   46-00031:  SmithKline Beecham d/b/a GlaxoSmithKline (1250 South Collegeville Road, Collegeville, PA 19426) for an administrative amendment to Title V Operating Permit 46-00031 in Upper Providence Township, Montgomery County. The previously issued permit has been amended to address the following concerns expressed in an appeal:  (1) schedule of submission for the ''reporting of deviations'' and the Compliance Certification; (2) boilers--monitoring and recordkeeping frequency and the reporting frequency from quarterly to semiannually to comply with the revised 40 CFR 60.48c; and (3) revise monitoring and recordkeeping technique for the coolant/holding reservoir tank. The changes do not result in an increase of emissions.

   46-00035:  SmithKline Beecham d/b/a GlaxoSmithKline (709 Swedeland Road, King of Prussia, PA 19406) for an administrative amendment to Title V Operating Permit 46-00035 in Upper Merion Township, Montgomery County. The previously issued permit is being amended to incorporate following concerns in an appeal:  (1) name change; (2) removal of Sources Nos. 035, 036, 040 and 041, Boilers Nos. 7, 8, 12 and 13, Source C01, various type condensers and Source 105, Pilot Laboratory; (3) establish a schedule of submission for the ''reporting of deviations'' and the Compliance certifications; (4) monitoring and recordkeeping frequency of the boilers and emergency generators; and (5) incorporate the amendments of Operating Permits 46-313-114 and 46-399-093. The permit was also modified for:  (1) RFD No. 46-A01-1919--the modification of an acid gas scrubber for the Source 200; and (2) RFD No. 46-A01-1917--the modification of the general exhaust system in building 29. The changes do not result in an increase of emissions.

   09-00076:  Cartex Corp. (200 Rock Run Road, Fairless Hills, PA 19030) for an administrative amendment to Title V Operating Permit 09-00076 in Falls Township, Bucks County. The previously issued permit is being amended to incorporate the following conditions from Plan Approval 09-399-040A for Source 101, Urethane Foam Manufacturing:  (1) emissions of particulate matter shall be controlled by an existing filtration system that has at least an 80% removal efficiency; (2) particulate matter shall be limited to 0.6 lb/hr and 2 tons in a 12 month rolling period; and (3) the company shall submit a report every calendar year for the next 5 years detailing the progress of the lower VOC content mold release agent research program. The changes do not result in an increase of emissions.

   1.  To reroute 300 feet of an unnamed intermittent tributary to Manataway Creek (CWF) through a stormwater conduit.

   4.  To eliminate 580 linear feet of drainage channel along the east side of the proposed Hummingbird Lane.

   This permit also includes an Environmental Assessment approval for the construction of two on-stream nonjurisdictional dams impacting 140 linear feet of unnamed intermittent tributaries to Manataway Creek (CWF). The permittee has met the wetland replacement requirement by participating in the Commonwealth wetland replacement project for the 0.07 acre if wetland impact.

   To relocate and maintain 540 feet of the Hermesprota Creek (WWF) for the purpose of the construction of a shopping center consisting of four buildings, parking areas, storm sewer system and underground stormwater detention basins. The relocation will consist of 245 linear feet of earthen trapezoidal channel with 3:1 side slopes and continue into 195 linear feet of concrete rectangular channel with concrete walls on either side ranging from 7 feet to 12 feet in height. The channel will then be conveyed through a 59-foot long, 20-foot by 8-foot concrete arch culvert, which will ultimately tie into the existing 8-foot by 6-foot MacDade Boulevard arch culvert crossing with a junction box. The proposed channel relocation is located 200 feet northeast of the intersection of Oak Lane and MacDade Boulevard (Lansdowne, PA Quadrangle; N:  6.0 inches; and W:  5.0 inches).

   3.  To realign approximately 350 feet of the channel of Mill Creek extending upstream from Glenwood Park Avenue.

   4.  To construct and maintain a 60-inch diameter stormwater outfall pipe along the right bank of the relocated channel of Mill Creek between West 38th Street and Glenwood Park Avenue.

BUREAU OF DEEP MINE SAFETY

Request for Variance

   The Department of Environmental Protection (Department), Bureau of Deep Mine Safety (Bureau), has received a request for variance from DLR Mining, Inc. The following notification contains a summary of this request. A complete copy of the variance request may be obtained from Allison Gaida by calling (724) 439-7469 or from the Bureau website at http://www.dep.state.pa.us/dep/deputate/minres/dms/dms.htm.

   The Department is publishing a summary of the request to solicit comments from affected parties on the proposed variance request. Comments may be used by the Bureau to assist in its investigation of the variance request. Comments will be accepted for 30 days following the publication of this notice. Comments should be addressed to Paul L. Hummel, Acting Director, Bureau of Deep Mine Safety, Fayette County Health Center, 100 New Salem Road, Room 167, Uniontown, PA 15401.

   Section 702 of the Bituminous Coal Mine Act (act) provides a mechanism for operators to obtain variances from specific requirements of the act to accommodate the adoption of new machinery, equipment, tools, supplies, methods or processes.

   Section 224(b) of the act and the Governor's Administrative Order dated August 30, 2002, provides drilling procedures for any working place in a mine that approaches within 50 feet of abandoned workings certified by an engineer or within 200 feet of any abandoned workings which cannot be inspected or within 200 feet of any other abandoned workings that have been identified by ''hard or credible evidence'' or within 500 feet of abandoned mine workings that have not been located by ''hard or credible'' evidence. Exploratory boreholes shall be drilled at least 20 feet in advance of the face of the working place. Boreholes shall be drilled sufficiently close to each other to insure that the advancing face will not accidentally hole through into the workings. Boreholes shall also be drilled not more than 8 feet apart in the rib of the working place to a distance of at least 20 feet at an angle of 45 degrees. Rib holes shall be drilled in one or both ribs of the working place as may be necessary for adequate protection of persons working in the place.

   Summary of the Request:  DLR Mining, Inc., Ridge Mine requested a variance from section 224(b) of the act to drill in advance of mining when the operator approaches to within 200 feet of an abandoned mine or within 500 feet of an abandoned mine.
