FEDERAL WATER POLLUTION CONTROL ACT SECTION 401

   The Department of Environmental Protection (Department) has taken the following actions on previously received permit applications, requests for Environmental Assessment approval and requests for Water Quality Certification under section 401 of the Federal Water Pollution Control Act (FWPCA) (33 U.S.C.A. § 1341(a)).

   Except as otherwise noted, the Department certifies that the construction and operation herein described will comply with the applicable provisions of sections 301--303, 306 and 307 of the FWPCA (33 U.S.C.A. §§ 1311--1313, 1316 and 1317) and that the construction will not violate applicable Federal and State Water Quality Standards.

   Persons aggrieved by an action may appeal, under section 4 of the Environmental Hearing Board Act (35 P. S. § 7514) and 2 Pa.C.S. §§ 501--508 and 701--704 (relating to the Administrative Agency Law), to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, 400 Market Street, P. O. Box 8457, Harrisburg, PA 17105-8457, (717) 787-3483. TDD users may contact the Environmental Hearing Board (Board) through the Pennsylvania Relay Service, (800) 654-5984. Appeals must be filed with the Board within 30 days of publication of this notice in the Pennsylvania Bulletin, unless the appropriate statute provides a different time period. Copies of the appeal form and the Board's rules of practice and procedure may be obtained from the Board. The appeal form and the Board's rules of practice and procedure are also available in Braille or on audiotape from the Secretary to the Board at (717) 787-3483. This paragraph does not, in and of itself, create any right of appeal beyond that permitted by applicable statutes and decision law.

   For individuals who wish to challenge an action, appeals must reach the Board within 30 days. A lawyer is not needed to file an appeal with the Board.

   Important legal rights are at stake, however, so individuals should show this notice to a lawyer at once. Persons who cannot afford a lawyer may qualify for free pro bono representation. Call the Secretary to the Board at (717) 787-3483 for more information.

   To place fill in a de minimis area of PFO wetlands equal to 0.05 acre for the purpose of constructing a driveway to access uplands on Lot 52, Section G of the Estates at Emerald Lakes. The project is located on the eastern side of Sioux Court, approximately 0.7 mile north of the intersection of SR 4002 and Interstate 80 (Pocono Pines, PA Quadrangle N:  14.8 inches; W:  9.4 inches) (Subbasin 02A).

   To place fill in 0.22 acre of PEM wetlands within the Wildcat Creek Watershed (CWF) for the purpose of preparing the lot for commercial development. The permittee is required to provide for 0.22 acre of replacement wetlands by contributing $2,500 to the Pennsylvania Wetland Replacement Project. The project is located approximately 400 feet northeast of the intersection of SR 1010 (Betty Street) and SR 0006 (Carbondale, PA Quadrangle N:  0.2 inch; W:  11.0 inches), Subwatershed (5A).

   E03-413. Department of Transportation, Engineering District 10-0, P. O. Box 429, Indiana, PA 15701. Redbank Township, Armstrong County, ACOE Pittsburgh District.

   To remove the existing bridge and to construct and maintain a precast concrete box culvert having a single waterway opening of 17 feet wide by 7 feet high (1 foot depressed invert with baffles) and 32 feet long with concrete wing walls in Nye Branch Pine Run, which is a perennial stream classified as a CWF. The project proposes to directly affect 45.0 linear feet of stream channel. No wetlands will be impacted by this project. The project is located on SR 1012 approximately 250 feet north of its intersection with T-784 (Dayton, PA Quadrangle N:  15.1; W:  13.6 inches).

   E26-305. Department of Transportation, Engineering District 12-0, P. O. Box 459, Uniontown, PA 15401. Henry Clay Township, Fayette County, ACOE Pittsburgh District.

   To remove the existing structure and to construct and maintain a precast concrete box culvert having a single waterway opening of 15.0 feet wide by 8.0 feet high (1.0 foot depressed invert) and 130 feet long with concrete wing walls in Tub Run (WWF). The project proposes to directly affect 184 linear feet of stream channel. The project is located on SR 0281 approximately 1,200 feet west of its intersection with T-880 (Ohiopyle, PA Quadrangle N:  5.8 inches; W:  6.4 inches).

ENVIRONMENTAL ASSESSMENTS

   EA0913-244. Game Commission, 2001 Elmerton Avenue, Harrisburg, PA 17110-9797. Tinicum Township, Bucks County, ACOE Philadelphia District.

   Project proposes to modify Wildcat Dam to address existing structural inadequacies with the dam impacting a de minimis area of wetland (PEM) equal to 0.03 acre. The modifications will include regrading the dam embankment to a uniform elevation, armoring the emergency spillway with concrete block mats, installing a stone drain along the downstream embankment toe and repairing the principal spillway structure. Modifications will lower the normal pool 6 to 9 inches below the level maintained in recent years. The dam is located across a tributary to Beaver Creek (EV) approximately 2,000 feet north of the intersection of T425 and T485 (Frenchtown, NJ-PA Quadrangle N:  2.60 inches; W:  15.65 inches).

   D4513-155A. East Stroudsburg Borough, 24 Analomink Street, P. O. Box 303, East Stroudsburg, PA 18301. Middle Smithfield Township, Monroe County, ACOE Philadelphia District.

   Project proposes to construct a swale and measuring weirs at the base of the East Stroudsburg Reservoir Dam temporarily impacting approximately 0.07 acre of wetland (PEM) to monitor seepage through the dam. The dam is located across Sambo Creek (CWF, MF) approximately 500 feet northwest of the intersection of Brushy Mountain Road (T513) and Wooddale Drive (T527) (East Stroudsburg, PA Quadrangle N:  11.5 inches; W:  5.3 inches).

   EA1313-001. Afran Realty, 2123 Washington Avenue, Northampton, PA 18067. Lower Towamensing Township, Carbon County, ACOE Philadelphia District.

   Project proposes to relocate and reconstruct a nonjurisdictional dam adjacent to Borger Creek (CWF, MF) impacting a de minimis area of wetland (PEM) equal to 0.02 acre. The dam is located approximately 200 feet southwest of the intersection of Spruce Road (T369) and 57 Road (T378) (Palmerton, PA Quadrangle N:  18.3 inches; W:  0.4 inch).

SPECIAL NOTICES

Public Hearing on the East Penn Sanitation, Inc. Major Permit Modification Application Lower Nazareth Township, Northampton County

   The Department of Environmental Protection will conduct a public hearing to solicit comments on East Penn Sanitation, Inc.'s Major Permit Modification Application, ID No. 101358, which consists of the implementing of a Radiation Monitoring Plan, an increase in the daily capacity and the incorporation of rail transportation at this municipal waste transfer station located in Lower Nazareth Township, Northampton County. The public hearing has been scheduled for Wednesday, May 7, 2003, at 7 p.m. at Nazareth Area Middle School, 355 Tatamy Road, Nazareth.

   A copy of East Penn Sanitation, Inc.'s application may be reviewed at the Department of Environmental Protection, Northeast Regional Office, 2 Public Square, Wilkes-Barre, PA 18711-0790. For further information, contact Robert C. Wallace, (570) 826-2511. A copy of this application has been provided to Lower Nazareth Township and the Lehigh Valley Planning Commission.

   Persons intending to participate in the hearing should submit a written Notice of Intent by May 5, 2003, to William Tomayko, Program Manager, Waste Management Program, Department of Environmental Protection, Northeast Regional Office, 2 Public Square, Wilkes-Barre, PA 18711-0790. The written notice should include the person's name, address, telephone number and a brief statement as to the nature (oral or written) of the presentation. Persons unable to attend the hearing may submit written statements and comments to William Tomayko by May 5, 2003.

Certification to Perform Radon-Related Activities in this Commonwealth

   In the month of March 2003, the Department, under the authority contained in the Radon Certification Act (63 P. S. §§ 2001--2014) and regulations promulgated thereunder at 25 Pa. Code Chapter 240, has certified the persons listed to perform radon-related activities in this Commonwealth. The period of certification is 2 years.
