FEDERAL WATER POLLUTION CONTROL ACT, SECTION 401

   The following permit applications and requests for Environmental Assessment approval and requests for Water Quality Certification have been received by the Department of Environmental Protection (Department). Section 401 of the Federal Water Pollution Control Act (FWPCA) (33 U.S.C.A. § 1341(a)), requires the state to certify that the involved projects will not violate the applicable provisions of Sections 301--303, 306 and 307 of the FWPCA 33 U.S.C.A. §§ 1311--1313, 1316 and 1317 as well as relevant state requirements. Initial requests for 401 Water Quality Certification will be published concurrently with the permit application. Persons objecting to approval of a request for certification under section 401 or to the issuance of a Dam Permit, Water Obstruction and Encroachment Permit or the approval of an Environmental Assessment must submit any comments, suggestions or objections within 30 days of the date of this notice as well as any questions to the office noted before the application. Comments should contain the name, address and telephone number of the person commenting, identification of the certification request to which the comments or objections are addressed and a concise statement of comments, objections or suggestions including the relevant facts upon which they are based.

   The Department may conduct a fact-finding hearing or an informal conference in response to comments if deemed necessary. Each individual will be notified, in writing, of the time and place of a scheduled hearing or conference concerning the certification request to which the comment, objection or suggestion relates. Maps, drawings and other data pertinent to the certification request are available for inspection between the hours of 8 a.m. and 4 p.m. on each working day at the office noted above the application.

   Persons with a disability who wish to attend the hearing and require an auxiliary aid, service or other accommodation to participate in the proceedings, should contact the specified program. TDD users may contact the Department through the Pennsylvania AT&T Relay Service at (800) 654-5984.

WATER OBSTRUCTIONS AND ENCROACHMENTS

   Northeast Region:  Water Management Program Manager, 2 Public Square, Wilkes Barre, PA 18711-0790.

   E40-608. City of Wilkes-Barre, 40 East Market Street, Wilkes-Barre, PA 18711, in City of Wilkes-Barre, Luzerne County, United States Army Corps of Engineers, Baltimore District.

   To remove the existing structures and to construct and maintain 4 single-span prestressed concrete adjacent boxbeam bridges, within a 1,000 foot reach of Solomon Creek (CWF). Each bridge has a proposed span of approximately 48 feet. Approximately 80 linear feet of channel paving is proposed at each structure. The bridges are located at Waller, Barney, Regent and South Franklin Streets (Wilkes-Barre West, PA Quadrangle N:  19.8 inches; W:  4.8 inches).

   E40-609. PPL Susquehanna, LLC, 634 Salem Boulevard, Berwick, PA 18603, in Salem Township, Luzerne County, United States Army Corps of Engineers, Baltimore District.

   To replace 15 existing culverts in wetlands, at the Susquehanna Steam Electric Station River Lands, to install and maintain riprap shoreline stabilization along approximately 100 linear feet of the northeastern shore of Lake Took-A-While, to maintain approximately 230 linear feet of shoreline protection along the central-eastern shoreline of Lake Took-A-While, and to maintain riprap protection around the abutments of 3 existing bridges crossing the canal adjacent to the lake. The project is located on the north side of T-421 between SR 0011 and the Susquehanna River (Berwick, PA Quadrangle N:  14.5 inches; W:  1.3 inches).

   E35-362. Robert Burke, 1510 Electric Street, Dunmore, PA 18512, in City of Scranton, Lackawanna County, United States Army Corps of Engineers, Baltimore District.

   To construct and maintain building and parking facilities within the floodway of the Lackawanna River (WWF). The project is associated with the proposed Scranton Skating Complex located immediately north of Olive Street and Love Road (Scranton, PA Quadrangle N:  7.6 inches; W:  5.4 inches).

   E35-360. Edwin Baldoni, 790 Northern Boulevard, Suite B, Clarks Summit, PA 18411, in Glenburn Township, Lackawanna County, United States Army Corps of Engineers, Baltimore District.

   To construct and maintain a road crossing through 0.22 acre of wetland and tributary to Ackerly Creek (CWF) consisting of clean fill and a 30-inch diameter cross drain pipe for the purpose of constructing the Summerfield Village residential subdivision. The project is located on the east side of Waverly Road, approximately 0.7 mile north of its intersection with SR 6 and 11. (Dalton, PA Quadrangle N:  3.7 inches; W:  12.4 inches).

   E40-606. Kimberly A. Coffee, R. R. 1, Box 78, Harveys Lake, PA 18618, in Harveys Lake Borough, Luzerne County, United States Army Corps of Engineers, Baltimore District.

   To modify and maintain an existing house and dock structure in Harveys Lake (HQ-CWF), with work consisting of constructing a 24-foot by 14-foot cantilevered addition on the lakeward side of the existing house. The project is located at Pole No. 164. (Harveys Lake, PA Quadrangle N:  22.1 inches; W:  6.8 inches).

   E40-607. Jeffrey and Kathy Jean Barrett, 75 Hickory Street, Trucksville, PA 18708, in Harveys Lake Borough, Luzerne County, United States Army Corps of Engineers, Baltimore District.

   To construct and maintain a 1,200-square foot pile-supported residential dock structure in Harveys Lake (HQ-CWF). The proposed structure extends 50 feet from the shoreline and has an overall width of 30 feet, with areas of open water between the structure and the shoreline. The project is located on Lot No. 2 at Pole No. 288. (Harveys Lake, PA Quadrangle N:  18.3 inches; W:  6.1 inches).

   E01-236. Luther Mummert, Huntington Township, P. O. Box 247, York Springs, PA 17372 in Huntington Township, Adams County, ACOE Baltimore District.

   To remove two corrugated metal pipe culverts, construct and maintain two corrugated metal pipe culverts and repair an existing concrete pipe culvert all in an unnamed tributary to Bermudian Creek (WWF) (Biglerville, PA Quadrangle N:20.7 inches; W:  2.5 inches) in Huntington Township, Adams County. One of the corrugated metal pipe culverts and the concrete pipe culvert are authorized by General Permit No. 7.

   E22-442. John Payne, Dauphin County Commissioners, P. O. Box 1295, Harrisburg, PA 17108 in Washington Township, Dauphin County, ACOE Baltimore District

   To remove an existing covered timber bridge from its foundation and to:  (1) reconstruct and maintain the timber bridge in place using new timber members and to place R-6 rock riprap in a scour hole at the north corner of the west abutment in the Wiconisco Creek (WWF); and, to (2) construct a paved access drive and parking lot in the floodway of the Wiconisco Creek (WWF) all for the purpose of rehabilitating the Dauphin County Bridge No. 43A located on Henninger Road (T-j624) (Elizabethville, PA Quadrangle N:  14.0 inches; W:  4.7 inches) in Washington Township, Dauphin County.

   E08-396. Pennsylvania Department of Transportation, District 3-0, 715 Jordan Avenue, Montoursville, PA 17754. Bridge Construction, in Athens Township and Athens Borough, Bradford County, ACOE Baltimore District (Sayre, PA Quadrangle N:  15.1 inches; W:  2.1 inches).

   To remove the existing twin span riveted thru-truss bridge which has an open steel grid deck, normal clear span lengths of 290 feet and 253 feet for the west and east span, respectively, a minimum underclearance of 21.0 feet and a hydraulic opening of 15,071 square feet and to construct and maintain a five span prestressed concrete I-beam bridge with normal clear spans of 118.25 feet for the two end spans and 118.75 feet for the three interior spans with a hydraulic opening of 16,184 square feet and a minimum underclearance of 20.6 feet. The piers and abutments will be built normal to the roadway and at a 90° skew to the Susquehanna River and to construct a separate causeways constructed of clean rock material and 4 foot and 6 foot diameter pipes for existing bridge removal and new bridge construction. The bridge will span the Susquehanna River between Athens and East Athens on SR 1056, Section 001. The project will not impact wetlands while impacting about 130 feet of waterways. The Susquehanna River is a Warm Water Fisheries Stream.

   E59-435. Pennsylvania Department of Transportation, 715 Jordan Ave., Montoursville, PA 17754. Tributary to Hammond Creek Crossing, in Jackson Township, Tioga County, ACOE Baltimore District (Millerton, PA Quadrangle N:  21.5 inches; W:  11 inches).

   The application proposes to remove the existing R. C. slab bridge structure and replace it with a 10-foot by 9-foot reinforced concrete box culvert. The culvert is proposed to be depressed 1 foot below the natural streambed to allow for natural migration of aquatic life. This project proposes to impact 200 linear feet of an unnamed tributary to Hammond Creek which is designed as a cold water fishery channel and does not intend to impact any wetlands.

   E02-1390. New Community Church, 1000 Brooktree Road, Wexford, PA 15090. Pine Township, Allegheny County, ACOE Pittsburgh District.

   To construct and maintain 1,000 seat sanctuary and parking lot and their associated fill along the right bank side of the North Fork Pine Creek (CWF); to construct and maintain two stormwater outfalls to the North Fork Pine Creek; to construct and maintain an administrative building and parking lots and their associated fill along the left bank side of a tributary to the North Fork Pine Creek; to construct and maintain a single span bridge having a span of 80 feet and underclearance of 6 feet across the North Fork Pine Creek; to place and maintain fill in 0.21 acres of wetlands as part of the proposed construction of the New Community Church. The project is located in the southwest corner of the intersection of Wexford Bayne Road (SR 910) and Pearce Mill Road (SR 4063)(Mars, PA Quadrangle N:  0.3 inches; W:  3.7 inches).

   To remove the existing structure and to construct and maintain a precast concrete box beam bridge having a clear span of 48.7 feet and an underclearance of 7 feet on a 70° skew across Hadden Run on T-380 Clark Road approximately 250 feet south of SR 3011 Burrett Road.

   To remove the existing structure and to construct and maintain a precast concrete spread box beam bridge having a clear span of 48.2 feet and an underclearance of 16 feet on an 80° skew across Stump Creek on South Park Street approximately 1,000 feet south of SR 119.

   The Department of Environmental Protection (Department) has taken the following actions on previously received permit applications and requests for plan approval. The actions are listed in two categories. Section I lists all municipal and industrial permits and section II lists oil and gas related permits.

APPROVALS TO USE NPDES AND/OR OTHER GENERAL PERMITS

   The following parties have submitted:  (1) Notices of Intent (NOIs) for Coverage Under (1) General NPDES Permits to Discharge Wastewater into the Waters of the Commonwealth. The approval for coverage under these general NPDES permits is subject to applicable effluent limitations. Monitoring, reporting requirements and other conditions set forth in the general permit;  (2) General Permits for Beneficial Use of Sewage Sludge or Residential Septage by Land Application in Pennsylvania; (3) General NPDES Permit Authorizing the Discharge of Stormwater Associated with Construction Activities to Waters of the Commonwealth; (4) Notification for First Use Application of Sewage Sludge.

   The approval of coverage for land application of sewage sludge or residential septage under these general permits is subject to pollutant limitations, pathogen and vector attraction reduction requirements, operational standards, general requirements, management practices and other conditions set forth in the respective permit. The Department of Environmental Protection (Department) approves the following coverage under the specific General Permit.

   The EPA Region III Administrator has waived the right to review or object to this permit action under the waiver provision 40 CFR 123.23(d).

   The application and related documents, effluent limitations, permitting requirements and other information are on file and may be inspected and arrangements made for copying at the contact office noted.
