LAND RECYCLING AND ENVIRONMENTAL REMEDIATION

UNDER ACT 2, 1995

PREAMBLE 3


The Department has taken action on the following plans and reports under the Land Recycling and Environmental Remediation Standards Act (35 P. S. §§ 6026.101--6026.908).

   Provisions of 25 Pa. Code § 250.8, Administration of the Land Recycling and Environmental Remediation Standards Act (Act) requires the Department of Environmental Protection (Department) to publish in the Pennsylvania Bulletin a notice of its final actions on plans and reports. A final report is submitted to document cleanup of a release of a regulated substance at a site to one of the remediation standards of the Land Recycling and Environmental Remediation Standards Act. Plans and reports required by provisions of the Act for compliance with selection of remediation to a site-specific standard, in addition to a final report, include a remedial investigation report, risk assessment report and cleanup plan. A remedial investigation report includes conclusions from the site investigation, concentration of regulated substances in environmental media; benefits of refuse of the property and, in some circumstances, a fate and transport analysis. If required, a risk assessment report describes potential adverse effects caused by the presence of regulated substances. A cleanup plan evaluates the abilities of potential remedies to achieve remedy requirements. A final report provides a description of the site investigation to characterize the nature and extent of contaminants in environmental media, the basis of selecting the environmental media of concern, documentation supporting the selection of residential or nonresidential exposure factors, a description of the remediation performed and summaries of sampling methodology and analytical results which demonstrate that the remediation has attained the cleanup standard selected. The Department may approve or disapprove plans and reports submitted. This notice provides the Department's decision and, if relevant, the basis for disapproval.

   For further information concerning the plans and reports, contact the Environmental Cleanup Program Manager in the Department of Environmental Protection Regional Office under which the notice of the plan or report appears. If information concerning a final report is required in an alternative form, contact the Community Relations Coordinator at the appropriate Regional Office listed.    The Department has received the following final reports:

   Southcentral Region:  Environmental Cleanup Program Manager, 909 Elmerton Avenue, Harrisburg, PA 17110.

   Allfirst Bank 305 Hill Street Property, Spring Garden Township, York County. Alliance Environmental Services, 1414 North Cameron Street, Suite B, Harrisburg, PA 17103 (on behalf of York Realty Holding Company, Inc., A Wholly-Owned Subsidiary of Allfirst Bank, 213 Market Street, Harrisburg, PA 17105) submitted a combined remedial Investigation and Final Report concerning the remediation of site soils and groundwater contaminated with PCBs, lead, heavy metals, solvents, BTEX and PAHs. The combined report demonstrated attainment of a combination of the Background, Statewide Health and Site-Specific standards and was approved by the Department on October 26, 2001.

   Clifton Blume Property, Laureldale Borough, Berks County. Mulry & Cresswell Environmental, Inc., 1691 Horseshoe Pike, Suite 1, Glenmoore, PA 19343 (on behalf of Clifton Blume, 3001 Marion Street, Reading, PA 19605) submitted a Final Report concerning remediation of site soils contaminated with lead. The final report demonstrated attainment of the Statewide Health standard and was approved by the Department on October 31, 2001.

   Dorothy Golden Property, Laureldale Borough, Berks County. Mulry & Cresswell Environmental, Inc., 1691 Horseshoe Pike, Suite 1, Glenmoore, PA 19343 (on behalf of Dorothy Golden, 1511 Prince Street, Reading, PA 19605) submitted a Final Report concerning remediation of site soils contaminated with lead. The final report demonstrated attainment of the Statewide Health standard and was approved by the Department on October 31, 2001.

   Marlene Kahn Property, Laureldale Borough, Berks County. Mulry & Cresswell Environmental, Inc., 1691 Horseshoe Pike, Suite 1, Glenmoore, PA 19343 (on behalf Marlene Kahn 3008 Marion Street, Reading, PA 19605) submitted a Final Report concerning remediation of site soils contaminated with lead. The final report demonstrated attainment of the Statewide Health standard and was approved by the Department on October 31, 2001.

   Linda Katzenmoyer Property, Laureldale Borough, Berks County. Mulry & Cresswell Environmental, Inc., 1691 Horseshoe Pike, Suite 1, Glenmoore, PA 19343 (on behalf of Linda Katzenmoyer, 3146 Montrose Avenue, Reading, PA 19605) submitted a Final Report concerning remediation of site soils contaminated with lead. The final report demonstrated attainment of the Statewide Health standard and was approved by the Department on October 31, 2001.

   Walter Palmer Property, Laureldale Borough, Berks County. Mulry & Cresswell Environmental, Inc., 1691 Horseshoe Pike, Suite 1, Glenmoore, PA 19343 (on behalf of Walter Palmer, 3152 Montrose Avenue, Reading, PA 19605) submitted a Final Report concerning remediation of site soils contaminated with lead. The final report demonstrated attainment of the Statewide Health standard and was approved by the Department on October 31, 2001.

   Robin Stein (formerly Rodney Tyson) Property, Laureldale Borough, Berks County. Mulry & Cresswell Environmental, Inc., 1691 Horseshoe Pike, Suite 1, Glenmoore, PA 19343 (on behalf of Robin Stein, 1513 Prince Street, Reading, PA 19605) submitted a Final Report concerning remediation of site soils contaminated with lead. The final report demonstrated attainment of the Statewide Health standard and was approved by the Department on October 31, 2001.

   Donald Stibitz Property, Muhlenberg Township, Berks County. Mulry & Cresswell Environmental, Inc., 1691 Horseshoe Pike, Suite 1, Glenmoore, PA 19343 (on behalf of Donald Stibitz, 48 Seminary Avenue, Reading, PA 19605) submitted a Final Report concerning remediation of site soils contaminated with lead. The final report demonstrated attainment of the Statewide Health standard and was approved by the Department on October 31, 2001.

   Lancaster Scrap Facility, City of Lancaster, Lancaster County. PSC, 550 Pinetown Road, Suite 166, Fort Washington, PA 19034, (on behalf of Redevelopment Authority of the City of Lancaster, 120 North Duke Street, P. O. Box 1599, Lancaster, PA 17608-1599) submitted a Baseline Environmental Report concerning the remediation of site soils and groundwater contaminated with heavy metals, lead and PCBs. The report was approved by the Department on November 2, 2001.

   Northwest Region:  Environmental Cleanup Program Manager, 230 Chestnut Street, Meadville, PA 16335-3481.

   Haywood Development Site, 15 Roemer Blvd., Farrell, PA 16121, City of Farrell, Mercer County and Jo Hinish, P.G., on behalf of Mountain Research, Inc., 825 25th Street, Altoona, PA 16601, had submitted a Baseline Environmental Report concerning remediation of soil and groundwater. The report was approved by the Department on October 22, 2001, and did demonstrate attainment of the site to use a Special Industrial Area.

RESIDUAL WASTE GENERAL PERMITS


Permits Revoked under the Solid Waste Management Act (35 P. S. §§ 6018.101--6018.1003); the Municipal Waste Planning, Recycling and Waste Reduction Act (53 P. S. §§ 4000.101--4000.1904); and Residual Waste Regulations for a General Permit to Operate Residual Waste Processing Facilities and the Beneficial Use of Residual Waste other than Coal Ash.

The Natural Minor facility's significant air emission sources include two zinc galvanizing kettles, a 450,000 BTU/hr No. 2 oil-fired kettle burner, five pickle tanks, a strip tank, a caustic tank, two flux tanks and yard lot/vehicle traffic. All emissions are fugitive.

   99-003:  Royal-Pioneer Industries, Inc. (2345 Castor Avenue, Philadelphia, PA 19134-4699) on October 16, 2001, for paperboard box manufacturing and printing in the City of Philadelphia, Philadelphia County. The Synthetic Minor facility's air emission sources include three flexographic printing presses, a 6.75 mmBtu/hr natural gas/ #2 fuel oil-fired boiler and three natural gas-fired press dryers each rated at 8.0 mmBtu/hr or less.

   96-049:  Conrail--South Philadelphia Bulk Material Yard (Pier 122 South, Philadelphia, PA 19148) on October 23, 2001, for performing barge unloading and truck loading in the City of Philadelphia, Philadelphia County. The Natural Minor facility's air emission sources include dry bulk material sources consisting of barge unloading to conveyor, material conveying, a transfer tower, bulldozing operations, truck loading and a storage pile. All emissions are fugitive.

   96-013:  Mutual Pharmaceutical Co., Inc. (1100 Orthodox Street, Philadelphia, PA 19124) on October 30, 2001, for manufacturing solid dosage generic pharmaceutical products in the City of Philadelphia, Philadelphia County. The Natural Minor facility's air emission sources include manufacturing processes consisting of solvent and water-based blending operations including production and cleaning operations, five solvent-based electric granulating ovens, 12 water-based electric granulating ovens, five water-based tablet coating pans, three natural gas-fired hot water heaters each rated less than 3 mmBtu/hr and two natural gas-fired steam boilers each rated at 550,000 BTU/hr. The facility's air emission control devices include a 2.0 mmBtu/hr natural gas-fired catalytic oxidizer that oxidizes alcohol vapors and five dust collectors for particulate capture.

   23-0014A:  Kimberly-Clark Corp. (Front and Avenue of the States, Chester, PA 19013) for operation of a 350 kW and a 950 kW emergency generators in City of Chester, Delaware County. The facility is a Title V facility. The Operating Permit was modified to increase the hourly fuel usage rates for both generators due to data obtained from the manufacturers. The modification does not involve increase in any emission limits for the facility. The company shall keep records of hours of operations of the emergency generators and also records of usage of diesel fuel to show compliance.

ACTIONS ON COAL AND NONCOAL MINING ACTIVITY APPLICATIONS


Actions on applications under the Surface Mining Conservation and Reclamation Act (52 P. S. §§ 1396.1--1396.19a); the Noncoal Surface Mining Conservation and Reclamation Act (52 P. S. §§ 3301--3326); The Clean Streams Law (35 P. S. §§ 691.1--691.1001); the Coal Refuse Disposal Control Act (52 P. S. §§ 30.51--30.66); The Bituminous Mine Subsidence and Land Conservation Act (52 P. S. §§ 1406.1--1406.21).    SMP No. 65970103, NPDES No. PA0201898. Derry Stone & Lime Co., Inc. (R. D. 5, Box 34, Latrobe, PA 15650). Transfer of permit formerly issued to M. B. Energy, Inc. Permit issued for continued operation and reclamation of a bituminous surface mine/limestone quarry located in Derry Township, Westmoreland County, affecting 105.0 acres. Receiving streams:  unnamed tributary to Stoney Run. Application received:  February 27, 2001. Transfer permit issued:  October 30, 2001.

   SMP No. 03960102, NPDES No. PA0201545. Walter L. Houser Coal Co., Inc. (R. R. 9, Box 434, Kittanning, PA 16201). Notification of Receipt of the Merck and Co., Inc. Updated Risk Assessment Protocol

   On October 31, 2001, the Bureau of Air Quality received a copy of revisions to the Risk Assessment Protocol for the fluidized bed combustor at the Merck and Co., Inc. Cherokee Facility in Riverside, Northumberland County. The protocol for the fluidized bed combustor that will burn liquid wastes and wastewater treatment plant sludge from the Cherokee site was approved by the Department on November 24, 1999. The revisions will be incorporated into the previously approved protocol and the revised protocol will serve as the method outline for performing a multipathway human health and ecological risk assessment for the handling and burning of permitted site wastes in the fluidized bed combustor. Revisions and additions to the protocol include incorporation of numerical system upset factors, use of laboratory and modeled analytical detection limits and screening level ecological risk assessment methodology, which will replace the previously approved methodology.
