   Section 268(b) states that shelter holes shall be provided on the clearance side along designated travelingways, which are also used as haulage entries, other than belt conveyor haulage entries. The shelter holes shall be spaced not more than 80 feet apart.

   Summary of the request: Helvetia Coal Company requests a variance to exceed the 80 feet spacing but not to exceed 130 feet distance through the Stewart Run stream area, approximately 600 feet long at the Lucerne No. 6E Mine.

   Helvetia Coal Company

   The Bureau of Deep Mine Safety has received a request for variance from Helvetia Coal Company. The following notification contains a summary of this request. A complete copy of the variance request may be obtained from Allison Trader by calling (724) 439-7469 or from the BDMS web site at http://www.dep.state.pa.us/dep/deputate/minres/dms/dms.htm.

   The Department is publishing a summary of the request to solicit comments from affected parties on the proposed variance request. Comments may be used by the Bureau to assist in its investigation of the variance request. Comments will be accepted for 30 days following the publication of this notice.    Section 702 of the Bituminous Coal Mine Act (52 P. S. §§ 701 and 702) (act), provides a mechanism for operators to obtain variances from specific requirements of the act to accommodate the adoption of new machinery, equipment, tools, supplies, methods or processes.

   Section 242(c) states that where belt conveyors are installed, main stoppings and regulators shall be so arranged as to reduce the quantity of air traveling in the belt conveyor entry to a minimum for effective ventilation and to provide an intake air split as an escapeway from the face area to the main air current.

   Summary of the request: Helvetia Coal Company requests a variance to allow for the common ventilation of belt conveyor entries with other entries at the Lucerne No. 6E Mine.

ABANDONED MINE RECLAMATION

   Under Act 181 of 1984, the Department of Environmental Protection solicits letters of interest from the landowners and/or licensed mine operators for the reclamation of the following abandoned strip mine project:

ENCROACHMENTS

   The following Dam Safety and Encroachment permit applications, requests for Environmental Assessment approval and requests for water quality certification have been received by the Department of Environmental Protection (Department). Section 401(a) of the Federal Water Pollution Control Act (33 U.S.C.A. § 1341(a)) requires the State to certify that the involved projects will not violate the applicable provisions of 33 U.S.C.A. §§ 1311--1313, 1316 and 1317, as well as relevant State requirements. Initial requests for 401 certification will be published concurrently with the permit application. Persons objecting to approval of a request for certification under section 401 or to the issuance of a Dam Safety or Encroachment Permit or the approval of Environmental Assessments must submit comments, suggestions or objections within 30 days of the date of this notice as well as any questions to the office noted above the application.

   E13-117.  Encroachment. White Haven Municipal Authority, 50 East Woodhaven Drive, White Haven, PA 18661. To construct and maintain a 6-inch HDPE sanitary sewer force main utility line crossing of the Lehigh River (HQ-CWF), to be accomplished using directional boring. The project includes four additional sanitary sewer line crossings of tributaries to Black Creek and a tributary to the Lehigh River, located along S. R. 0940 in Kidder Township, Carbon County, which will be constructed in accordance with the Department's General Permit BDWM-GP-5. The Lehigh River Crossing is located immediately south of S. R. 0940 bridge, (White Haven, PA Quadrangle N: 11.1 inches; W: 2.8 inches), East Side Borough, Carbon County and White Haven Borough, Luzerne County (Philadelphia District, U. S. Army Corps of Engineers).

   E35-308.  Encroachment. Clarks Summit Borough, 304 South State Street, Clarks Summit, PA 18411. To remove the existing structure and to construct and maintain a 200 foot long, 64-inch × 43-inch CMPA stream enclosure in a tributary (Tributary B) to Ackerly Creek (CWF). The project is located approximately 200 feet southeast of the intersection of S. R. 4024 (Winola Road) and Electric Street (Scranton, PA Quadrangle N: 20.9 inches; W: 12 inches), Clarks Summit Borough, Lackawanna County (Baltimore District, U. S. Army Corps of Engineers).

   E35-309.  Encroachment. Scott Township, R. R. 1, Box 458, Olyphant, PA 18447-0000. To excavate in 0.23 acre of PEM Wetlands in a tributary to Hull Creek (CWF) to form approximately 500 linear feet of trapezoidal channel having a bottom width of 6 feet, 2H:1V side slopes and a 2-foot minimum depth, with 100 feet of the upstream channel having R5 riprap channel lining. The project is intended to reduce frequent flooding by increasing the channel capacity. The project, known as ''Unnamed Tributary to Hull Creek Channel Improvements'' is located at a beginning point approximately 1,000 feet east of the intersection of T427 and T531 (Scranton, PA Quadrangle N: 22.3 inches; W: 0.1 inch), extending downstream 600 feet in Scott Township, Lackawanna County (Baltimore District, U. S. Army Corps of Engineers).

   E39-361.  Encroachment. Church of the Assumption B.V.M., 4101 Old Bethlehem Pike, Bethlehem, PA 18105. To fill in 0.36 acre of PEM/SS Wetlands for the construction of a combination soccer and softball field. The project, associated with the expansion of St. Michael's School, is located east of the intersection of S. R. 2038 (Oakhurst Road) and T-835 (Old Bethlehem Pike) (Allentown East, PA Quadrangle N: 12.9 inches; W: 2.6 inches), Upper Saucon Township, Lehigh County (Philadelphia District, U. S. Army Corps of Engineers).

   E40-516.  Encroachment. Gregory A. Renninger, 2656 Old Berwick Road, Bloomsburg, PA 17815. To place fill in the floodway of the Susquehanna River (WWF) for the purpose of constructing a motocross track, including periodic jumps, varying from 2 to 9 feet in height. The project includes modification of an existing 26-foot × 48-foot block building to add an 8-foot × 16-foot deck and awning. The project is located along Flats Road (T-573) (Wilkes-Barre, West, PA Quadrangle N: 19.2 inches; W: 11.8 inches), Plymouth Township, Luzerne County (Baltimore District, U. S. Army Corps of Engineers).

   E40-517.  Encroachment. City of Wilkes-Barre, 40 East Market Street, Wilkes-Barre, PA 18711. To remove the existing structure and to construct and maintain a prestressed concrete box beam bridge, having a span of 21.3 feet (6.5 meters) and a minimum underclearance of 7.2 feet (2.2 meters), across Coal Brook (CWF). The project is located on Scott Street, approximately 300 feet west of the intersection of Scott Street and Business Route 309, (Wilkes-Barre East, PA Quadrangle N: 22.4 inches; W: 14.7 inches), City of Wilkes-Barre, Luzerne County (Baltimore District, U. S. Army Corps of Engineers).

   E45-368.  Encroachment. James and Debora Zug, 1164 St. Andrews Road, Bryn Mawr, PA 19010. To place fill in 0.03 acre of PFO wetlands for the purpose of constructing a carport and storage shed on Lot 309 in Pocono Lake Preserve. The total wetland impact, considering a previously authorized wetland fill by Permit No. E45-281 is equal to 0.24 acre. The project is located on the western side of Pocono Lake, approximately 900 feet southeast of S. R. 0940 (Blakeslee, PA Quadrangle N: 20.3 inches; W: 1.85 inches), Tobyhanna Township, Monroe County (Philadelphia District, U. S. Army Corps of Engineers).

   E01-206.  Encroachment. David LeVan, 1094 Baltimore Pike, Gettysburg, PA 17325. To remove an existing structure and to (1) construct and maintain 20 linear feet of 57-inch by 38-inch corrugated metal pipe arch in an unnamed tributary to Rock Creek; (2) maintain a chain link privacy fence across the stream at this location; (3) restore approximately 100 linear feet of channel capacity; and (4) construct approximately 120 linear feet of a previously filled channel located upstream of the culvert. The site is located east of US 140 (Baltimore Pike) 1.2 miles south of Gettysburg Square (Gettysburg, PA Quadrangle N: 11.6 inches; W: 13.6 inches) in Cumberland Township, Adams County.

   E07-307.  Encroachment. Altoona City Authority, 20 Greenwood Road, Altoona, PA 16602. To excavate approximately 300 feet of stream channel to a depth of 2.5 feet and to replace the excavated material with limestone rock for the purpose of adding alkalinity to Glenwhite Run as part of an acid mine drainage abutment project in the Glenwhite watershed located about 2.5 miles upstream of the Horseshoe Curve (Cresson, PA Quadrangle N: 22.6 inches; W: 3.8 inches) in Allegheny Township, Blair County.

   E07-308.  Encroachment. Blair Township, 575 Cedarcrest Drive, Duncansville, PA 16635. To rehabilitate approximately 470 feet of stream channel which will include about 312 feet of streambank protection and about 140 feet of reconstructed channel in Poplar Run for the purpose of providing flood protection to a nearby residence located about 900 feet upstream of the SR 0036 bridge over Poplar Run (Hollidaysburg, PA Quadrangle N: 2.6 inches; W: 5.5 inches) in Blair Township, Blair County.

   E07-309.  Encroachment. Blair Township Water & Sewer Authority, 577 Cedarcrest Drive, Duncansville, PA 16635. To place fill in the floodway of Halter Creek and to place fill in the floodplain of Poplar Run for the purpose of constructing two wastewater pump stations as part of the construction of a wastewater collection system which will serve approximately 600 homes in and around Blair Township (Roaring Springs, PA Quadrangle N: 22.7 inches; W: 6.8 inches) in Blair Township, Blair County.

   E14-339.  Encroachment. Spring-Benner-Walker Joint Authority, 170 Irish Hollow Road, Bellefonte, PA 16823. To construct and maintain one 12 inch sewer main and seven 8 inch sewer mains through Spring Creek located 2 miles south of Bellefonte on SR 3001 from the intersection of Rt. 550 and SR 3001 extending 2 miles along SR 3001 (Bellefonte, PA Quadrangle N: 3.5 inches; W: 5.7 inches) in Benner Township, Centre County. This project proposes to impact 1,000 linear feet of Spring Creek which is designated a High Quality--Cold Water Fishery and proposes to impact 0.30 acre of Exceptional Value wetlands.

   E18-264.  Encroachment. Schrack Farms Partnership, R. R. 2, Box 68, Loganton, PA 17747. To realign the channel of Fishing Creek (High Quality--Cold Water Fishery) for the mitigation of flood damage. The realignment shall consist of removing 1,771 cubic yards of deposition, debris and woody vegetation through a 820-feet reach of channel. The project will not impact wetlands while impacting 820 feet of waterway that is located along the eastern right-of-way of SR 0880 approximately 2,000-feet east of the intersection of T-346 and SR 0880 (Mill Hall, PA Quadrangle N: 0.6 inch; W: 1.9 inches) in Logan Township, Clinton County. This permit also will authorize the construction, operation and maintenance of an agricultural crossing of Fishing Creek which shall be done in accordance with the Department's BDWM-GP-6.

   E55-157.  Encroachment. Emmit L. Kreamer, P. O. Box 88, Middleburg, PA 17842. The applicant is seeking authorization to place and maintain fill in 0.4 acre of man-made wetlands to expand an existing business. The proposed project site is located along the north side of US Route 522, approximately 1 mile east of Middleburg. The site is in Franklin Township, Snyder County (Middleburg PA Quadrangle N: 7.3 inches; W: 2.25 inches). The affected wetland is a 0.4 acre isolated palustrine emergent wetland created in 1963 by clay excavation. Onsite replacement would affect areas with ''high probability'' of archaeological significance. Therefore, replacement by payment to the Pennsylvania Wetland Replacement Project (Fund) is proposed.

   E59-381.  Encroachment. Covington Township, R. R. 1, Box 87, Covington, PA 16917. To maintain: 1) fill in the channel, with no added erosion protection, having a length of 1,040-feet, a maximum bottom width of 180-feet and a maximum height of 8.5-feet next to the left bank of the Tioga River for the purpose of redirecting flood flows away from both riverbanks, 2) to remove gravel deposits from the riverbed for a distance of 400 feet upstream of the island immediately downstream of the fill and a distance of 100 feet into the left and right channel from the top of the island, both encroachments are located 1,000 feet northwest of the intersection of S. R. 6015 and T-437 (Blossburg, PA Quadrangle N: 19.6 inches; W: 11.3 inches) in Covington Township, Tioga County. The project impacts 1,500 feet of the Tioga River, which is classified as a Cold Water Fishery.

   E02-1263.  Encroachment. Wil-Mar Group, 431 Brown Lane, P. O. Box 15284, Pittsburgh, PA 15237. To construct and maintain a 48 inch outfall pipe along the left bank side of Brush Creek (WWF) and to place and maintain fill in 0.8 acre of wetlands (PEM/PSS) for a proposed commercial development known as Warrendale Village. The development is located along the north side of Warrendale-Bayne Road (SR 4052) approximately 700 feet west of its intersection with Perry Highway (SR 0019) (Mars, PA Quadrangle N: 5.7 inches; W: 12.5 inches) in Marshall Township, Allegheny County. For the wetland replacement the applicant proposes to construct 0.4 acre of replacement wetlands (PEM/PSS) and to pay $7,500 to the wetland replacement fund.

   E11-271.  Encroachment. Hastings Area Industrial Development Association, 180 Bears Road, Hastings, PA 16646. To construct and maintain a 83-foot long, 14-foot by 8-foot R. C. box culvert in Brubaker Run (CWF) and to relocate and maintain the channel, approximately 16 l. f. upstream and 82 l. f. downstream of the structure for the purpose of constructing a new industrial park access road (Haida Road). The project includes placement and maintenance of fill in 0.15 acre of wetlands (PEM) for the purpose of a Pennsylvania Department of Transportation mitigation bank. The proposed road begins approximately 800 feet west of the intersection of S. R. 4021 and S. R. 4019 and extends easterly and ends at the intersection of S. R. 4010 (Hastings, PA Quadrangle N: 5.8 inches; W: 12.75 inches) in Susquehanna Township and Hastings Borough, Cambria County.

   E10-294.  Encroachment. County of Butler, 124 West Diamond Street, P. O. Box 1208, Butler, PA 16003-1208. To remove the existing structure and to construct and maintain a steel I-beam bridge with a single clear span of 31 feet, 11 inches and a maximum underclearance of 6 feet, 3 inches on Thompsontown Road across Muddy Creek (HQ-CWF). The project is located on Thompsontown Road across Muddy Creek approximately 4,200 feet southwest of the intersection of S. R. 0308 and S. R. 4002 (Mahood Road) (Mount Chestnut, PA Quadrangle N: 17.2 inches; W: 6.2 inches) located in Clay Township, Butler County.

To construct, operate and maintain Maple Creek Slurry Pond No. 3, Dam No. 2 across a tributary to Pigeon Creek (WWF), for the purpose of expanding Slurry Pond No. 3 and isolating the proposed Mon-Fayette Expressway from Slurry Pond No. 3 with the proposed construction of Dam No. 2 at the Refuse Area No. 2 site (Monongahela, PA Quadrangle N: 12.3 inches; W: 15.7 inches) in Carroll Township, Washington County.

   D67-530.  Dam. Pennsylvania Power and Light Company, Inc. (Two North Ninth Street, Allentown, PA 18101-1179). To modify, operate and maintain Brunner Island Ash Basin No. 4 across a tributary to the Susquehanna River (WWF), for the purpose of closing Ash Basin No. 4 by covering the basin bottoms and sides with 1 foot of soil and seeding after removing plant waste (mill rejects) (York Haven, PA Quadrangle N: 16.5 inches; W: 9.0 inches) in East Manchester Township, York County.

WATER ALLOCATIONS


Applications received under the act of June 24, 1939 (P. L. 842, No. 365) (35 P. S. §§ 631--641) relating to the acquisition of rights to divert waters of the Commonwealth.

   The Department of Environmental Protection (Department) has taken the following actions on previously received permit applications and requests for plan approval and has issued the following significant orders.

Approvals to Use NPDES and/or Other General Permits

   The following parties have submitted Notices of Intent (NOIs) for Coverage under (1) General NPDES Permit(s) to discharge wastewater into the surface waters of this Commonwealth. The approval for coverage under these general NPDES permits is subject to applicable effluent limitations, monitoring, reporting requirements and other conditions set forth in the general permit; (2) General Permit(s) for Beneficial Use of Sewage Sludge or Residential Septage by Land Application in Pennsylvania. The approval of coverage for land application of sewage sludge or residential septage under these general permits is subject to pollutant limitations, pathogen and vector attraction reduction requirements, operational standards, general requirements, management practices and other conditions set forth in the respective general permit. The Department of Environmental Protection approves the following coverages under the specified General Permit.

   The EPA Region III Regional Administrator has waived the right to review or object to this permit action under the waiver provision: 40 CFR 123.24.

   The application and related documents, effluent limitations, permitting requirements and other information are on file and may be inspected and arrangements made for copying at the contact office noted.
