Actions Taken by the Commission

   The Independent Regulatory Review Commission met publicly at 10:30 a.m., Thursday, February 15, 2001, and took the following actions:

Regulations Approved:

   Department of Agriculture # 2-119: Farm Safety and Occupational Health Grant Program (adds Chapter 138k to 7 Pa. Code).

   Department of Agriculture # 2-122: Farm Safety and Occupational Health Developmental Program (adds Chapter 138j to 7 Pa. Code).

   Department of Agriculture # 2-123: Farm Safety and Occupational Health Tuition Assistance Program (adds Chapter 138i to 7 Pa. Code).

   On January 31, 2000, the Independent Regulatory Review Commission (Commission) received this proposed regulation from the Department of Agriculture (Department). This rulemaking adds Chapter 138k to 7 Pa. Code. The proposed regulation was published in the February 12, 2000, Pennsylvania Bulletin with a 30-day public comment period. The final-form regulation was submitted to the Commission on January 24, 2001.

   This regulation is a grant program for statewide farm organizations, volunteer fire companies, ambulance services and rescue squads. These groups may apply for annual grants, up to $2,500, for offering education or training programs related to farm safety, occupational health or response to emergencies and accidents related to farms or agriculture.

   We have determined this regulation is consistent with the statutory authority of the Department (3 P. S. §§ 1905 and 1906(c)(2)) and the intention of the General Assembly. Having considered all of the other criteria of the Regulatory Review Act, we find promulgation of this regulation is in the public interest.

Department of Agriculture; Farm Safety and Occupational Health Developmental and Instructional Program; Regulation No. 2-122

   On January 31, 2000, the Independent Regulatory Review Commission (Commission) received this proposed regulation from the Department of Agriculture (Department). This rulemaking adds Chapter 138j to 7 Pa. Code. The proposed regulation was published in the February 12, 2000, Pennsylvania Bulletin with a 30-day public comment period. The final-form regulation was submitted to the Commission on January 24, 2001.

   The regulation is a grant program intended for the Pennsylvania Fire Academy, colleges, universities, community colleges, or vocational or technical schools. These institutions may apply for annual grants, up to $30,000, for providing technical courses of instruction in farm safety and occupational health.

   We have determined this regulation is consistent with the statutory authority of the Department (3 P. S. §§ 1905 and 1906(c)(1)) and the intention of the General Assembly. Having considered all of the other criteria of the Regulatory Review Act, we find promulgation of this regulation is in the public interest.

Department of Agriculture; Farm Safety and Occupational Health Tuition Assistance Program; Regulation No. 2-123

   On January 31, 2000, the Independent Regulatory Review Commission (Commission) received this proposed regulation from the Department of Agriculture (Department). This rulemaking adds Chapter 138i to 7 Pa. Code. The proposed regulation was published in the February 12, 2000, Pennsylvania Bulletin with a 30-day public comment period. The final-form regulation was submitted to the Commission on January 24, 2001.

   This regulation is a tuition assistance program for individuals involved in agriculture production who attend farm safety, occupational health and emergency response programs. Applicants may receive up to $100 annually.

   We have determined this regulation is consistent with the statutory authority of the Department (3 P. S. §§ 1905 and 1906(a)) and the intention of the General Assembly. Having considered all of the other criteria of the Regulatory Review Act, we find promulgation of this regulation is in the public interest.
