FEDERAL WATER POLLUTION CONTROL ACT SECTION 401

   The Department of Environmental Protection (Department) has taken the following actions on previously received permit applications, requests for Environmental Assessment approval and requests for Water Quality Certification under section 401 of the Federal Water Pollution Control Act (FWPCA) (33 U.S.C.A. § 1341(a)).

   Except as otherwise noted, the Department certifies that the construction and operation herein described will comply with the applicable provisions of sections 301--303, 306 and 307 of the FWPCA (33 U.S.C.A. §§ 1311--1313, 1316 and 1317) and that the construction will not violate applicable Federal and State Water Quality Standards.

   Persons aggrieved by these actions may appeal, under section 4 of the Environmental Hearing Board Act (35 P. S. § 7514) and 2 Pa.C.S. §§ 501--508 and 701--704 (relating to the Administrative Agency Law), to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, 400 Market Street, P. O. Box 8457, Harrisburg, PA 17105-8457, (717) 787-3483. TDD users may contact the Environmental Hearing Board (Board) through the Pennsylvania Relay Service, (800) 654-5984. Appeals must be filed with the Board within 30 days of publication of this notice in the Pennsylvania Bulletin, unless the appropriate statute provides a different time period. Copies of the appeal form and the Board's rules of practice and procedure may be obtained from the Board. The appeal form and the Board's rules of practice and procedure are also available in Braille or on audiotape from the Secretary to the Board at (717) 787-3483. This paragraph does not, in and of itself, create any right of appeal beyond that permitted by applicable statutes and decisional law.

   For individuals who wish to challenge this action, appeals must reach the Board within 30 days. A lawyer is not needed to file an appeal with the Board.

   To relocate approximately 2,700 linear feet of an intermittent segment of Plymouth Creek (WWF) and associated flood plain and to construct and maintain approximately 2,140 linear foot of new channel associated with the proposed Blue Route Industrial Center. This site is located approximately 5,000 feet southwest from the intersection of Ridge Pike and Alanwood Road (Norristown, PA Quadrangle; beginning at N:  16.35 inches; W:  8.7 inches and ending at N:  15.0 inches; W:  8.6 inches).

   To remove the existing culverts and to construct and maintain a stream enclosure of a tributary to Spring Run, consisting of approximately 570 linear feet of 64-inch by 43-inch steel pipe arch. The project is located in the Georgetown section, north of S.R. 0081, between Hemlock Street and New Street (Wilkes-Barre East, PA Quadrangle N:  19.3 inches; W:  16.4 inches).

   E40-564. Richard Angelicola, 180 Wellington Drive, Shavertown, PA 18708. Harveys Lake Borough, Luzerne County, Army Corps of Engineers Baltimore District.

   To remove the existing structures and to construct and maintain two pile-supported structures in Harveys Lake. The structures (30` x 38` x 58` by 38`) will each be connected to the shore with a 6-foot-wide walkway and will extend approximately 50 feet lakeward from the shoreline. The structures and associated walkways will have a total areal coverage of approximately 3,490 square feet. The project includes the placement of 5 inches of gravel on the lake bed, within an area extending approximately 15 feet lakeward from the low water mark and approximately 130 feet along the shoreline, to provide shallow water habitat mitigation. The project is located along Lakeside Drive (S.R. 0415), between Poles 156 and 157 (Harveys Lake, PA Quadrangle N:  22.3 inches; W:  6.6 inches).

   E40-559. Michael Fort, 37 North Washington Street, Wilkes-Barre, PA 18701. Hanover Township, Luzerne County, Army Corps of Engineers Baltimore District.

   To place fill in a 0.13-acre wetland in order to develop a 1.18-acre residential building lot identified as Lot No. 4 in the proposed Clifton Court Residential Subdivision. The project is located approximately 0.6 mile north of the intersection of Ashley Street and Middle Road (Wilkes-Barre West, PA Quadrangle N:  16.3 inches; W:  9.7 inches).

   E35-344. Game Commission, 2001 Elmerton Avenue, Harrisburg, PA 17110-9797. Clifton Township, Lackawanna County, Army Corps of Engineers Philadelphia District.

   To construct and maintain the following:  (1) a low-flow crossing consisting of a 48-inch diameter corrugated metal pipe depressed 12-inches below stream bed elevation and a 49-inch x 33-inch corrugated metal arch pipe across Mash Creek; (2) a low-flow crossing consisting of a 30-inch diameter corrugated metal pipe depressed 6-inches below stream bed elevation and a 35-inch x 24-inch corrugated metal arch pipe across Ash Creek; (3) a low-flow crossing consisting of a 24-inch diameter corrugated metal pipe across a tributary to Ash Creek; and (4) a low-flow crossing consisting of a 24-inch diameter corrugated metal pipe across a second tributary to Ash Creek. The crossings will be constructed as part of a haul road for timber harvesting operations and will become a permanent part of the Game Commission's road system. The project is located on State Game Land No. 135, approximately 8,500 feet northwest of the intersection of S.R. 2013 and S.R. 2017 (Thornhurst, PA Quadrangle N:  22.6 inches; W:  8.5 inches).

   E48-304. Moore Township, 2491 Community Drive, Bath, PA 18014. Moore Township, Northampton County, Army Corps of Engineers Philadelphia District.

   To remove the existing structure and to construct and maintain a 117-inch x 79-inch aluminized steel arch culvert in a tributary to Hokendauqua Creek, including a 60-foot long wingwall along the western stream bank for the purpose of directing floodflows through the culvert. The project is located along Township Road T565 (South Oaks Road), approximately 0.4 mile east of S.R. 4005 (Kunkletown, PA Quadrangle N:  3.9 inches; W:  10.7 inches).

   Southcentral Region:  Water Management Program Manager, 909 Elmerton Avenue, Harrisburg, PA 17110.

   E01-226. Hamilton Township, 272 Mummerts Church Road, Abbottstown, PA 17301 in Hamilton Township, Adams County, ACOE Baltimore District

   To construct and maintain 20,000 feet of gravity sewer main, 10,000 feet of sanitary force main and three pump stations in the floodway of tributaries to South Branch Conewago Creek (WWF) which will permanently impact 0.04 acre of palustrine emergent wetlands (Hampton, PA Quadrangle N:  22.4 inches; W:  4.9 inches) in Hamilton Township, Adams County. The amount of wetland impact is considered a de minimis impact of 0.04 acre and wetland mitigation is not required.

   E34-095. Excel Homes, Incorporated, R. R. 2 Box 682, Liverpool, PA 17045 in Susquehanna Township, Dauphin County, ACOE Baltimore District

   To place fill in 0.45 acre of wetlands within the floodplain of the Susquehanna River (WWF) for the purpose of constructing a private driveway and to increase the size of a staging area located along the north side of Routes 11 and 15 and approximately 0.38 mile south of Routes 11 and 15 crossing Mahantango Creek (Dalmatia, PA Quadrangle N:  2.3 inches; W:  10.0 inches) in Susquehanna Township, Dauphin County. The permittee is required to provide 0.45 acre of replacement wetlands.

   E36-715. Bart Township, 46 Quarry Road, Quarryville, PA 17566 in Bart Township, Lancaster County, ACOE Baltimore District

   To relocate about 180 feet of the Meetinghouse Creek (CWF) channel and to construct and maintain a box culvert having a span of 19 feet with an underclearance of 6 feet on Haita Road located about 4,000 feet southwest of Georgetown Village (Gap, PA Quadrangle N:  9.5 inches; W:  12.68 inches) in Bart Township, Lancaster County.

   E67-709. Texas Eastern Products Pipeline Company, 71-73 Denison Parkway, Corning, NY 14830 in Lower Allen Township and Fairview Townships, Cumberland and York Counties, ACOE Baltimore District

   To remove an existing 6-inch diameter petroleum products pipeline and to construct a new 6-inch diameter petroleum products pipeline under the bed of the Yellow Breeches Creek (CWF), about 5 feet to the south of the existing pipe, at a location approximately 1,000 feet northeast of Saint Johns Road crossing of the creek (Lemoyne, PA Quadrangle N:  14.5 inches; W:  6.85 inches) in Lower Allen Township and Fairview Townships, Cumberland and York Counties.

   Northcentral Region:  Water Management Program Manager, 208 West Third Street, Williamsport, PA 17701.

   E08-384. Pennsylvania Department of Transportation, District 3-0, 715 Jordan Ave., Montoursville, PA 17754 Bridge Replacement in Towanda Township, Bradford County. ACOE Baltimore District (Monroeton, PA Quadrangle N:  21.00 inches; W:  8.13 inches).

   To remove the existing through-truss one lane bridge which has a clear span of 181 feet and an out-to-out width of 18 feet and to construct and maintain a twin span composite prestressed I-beam bridge with a span between abutments of 249 feet, a normal span of 120 feet, an underclearance of 21.4 feet on a skew of 75 degrees over Towanda Creek on SR 2024, Section 0001 and to construct a temporary stream crossing approximately 300 feet northwest of the intersection of SR 2024 with Tip Top Road.

   E08-385. Martha D. Young, R. R. 1, Box 30, LeRaysville, PA 18829. Building in Floodway, in Pike Township, Bradford County, ACOE Baltimore District (LeRaysville, PA Quadrangle N:  16.7 inches; W:  5.7 inches).

   To construct and maintain a barn 100` by 85` with a peripheral 15' wide concrete pad and berm on an average of 31/2 feet of placed fill. Approximately 1/3 of the structure and pad will be located in the nondelineated 50' floodway of Ford Street Creek on the north side of SR 1026 approximately one mile east of LeRaysville in Pike Township, Bradford County. This permit was issued under §  105.13(e) ''Small Projects.''

   E14-402. George Khoury, Pennsylvania Department of Transportation, District 2-0, 1924-30 Daisy, Clearfield, PA 16830. SR 6220 Improvements (A11), in Worth Township, Centre County, ACOE Baltimore District (Port Matilda, PA Quadrangle N:  10.85 inches; W:  8.35 inches).

   This project includes construction of 2.6 miles of a new four-lane, divided, limited access highway west of State College in Centre County, PA (S.R. 6220). Section A11 is located in Worth Township. This project proposes to construct and maintain the following:

   4.  Structure 218, twin 14-foot wide by 6-foot high precast concrete box culverts with the associated R-7 riprap in Oliver Run under Laurel Run Road (T-313) at latitude 40° 48` 42" and longitude 78° 04` 21".

   5.  Structures 219 (eastbound) and 220 (westbound), two parallel concrete bridges across Oliver Run for S.R. 0322, Sta. 67+90 at latitude 40° 48` 41" and longitude 78° 04` 18".

   a)  Two temporary stream crossings during the construction of Structures 218, 219 and 220:  1) Temporary stream crossing #1, six 48-inch diameter pipes and associated R-6 rock fill in Oliver Run at latitude 40° 48` 41" and longitude 78° 04` 18", 2) Temporary stream crossing #2, five 36-inch pipes and associated R-7 rock fill in Oliver Run at latitude 40° 48` 38" and longitude 78° 04` 04".

   6.  Culvert #2, a 60-inch diameter 265-foot long reinforced concrete pipe (RCP) and the associated fill to convey an unnamed tributary to Oliver Run under S.R. 0322, Sta. 83+30 at latitude 40° 48` 43" and longitude 78° 04` 01".

   a)  135 feet of existing channel is to be relocated approximately 30 feet to the left of its present alignment and turned into a trapezoidal R-5 riprapped lined channel to Oliver Run.

   b)  A temporary bypass enclosure system comprised of a 365-foot long 60-inch diameter corrugated metal pipe with its associated earthen diversion dam and a 17.3-foot long by 13.0 foot wide concrete USBR Type VI energy-dissipating hanging baffle to pass stream water from the unnamed tributary to Oliver Run around the Culvert #1's construction area.

   7.  Culverts #3, a 36-inch diameter 390-foot long culvert that is designed to convey an unnamed tributary to Oliver Run under the proposed SR 0322 EB at Sta. 94+76 at latitude 40° 48` 38" and longitude 78° 03` 48".

   8.  Culverts #4, a 24-inch diameter 375-foot long culvert that is designed to convey an unnamed tributary to Oliver Run under the proposed SR 0322 EB at Sta. 104+03 at latitude 40° 48` 35" and longitude 78° 03' 38".

   9.  Culverts #6, a 60-inch diameter 965-foot long culvert that is designed to convey an unnamed tributary to Laurel Run under the proposed SR 0622 NB at Sta. 610+03 at 40° 48` 33" and longitude 78° 03` 22".

   10.  Bridge #211, a concrete bridge and associated storm drain system designed to convey an unnamed tributary to Zendt Hollow Run for the proposed SR 0622 NB at Sta. 623+00 at 40° 48` 37" and longitude 78° 03` 38".

   12.  Construct and maintain a 767-foot relocated applied fluvial geomorphological designed reach of Oliver Run, called Oliver I and IA, near S.R. 0322 WB, Sta. 66+00 at latitude 40° 48` 41" and longitude 78° 04` 20".

   13.  Divert Oliver Run into the 767-foot reach.

   14.  Construct and maintain a 338-foot relocated applied fluvial geomorphological designed reach of Oliver Run, called Oliver II, near S.R. 0322 EB, Sta. 76+50 at latitude 40° 48` 38" and longitude 78° 04` 14".

   15.  Divert Oliver Run into the 338-foot reach.

   16.  Fill and maintain abandoned reaches of Oliver Run.

   E55-176. Pennsylvania Department of Transportation, Engineering District 3-0, P. O. Box 218, Montoursville, PA 17754-0218. Water Obstruction and Encroachment Permit Application in Franklin Township, Snyder County, ACOE Susquehanna River Basin District (Middleburg, PA Quadrangle N:  12.4 inches; W:  4.3 inches).

   To remove existing corrugated metal pipe, construct and maintain 48 linear feet of 58-inch by 91-inch elliptical concrete pipe in an unnamed tributary to Middle Creek located along SR 1001, Segment 0010, offset 0710, in Franklin Township, Snyder County. This permit was issued under § 105.13(e) ''Small Projects.'' This permit also includes 401 Water Quality Certification.

   Southwest Region:  Water Management Program Manager, 400 Waterfront Drive, Pittsburgh, PA 15222-4745.

   E03-402. Pennsylvania Department of Transportation, Engineering District 10-0, 2550 Oakland Avenue, P. O. Box 429, Indiana, PA 15701-0429. Plumcreek Township, Armstrong County, ACOE Pittsburgh District.

   To relocate and maintain 197 linear feet of an unnamed tributary to Crooked Creek (WWF) and to place and maintain fill in 0.056 acre of palustrine emergent wetland for the purpose of widening S.R. 0210, Section 102 (Power Plant Road). Also to construct and maintain a 30 inch diameter RCP outfall in an unnamed tributary to Crooked Creek (WWF). The project is located along S.R. 0210 approximately 4,400 feet south of its intersection with S.R. 0422. To compensate for the loss of wetlands, the applicant proposes a monetary contribution to the Pennsylvania Wetland Replacement Project (Elderton, PA Quadrangle N:  9.4 inches; W:  13.4 inches).

   E32-436. Norfolk Southern Corporation, 99 Spring Street, Atlanta, GA 30303-0142. Young Township, Indiana County, ACOE Pittsburgh District.

   To remove the existing superstructure of the Norfolk Southern bridge No. KF-42.19 across Blacklegs Creek (CWF) and to construct and maintain a concrete ballast deck and a 6-inch concrete encasing on the existing abutments. The proposed bridge has a clear span of 34 feet and an underclearance of 13.1 feet and is located approximately 600 feet east of Whiskey Run Road.
