   To effectively manage the wildlife resources of this Commonwealth, the Game Commission (Commission), at its January 23, 2001, meeting, adopted the following change:

   Add § 143.10 (relating to fee for return postage) to require the payment of $1.50 at the time of application for a general hunting or furtaker license by mail order, fax or over the Internet.

   This amendment is hereby adopted under the authority of 34 Pa.C.S. (relating to the Game and Wildlife Code) (code).

1.  Introduction

   To more effectively issue hunting and furtaking licenses, the Commission at its October 12, 2000, meeting proposed, and at its January 23, 2001, meeting finally adopted the addition of § 143.10 providing for a fee of $1.50 on licenses issued through the mail. This addition is being adopted, under section 2722(g)(2) of the code (relating to authorized license-issuing agents).

2.  Purpose and Authority

   The Commission has issued hunting and furtaking licenses by mail for some time. Now those licenses are being offered at the Commission's website. Each time a license is purchased by mail, facsimile or on the Internet, a package must be sent to the licensee. The current cost of postage alone to send a license package is $1.43. This figure does not include package materials and preparation. To defray these costs, the Commission will charge a $1.50 fee for each general or furtaker license issued by mail order, fax or over the Internet.

   Section 2722(g)(2) of the code authorizes the Commission to adopt regulations for the administration, control and performance of license issuance activities. This provision supplies the authority for the adoption.

3.  Regulatory Requirements

   The addition will require the payment of $1.50 at the time of application for a general hunting or furtaker license by mail order, fax or over the Internet.

4.  Persons Affected

   Individuals wishing to take advantage of license issuance by mail, fax or Internet will be required to pay the additional fee.

5.  Comment and Response Summary

   No official comments were received with regard to the adoption.

6.  Cost and Paperwork Requirements

   There will be no additional paperwork resulting from the adoption. There will be an additional fee of $1.50 to defray the cost of mailing the license package.

7.  Effective Date

   The adoption will be effective on final publication in the Pennsylvania Bulletin and will remain in effect until changed by the Commission.

Findings

   The Commission finds that:

   (1)  Public notice of intention to adopt the administrative amendment adopted by this order has been given under sections 201 and 202 of the act of July 31, 1968 (P. L. 769, No. 240) (45 P. S. §§ 1201 and 1202) and the regulations thereunder in 1 Pa. Code §§ 7.1 and 7.2.

   (2)  The adoption in the manner provided in this order is necessary and appropriate for the administration and enforcement of the authorizing statute.

Order

   The Commission, acting under authorizing statute, orders that:

   (a)  The regulations of the Commission, 58 Pa. Code Chapter 143, are amended by adding § 143.10 to read as set forth at 30 Pa.B. 6357 (December 9, 2000).

   (b)  The Acting Director of the Commission shall submit this order and 30 Pa.B. 6357 and deposit them with the Legislative Reference Bureau as required by law.

   (c)  This order shall take effective upon final publication in the Pennsylvania Bulletin.
