FINAL ACTIONS TAKEN UNDER THE CLEAN STREAMS LAW AND THE FEDERAL CLEAN WATER ACT--NPDES AND WQM PART II PERMITS

INDUSTRIAL WASTE AND SEWERAGE WASTEWATER

   The Department of Environmental Protection has taken the following actions on previously received permit applications and requests for plan approval.

   Persons aggrieved by an action may appeal, under section 4 of the Environmental Hearing Board Act (35 P. S. § 7514) and 2 Pa.C.S. §§ 501--508 and 701--704 (relating to the Administrative Agency Law), to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, 400 Market Street, P. O. Box 8457, Harrisburg, PA 17105-8457, (717) 787-3483. TDD users may contact the Environmental Hearing Board (Board) through the Pennsylvania Relay Service, (800) 654-5984. Appeals must be filed with the Board within 30 days of publication of this notice in the Pennsylvania Bulletin, unless the appropriate statute provides a different time period. Copies of the appeal form and the Board's rules of practice and procedure may be obtained from the Board. The appeal form and the Board's rules of practice and procedure are also available in Braille or on audiotape from the Secretary to the Board at (717) 787-3483. This paragraph does not, in and of itself, create any right of appeal beyond that permitted by applicable statutes and decision law.

   For individuals who wish to challenge an action, appeals must reach the Board within 30 days. A lawyer is not needed to file an appeal with the Board.

   Description of Proposed Action/Activity: Renewal to discharge into Neshaminy Creek-2F Watershed.

   NPDES Permit No. PA0056120,  Sewage, Sarah Mims, 814 Denton Hollow Road, West Chester, PA 19832. This proposed facility is located in Pocopson Township, Chester County.

   Description of Proposed Action/Activity: Renewal to discharge into Pocopson Creek.

   NPDES Permit No. PA0054780 Amendment No. 1,  Sewage, Stone Mill Estates, L.P., 3103 Philmont Avenue, Huntingdon Valley, PA 18966. This proposed facility is located in Concord Township, Delaware County.

   Description of Proposed Action/Activity: Amendment to remove the monitoring requirements for chlorine.

   WQM Permit No. 1502407,  Sewerage, London Grove Township Municipal Authority, 372 Rose Hill Road, Suite 300, West Grove, PA 19390. This proposed facility is located in London Grove Township, Chester County.

   Description of Proposed Action/Activity: Construction and operation of sewage pump station and force main to serve Webb Subdivision.

   WQM Permit No. 4602404,  Sewerage, Lower Salford Township Authority, 57 Main Street, P. O. Box 243, Mainland, PA 19451-0243. This proposed facility is located in Lower Salford Township, Montgomery County.

   Description of Proposed Action/Activity: Construction and operation of sewage pump station and force main to serve the proposed Estates at Salford Lea Residential Development.

   WQM Permit No. 0900421,  Sewerage, Pennridge Wastewater Treatment Authority, 180 Maple Avenue, P. O. Box 31, Sellersville, PA 18960-0031. This proposed facility is located in West Rockhill Township, Bucks County.

   Description of Proposed Action/Activity: Approval for expansion and upgrade the wastewater treatment plant.

   Northeast Region: Water Management Program Manager, 2 Public Square, Wilkes-Barre, PA 18711-0790.

   NPDES Permit No. PA0032328,  Sewage, Hickory Hills Manufactured Housing Community, LLC, 121 Hickory Hills Drive, Bath, PA 18014. This proposed facility is located in Moore Township, Northampton County and discharge to unnamed tributary to East Branch Monocacy Creek.

   Description of Proposed Action/Activity: Renewal of NPDES Permit.

   NPDES Permit No. PA0020206,  Sewage, Bath Borough Authority, Race and Mill Streets, P. O. Box 87, Bath, PA 18014. This proposed facility is located in Bath Borough, Northampton County.

   Description of Proposed Action: Renewal of NPDES Permit.

   NPDES Permit No. PA0083470,  Sewage, Paradise Township Sewer Authority, 196 Blackhorse Road, Paradise, PA 17562. This proposed facility is located in Paradise Township, Lancaster County.

   Description of Proposed Action/Activity: Authorization to discharge to Pequea Creek in Watershed 7-K.

   WQM Permit No. 2278407 Amendment No. 02-1,  Sewerage, Derry Township Municipal Authority, 670 Clearwater Road, Hershey, PA 17033. This proposed facility is located in Derry Township, Dauphin County.

   Description of Proposed Action/Activity: Authorization for the modifications to the construction/operation of pump stations.

   Northcentral Region: Water Management Program Manager, 208 West Third Street, Williamsport, PA 17701.

   NPDES Permit No. PA0112488,  Sewerage, SIC 4952, Ralpho Township Municipal Authority, 32A South Market Street, Elysburg, PA 17824-9602. This proposed facility is located in Ralpho Township, Northumberland County.

   Description of Proposed Action/Activity: Renewal of NPDES Permit for Bear Gap Sewage Treatment Plant.

   NPDES Permit No. PA0028738,  Sewerage, SIC 4952, Ralpho Township Municipal Authority, 32A South Market Street, Elysburg, PA 17824-9602. This proposed facility is located in Ralpho Township, Northumberland County.

   Description of Proposed Action/Activity: Renewal of NPDES Permit for Main Sewage Plant.

   NPDES Permit No. PAS604803,  Industrial Stormwater SIC 5093, Patrick R. Burns, 278 Lower Coleville Road, Bellefonte, PA 16823. This proposed facility is located in Benner Township, Centre County.

   Description of Proposed Action/Activity: Issuance of a new NPDES Permit.

   WQM Permit No. 4102403,  Sewerage SIC 4952, Jeannette L. Fraser, 901 Harvey Road, Williamsport, PA 17701. This proposed facility is located in Eldred Township, Lycoming County.

   Description of Proposed Action/Activity: Construction and operation of residential sewage treatment plant.

   WQM Permit No. 5902404,  Sewerage, Delmar Township Supervisors, R. D. 5 Box 70A, Wellsboro, PA 16901. This proposed facility is located in Delmar Township, Tioga County.

   Description of Proposed Action/Activity: Construction of approximately 10,000 LF of 4-inch low-pressure force main, 20,000 LF of 2- and 2 1/2-inch pressure sewer and 80 individual grinder pumps north of Wellsboro along Routes 6 and 287.

   Southwest Region: Water Management Program Manager, 400 Waterfront Drive, Pittsburgh, PA 15222-4745.

   NPDES Permit No. PA0204901,  Industrial, Port Authority of Allegheny County, 345 Sixth Avenue, 3rd Floor, Pittsburgh, PA 15222 is authorized to discharge from a facility located at the Ross Maintenance Garage, Ross Township, Allegheny County to receiving waters named Nelson Run.

   NPDES Permit No. PA0022365,  Sewage, Perryopolis Area Joint Authority, P. O. Box 298, Perryopolis, PA 15437 is authorized to discharge from a facility located at the Perryopolis Sewage Treatment Plant, Perryopolis Borough, Fayette County to receiving waters named Youghiogheny River.

   NPDES Permit No. PA0043435,  Sewage, Cecil Wastewater Treatment Company, Inc., 10 Bayberry Lane, Cecil, PA 15321-1206 is authorized to discharge from a facility located at Monaco Manor Sewage Treatment Plant, Cecil Township, Washington County to receiving waters named Drainage Swale Tributary to an unnamed tributary of Coal Run.

   NPDES Permit No. PA0095974,  Sewage, Mabel Yemc, P. O. Box 423, New Stanton, PA 15672 is authorized to discharge from a facility located at the Jane Ann Restaurant STP, Sewickley Township, Westmoreland County to receiving waters named unnamed tributary of Sewickley Creek.

   NPDES Permit No. PA0217603,  Sewage, RAG Cumberland Resources, LP, P. O. Box 1020, 158 Portal Road, Waynesburg, PA 15370 is authorized to discharge from a facility located at Cumberland Mine Bathhouse Portal No. 6 STP, Whiteley Township, Greene County to receiving waters named unnamed tributary of Patterson Run.

   NPDES Permit No. PA0219169,  Sewage, Laurel Highlands Municipal Authority, 164 Jubilee Street, Rockwood, PA 15557 is authorized to discharge from a facility located at New Centerville Borough STP, New Centerville Borough, Somerset County to receiving waters named Middle Creek.

   Northwest Region: Water Management Program Manager, 230 Chestnut Street, Meadville, PA 16335-3481.

   WQM Permit No. 1002404,  Sewerage, Department of Conservation and Natural Resources, Moraine State Park, 195 Park Road, P. O. Box 387, Prospect, PA 16052-0387. This proposed facility is located in Muddy Creek Township, Butler County.

   Description of Proposed Action/Activity: This project is for the replacement of existing sand filters with new continuous backwash, upflow filters.

   WQM Permit No. 1002406,  Sewerage, Cornerstone Family Services, 2700 Mt. Royal Boulevard, Glenshaw, PA 15116. This proposed facility is located in Franklin Township, Butler County.

   Description of Proposed Action/Activity: This project is for the construction and operation of a sewage treatment facility to serve a residential and commercial community.

   WQM Permit No. 1002402,  Sewerage, Sutton Mobile Home Park, 129 Elgie Drive, Butler, PA 16001. This proposed facility is located in Clay Township, Butler County.

   Description of Proposed Action/Activity: This project is for the construction of an extended aeration sewage treatment plant to replace a malfunctioning onlot sewage system.

   WQM Permit No. 6202401,  Sewerage, Gilbert W. Epperson, 1040 Silliman Avenue, Erie, PA 16511. This proposed facility is located in Conewango Township, Warren County.

   Description of Proposed Action/Activity: This project is for a single residence discharging to Scott Run.

   WQM Permit No. 6201409,  Sewerage, Martin and Gloria Hancock, 14 Catherine Lane, Warren, PA 16365. This proposed facility is located in Conewango Township, Warren County.

   Description of Proposed Action/Activity: This project is for a single residence discharging to unnamed tributary to Jackson Run.

APPROVALS TO USE NPDES AND/OR OTHER GENERAL PERMITS

   The following parties have submitted: (1) Notices of Intent for Coverage under (1) General NPDES Permits to Discharge Wastewater into the Waters of the Commonwealth. The approval for coverage under these general NPDES permits is subject to applicable effluent limitations. Monitoring, reporting requirements and other conditions set forth in the general permit: (2) General Permits for Beneficial Use of Sewage Sludge or Residential Septage by Land Application in this Commonwealth; (3) General NPDES Permit Authorizing the Discharge of Stormwater Associated with Construction Activities to Waters of the Commonwealth; (4) Notification for First Use Application of Sewage Sludge.

   The approval of coverage for land application of sewage sludge or residential septage under these general permits is subject to pollutant limitations, pathogen and vector attraction reduction requirements, operational standards, general requirements, management practices and other conditions set forth in the respective permit. The Department of Environmental Protection approves the following coverage under the specific General Permit.

   The EPA Region III Administrator has waived the right to review or object to this permit action under the waiver provision 40 CFR 123.23(d).

   The application and related documents, effluent limitations, permitting requirements and other information are on file and may be inspected and arrangements made for copying at the contact office noted.

PUBLIC WATER SUPPLY PERMITS

   The Department of Environmental Protection has taken the following actions on applications received under the Safe Drinking Water Act for the construction, substantial modification or operation of a public water system.

   Persons aggrieved by an action may appeal, under section 4 of the Environmental Hearing Board Act (35 P. S. § 7514) and 2 Pa.C.S. §§ 501--508 and 701--704 (relating to the Administrative Agency Law), to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, 400 Market Street, P. O. Box 8457, Harrisburg, PA 17105-8457, (717) 787-3483. TDD users may contact the Environmental Hearing Board (Board) through the Pennsylvania Relay Service, (800) 654-5984. Appeals must be filed with the Board within 30 days of publication of this notice in the Pennsylvania Bulletin, unless the appropriate statute provides a different time period. Copies of the appeal form and the Board's rules of practice and procedure may be obtained from the Board. The appeal form and the Board's rules of practice and procedure are also available in Braille or on audiotape from the Secretary to the Board at (717) 787-3483. This paragraph does not, in and of itself, create any right of appeal beyond that permitted by applicable statutes and decision law.

   For individuals who wish to challenge an action, appeals must reach the Board within 30 days. A lawyer is not needed to file an appeal with the Board.

   Important legal rights are at stake, however, so individuals should show this notice to a lawyer at once. Persons who cannot afford a lawyer may qualify for free pro bono representation. Call the Secretary to the Board at (717) 787-3483 for more information.

   Plan Description: The Department has reviewed the Borough of Lehighton's (Borough) responses, dated January 7, 2002 (received by the Department on January 10, 2002) and September 9, 1999 (received by the Department on September 13, 1999), with regard to the Department's November 20, 2001, and July 10, 1998, correspondence concerning the January 16, 1997 Corrective Plan and Schedule (CP&S) Special Study (Special Study). The Department agrees with the conclusions/course of action proposed in the Borough's response documents. The Special Study is hereby approved. The Borough should complete implementation of the remaining tasks outlined in Activities 3 and 4 of the CP&S. The Department will continue to monitor the Borough's implementation of the remaining tasks in the CP&S.

LAND RECYCLING AND ENVIRONMENTAL REMEDIATION

UNDER ACT 2, 1995

PREAMBLE 2


The following final reports were submitted under the Land Recycling and Environmental Remediation Standards Act (35 P. S. §§ 6026.101--6026.908).

   Provisions of Chapter 3 of the Land Recycling and Environmental Remediation Standards Act (Act) require the Department of Environmental Protection (Department) to publish in the Pennsylvania Bulletin a notice of submission of final reports. A final report is submitted to document cleanup of a release of a regulated substance at a site to one of the Act's remediation standards. A final report provides a description of the site investigation to characterize the nature and extent of contaminants in environmental media, the basis for selecting the environmental media of concern, documentation supporting the selection of residential or nonresidential exposure factors, a description of the remediation performed and summaries of sampling analytical results which demonstrate that remediation has attained the cleanup standard selected.

   For further information concerning the final report, contact the Environmental Cleanup Program Manager in the Department Regional Office under which the notice of receipt of a final report appears. If information concerning a final report is required in an alternative form, contact the Community Relations Coordinator at the appropriate Regional Office listed.    The Department has received the following final reports:

   Feasterville Aamco Transmission, Lower Southampton Township, Bucks County. Paul M. Davis, Philip Services Corp., 550 Pinetown Rd., Suite 166, Fort Washington, PA 19034, on behalf of Pete Rancourt, The Bellevue, 200 S. Broad St., Philadelphia, PA 19102, has submitted a Final Report concerning remediation of site soil contaminated with BTEX, PHCs and PAHs. The report is intended to document remediation of the site to meet the Statewide Health Standard.

   Hull Corporation Site, Upper Moreland Township, Montgomery County. Darryl D. Borrelli, Manko Gold & Katcher, LLP, 401 City Ave., Suite 500, Bala Cynwyd, PA 19004, on behalf of Hull Corp., 21 Bonair Dr., Warminster, PA 18974, has submitted a Remedial Investigation Report concerning remediation of site soil contaminated with PCBs, BTEX, PAHs and solvents; and groundwater contaminated with solvents and VOCs.

   Sunoco, Inc. #0363-0043, Upper Gwynedd Township, Montgomery County. Michael Sarcinello, Groundwater & Environmental Services, Inc., 410 Eagleview Blvd., Suite 110, Exton, PA 19341, on behalf of Sunoco, Inc., Ten Penn Center, 1801 Market St., Philadelphia, PA 19103, has submitted a Final Report concerning remediation of site soil and surface water contaminated with BTEX and PHCs. The report was submitted within 90 days of the release of the contaminants and is intended to document remediation of the site to meet the Statewide Health Standard.

   Former Industrial Engraving--Knox Facility, Forks Township, Northampton County. Dr. William K. Ahlert, Manager, Mid-Atlantic Services, Lawler, Matusky and Skelly Engineers, LLP, The Sovereign Building, 609 Hamilton Mall, Allentown, PA 18101, submitted a Final Report (on behalf of Valley Housing Development Corporation, 635 Broad Street, Emmaus, PA 18049) concerning the characterization and remediation of site soil and groundwater found or suspected to have been contaminated with solvent compounds. The report was submitted to demonstrate attainment of the site-specific standard.

   Former Philipsburg Sunoco (Petrolec), Borough of Philipsburg, Centre County. Environmental Remediation & Recovery, Inc. (ER&R), on behalf of Russell Real Estate, R. D. 1, Box 179, Curwensville, PA 16833, has submitted a Baseline Environmental Report concerning soil contaminated with lead, BTEX and PAHs. The report has been submitted in partial fulfillment of the Special Industrial Area requirements.
