   These actions of the Department of Environmental Protection (Department) may be appealed to the Environmental Hearing Board (Board), Second Floor, Rachel Carson State Office Building, 400 Market Street, P. O. Box 8457, Harrisburg, PA 17105-8457, (717) 787-3483, by any aggrieved person under the Environmental Hearing Board Act (35 P. S. § 7514) and 2 Pa.C.S. §§ 501--508 and 701--704 (relating to the Administrative Agency Law). Appeals must be filed with the Board within 30 days from the date of this issue of the Pennsylvania Bulletin unless the appropriate statute provides a different time period. Copies of the appeal form and the Department's regulations governing practice and procedure before the Board may be obtained from the Board.

FEDERAL WATER POLLUTION CONTROL ACT SECTION 401

   The Department of Environmental Protection (Department) has taken the following actions on previously received permit applications, requests for Environmental Assessment approval, and requests for Water Quality Certification under section 401 of the Federal Water Pollution Control Act (FWPCA) (33 U.S.C.A. § 1341(a)).

   Except as otherwise noted, the Department certifies that the construction and operation herein described will comply with the applicable provisions of sections 301--303, 306 and 307 of the FWPCA (33 U.S.C.A. §§ 1311--1313, 1316 and 1317), and that the construction will not violate applicable Federal and State Water Quality Standards.

   Any person aggrieved by this action may appeal, under section 4 of the Environmental Hearing Board Act (35 P. S. § 7514), and 2 Pa.C.S. §§ 501--508 and 701--704 (relating to the Administrative Agency Law) to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, P. O. Box 8457, Harrisburg, PA 17105-8457 (717) 787-3483. TDD users may contact the Board through the Pennsylvania Relay Service (800) 654-5984. Appeals must be filed with the Environmental Hearing Board within 30 days of receipt of written notice of this action unless the appropriate statute provides a different time period. Copies of appeal form and the Board's rules of practice and procedure may be obtained from the Board. The appeal form and the Board's rules of practice and procedure are also available in Braille or on audiotape from the Secretary of the Board at (717) 787-3483. This paragraph does not, in and of itself, create any right of appeal beyond that permitted by applicable statutes and decisional law.

   E45-409.  TYKA, Ltd. Land Development, R. R. 5, Box 5241G, Stroudsburg, PA 18360, Smithfield Township, Monroe County, Army Corps of Engineers Philadelphia District.

   To construct and maintain a sanitary sewer line stream crossing of a tributary to Sambo Creek consisting of a 4-inch diameter PVC pipe in a 6-inch diameter steel conduit pipe attached to an 18-inch steel beam supported by concrete abutments. The structure has a span of approximately 25 feet and underclearance of approximately 4 feet and is located on the north side of S.R. 0209, approximately 0.35 mile west of Township Road T536 (Airport Road). (East Stroudsburg, PA Quadrangle N: 5.2 inches; W: 4.9 inches).

   E35-336.  Lackawanna County Railroad Authority, 701 Wyoming Avenue, Scranton, PA 18509-3017. City of Scranton and Borough of Moosic, Lackawanna County, Army Corps of Engineers Baltimore District.

   To repair and maintain four existing bridges and one existing culvert, in and across Roaring Brook, Stafford Meadow Brook and a tributary to Stafford Meadow Brook, for the purpose of restoring train and trolley service along the Laurel Line between the trolley museum and the Lackawanna County Visitor's Center. Work will include replacement of the superstructures and bearings of four bridges, reinforcement of the roof of a concrete culvert, repointing stone masonry and repairing concrete abutments/piers, and placing riprap scour protection around abutments and piers. The project begins at a point approximately 0.4 mile northwest of Interchange 53 of Interstate 81 (at the railroad bridge across Roaring Brook), and extends in a southwesterly direction along the existing railroad alignment for approximately 3 miles. (Scranton, PA Quadrangle N: 4.6 inches; W: 3.8 inches).

   E48-296.  Northampton County, Seventh and Northampton Streets, Easton, PA 18042. Upper Mount Bethel Township, Northampton County, Army Corps of Engineers Philadelphia District.

   To remove the existing structure and to construct and maintain a 20-foot x 7-foot reinforced concrete box culvert having a 6-inch culvert depression in a tributary to Allegheny Creek. The bridge, known as County Bridge No. 183, is located along Township Road T712 (Hemlock Drive), approximately 0.1 mile north of its intersection with T687. (Belvidere, NJ-PA Quadrangle N: 20.3 inches; W: 15.1 inches).

   E48-299.  Northampton County, 669 Washington Street, Easton, PA 18042. Lower Nazareth Township, Northampton County, Army Corps of Engineers Philadelphia District.

   To remove the existing structure and to construct and maintain a prestressed concrete box beam bridge having a normal span of 40 feet and an underclearance of 9.5 feet across Monocacy Creek. The bridge is known as County Bridge No. 102 and is located along Township Road T436 (Georgetown Road), approximately 500 feet north of Hanoverville Road (Nazareth, PA Quadrangle N: 11.8 inches; W: 14.4 inches).

   Northcentral Region: Water Management Program Manager, 208 West Third Street, Williamsport, PA 17701.

   E14-397.  College Township, 1481 East College Avenue, State College, PA 16801. Slab Cabin Run Footbridge, in College Township, Centre County, ACOE Baltimore District (State College, PA Quadrangle N: 10.3 inches; W: 10.6 inches).

   To construct, operate and maintain a single span wooden footbridge across Slab Cabin Run to provide pedestrian access in a public recreation area. The single span footbridge shall be constructed with a minimum span of 24-feet, underclearance of 5.7-feet and width of 3.8-feet. The footbridge construction is located along southern right-of-way of SR 0322 approximately 200-feet east of SR 0026 and SR 0322 intersection. This permit was issued under § 105.13(e) ''Small Projects.''

   E19-218.  John Beck, Supervisor, Greenwood Township, 90 Shed Road, Millville, PA 17846. Culvert Replacement, in Greenwood Township, Columbia County, ACOE Susquehanna River Basin District (Bloomsburg, PA Quadrangle N: 22.1 inches; W: 16.6 inches).

   To a) remove existing 60-inch metal pipe, b) construct and maintain a precast concrete box culvert with a clear span of 14 feet and a minimum underclearance of 4 feet in Mud Run, c) temporarily construct and maintain a concrete, sand bag diversion dike and relocated stream channel at the existing culvert site, all of which are located 0.7 mile south of SR 0254 on T-526 (Camp Victory Road). This permit was issued under § 105.13(e) ''Small Projects.'' This permit also includes 401 Water Quality Certification.

   E41-486.  Robert Cohick, P. O. Box 419, Salladasburg, PA 17740. Stream bank stabilization, in Salladasburg Borough, Lycoming County, ACOE Baltimore District (Salladasburg, PA Quadrangle N: 4.85 inches; W: 13.7 inches).

   To construct, operate and maintain 360 linear feet of stream bank stabilization by installing four rock deflectors, armoring the bank with R-5 and R-6 riprap and removing a gravel bar located on the left side of the channel of Larry's Creek. This project is located .5 mile east on SR 973 from the intersection with SR 287, behind Cohicks Trading Post. This permit was issued under Section 105.13. This permit also includes 401 Water Quality Certification.

   E49-250.  Pennsylvania Department of Transportation, Engineering District 3-0, P. O. Box 218, Montoursville, PA 17754-0218. Water Obstruction and Encroachment Joint Permit Application, in Lewis Township, Northumberland County, ACOE Susquehanna River Basin District (Muncy, PA Quadrangle N: 1.0 inch; W: 6.1 inches).

   To remove existing structure and construct and maintain a single span prestressed adjacent box beam bridge having a span of 37 feet, and a minimum underclearance of 4.83 feet with a skew of 90° in Warrior Run located 400 feet along SR 1008, west of the intersection of SR 1007 north and SR 1008.

   E55-159.  Pennsylvania Department of Transportation, 715 Jordan Avenue, Montoursville, PA, 17754. Dry Run crossing, in Centre Township, Snyder County, ACOE Baltimore District (Middleburg, PA Quadrangle N: 16.5 inches; W: 6 inches).

   To remove the existing single span arch structure and construct, operate and maintain a single span adjacent box beam concrete bridge. This structure will have a span of 40 feet and a design underclearance of 6.5 feet. This permit also authorizes a temporary roadway constructed of four 48 inch culvert pipes and associated fill.

   E02-993-A1.  Township of McCandless, 995 Grubbs Road, Wexford, PA 15090. McCandless Township, Allegheny County, ACOE Pittsburgh District.

   To place and maintain fill in 0.11 acre of additional wetlands (PEM/PSS), to restore and maintain 0.24 acre of wetlands (PSS), to construct and maintain a 24-inch diameter outfall structure along the left bank of Pine Creek (CWF), to construct and maintain 0.35 acre of replacement wetlands (PSS) and to place and maintain fill in the floodplain and on the left bank of said stream for the purpose of constructing an access road (Early Drive). The restored and replacement wetlands will compensate for unauthorized wetland fill placed by previous owner. The project is located on the north side of Blazier Drive, just north from the intersection of Blazier Drive and Ingomar Road (Emsworth, PA Quadrangle N: 17.0 inches; W: 3.5 inches).

   E02-1329.  Billy J. Marzec, 1237 Laurel Hill Drive, West Homestead, PA 15120. West Mifflin Borough, Allegheny County, ACOE Pittsburgh District.

   To operate and maintain two existing 36-inch culverts 200-feet long, to construct and maintain a parallel 48-inch culvert 200 feet long, to construct and maintain an elevated 36-inch culvert 80 feet long and to construct and maintain an 18-inch storm water culvert outfall in Thompson Run Creek (WWF), to provide additional capacity to the existing stream enclosure. The project is located in the northeast corner of Buttermilk Hollow Road and Thompson Road intersection (Glassport, PA Quadrangle N: 20.1 inches; W: 4.5 inches).

   E04-266-A1.  Pennsylvania Department of Transportation, Engineering District 11-0, 45 Thoms Run Road, Bridgeville, PA 15017. New Sewickley Township, Beaver County, ACOE Pittsburgh District.

   To amend Permit No. E04-266, construct and maintain a twin cell con span structure with a span of 16 feet, and underclearance of 4.6 feet in lieu of the twin cell rigid frame bridge having two clear spans of 15 feet and a maximum underclearance of 4.6 feet across Crows Run. (Baden, PA Quadrangle Begins: N: 9.3 inches; W: 5.3 inches and Ends at N: 9.6 inches; W: 9.5 inches).
