Amendment to Proclamation of Disaster Emergency

September 15, 1999

   Whereas, on August 26, 1999, I declared a State of Disaster Emergency in McKean County due to a flash flood that caused extensive damage to roads and streets, private homes, and businesses in various parts of McKean County; and

   Whereas, during the same time period another localized and unusually heavy rainstorm struck parts of Juniata County and caused similar damage to private homes and businesses in various parts of Juniata County; and

   Whereas, on or about September 6, 1999, another series of unusually heavy rains, caused by Tropical Depression Dennis, produced flash floods in parts of Lycoming, Northumberland, Snyder, and Union Counties which resulted in extensive damage to roads and streets, private homes, businesses, and caused other adverse impacts upon the general population of these counties; and

   Whereas, the emergency situation has been of such magnitude and severity as to render essential the Commonwealth's supplementation of county and municipal efforts and resources and the activation of all applicable state, county, and municipal emergency response plans; and

   Now Therefore, pursuant to the provisions of Subsection 7301(c) of the Emergency Management Services Code (35 Pa.C.S.A. Section 7101 et seq.), I Tom Ridge, Governor of the Commonwealth of Pennsylvania, do hereby amend my Proclamation of August 26, 1999, as follows:

   1.  The Counties of Juniata, Lycoming, Northumberland, Snyder, and Union are now declared to be in a state of disaster emergency and are added to the previously declared disaster emergency area.

   2.  I hereby transfer up to $200,000 in unused appropriated funds to the Pennsylvania Emergency Management Agency. The aforementioned funds shall be used for disaster-related expenses incurred by various state agencies and departments. These funds shall be credited to a special account established by the Office of the Budget. All Commonwealth agencies purchasing supplies or services in response to this emergency are authorized to utilize the emergency procurement procedures set forth in Section 516 of the Commonwealth Procurement Code, Act of May 15, 1998, P. L. 358, No. 57, § 1, 62 Pa.C.S. § 516. This Proclamation shall serve as the written determination of the basis for the emergency under Section 516.

   3.  This Proclamation amendment shall take effect immediately from the date of this amendment.

   Given under my hand and the Seal of the Governor, at the city of Harrisburg, this fifteenth day of Septem-ber in the year of our Lord, one thousand nine hundred and ninety-nine and of the Commonwealth, the two hundred and twenty-fourth.
