet east of Sullivan Road (T-327) and Clay Creek Road (S. R. 3011) (West Grove, PA-DEL Quadrangle N: 10.6 inches; W: 5.7 inches) in London Grove Township, Chester County.

   E40-481.  Encroachment. Frank L. Miner, R. R. 2, Box 164, Mehoopany, PA 18629-9514. To construct and maintain a cantilevered dock, extending from a concrete pad, in Lake Silkworth, and to modify and maintain an existing stone wall along the shoreline. The dock extends approximately 40 feet from the shoreline, and is 8 feet wide. The project is located along the eastern shoreline of the lake, approximately 0.25 mile northeast of the intersection of S. R. 0029 and T-579 (Harveys Lake, PA Quadrangle N: 4.3 inches; W: 11.1 inches), in Lehman Township, Luzerne County (Baltimore District, U. S. Army Corps of Engineers).

   E64-192.  Encroachment. Rutnel, Inc., 12 South 21st Street, Kenilworth, NJ 07033. To excavate within Kinneyville Pond for the purpose of removing tree stumps throughout the 27.75-acre pond area and deepening an area used for water skiing training, and to construct and maintain a 10-foot by 10-foot concrete block to serve as an anchor. The project is located southwest of the intersection of T-601 and T-603 (Lake Como, PA-NY Quadrangle N: 17.5 inches; W: 8.0 inches) in Buckingham Township, Wayne County (Philadelphia District, U. S. Army Corps of Engineers).

   E01-194.  Encroachment. PA Department of Transportation, Engineering District 8-0, 2140 Herr Street, Harrisburg, PA 17103. To remove an existing structure and to construct and maintain a 20-foot by 5-foot by 35 feet long reinforced concrete box culvert in a tributary to marsh Creek on SR 3004, Section 001, Segment 0040, Offset 0740 Station 73+68 just east of SR 0015 (Emmitsburg, PA Quadrangle N: 21.8 inches; W: 2.7 inches) in Cumberland Township, Adams County.

   E05-267.  Encroachment. PA Department of Transportation, District 9-0, Dain Davis, 1620 N. Juniata Street, Hollidaysburg, PA 16648. To remove the existing two span bridge and to construct and maintain a new single span prestressed concrete spread box beam bridge having a 42 feet clear span on a 40 degree skew with a 5.8 feet minimum underclearance over Yellow Creek on SR 1005, Section 002, Segment 0230, Offset 0297, Station 25+79.19 located in Loysburg Village (New Enterprise, PA Quadrangle N: 6.55 inches; W: 0.1 inch) in South Woodbury Township, Bedford County.

   E28-254.  Encroachment. PA DCNR for American Farmlands Trust, P. O. Box 8451, Harrisburg, PA 17105. To construct a single span bridge having a span of 39 feet with a minimum underclearance of 6 feet across Little Cove Creek for cattle crossing located about 900 feet east of Little Cove Church (Cherry Run, PA Quadrangle N: 21.7 inches; W: 4.3 inches) in Warren Township, Franklin County.

   E28-255.  Encroachment. PA Department of Transportation, District 8-0, John Rautzahn, 2140 Herr Street, Harrisburg, PA 17103. To remove the existing culvert and to construct and maintain a 12-foot × 5-foot concrete box culvert in the channel of an unnamed tributary to Narrows Branch Tuscarora Creek on SR 4007, Segment 0160, Offset 1303, Station 62+93 located about 1.1 miles east from its intersection with PA 75 (Blairs Mills, PA Quadrangle N: 2.98 inches; W: 8.08 inches) in Fannett Township, Franklin County.

   Northcentral Region: Water Management, Soils and Waterways Section, F. Alan Sever, Chief, 208 West Third St., Suite 101, Williamsport, PA 17701.

   E14-324.  Encroachment. Edward J. Lauth, Aquapenn Spring Water Co., One Aquapenn Dr., Milesburg, PA 16853. To install, operate and maintain 25,000 feet utility line to supply potable water for municipal supply and commercial bottling that will require the crossing of Spring Creek, Buffalo Run, Bald Eagle Creek and an unnamed tributary to Bald Eagle Creek. The crossings shall be constructed with a 16 inch diameter ductile iron pipe that will be encased in concrete and installed a minimum of 3 feet beneath the stream bed. The project is located along the eastern right-of-way of SR 0220 approximately 4,000 feet east of the intersection of SR 0144 and SR 0220 (Bellefonte, PA Quadrangle N: 11.2 inches; W: 5.5 inches) in Bellefonte Borough, Boggs Township, Milesburg Borough and Spring Township, Centre County. Estimated stream disturbance is 255 linear feet maximum of waterway with no wetland impact.

   E14-326.  Encroachment. Pa. Dept. of Transportation, 1924-30 Daisy St., Clearfield, PA 16830. To construct and maintain a 4 span steel multi-girder bridge with a total span of 882 feet and minimum underclearance of 101 feet across Logan Branch of Spring Creek for SR 0026 Section C05 located above SR 0144 approximately 1.25 miles south of the village of Axemann (Bellefonte, PA Quadrangle N: 0.69 inch; W: 1.88 inches) in Spring Township, Centre County. This stream is designated HQ-CWF and this project will not impact the stream of wetlands.

   E03-369.  Encroachment. Arthur V. Whittaker, 6676 Shawbutte Drive, Poland, Ohio 44514. To operate and maintain approximately 180 feet of rock bank protection along the right bank of the Allegheny River (WWF) near river mile 65.4 (East Brady, PA Quadrangle N: 19.8 inches; W: 10.4 inches) in Washington Township, Armstrong County.

   E03-373.  Encroachment. Armstrong County Industrial Development Authority, 402 Market Street, Kittanning, PA 16201-1485. To relocate approximately 950 l. f. of an unnamed tributary to Glade Run (TSF) for the purpose of property development and to place and maintain fill in 0.33 acre of wetlands (PEM and PSS) located on Wible Road (T-530), approximately 0.5 mile south of its intersection with SR 4010 in the (Kittanning, PA Quadrangle N: 12.7 inches; W: 8.0 inches) in East Franklin Township, Armstrong County.

   E63-454.  Encroachment. Tyrol Development Company, LLC, 100 Wood Street Building, Pittsburgh, PA 15222. To construct and maintain a dual 7 feet diameter CMP culvert and to relocate and maintain approximately 240 feet of a tributary to Little Chartiers Creek (HQ-WWF) for the purpose of constructing a commercial complex. The project is located on the south side of SR 0019 southwest of its intersection with Locust Street (Canonsburg, PA Quadrangle N: 0.8 inch; W: 5.3 inches) in North Strabane Township, Washington County.

   E02-1233.  Encroachment. Caste Real Estate Company, P. O. Box 10360, Pittsburgh, PA 15234. To place and maintain fill in an unspecified acreage of wetlands associated with an unnamed tributary to Sawmill Run (WWF) for the purpose of expanding the Steeplechase Development. The project is located on the west side of Weyman Road, approximately 1,000 feet south from the intersection of Weyman Road and McRoberts Road (Glassport, PA Quadrangle N: 21.3 inches; W: 17.3 inches) in Whitehall Borough, Allegheny County.

   E65-696.  Encroachment. Borough of Ligonier, Town Hall, 120 East Main Street, Ligonier, PA 15658. To operate and maintain the existing Ligonier Borough Sewage Treatment Plant and to construct and maintain modifications to existing sewage treatment structures and new sewage treatment structures within the boundaries of the existing treatment plant located within the 100-year floodway boundaries of Mill Creek for the purpose of meeting the sewage treatment needs of the service area. The project is located adjacent to SR 30, approximately 0.7 mile west of its intersection with SR 711 (Ligonier, PA Quadrangle N: 22.3 inches; W: 17.35 inches) in Ligonier Township, Westmoreland County.

   E16-105.  Encroachment. PA Department of Transportation, Engineering District 10-0, P. O. Box 429, Route 286 South, Indiana, PA 15701. To remove the existing temporary steel bridge constructed after the July 1996 Floods, and to place and maintain a twin cell pre-cast reinforced concrete box culvert with each water way opening having a span of 4.5 meters, a rise of 2.7 meters, and a length of 58 meters on S. R. 0068 across Brush Run (CWF). The box culvert will be placed approximately 125 meters downstream of the existing bridge as part of a new roadway realignment to improve traffic safety. This new roadway will result in fill being placed within 0.89 acre of wetlands. This project will include creation of 0.89 area of replacement wetlands adjacent to the project. This project is located on S. R. 0068 across Brush Run approximately 4,500 feet south of the intersection of S. R. 0068 and I-80 at interchange 9 located in Monroe Township, Clarion County.

To construct and maintain a nonjurisdictional dam across a tributary to East Branch Stony Fork (CWF) for the purpose of recreation located approximately 4,500 feet northeast of the intersection of S. R. 3007 and T-399 (Tiadaghton, PA Quadrangle N: 11.25 inches; W: 1.95 inches) in Delmar Township, Tioga County.
