ENCROACHMENTS

   The Department of Environmental Protection (Department) has taken the following actions on previously received permit applications, requests for Environmental Assessment approval, and requests for Water Quality Certification under Section 401 of the Federal Water Pollution Control Act (33 U.S.C.A. § 1341(a)).

   Any person aggrieved by this action may appeal, under section 4 of the Environmental Hearing Board Act (35 P. S. § 7514) and 2 Pa.C.S. §§ 501--508 and 701--704 (relating to the Administrative Agency Law), to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, P. O. Box 8457, Harrisburg, PA 17105-8457, (717) 787-3483. TDD users may contact the Board through the Pennsylvania Relay Service, (800) 654-5984. Appeals must be filed with the Environmental Hearing Board within 30 days of receipt of written notice of this action unless the appropriate statute provides a different time period. To construct, operate and maintain approximately 83 linear feet of cast-in-place, triple-cell concrete box culvert, in and along an unnamed tributary to West Valley Creek (CWF) and 0.10 acre of adjacent wetlands (PEM). The outer cells will be 4.25 feet high by 12 feet wide. The center cell will be 5.25 feet high by 12 feet wide. The structure is associated with the construction of a connector road from Lincoln Highway (S. R. 0030) to Swedesford Road (Malvern, PA Quadrangle N:  6.8 inches; W:  13.15 inches) in West Whiteland Township, Chester County. The mitigation will be done in accordance with the plan submitted and approved by the Department.

   E46-821. Encroachment Permit. The Cutler Group, Inc., 5 Sentry Parkway West, Suite 100, Blue Bell, PA 19422. To perform the following activities associated with the construction of the Estates of Faraway Farms:

   1.  To maintain an 88-foot long, 4-foot diameter RCP culvert in and along an unnamed tributary to Perkiomen Creek (TSF) for the Longacre Drive roadway stream crossing, and to place fill in 0.25 acre of adjacent wetlands (PEM/SS);

   2.  To maintain an energy dissipator for a stormwater outfall in wetlands (de minimis 0.01 acre of impact).

   The Estates of Faraway Farms is located on the northeast corner of the intersection of Route 113 and Hopwood Road (Collegeville, PA Quadrangle N:  10.3 inches; W:  14.7 inches) in Upper Providence Township, Montgomery County. The applicant proposes to construct 0.58 acre of replacement wetlands.

To construct and maintain a 12-inch diameter intake and an 8-inch diameter outfall structure along the left bank of the Conodoguinet Creek for the purpose of constructing a golf course and a sewage treatment plant located about 0.6 mile downstream of Meadowbrook Road Bridge (T404) (Carlisle, PA Quadrangle N:  16.6 inches W:  16.08 inches) in North Middleton Township, Cumberland County This permit was issued under section 105.13(e) ''Small Projects.'' This permit also includes 401 Water Quality Certification.

   E21-288. Encroachment. Mount Zion Associates, LP, Timothy Harrison, 20 Erford Road, Lemoyne, PA 17043. To construct and maintain a 31.59-foot by 12.08-foot steel arch bridge over Sears Run in order to construct Technology Parkway located immediately downstream of I-81 culvert about 3,500 feet south of the I-81 and PA 944 Interchange No. 20 (Harrisburg, PA Quadrangle N:  5.25 inches; W:  14.66 inches) in Hampden Township, Cumberland County. This permit also includes 401 Water Quality Certification.

   E28-270. Encroachment. Ralph Garber, 724 Mont Alto Rd., Fayetteville, PA 17222. To dredge and maintain the channel of an unnamed tributary to Conococheague Creek (CWF) (locally called English Valley Run) in order to maintain the positive slope starting at the Mont Alto Road bridge and extending 2,000 feet upstream (Scotland, PA Quadrangle N:  4.45 inches; W:  7.78 inches) in Guilford Township, Franklin County. This permit was issued under section 105.13(e) ''Small Projects.'' This permit also includes 401 Water Quality Certification.

   E06-530. Encroachment. PA Department of Transportation, Engineering District 5-0, 1713 Lehigh Street, Allentown, PA 18103. To remove an existing structure and to construct and maintain a twin-cell reinforced concrete box culvert with each cell being 16 feet × 9 feet in the channel of Willow Creek (CWF) at a point at SR 1011 (Fleetwood, PA Quadrangle N:  14.0 inches; W:  13.1 inches) in Richmond Township, Berks County. This permit was issued under section 105.13(e) ''Small Projects.'' This permit also includes 401 Water Quality Certification.

   E07-319. Encroachment. Blair County Commission, 423 Allegheny Street, Hollidaysburg, PA 16648. To (1)  remove the existing County Bridge No. 68; (2)  construct and maintain a prestressed adjacent concrete box beam bridge having a normal clear span of 36.20 feet and an underclearance of 6.08 feet across Old Town Run (WWF); (3)  place R-7 riprap at both abutments to prevent scour; and (4)  construct a temporary sandbag cofferdam in the channel to facilitate the construction of the bridge located on Township Road T-378 about 3.0 miles southeast of its intersection with SR 2007 (Frankstown, PA Quadrangle N:  3.0 inches; W:  12.0 inches) in Frankstown Township, Blair County. This permit was issued under section 105.13(e) ''Small Projects.'' This permit also includes 401 Water Quality Certification.

   E22-411. Encroachment. PA Dot Engineering District 8-0, 2140 Herr Street, Harrisburg, PA 17103. To impact 0.838 acre of wetlands in and along a tributary to Swatara Creek at a point at North Union Street for the purpose of constructing SR 0300-009 interchange ramps (Middletown, PA Quadrangle N:  18.4 inches; W:  1.7 inches) in Lower Swatara Township, Dauphin County. The permittee agrees to provide 1.0 acre of replacement wetlands for 0.838 acre of wetland impact. This permit also includes 401 Water Quality Certification.

   E31-157. Encroachment. Department of Conservation Natural Resources, 400 Market Street, Harrisburg, PA 17105. To remove an existing deteriorated structure and to construct and maintain a single span prestressed concrete adjacent box beam bridge having a normal clear span of 52.70 feet and a maximum underclearance of 8.63 feet across Standing Stone Creek (HQ-CWF) and construct R-7 riprap, choked with R-4 size rock, revetment at both bridge abutments and along both stream banks upstream and downstream of the bridge located on Martin Road (T-486) about 0.83 mile south of its intersection with SR 1019 (Allensville, PA Quadrangle N:  14.5 inches; W:  15.2 inches) in Miller Township, Huntingdon County. A diversion dike will be constructed in the channel to facilitate construction of the bridge. This permit also includes 401 Water Quality Certification.

It was also requested that because of reported aggravated accumulation of basin sediments the past 2 years, this Section 401 Water Quality Certification allow for subsequent dredging of the East Avenue Launch Ramp and discharge of that material into the CDF for 1 year after final certification without additional sampling and testing.

   Final Action on Request:  Certification granted. This is a 1-year certification for the above described project.

   Location:  East Avenue Launch Ramp basin (Erie North, PA Quadrangle N:  3.6 inches; W:  8.9 inches) and the discharge of this dredged material into the Lake Erie Harbor Confined Disposal Facility (Erie North, PA N:  4.7 inches; W:  10.3 inches).

   Final Action on Request:  Certification granted. This is a 1-year certification for the above described project.
