FEDERAL WATER POLLUTION CONTROL ACT, SECTION 401

   The following permit applications and requests for Environmental Assessment approval and requests for Water Quality Certification have been received by the Department of Environmental Protection (Department). Section 401 of the Federal Water Pollution Control Act (FWPCA) (33 U.S.C.A. § 1341(a)), requires the State to certify that the involved projects will not violate the applicable provisions of sections 301--303, 306 and 307 of the FWPCA (33 U.S.C.A. §§ 1311--1313, 1316 and 1317) as well as relevant State requirements. Initial requests for 401 Water Quality Certification will be published concurrently with the permit application. Persons objecting to approval of a request for certification under section 401 or to the issuance of a Dam Permit or Water Obstruction and Encroachment Permit, or the approval of an Environmental Assessment must submit comments, suggestions or objections within 30 days of the date of this notice as well as questions to the office noted before the application. Comments should contain the name, address and telephone number of the person commenting, identification of the certification request to which the comments or objections are addressed and a concise statement of comments, objections or suggestions including the relevant facts upon which they are based.

   The Department may conduct a fact-finding hearing or an informal conference in response to comments if deemed necessary. Each individual will be notified, in writing, of the time and place of a scheduled hearing or conference concerning the certification request to which the comment, objection or suggestion relates. Maps, drawings and other data pertinent to the certification request are available for inspection between the hours of 8 a.m. and 4 p.m. on each working day at the office noted before the application.

To place fill in 0.084 acre of wetland (PEM) for the purpose of expanding the existing National Can Building and to construct and maintain 320 linear feet of 8-inch DIP sanitary sewer line across wetlands. The site is located approximately 2,400 feet north of the intersection of Borden Town Road and New Ford Mill Road (Trenton West, NJ-PA, N:  6.3 inches; W:  2.5 inches).

The project is located adjacent to T-852 (Center Street) approximately 1,900 feet southeast of its intersection with SR 4007 (Main Street) (Slatedale, PA Quadrangle N:  20.9 inches; W:  1.0 inch).

   E48-331. Bethlehem Township, 4225 Easton Avenue, Bethlehem, PA 18020-1496, in Bethlehem Township, Northampton County, U. S. Army Corps of Engineers, Philadelphia District.

   To construct and maintain a 440 LF channel change in a tributary to Nancy Run (HQ-CWF) for the purpose of preventing flooding of an exercise path in Bethlehem Township Municipal Park. The project is located approximately 0.5 mile southeast of the intersection of SR 2020 (William Penn Highway) and SR 2011 (Farmersville Road) (Nazareth, PA Quadrangle N:  6.4 inches; W:  7.3 inches).

   E54-300. West Penn Township, R. R. 1, Box 100D, New Ringgold, PA 17960, in West Penn Township, Schuylkill County, U. S. Army Corps of Engineers, Philadelphia District.

   To remove the existing structure and to construct and maintain a bridge having a span of approximately 25 feet and an underclearance of approximately 4.4 feet across a tributary to Mahoning Creek (CWF). The project is located on Berry Road (T-954) approximately 0.5 mile south of its intersection with SR 3004 (Tamaqua, PA Quadrangle N:  5.3 inches; W:  13.1 inches).

   E45-438. Game Commission, 2001 Elmerton Avenue, Harrisburg, PA 17110-9797, in Coolbaugh Township, Monroe County, U. S. Army Corps of Engineers, Philadelphia District.

   To remove the existing structures and to construct and maintain a road crossing in Cross Keys Run (HQ-CWF), Fritz Run (HQ-CWF) and a tributary to Fritz Run (HQ-CWF) for the purpose of maintaining a restricted access road through State Game Lands No. 127. The projects are generally located southwest of SR 0380 (Tobyhanna, PA Quadrangle N:  14.4 inches; W:  14.4 inches).

   E54-302. Thomas J. McAndrew, 619 West Oak Street, Frackville, PA 17931, in West Mahoning Township, Schuylkill County, U. S. Army Corps of Engineers, Philadelphia District.

   To place fill in a 0.13 acre of PEM wetland for the purpose of constructing a new facility for a business known as T. J. McAndrew Excavating and Hauling. The project is located in the Frackville Industrial Park--Lot 4 at the end of Firemens Road (Shenandoah, PA Quadrangle N:  5.0 inches; W:  10.8 inches).

   E40-613. Department of General Services, Bureau of Engineering and Architecture, 18th and Herr Streets, Harrisburg, PA 17125, in Dupont Borough, Luzerne County, U. S. Army Corps of Engineers, Baltimore District.

   To maintain the existing concrete trapezoidal channel and to construct and maintain new sections of rectangular concrete channel and concrete box culvert stream enclosure, within a 3,000-foot reach of Mill Creek (CWF) and a 200-foot reach of Collins Creek (CWF), for the purpose of flood control. Work within the upper 1,880 linear feet of channel will include rehabilitation of joints, removal and replacement of a 187-foot section with a concrete rectangular section and replacement of a damaged 255-foot section. The project will tie into the SR 2035 structure as proposed for replacement under application E40-603 by the Department of Transportation. Continuing downstream from SR 0315 north, work will include construction of 358 feet of rectangular concrete channel to replace the existing gavian-walled channel section, construction of 495 feet of concrete box culvert stream enclosure and abandonment of the existing masonry culvert and resurfacing the invert of the existing SR 0315 south bridge. A rectangular concrete channel will be constructed in Collins Creek, extending 163 feet from the existing SR 0315 north structure to the confluence with Mill Creek. The project (known as Project No. DGS 184-23, Phase II, Unit II) extends from SR 0081 downstream to SR 0315 South (Avoca, PA Quadrangle N:  12.6 inches; W:  17.0 inches).

   E45-439. Arrowhead Lake Community Association, Inc., H.C. 88, Box 305, Pocono Lake, PA 18347, in Coolbaugh and Tobyhanna Townships, Monroe County, U. S. Army Corps of Engineers, Philadelphia District.

   To dredge the Eastern Cove and Lewis Creek Cove areas within Arrowhead Lake (HQ-CWF) for the purpose of constructing approximately 6,540 L.F. of navigation channels to improve boat access to the main portions of the lake. The project also includes a channel change and bank stabilization work in and along Lewis Creek at the southern end of Lewis Creek Cove. The project is located at Arrowhead Lake, approximately 0.3 mile north of SR 4003 (Thornhurst, PA Quadrangle N:  3.9 inches; W:  9.3 inches).

   E39-415. Robert Susko, 1664 Penns Crossing, Allentown, PA 18104, in City of Allentown, Lehigh County, U. S. Army Corps of Engineers, Philadelphia District.

   To construct and maintain a 27-inch diameter concrete outfall structure with a rip-rap apron in the floodway of Little Lehigh Creek (HQ-CWF) associated with a residential subdivision known as Estates at Fish Hatchery. The project is located adjacent to Fish Hatchery Road (SR 2010) approximately 0.75 mile east of its intersection with SR 0029 (Allentown West, PA Quadrangle N:  11.9 inches; W:  0.6 inch).

   E35-363. Master Halco, Inc., 1275 Keyser Avenue, Scranton, PA 18504, in City of Scranton, Lackawanna County, U. S. Army Corps of Engineers, Baltimore District.

   To remove the existing structure and to construct and maintain the upstream portion of a 327-foot long stream enclosure consisting of 212 feet of a 9 foot 4 inch by 6 foot 3 inch corrugated metal pipe arch and 90 feet of 10-foot by 4-foot concrete box culvert connected by a 25-foot long concrete transition structure in a tributary to Keyser Creek (CWF). The upstream portion consists of the corrugated metal pipe arch. The project is located adjacent to SR 3011 (Keyser Avenue) approximately 0.55 mile south of its intersection with SR 0307 (Morgan Highway) (Scranton, PA Quadrangle N:  11.5 inches; W:  7.8 inches).

   E35-364. Pennsylvania Department of Transportation, Engineering District 4-0, P. O. Box 111, Scranton, PA 18501, in City of Scranton, Lackawanna County, U. S. Army Corps of Engineers, Baltimore District.

   To remove the existing structure and to construct and maintain the downstream portion of a 327-foot long stream enclosure consisting of 212 feet of a 9 foot 4 inch by 6 foot 3 inch corrugated metal pipe arch and 90 feet of 10 foot by 4 foot concrete box culvert connected by a 25-foot long concrete transition structure in a tributary to Keyser Creek (CWF). The downstream portion consists of the concrete box culvert and transition structure. The project is located on SR 3011 (Keyser Avenue) approximately 0.55 mile south of its intersection with SR 0307 (Morgan Highway) (Scranton, PA Quadrangle N:  11.4 inches; W:  7.4 inches).

   E05-306. Pennsylvania Department of Transportation, District 9-0, 1620 N. Juniata Street, Hollidaysburg, PA 16648 in Juniata Township, Bedford County, ACOE Baltimore District.

   To remove the existing bridge and to construct and maintain a prestressed concert bridge having a clear span of 48.5 feet with a minimum underclearance of 4.26 feet across Kegg Run (WWF) on SR 3039 Section 018 Segment 0180 Offset 2141 located about 1.3 miles north of North Buena Vista Village (Schellsburg, PA Quadrangle N:  5.0 inches; W:  10.2 inches) in Juniata Township, Bedford County.

   E06-579. Jeffrey Smallman, Pennsylvania Department of Transportation, District 5-0, 1713 Lehigh Street, Allentown, PA 18103 in Hamburg Borough and Windsor Township, Berks County, ACOE Philadelphia District.

   To:  (1) rehabilitate and maintain the bridge over the Schuylkill River (WWF) on SR 0078 Section 17M and to relocate, regrade and maintain an unnamed tributary to Schuylkill River having an overall length of 840 feet; (2) fill in 0.004 acre of wetland; and (3) construct and maintain a 60-inch diameter culvert and several 18-inch diameter culverts by General Permit No. 7, all for the purpose of improving SR 0078. The improvement starts from the bridge and extends to about 3 miles towards the east (Hamburg, PA Quadrangle N:  11.0 inches; W:  15.9 inches; N:  12.9 inches; W:  15.6 inches, N:  14.0 inches; W:  13.5 inches respectively) in Hamburg Borough and Windsor Township, Berks County. Wetland impact is de minimis and mitigation is not required.

   E28-308. Thomas Beddard, Lady Moon Farms Inc., 1795 Criders Church Rd., Chambersburg PA 17201 in St. Thomas Township, Franklin County, ACOE Baltimore District.

   To maintain a 12-foot by 14-foot pump house perched on fill material in the floodway of Dennis Creek (CWF) located approximately 850 feet upstream from its confluence with Back Creek (Chambersburg, PA Quadrangle N:  13.15 inches; W:  16.2 inches) in St. Thomas Township, Franklin County.

   E67-728. Dennis McWilliams, 8495 Reynolds Mill Road, Seven Valleys, PA 17360 in North Hopewell and Chanceford Townships, York County, ACOE Baltimore District.

   To construct and maintain a 12-foot wide by 189-foot long five-pier bridge across the North Branch of Muddy Creek (CWF) located downstream of the confluence of Pine Run (Stewartstown, PA Quadrangle N:  18.1 inches; W:  8.35 inches) in North Hopewell and Chanceford Townships, York County.

   E17-375. City of DuBois, P. O. Box 408, DuBois, PA 15801. City of DuBois municipal wastewater collection and treatment facility in Sandy Township, Clearfield County, ACOE Pittsburgh District (Falls Creek, PA Quadrangle N:  0.8 inch; W:  3.6 inches).

   To place and maintain fill in 0.007 acre of wetlands; modify, operate and maintain an existing wastewater treatment facility located within the 100-year floodplain of the Sandy Lick Creek for the treatment of municipal wastewater; and construct, operate and maintain an outfall structure along Sandy Lick Creek (CWF) for the discharge of municipal sewage. Modifications to the wastewater treatment facility shall consist of constructing a 24-inch diameter overflow sewer line, an overflow pumping station, an outfall structure and a 2 million gallon flow equalization basin for the abatement of sewage bypasses. The project will permanently impact 0.007 acre of wetland and 15 feet of waterway while temporarily impacting 0.026 acre of wetland. The project is located along the western right-of-way of SR 0219 approximately 2,700 feet west of SR 4019 and SR 0219 intersection.

   Southwest Region: Water Management Program Manager, 400 Waterfront Drive, Pittsburgh, PA 15222-4745.

   E02-1405. Shipley Brothers Development, Inc., 12300 Perry Highway, Suite 211, Wexford, PA 15090. Pine Township, Allegheny County, ACOE Pittsburgh District.

   To construct and maintain a wood roadway bridge across a tributary to Breakneck Creek (WWF); to construct and maintain two trail crossings across the same stream; to construct and maintain three boat mooring facilities, a boat house and two boardwalks on and over Lake MacLeod located in a tributary to Breakneck Creek; and to place and maintain fill in 0.29 acre of wetlands for a proposed 75 lot residential development known as MacLeod Pan of Lots. To meet the wetland replacement requirements, the applicant proposes to pay into the wetland replacement fund. The applicant also proposes to culvert approximately 1,110 feet of stream channels; these channels qualify for authorization under the Department's waiver 105.12(a)(2). The project is located on the northwest side of Babcock Boulevard approximately 0.6 mile west of its intersection with Valencia Road (Mars, PA Quadrangle N:  7.7 inches; W:  0.7 inch).

   E02-1407. Pennsylvania Department of Engineering, District 11-0, 45 Thoms Run Road, Bridgeville, PA 15107-2853. McCandless Township, Allegheny County, ACOE Pittsburgh District.

   To operate and maintain an existing 96 inch by 110 inch arch culvert approximately 280 feet long in Little Pine Creek (CWF) and to construct and maintain a 96 inch by 144 inch Conspan Arch Culvert extension for a distance of 48 feet to the upstream end of the existing arch culvert for the purpose of widening McKnight Road. The project is located on the west side of McKnight Road approximately 1 mile north of its intersection with Peebles Road (Emsworth, PA Quadrangle N:  12.1 inches; W:  3.5 inches).

INDUSTRIAL WASTE AND SEWERAGE WASTEWATER

   The Department of Environmental Protection has taken the following actions on previously received permit applications and requests for plan approval.

   Persons aggrieved by an action may appeal, under section 4 of the Environmental Hearing Board Act (35 P. S. § 7514) and 2 Pa.C.S. §§ 501--508 and 701--704 (relating to the Administrative Agency Law), to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, 400 Market Street, P. O. Box 8457, Harrisburg, PA 17105-8457, (717) 787-3483. TDD users may contact the Environmental Hearing Board (Board) through the Pennsylvania Relay Service, (800) 654-5984. Appeals must be filed with the Board within 30 days of publication of this notice in the Pennsylvania Bulletin, unless the appropriate statute provides a different time period. Copies of the appeal form and the Board's rules of practice and procedure may be obtained from the Board. The appeal form and the Board's rules of practice and procedure are also available in Braille or on audiotape from the Secretary to the Board at (717) 787-3483.    Description of Proposed Action/Activity: Renewal of NPDES permit.

   NPDES Permit No. PA0060194, Sewage, Blue Ridge School District, R. R. 3, Box 220, New Milford, PA 18834-9503. This proposed facility is located in New Milford Township, Susquehanna County.

   Description of Proposed Action/Activity: Renewal of NPDES Permit to discharge 0.026 mgd to Beaver Creek.

   NPDES Permit No. PA0023469, Sewage, Honesdale Borough, 958 Main Street, Honesdale, PA 18431-1926. This proposed facility is located in Texas Township, Wayne County.

   Description of Proposed Action/Activity: Renewal of permit to discharge treated sewage to Lackawaxen River.

   WQM Permit No. 6402402, Sewerage, Waymart Area Authority, P. O. Box 3300, Waymart, PA 18472. This proposed facility is located in Waymart Borough and Canaan Township, Wayne County.

   Description of Proposed Action/Activity: Permit approval for the construction of sewage treatment plant upgrade and sewer extension and outfall structure.

   NPDES Permit No. PA0043257, Sewage, New Freedom Borough Authority, 49 East Main Street, New Freedom, PA 17349. This proposed facility is located in Railroad Borough, York County.

   Description of Proposed Action/Activity: Authorization to discharge to South Branch Codorus Creek in Watershed 7-H.

   NPDES Permit No. PA0080713, Sewage, Pennsy Supply, Inc., One Clearspring Road, Annville, PA 17003. This proposed facility is located in North Londonderry Township, Lebanon County.

   Description of Proposed Action/Activity: Authorization to discharge to Killinger Creek in Watershed 7-D.

   NPDES Permit No. PA0088480 and WQM Permit No. 0102401, Sewage, Double L Partner's, 982 Bollinger Road, Littlestown, PA 17340. This proposed facility is located in Mount Pleasant Township, Adams County.

   Description of Proposed Action/Activity: Authorization to discharge to UNT South Branch Codorus Creek in Watershed 7-F and construction of new extended aeration package treatment plant to serve the Centennial Meadows development.

   WQM Permit No. 2202401, Sewerage, West Hanover Township Water and Sewer Authority, 7901 Jonestown Road, Harrisburg, PA 17112-9728. This proposed facility is located in West Hanover Township, Dauphin County.

   Description of Proposed Action/Activity: Construction/operation of gravity sewers and pump station to serve the Sandy Hollow Road area.

   WQM Permit No. 2897402, Sewage, Sean and Monique White, 8835 Iron Bridge Road, Chambersburg, PA 17201. This proposed facility is located in Letterkenny Township, Franklin County.

   Description of Proposed Action/Activity: Transfer of permit.

   NPDES Permit No. PA0008265, Industrial Waste, Appleton Papers, Inc., 100 Paper Mill Road, Roaring Springs, PA 16673-1488. This proposed facility is located in Blair Township, Blair County.

   Description of Proposed Action/Activity: Permit amendment.

   WQM Permit No. 0602202, Industrial Waste, Cambridge-Lee Industries, Inc., Reading Tube Division, P. O. Box 14026, Reading, PA 19612. This proposed facility is located in Ontelaunee Township, Berks County.

   Description of Proposed Action/Activity: Construction/operation of a 8,100-square foot vegetated wetland treatment system. The constructed wetland will be 45 feet by 180 feet.

   Northcentral Region: Water Management Program Manager, 208 West Third Street, Williamsport, PA 17701.

   PA0228508, Sewage, SIC 4952, Huston Township Authority, P. O. Box 40, Julian, PA 16844. This proposed facility will be located in Huston Township, Centre County.

   Description of Proposed Activity: Issuance of an NPDES discharge permit for the sewage treatment facility to serve the Village of Julian. Treatment will consist of an activated sludge system and the discharge will be to Bald Eagle Creek. It was incorrectly reported, in the application received notice published at 32 Pa.B. 4500 (September 14, 2002), that the associated treatment facility would serve the Village of Mazzepa.

   NPDES Permit No. PA0020273, SIC 4952, Milton Regional Sewer Authority, P. O. Box 150, Milton, PA 17847. This facility is located in West Chillisquaque Township, Northumberland County.

   Description of Proposed Action/Activity: Renewal of a NPDES permit for the discharge of 3.42 MGD of treated sewage and food processing wastewater to the West Branch Susquehanna River from a municipal wastewater treatment facility. The public notice of the draft permit published at 32 Pa.B. 3706 (August 3, 2002) incorrectly listed the effluent on BOD5, adjusted for the cotreatment of food processing wastes, as CBOD5.

   NPDES Permit No. PA0020699, SIC 4952, Montgomery Water and Sewer Authority, 35 South Main Street, Montgomery, PA 17752-0125. This facility is located in Montgomery Borough, Lycoming County.

   Description of Proposed Action/Activity: Renewal of a NPDES permit for municipal wastewater treatment facilities.

   NPDES Permit No. PA0027553, Sewerage SIC 4952, Pine Creek Municipal Authority, P. O. Box 608, Avis, PA 17721. This existing facility is located in Pine Creek Township, Clinton County.

   Description of Proposed Action/Activity: Renewal of NPDES Permit for the discharge of 1.3 million gallons per day of treated sewage to the West Branch Susquehanna River.

   NPDES Permit No. PA0021687, Sewage, SIC 4952, Wellsboro Municipal Authority, 28 Crafton Street, Wellsboro, PA 16901. This existing facility is located in the Wellsboro Borough, Tioga County.

   Description of Proposed Activity: Renewal of Major NPDES Permit for the Wellsboro Municipal Authority Sewage Treatment Plant. The discharge of treated effluent is to Marsh Creek.

   Southwest Region: Water Management Program Manager, 400 Waterfront Drive, Pittsburgh, PA 15222-4745.

   NPDES Permit No. PA0217620, Sewage, Consol Pennsylvania Coal Company, P. O. Box 355, Eighty Four, PA 15330 is authorized to discharge from a facility located at Crabapple Portal Sewage Treatment Plant, Rich Hill Township, Greene County to receiving waters named Crabapple Creek.

   NPDES Permit No. PA0219274, Sewage, Adelphoi, Inc., Paschal Center, 352 Main Street, Latrobe, PA 15650 is authorized to discharge from a facility located at Greystone House STP, Jenner Township, Somerset County to receiving waters named Coal Run.

   Northwest Region: Water Management Program Manager, 230 Chestnut Street, Meadville, PA 16335-3481.

APPROVALS TO USE NPDES AND/OR OTHER GENERAL PERMITS

   The following parties have submitted: (1) Notices of Intent for Coverage under (1) General NPDES Permits to Discharge Wastewater into the Waters of the Commonwealth. The approval for coverage under these general NPDES permits is subject to applicable effluent limitations. Monitoring, reporting requirements and other conditions set forth in the general permit: (2) General Permits for Beneficial Use of Sewage Sludge or Residential Septage by Land Application in Pennsylvania; (3) General NPDES Permit Authorizing the Discharge of Stormwater Associated with Construction Activities to Waters of the Commonwealth; (4) Notification for First Use Application of Sewage Sludge.

   The approval of coverage for land application of sewage sludge or residential septage under these general permits is subject to pollutant limitations, pathogen and vector attraction reduction requirements, operational standards, general requirements, management practices and other conditions set forth in the respective permit. The Department of Environmental Protection approves the following coverage under the specific General Permit.

   The EPA Region III Administrator has waived the right to review or object to this permit action under the waiver provision 40 CFR 123.23(d).

   The application and related documents, effluent limitations, permitting requirements and other information are on file and may be inspected and arrangements made for copying at the contact office noted.
