FINAL ACTIONS TAKEN UNDER THE PENNSYLVANIA CLEAN STREAMS LAW AND THE FEDERAL CLEAN WATER ACT

NATIONAL POLLUTION DISCHARGE ELIMINATION SYSTEM PROGRAM (NPDES)

INDUSTRIAL WASTE AND SEWERAGE WASTEWATER

   The Department of Environmental Protection (Department) has taken the following actions on previously received permit applications and requests for plan approval.

   Persons aggrieved by this action may appeal, under Section 4 of the Environmental Hearing Board Act (35 P. S. § 7514) and 2 Pa.C.S. §§ 501--508 and 701--704 (relating to the Administrative Agency Law), to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, P. O. Box 8457, Harrisburg, PA 17105-8457, (717) 787-3483. TDD users may contact the Board through the Pennsylvania Relay Service, (800) 654-5984. Appeals must be filed with the Environmental Hearing Board within 30 days of receipt of written notice of this action unless the appropriate statute provides a different time period. Copies of appeal form and the Board's rules of practice and procedure may be obtained from the Board. The appeal form and the Board's rules of practice and procedure are also available in Braille or on audiotape from the Secretary of the Board at (717) 787-3483. This paragraph does not, in and of itself, create any right of appeal beyond that permitted by applicable statutes and decisional law.

The Department of Environmental Protection approves the following coverage under the specific General Permit.

   The EPA Region III Administrator has waived the right to review or object to this permit action under the waiver provision 40 CFR 123.24.

SEWAGE FACILITIES ACT PLAN APPROVAL

   Plan Description: The Raceway Truck Stop is located off Interstate 81 at the Ravine Exit at the intersection of S.R. 125 and Molleystown Road in Tremont Township, Schuylkill County. The proposed project consists of the construction of a 70 unit motel at an existing restaurant and truck stop. The project is commercial in nature and involves one lot of 5 acres. The anticipated peak daily flow for the facilities is 15,000 gallons per day (gpd), or 37.5 equivalent dwelling units (edu).

   The proposed method of sewage disposal is through the utilization of a package treatment plant with a discharge to the Swatara Creek. The treatment facilities will be privately owned and operated. A 15,000 gpd package treatment plant is proposed as the ultimate, long-term method of sewage disposal for the project. The discharge point will be located west of Molleystown Road, just north of S.R. 125. There are no adjacent parcels under the same ownership of the subject property. The existing restaurant utilizes an on-lot disposal system that is malfunctioning. Water supply is provided by an existing on-site well.

   Plan Description:  This plan purposed to provide new sewers and a sewage treatment plant for the village of Pottsgrove. The new sewer system was projected to serve 114 existing EDU's. The plan was disapproved because conflicts with the PA Historical & Museum Commission's requirements were not resolved, the implementation schedule was not completed and there was no analysis of the impacts of the proposed project on the stormwater management plan for the area.

HAZARDOUS SITES CLEAN-UP

UNDER THE ACT OF OCTOBER 18, 1988

SETTLEMENT UNDER THE COMPREHENSIVE ENVIRONMENTAL RESPONSE, COMPENSATION AND LIABILITY ACT AND THE HAZARDOUS SITES CLEANUP ACT

   The Department of Environmental Protection (Department), under the authority of the Hazardous Sites Cleanup Act (HSCA) (35 P. S. §§ 6020.101--6020.1305) and the Comprehensive Environmental Response, Compensation and Liability Act (CERCLA) (42 U.S.C.A. §§ 9601--9675), has entered into a proposed settlement with Drum Service of Richmond, Inc., under section 707 of the HSCA and section 122(g) of CERCLA relating to the cleanup of the Container Recyclers Ltd. HSCA Site (Site) at 10 E. Wolf Street, Philadelphia PA.

   Contamination identified by the Department at the Site included hydrofluoric acid, hydrochloric acid, aqueous wastes with pH greater than 12.5, ignitable or corrosive waste, methyl ethyl ketone and trichloroethylene. A prompt interim response was implemented in accordance with a Statement of Decision (SOD) issued by the Department on December 21, 1994. The response conducted by the Department, which included the removal of hazardous wastes and materials located at the Site, was completed in late 1995. Under the terms of the proposed Consent Decree, Drum Service of Richmond, Inc., will pay the Department $39,337.00 as partial reimbursement for costs incurred by the Department in connection with the Site.

   This notice is provided under section 1113 of the HSCA. The Department will provide for a 60-day comment period on the proposed Consent Order and Agreement from the date of publication of this notice. The proposed Consent Order may be examined from 8 a.m. to 4 p.m. at the Department's office at Lee Park, Suite 6010, 555 North Lane, Conshohocken PA 19428, by contacting Donna Suevo at (610) 832-6194 or Anderson Hartzell at (610) 832-6300 during normal business hours. Persons may submit written comments to Donna Suevo at the previous address. The Department will provide a response to significant written comments received during the public comment period, and the proposed Consent Order and Agreement authorizes the Department to withhold or withdraw its consent in the event that the Department determines, based on comments received during the public comment period, that the Consent Order and Agreement is inappropriate, improper or not in the public interest.

LAND RECYCLING AND ENVIRONMENTAL REMEDIATION

The following final reports were submitted under the Land Recycling and Environmental Remediation Standards Act (35 P. S. §§ 6026.101--6026.908).

   Provisions of Chapter 3 of the Land Recycling and Environmental Remediation Standards Act (Act) require the Department of Environmental Protection (Department) to publish in the Pennsylvania Bulletin a notice of submission of final reports. A final report is submitted to document cleanup of a release of a regulated substance at a site where one of the Act's remediation standards. A final report provides a description of the site investigation to characterize the nature and extent of contaminants in environmental media, the basis for selecting the environmental media of concern, documentation supporting the selection of residential or nonresidential exposure factors, a description of the remediation performed, and summaries of sampling analytical results which demonstrate that remediation has attained the cleanup standard selected.

   For further information concerning the final report, please contact the Environmental Cleanup Program Manager in the Department of Environmental Protection Regional Office under which the notice of receipt of a final report appears. If information concerning a final report is required in an alternative form, contact the Community Relations Coordinator at the appropriate Regional Office listed.    Former Murray Lincoln-Mercury Property, East Pikeland Township, Chester County. John F. Van Wagenen, Center Point Tank Services, Inc., 536 E. Benjamin Franklin Highway, Douglassville PA 19518, on behalf of Valley Land Holdings, P. O. Box 187, Catasauqua, PA 18032, has submitted a Final Report concerning remediation of site groundwater contaminated with BTEX. The report is intended to document remediation of the site to meet the Statewide Health Standard.

   Spring City Electrical Manufacturing Co., Spring City Borough, Chester County. Christopher Orzechowski, RT Environmental Services, Inc., 215 W. Church Road, King of Prussia, PA 19406, on behalf of Spring City Electrical Manufacturing Co., Main and Hall Sts., Spring City, PA 19475, has submitted a Final Report concerning remediation of site soil contaminated with solvents and polycyclic aromatic hydrocarbons and site groundwater contaminated with solvents. The report is intended to document remediation of the site to meet Background and Statewide Health Standards.

LAND RECYCLING AND ENVIRONMENTAL REMEDIATION

The Department has taken action on the following plans and reports under the Land Recycling and Environmental Remediation Standards Act (35 P. S. §§ 6026.101--6026.908).

   Provisions of 25 Pa. Code § 250.8, Administration of the Land Recycling and Environmental Remediation Standards Act (Act) requires the Department of Environmental Protection (Department) to publish in the Pennsylvania Bulletin a notice of its final actions on plans and reports. A final report is submitted to document cleanup of a release of a regulated substance at a site to one of the remediation standards of the Land Recycling and Environmental Remediation Standards Act. Plans and reports required by provisions of the Act for compliance with selection of remediation to a site-specific standard, in addition to a final report, include a remedial investigation report, risk assessment report and cleanup plan. A remedial investigation report includes conclusions from the site investigation, concentration of regulated substances in environmental media; benefits of refuse of the property and, in some circumstances, a fate and transport analysis. If required, a risk assessment report describes potential adverse effects caused by the presence of regulated substances. A cleanup plan evaluates the abilities of potential remedies to achieve remedy requirements. A final report provides a description of the site investigation to characterize the nature and extent of contaminants in environmental media, the basis of selecting the environmental media of concern, documentation supporting the selection of residential or non-residential exposure factors, a description of the remediation performed and summaries of sampling methodology and analytical results which demonstrate that the remediation has attained the cleanup standard selected. The Department may approve or disapprove plans and reports submitted. This notice provides the Department's decision and, if relevant, the basis for disapproval.

The report demonstrated attainment of the Statewide Health Standard and was approved by the Department on February 13, 2001.

   Northeast Region: Environmental Cleanup Program Manager, 2 Public Square, Wilkes-Barre, PA 18711-0790.

   St. Paul's Evangelical Lutheran Church, Kingston Township, Luzerne County. Eric B. Rosina, Project Manager, Storb Environmental, Inc., 410 N. Easton Road, Willow Grove, PA 19090 submitted a Final Report (on behalf of his client, St. Paul's Evangelical Lutheran Church, 196 N. Main Street, Shavertown, PA 18708) concerning the remediation of site soils found to have been contaminated with no. 2 home heating fuel oil constituents. The report documented attainment of the Statewide health standard and was approved on February 12, 2001.

   Southcentral Region: Environmental Cleanup Program Manager, 909 Elmerton Avenue, Harrisburg, PA 17110.

   Heller Property, Oley Township, Berks County. ExxonMobil Company, 1900 East Linden Avenue, P. O. Box 728, Linden, NJ 07036 on behalf of Fredericka S. Moxon Heller and Richard G. Heller, Reiff Road, Oley, PA 19547 submitted a Final Report concerning the remediation of site soils and groundwater contaminated with BTEX, PHCs and PAHs. The final report demonstrated attainment of the Statewide health standards and was approved the Department on February 15, 2001.

   Southwest Region: Environmental Cleanup Program Manager, 400 Waterfront Drive, Pittsburgh, PA 15222-4745.

   Hankison International, Chartiers Township, Washington County. Karen E. Souza, Civil and Environmental Consultants, Inc., 333 Baldwin Road, Pittsburgh, PA 15205 (on behalf of Hankison International, 75 Museum Road, Washington, PA 15301, and Hansen, Inc., 2600 Neville Road, Pittsburgh, PA 15225) has submitted a Final Report concerning the remediation of site soil contaminated with lead, heavy metals, and PAHs. The Final report did not demonstrate attainment of the Statewide Health Standard and was disapproved by the Department on February 9, 2001.

   LTV Southside UPMC Sports Performance Complex, City of Pittsburgh, Allegheny County. Martin Knuth, Civil and Environmental Consultants, Inc., 333 Baldwin Road, Pittsburgh, PA 15205-9702 (on behalf of Urban Redevelopment Authority of Pittsburgh, 200 Ross Street, Pittsburgh, PA 15219) has submitted a Final Report concerning the remediation of site soil contaminated with heavy metals, volatile organics and PAHs. Final report demonstrated attainment of the Site Specific Standard and was approved by the Department on February 9, 2001.

   Howard E. Stuber, Rochester Township, Beaver County. Shanin D. Sarnowski, Environmental & Geological Consultants, Inc., P. O. Box 512, 445 Second Street, Waterford, PA 16441-0512 (on behalf of Howard E. Stuber, 373 Cleveland Street, Rochester, PA 15074) has submitted a Final Report concerning the remediation of site soil contaminated with lead. The Final Report demonstrated attainment of the Statewide Health Standard and was approved by the Department on January 3, 2001.

   AMG Resource Neville Island, Neville Township, Allegheny County. Louis D. DeFabio (on behalf of AMG Resource Corporation, 4100 Grand Avenue, Pittsburgh, PA 15225, and William L. Bryant, Vulcan Materials Company, One Metroplex Drive, Birmingham, AL 35209) has submitted a Final Report concerning the remediation of site soil and groundwater contaminated with lead, heavy metals, solvents, and PHCs. The Final report demonstrated attainment of the Site Specific Standard and was approved by the Department on December 20, 2000.
