   The Independent Regulatory Review Commission met publicly at 11 a.m., Thursday, March 11, 1999, and took the following actions:

Regulations Approved:

   Environmental Quality Board #7-320:  Control of VOCs from Gasoline Dispensing Facilities (Stage II) Standards (amends 25 Pa. Code § 129.82).

   Environmental Quality Board #7-326:  Equivalency Determinations and Aerospace Manufacturing and Rework--VOC Emission Limitations (amends 25 Pa. Code §§ 121.1, 129.51 and 129.73).

   Environmental Quality Board--Control of VOCs from Gasoline Dispensing Facilities (Stage II); Regulation No. 7-320

Order

   On April 21, 1997, the Independent Regulatory Review Commission (Commission) received this proposed regulation from the Environmental Quality Board. This rulemaking amends 25 Pa. Code § 129.82. The authority for this regulation is 35 P. S. § 4005. The proposed regulation was published in the May 3, 1997 Pennsylvania Bulletin with a 60-day public comment period. The final-form regulation was submitted to the Commission on February 9, 1999.

   This regulation implements gasoline dispensing vapor control requirements for most gasoline dispensing facilities in seven southwestern Pennsylvania counties (Allegheny, Armstrong, Beaver, Butler, Fayette, Washington and Westmoreland). The amendments are a part of the overall ozone reduction strategy required to comply with the National Ambient Air Quality Standard. Controlling Volatile Organic Compounds (VOCs) will reduce ozone because VOCs are one of the precursors to the formation of ozone in the atmosphere.

   We have reviewed this regulation and find it to be in the public interest. This regulation will help move the southwestern Pennsylvania counties toward compliance with the Federally required standard for ozone.

Therefore, It Is Ordered That:

   1.  Regulation No. 7-320 from the Environmental Quality Board, as submitted to the Commission on February 9, 1999, is approved; and

   2.  The Commission will transmit a copy of this Order to the Legislative Reference Bureau.

   Environmental Quality Board--Equivalency Determinations and Aerospace Manufacturing and Rework--VOC Emission Limitations; Regulation No. 7-326

Order

   On August 12, 1997, the Independent Regulatory Review Commission (Commission) received this proposed regulation from the Environmental Quality Board (EQB). This rulemaking amends 25 Pa. Code §§ 121.1, 129.51 and 129.73. The authority for this regulation is sections 5(a)(1) and 5(a)(13) of the Air Pollution Control Act (35 P. S. §§ 4005(a)(1) and 4006(a)(13)). The proposed regulation was published in the August 23, 1997 Pennsylvania Bulletin with a 67-day public comment period. The final-form regulation was submitted to the Commission on February 9, 1999.

   The regulation sets forth the volatile organic compound limitations for operations in the aerospace manufacturing and rework industry. It incorporates the requirements contained in the provisions of a Control Techniques Guidance document from the United States Environmental Protection Agency (EPA). The regulation also deletes a provision that requires all equivalencies be submitted to the EPA as revisions to the State implementation plan.

   We have reviewed this regulation and find it to be in the public interest. This regulation is consistent with the operating and emission requirements for the aerospace industry in other states. It will allow Pennsylvania's industry to compete more effectively in meeting the demands of its customers including the United States Department of Defense and National Aeronautics and Space Administration. The changes to the equivalency provisions will allow industries in the Commonwealth to implement alternate compliance methods with greater expediency.

Therefore, It Is Ordered That:

   1.  Regulation No. 7-326 from the Environmental Quality Board, as submitted to the Commission on February 9, 1999, is approved; and

   2.  The Commission will transmit a copy of this Order to the Legislative Reference Bureau.
