Notice of Hearing

   Under the Teacher Certification Law, act of December 12, 1973 (P. L. 397, No. 141) as amended, (24 P. S. §§ 2070.1--2070.18), the Professional Standards and Practices Commission (Commission) has initiated hearing procedures to consider the application of Timothy Dempsey for reinstatement of his teaching certificate.

   On or about July 23, 1999, Timothy Dempsey filed an application for reinstatement of his teaching certificate under section 16 of the Teacher Certification Law (24 P. S. § 2070.16), §§ 35.1 and 35.2 of the General Rules of Administrative Practice and Procedure (1 Pa. Code §§ 35.1--35.2) and 22 Pa. Code § 233.14 (relating to reinstatement). Under section 16 of the Teacher Certification Law, the Department of Education (Department) on October 21, 1999 recommended to the Commission that the application be denied. In accordance with the Teacher Certification Law, and the General Rules of Administrative Practice and Procedure, the Commission will appoint a hearing examiner to serve as presiding officer to conduct the proceedings and hearings as might be necessary, and to prepare a proposed report to the Commission containing findings of fact, conclusions of law and a recommended decision on the application.

   An interested party desiring to participate in these hearing procedures must file a notice of intervention or a petition to intervene in accordance with §§ 35.27 to 35.32 of the General Rules of Administrative Practice and Procedure (1 Pa. Code §§ 35.27--35.32) within 30 days after publication of this notice in the Pennsylvania Bulletin. Persons objecting to the approval of the application may also, within 30 days after publication of this notice in the Pennsylvania Bulletin, file a protest in accordance with § 35.23 of the General Rules of Administrative Practice and Procedure (1 Pa. Code § 35.23).

   Notices and petitions to intervene and protest shall be filed with Carolyn Angelo, Executive Director of the Professional Standards and Practices Commission, at 333 Market Street, Harrisburg, PA 17126-0333, on or before 4 p.m. on the due date prescribed by this notice.
