NOTICE OF INTENT TO APPROVE

Plan Approval Application #PA-32-040B

   Under 25 Pa. Code § 127.44(a)(4), the Department of Environmental Protection (DEP) intends to issue a Plan Approval to Reliant Energy Mid-Atlantic Power Holdings, LLC to repower its existing Seward Station in East Wheatfield Township, Indiana County as described in its application received on September 2000.

   Copies of the application, DEP's analysis and other documents used in evaluation of the application are available for public inspection during normal business hours at the address above.

   In order for DEP to assure compliance with all applicable standards, DEP proposes to place the following conditions on the Plan Approval:

Special Conditions for Plan Approval PA-32-040B

   1.  The source is to be constructed in accordance with the plans submitted with the application (as approved herein).

   2.  Upon completion of the construction of the above indicated air contamination source an operating permit application must be obtained from the person noted below.

Section A--General Conditions

   3.  This Plan Approval is for the construction and operation of two CFB boilers and related/supporting equipment by Reliant Energy Mid-Atlantic Power Holdings, LLC to repower its existing Seward Station in East Wheatfield Township, Indiana County. The repowered facility will combust coal refuse or coal and use No. 2 fuel oil for CFB startup and support equipment.

   4.  The plant is subject to New Source Performance Standards for Electric Utility Steam Generating Units, Volatile Organic Liquid Storage Vessels, Coal Preparation Plants, and Non-Metallic Mineral Processing Plants (40 CFR Part 60, Subparts Da, Kb, Y, and OOO).

   5.  In accordance with 25 Pa. Code § 127.12b, the following emissions baseline is established for Seward Station.

   This baseline is established contingent upon the permanent retirement of Seward Station Boilers Nos. 12, 14 and 15.

   6.  Owner or operator, in accordance with 25 Pa. Code §§ 127.208, 127.209 and 127.211, shall secure by approved ERC registry transaction 72 VOC ERCs before commencement of operation of the CFB Boilers. The total ERCs represent a facility net potential emissions increase of 62 tons per year times the 1.15 offset ratio (25 Pa. Code § 127.210).

   7.  This approval to construct shall become invalid if: (1) construction is not commenced (as defined in 40 CFR 52.21(b)(8)) within 18 months after the date of this approval [or any extension issued thereafter]; or, (2) construction is discontinued for a period of 18 months or more; or (3) construction is not completed within 5 years.

Section B--Emission Limitations/Restrictions

   8.  The Owner or Operator shall not permit the emission to the outdoor atmosphere of visible emissions from the boilers, in such a manner that the opacity of the emission is equal to or greater than 10% for a period, or periods aggregating more than 3 minutes in any 1 hour, or 30% at any time. The presence of uncombined water is not considered a failure to meet the limitations (25 Pa. Code §§ 127.1 and 127.12(b)).

   9.  There shall be no fugitive emissions contrary to 25 Pa. Code §§ 123.1 and 123.2.

   10.  Ammonia slip from the boilers shall be limited to 10 ppmv at stack conditions. Continuing compliance with this condition shall be demonstrated by adhering to good operating practices (25 Pa. Code §§ 127.1 and 127.12b).

   11.  Emissions of sulfur oxides (as SO2) shall be reduced in the boiler and flyash reinjection system by at least 95% on a 12-month rolling average. Additional SO2 removal efficiency stated in the application shall be achieved by fuel beneficiation (25 Pa. Code §§ 127.1 and 127.12b).

   12.  The Owner or Operator shall not permit the emission into the outdoor atmosphere of particulate matter emissions from the fuel or limestone handling and processing any stack emissions in a manner that the concentration of particulate matter in the effluent gas exceeds 0.02 gr/dscf (40 CFR 60.672(a)(1), 25 Pa. Code §§ 127.1 and 127.12b).

   13.  Emissions for the boilers shall be limited as follows:

   14.  Potential emissions for the facility in any consecutive 12-month period shall be limited as follows (25 Pa. Code §§ 127.1 and 127.12b):

   15.  The Department may establish or revise the maximum allowable emission rates based upon CEM data, stack test results, optimization of each boiler and its associated air cleaning devices (25 Pa. Code § 127.12b).

Section C--Sampling & Testing Requirements

   16.  The Department reserves the right to require stack testing at any time for the sources covered by this Plan Approval (25 Pa. Code § 127.12b(c)).

   17.  Within 180 days of initial start-up but no later than 60 days of achieving maximum production, a stack test(s) shall be performed on one of the boilers in accordance with the provisions of Chapter 139 to determine the following pollutant emission rates (25 Pa. Code § 127.12b):

   a.  CO

   b.  PM10

   c.  NMVOC (as hexane)

   d.  Ammonia

   18.  The Owner or Operator shall submit a pretest protocol for review at least 60 days prior to performance of the stack tests (25 Pa. Code § 139.2).

   19.  The Owner or Operator shall also notify the Department at least 2 weeks prior to the stack tests so that an observer may be present at the time of the tests (25 Pa. Code § 139.2).

   20.  The Owner or Operator shall submit a stack test report to the Department within 60 days of the completed testing (25 Pa. Code § 127.12c).

Section D--Monitoring Requirements

   21.  The Owner or Operator shall install, certify, maintain, and operate continuous emission monitoring (CEM) systems in the common stack for sulfur oxides (as SO2), NOx (as NO2), and gas flow from the CFB boilers. Oxygen (O2) or carbon dioxide (CO2) shall be monitored at each location where SO2 or NOx are monitored in accordance with the requirements of 25 Pa. Code Chapter 139.

   22.  The Owner or Operator shall install, operate, and maintain a monitoring system for as-fired coal analysis in accordance with the requirements of 25 Pa. Code Chapter 139 or an alternate method approved by the Department. Sulfur analysis shall be determined on a daily basis with the results used to calculate monthly averages.

   23.  The Department reserves the right to require additional continuous monitoring for CO (25 Pa. Code § 127.12b).

Section E--Recordkeeping Requirements

   24.  The Owner or Operator shall keep readily accessible records showing the dimensions of the #2 fuel oil storage tank and an analysis showing the capacity of the #2 fuel oil storage tank (40 CFR 60.116b(b)).

   25.  The Owner or Operator shall maintain a monthly log of:

   A.  hours of operation for each air pollution source;

   B.  coal refuse, coal and fuel oil consumption;

   C.  ammonia and limestone consumption.

   This log shall be maintained on site for a minimum of five years and shall be made available to the Department upon request (25 Pa. Code § 127.12b).

Section F--Reporting Requirements

   26.  The plant is subject to New Source Performance Standards for Electric Utility Steam Generating Units, Volatile Organic Liquid Storage Vessels, Coal Preparation Plants, and Non-Metallic Mineral Processing Plants (40 CFR Part 60, Subparts Da, Kb, Y, and OOO). In accordance with 40 CFR 60.4, copies of all requests, reports, applications, submittals, and other communications shall be forwarded to both the EPA and the Department at the addresses listed below unless otherwise noted.

   27.  (a) The owner or operator shall report each malfunction that poses an imminent and substantial danger to the public health and safety or the environment or which it should reasonably believe may result in citizens complaints to the Department that occurs at this Title V facility. For purposes of this condition a malfunction is defined as any sudden, infrequent, and not reasonably preventable failure of air pollution control equipment, process equipment or a process to operate in a normal or usual manner that may result in an increase in the emissions of air contaminants (25 Pa. Code § 127.441).

   (b)  When the malfunction poses an imminent and substantial danger to the public health and safety, the notification shall be submitted to the Department no later than one hour after the incident.

   (1)  The notice shall describe the:

   (I)  name and location of the facility;

   (II)  nature and cause of the malfunction;

   (III)  time when the malfunction was first observed;

   (IV)  expected duration of excess emissions; and

   (V)  estimated rate of emissions

   (2)  The owner or operator shall notify the Department immediately when corrective measures have been accomplished.

   (3)  Subsequent to the malfunction, the owner or operator shall submit a full report on the malfunction to the Department within 15 days, if requested.

   (4)  The owner or operator shall submit reports on the operation and maintenance of the source to the regional Air Program Manager at such intervals and in such form and detail as may be required by the Department. Information required in the reports may include, but is not limited to, process weight rates, firing rates, hours of operation, and maintenance schedules.

   (c)  Malfunctions shall be reported to the Department at the following address:

   28.  The Owner or Operator shall submit an appropriate operating permit application to the Department within 120 days of the completion of construction (25 Pa. Code § 127.403).

   29.  This Plan Approval authorizes the temporary operation of the source(s) covered by this Plan Approval provided the following conditions are met (25 Pa. Code § 127.12b):

   (a)  The Department must receive written notice from the Owner or Operator of the completion of construction and the Operator's intent to commence operation at least 5 working days prior to the completion of construction. The notice should state when construction will be completed and when the Operator expects to commence operation.

   (b)  Operation is authorized only to facilitate the start-up and shake-down of sources and air cleaning devices, to permit operations pending the issuance of an Operating Permit or to permit the evaluation of the source for compliance with all applicable regulations and requirements.

   (c)  This condition authorizes temporary operation of the source(s) for a period of 180 days from the commencement of operation, provided the Department receives notice from the Owner or Operator pursuant to subpart (a), above.

   (d)  The Owner or Operator may request an extension if compliance with all applicable regulations and Plan Approval requirements has not been established. The extension request shall be submitted in writing at least 15 days prior to the end of the period of temporary operation and shall provide a description of the compliance status of the source, a detailed schedule for establishing compliance, and the reasons compliance has not been established.

   (e)  The notice submitted by the Owner or Operator pursuant to subpart (a), above, prior to the expiration of this Plan Approval shall modify the Plan Approval expiration date. The new Plan Approval date shall be 180 days from the date of notice.

   30.  The Owner or Operator shall submit to the Department for approval a detailed protocol for the optimization of the NOx control system at least 60 days prior to the start-up of Boilers #1 & #2 (25 Pa. Code § 127.12b).

   31.  At least 90 days prior to start-up, the Owner or Operator shall submit information required by Phase I of the Department's ''Continuous Source Monitoring Manual,'' Revision 6, January 1996 to the following address.

Section G--Work Practice Standards

   32.  The Owner or Operator shall install, maintain, and operate the boilers in accordance with the manufacturer's specifications (25 Pa. Code § 127.12b).

   33.  The Department reserves the right to require additional controls (for example, road paving, process equipment enclosures, conveyor covers, and the like) based on evaluation of the operation after start-up and a determination that the existing controls are inadequate to control fugitive emissions (25 Pa. Code § 127.12b).

   34.  The truck loading and unloading areas and the plant delivery roads shall be paved with asphalt, concrete, or an equivalent surface approved by the Department (25 Pa. Code § 127.12b).

   35.  Road dust shall be controlled by a road sweeper and the use of water sprays, oils, or other dust surfactants including 250 feet of public highway on either side of the access road (25 Pa. Code § 127.12b).

   36.  A pressurized water truck shall be on site and in use when the facility is operating on an as needed basis acceptable to the Department (25 Pa. Code § 127.12b).

   37.  The plant shall post a sign stating and shall enforce the requirement that ''All loaded trucks entering or exiting plant property shall be properly tarpaulin covered.'' The plant shall deny all non-tarped trucks access to the weigh station (25 Pa. Code § 127.12b).

   38.  The plant shall post and shall enforce a speed limit of 15 mph or less on all in-plant roads (25 Pa. Code § 127.12b).

   39.  All front-end loaders used to transfer and load coal shall maintain a minimal amount of drop from the front-end loader into bins or trucks so as to prevent fugitive emissions (25 Pa. Code § 127.12b).

   40.  All conveyor belts shall be partially enclosed, and all screens and crushers shall be full enclosed so as to prevent fugitive emissions from becoming airborne (25 Pa. Code § 127.12b).

   41.  Ash silos shall discharge through an ash conditioner which shall moisten the ash before it is loaded into trucks for disposal. Tanker truck pneumatic loading of dry ash is permitted (25 Pa. Code § 127.12b).

   42.  Coal shall not be stockpiled or loaded in any area that is not enclosed or adequately watered by the pressurized water truck and/or sprinkler system (25 Pa. Code § 127.12b).

   Any person wishing to provide the Department of Environmental Protection with additional information which they believe should be considered prior to the issuance of the Plan Approval may submit the information to the Department of Environmental Protection at the address shown below. A 30-day comment period, from the date of this publication, will exist for the submission of comments. Each written comment must contain the following:

   *  Name, address, and telephone number of the person submitting the comments.

   *  Identification of the proposed Plan Approval (specify the Plan Approval number).

   *  Concise statements regarding the relevancy of the information or objections to issuance of the Plan Approval.

   A public hearing may be held, if the Department of Environmental Protection (Department), in its discretion, decides that such a hearing is warranted based on the information received. All persons submitting comments or requesting a hearing will be notified of the decision to hold a hearing by publication in this newspaper or by the Pennsylvania Bulletin, or by telephone, where the Department determines such notification by telephone is sufficient. Lower Mount Bethel Energy, LLC

Public Hearing Notice

   The Department of Environmental Protection (Department) will hold a public hearing for the Department to take testimony concerning the air quality plan approval for Lower Mount Bethel Energy, LLC (the Permittee), Depues Ferry Road, Lower Mount Bethel Township, Northampton County, PA, for construction of two combustion turbines with duct burners and a cooling tower. All maximum potential emissions, emissions consumption of the available Prevention of Significant Deterioration (PSD) air quality increments and the conditions placed in the Plan Approval to show compliance with the applicable standards have previously been published in the January 16, 17, 18, 2001 issues of the Morning Call and in the February 17, 2001 issue of the Pennsylvania Bulletin.

   A public hearing will be held for the purpose of receiving comments on the proposed air quality plan approval. The hearing will be held on April 17, 2001 at 7:00 p.m. at the Nazareth High School, East Center Street, Nazareth, PA. Persons interested in commenting are invited to appear at the public hearing.

   Copies of the application, the Department's technical review and other supporting documents are available for public inspection between the hours of 8 a.m. and 4 p.m. at the Department's Bethlehem District Office, 4530 Bath Pike, Bethlehem, Pennsylvania. Appointments for scheduling a review may be made by calling (610) 861-2070.

   The general procedures for the hearing are as follows:

   To develop an agenda for the hearing, the Department requests that individuals wishing to testify at the hearing submit a written notice of their intent. The notice should be sent to Thomas A. DiLazaro, Hearing Examiner, Department of Environmental Protection, Air Quality Program, 2 Public Square, Wilkes-Barre, PA 18711-0790. The Department will accept notices up to the day of the public hearing.

   This written notice should include the person's name, address, telephone number and a brief description as to the nature of the testimony. Individuals who submit a notice of intent to testify will be given priority on the agenda. If time permits, the Department will allow individuals who have not submitted a notice of intent to testify to present their comments.

   Each individual will have up to 10 minutes to present testimony. The Department requests that individuals present written copies of their testimony in addition to their oral presentations.

   To insure that all speakers have a fair and equal opportunity to present their testimony, relinquishing of time will be prohibited. Further details relating to the procedures to be followed at the hearing will be outlined at the beginning of the hearing.

MINING ACTIVITY APPLICATIONS

   Applications under the Surface Mining Conservation and Reclamation Act (52 P. S. §§ 1396.1--1396.19a); the Noncoal Surface Mining Conservation and Reclamation Act (52 P. S. §§ 3301--3326); The Clean Streams Law (35 P. S. §§ 691.1--691.1001); the Coal Refuse Disposal Control Act (52 P. S. §§ 30.51--30.66); The Bituminous Mine Subsidence and Land Conservation Act (52 P. S. §§ 1406.1--1406.21). Mining activity permits issued in response to such applications will also address the applicable permitting requirements of the following statutes: the Air Pollution Control Act (35 P. S. §§ 4001--4015); the Dam Safety and Encroachments Act (32 P. S. §§ 693.1--693.27); and the Solid Waste Management Act (35 P. S. §§ 6018.101--6018.1003).

   The following permit applications to conduct mining activities have been received by the Department of Environmental Protection (Department). A copy of the application is available for inspection at the District Mining Office indicated above each application. Where a 401 Water Quality Certification is needed for any aspect of a particular proposed mining activity, the submittal of the permit application will serve as the request for such certification.

   Written comments or objections, or requests for informal conferences on applications, may be submitted by any person or any officer or head of any Federal, State or local government agency or authority to the Department at the same address within 30 days of this publication, or within 30 days after the last publication of the applicant's newspaper advertisement, as provided by 25 Pa. Code §§ 77.121--123 and 86.31--34 (relating to public notices of filing of permit applications, opportunity for comment, and informal conferences).

   Where any of the mining activities listed below will have discharges of wastewater to streams, the Department will incorporate NPDES permits into the mining activity permits issued in response to these applications. The NPDES permits will contain, at a minimum, technology-based effluent limitations (as described in the Department's regulations--25 Pa. Code §§ 77.522, 87.102, 88.92, 88.187, 88.242, 89.52 and 90.102) for iron, manganese, suspended solids, settable solids, alkalinity and pH. In addition to the above, more restrictive effluent limitations, restrictions on discharge volume, or restrictions on the extent of mining which may occur will be incorporated into a mining activity permit, when necessary, for compliance with water quality standards (in accordance with 25 Pa. Code Chapters 93 and 95). Persons or agencies which have requested review of the NPDES permit requirements for a particular mining activity within the above-mentioned public comment period will be provided with a 30-day period to review and submit comments on those requirements.

   Written comments or objections should contain the name, address and telephone number of persons submitting comments or objections; application number; and a statement of sufficient detail to inform the Department on the basis of comment or objection and relevant facts upon which it is based. Requests for an informal conference must contain the name, address and telephone number of requestor; application number; a brief summary of the issues to be raised by the requestor at the conference; and a statement whether the requestor desires to have the conference conducted in the locality of the proposed mining activities.

FEDERAL WATER POLLUTION CONTROL ACT, SECTION 401

   The following permit applications and requests for Environmental Assessment approval and requests for Water Quality Certification have been received by the Department of Environmental Protection. Section 401 of the Federal Water Pollution Control Act (FWPCA) (33 U.S.C.A. § 1341(a)), requires the State to certify that the involved projects will not violate the applicable provisions of sections 301--303, 306 and 307 of the FWPCA (33 U.S.C.A. §§ 1311--1313, 1316 and 1317) as well as relevant State requirements. Initial requests for 401 Water Quality Certification will be published concurrently with the permit application. Persons objecting to approval of a request for certification under Section 401 or to the issuance of a Dam Permit or Water Obstruction and Encroachment Permit, or the approval of an Environmental Assessment must submit any comments, suggestions or objections within 30 days of the date of this notice as well as any questions to the office noted above the application. Comments should contain the name, address and telephone number of the person commenting, identification of the certification request to which the comments or objections are addressed, and a concise statement of comments, objections or suggestions including the relevant facts upon which they are based.

   The Department may conduct a fact-finding hearing or an informal conference in response to comments if deemed necessary. Each individual will be notified, in writing, of the time and place of a scheduled hearing or conference concerning the certification request to which the comment, objection or suggestion relates.    4. Structure B-345: to reconstruct and maintain a single span bridge having a normal span of 8.02 meters and an underclearance of 1.8 meters across an unnamed tributary to East Branch Coxes Creek (WWF) located at Milepost 111.00 in Somerset Township.

   5. Culvert 181+130: to extend, and maintain an existing 50.5 meter long, 1050 mm reinforced concrete pipe culvert 3 meters downstream in an unnamed tributary to East Branch Coxes Creek (WWF) located at Milepost 112.54 in Somerset Township.
