Actions on applications under the Surface Mining Conservation and Reclamation Act (52 P. S. §§ 1396.1--1396.19a); the Noncoal Surface Mining Conservation and Reclamation Act (52 P. S. §§ 3301-3326); and The Clean Streams Law (35 P. S. §§ 691.1--691.1001); the Coal Refuse Disposal Control Act (52 P. S. §§ 30.51--30.66); and The Bituminous Mine Subsidence and Land Conservation Act (52 P. S. §§ 1406.1--1406.21).    To modify and maintain an existing flood protection levee which will include reconstruction of the berm and minor regarding within a 240-foot reach of the 100-year floodplain of Muckinipates Creek (WWF-MF). The site is located approximately 1,000 feet west of the intersection of Academy Avenue and South Avenue (Lansdowne, PA USGS Quadrangle; N: 5.5 inches; W: 7.1 inches).

   E15-696.  Valley Township Board of Supervisors, P. O. Box 467, Coatesville, PA 19320, Valley Township, Chester County, ACOE Philadelphia District.

   To reconstruct and maintain a damaged retaining wall structure and to construct and maintain approximately 100 linear feet of new retaining wall to improve the deteriorated section of Wagontown Road (T-230) for traffic safety. Total retaining wall rehabilitation is 300 feet long and about 25 feet high within the 100-year floodplain of West Branch Brandywine Creek (WWF-MF). The site is located approximately 1,000 feet northwest of the intersection of Glencrest East Road and Manor Road (Coatesville, PA-USGS Quadrangle N: 20.20 inches; W: 10.90 inches).

   E23-426.  Delaware County Council, Government Services Center, 2nd and Orange Streets, Media, PA 19063, Springfield and Nether Providence Townships, Delaware County, ACOE Philadelphia District.

   To perform the following activities associated with the expansion of Smedley Park:

   1.  To construct and maintain two 13-foot wide, approximately 60-foot long, single span steel bridges, reinforced concrete abutments, associated grading and riprap scour protection across and along Crum Creek (WWF). One of these bridges will replace an existing twin span steel bridge with masonry abutments and a masonry center pier.

   2.  To construct and maintain a stormwater basin and associated outlet works along Crum Creek and within the 100-year floodplain.

   3.  To install and maintain an aerial electric utility line across Crum Creek.

   4.  To operate and maintain an existing sanitary sewer line which crosses Crum Creek at three locations.

   5.  To perform various minor grading activities within the floodplain of Crum Creek associated with park renovations and ballfield construction.

   The project is located approximately 2,300 feet north of Interchange No. 3 of Interstate 476 at Baltimore Pike (Lansdowne, PA Quadrangle N: 8.5 inches; W: 16.50 inches).

   E22-445.  Doc Fritchey, Chapter Trout Unlimited, 2319 Valley Road, Harrisburg, PA 17104 in Swatara Township, Dauphin County, ACOE Baltimore District

   To construct and maintain a stream restoration project within the Spring Creek (WWF) watercourse and its tributaries for the purposes of stream bank stabilization, improved sediment transport, establishment of riparian buffers and improved aquatic habitat while implementing a natural stream channel design approach consisting of the following construction activities: stream and floodway excavation and filling, installation of rock vanes, cross vanes, J-hooks and riprap, placement of random boulders, root wads, stormwater best management practices, invasive plant species removal and riparian planting. The initial phase of the project consists of realigning and stabilizing approximately 850 feet of Spring Creek (WWF) beginning at a point approximately 250 feet downstream of Paxton Street and continuing 850 feet downstream (Harrisburg East, PA Quadrangle N: 0.8 inch; W: 11.7 inches) in Swatara Township, Dauphin County. The applicant is proposing to stabilize severely eroded stream banks, bank grading and the installation of in-stream rock and root wad habitat structures.

   Northcentral Region: Water Management Program Manager, 208 West Third Street, Williamsport, PA 17701.

   E08-393.  Chad M. Tew, 843 Meadow View, Kennett Square, PA 19348. Bridge Construction, in Windham Township, Bradford County, ACOE Baltimore District (Windham, PA Quadrangle N:  21.3 inches; W:  4.7 inches).

   To construct and maintain two 20-foot long by 43-inch by 64-inch corrugated metal arch culverts with a high water spillway in Russell Run and to construct and maintain a 30-foot long, 24-inch diameter corrugated metal pipe culvert in an intermittent unnamed tributary to Russell Run off Stone Jug Road about 1.2 miles from the intersection of Stone Jug Road with SR 1049 in Windham Township, Bradford County. This permit was issued under section 105.13(e) ''Small Projects.'' This permit also includes 401 Water Quality Certification.

   E14-435.  Snow Shoe Township Supervisors, P. O. Box 65, Clarence, PA 16829-0065. Bridge Replacement, in Snow Shoe Township, Centre County, ACOE Baltimore District (Snow Shoe, PA Quadrangle N:  9.5 inches; W:  6.0 inches).

   To: (1) construct and maintain a temporary diversion barrier; (2) remove an existing bridge; (3) construct and maintain a 36-foot 1-inch clear normal span prestressed concrete box beam bridge with a minimum underclearance of 4 feet 2 inches across the North Fork of Beech Creek; and (4) fill 0.016 de minimis acres of wetland with R-8 riprap along the right abutment, located 1,520 feet north on Pancake Road from Walnut Road. This permit was issued under section 105.13(e) ''Small Projects.'' This permit also includes 401 Water Quality Certification.

   E17-375.  City of DuBois, P. O. Box 408, DuBois, PA 15801. City of DuBois-Municipal Wastewater Collection and Treatment Facility, in Sandy Township, Clearfield County, ACOE Pittsburgh District (Falls Creek, PA Quadrangle N:  0.8 inch; W:  3.6 inches).

   To modify, operate and maintain an existing wastewater treatment facility, located within the 100-year floodplain of the Sandy Lick Creek, for the treatment of municipal wastewater. Modification work of the treatment facility shall consist of constructing a 14-foot wide gravel access road, pumping station, 2.1 million gallon flow equalization basin and an outfall structure within the floodplain of Sandy Lick Creek for the abatement of sewage bypasses. Construction activities at the wastewater treatment facility will require excavating, grading and stockpiling adjacent to wetlands; however, any wetland impacts that may be incurred during construction activates shall be temporary and not exceed 0.033 acre, with all wetlands protected or restored to ensure original hydrology. The project is located along the western right-of-way of SR 0219 approximately 800 feet south of SR 4019 and SR 0219 intersection (Falls Creek, PA Quadrangle N:  0.8 inch; W:  3.6 inches) in Sandy Township, Clearfield County.

   E41-515.  Raymond A. Thompson, 431 Oakland Avenue, Williamsport, PA 17701. Small Projects Water Obstruction and Encroachment Joint Permit Application, in McHenry Township, Lycoming County, ACOE Susquehanna River Basin District (Cammal, PA Quadrangle N:  2.12 inches; W:  10.88 inches).

   To construct and maintain a 12-foot by 27-foot wooden deck and a 15-foot by 15-foot residential structure addition in the floodway of Pine Creek, all of which is located 7 miles north of Waterville on SR 0414, in McHenry Township, Lycoming County. This permit was issued under section 105.13(e) ''Small Projects.''

   E49-265.  Upper Augusta Township Municipal Authority, R. R. 1, Box 310C, Sunbury, PA 17801. Packer Island Sewer System, in Upper Augusta Township, Northumberland County, ACOE Susquehanna River Basin District (Northumberland, PA Quadrangle N:  1.77 inches; W:  5.31 inches).

   To construct and maintain a sewage pumping station in the floodplain of the Susquehanna River. The project is located along the southern right-of-way of SR 0147 in Upper Augusta Township, Northumberland County. The sewer pumping station will not impact any jurisdictional wetlands while permanently impacting 384 square feet of floodplain. This permit was issued under section 105.13(e) ''Small Projects.''

   Northwest Region: Water Management Program Manager, 230 Chestnut Street, Meadville, PA 16335-3481.

   E10-363,  James Austin Company, 115 Downieville Road, Mars, PA 16046-0827. Austin Bridge and Building Addition, in Adams Township, Butler County, ACOE Pittsburgh District (Mars, PA Quadrangle N:  10.3 inches; W:  0.1 inch).

   To construct and maintain a single span pedestrian bridge having a clear span of approximately 60 feet and an underclearance of 8.4 feet across Breakneck Creek (WWF) in Adams Township, Butler County approximately 300 foot northeast of the intersection of SR 3015 (Mars Valencia Road) and Downieville Road. Project includes excavation a 160 feet long and 15 feet wide area along the left bank of Breakneck Creek. Also, to construct and maintain an addition for label storage onto the west side of the existing James Austin Company main building with the addition measuring approximately 30 feet wide by 100 feet long and partially within the 100-year floodway of Breakneck Creek.

   E10-364,  City of Butler, 140 West North Street, Butler, PA 16001. West Penn, West Brady and West New Castle Streets Across Sullivan Run, in City of Butler, Butler County, ACOE Pittsburgh District.

   To conduct the following activities on Sullivan Run in the City of Butler, Butler County:

   1.  Remove the existing bridge and to install and maintain a 59.25-foot long concrete box culvert having a 21-foot wide by 7.75-foot high waterway opening with wingwalls extending approximately 10 feet upstream and 25 feet downstream on West Penn Street immediately east of Miller Street (Butler, PA Quadrangle N:  20.9 inches; W:  4.3 inches).

   2.  Remove the existing bridge and to construct and maintain a 41.5-foot long concrete box culvert having a 20.5-foot wide by 5.25-foot high waterway opening with concrete wingwalls extending approximately 20 feet upstream and 35 feet downstream on West Brady Street between Snyder Avenue and Mitchell Avenue (Butler, PA Quadrangle N:  20.6 inches; W:  4.1 inches).

   3.  Remove the existing bridge and to construct and maintain a 47.3-foot long concrete box culvert having a 20.5-foot wide by 5.25-foot high waterway opening with wingwalls extending approximately 20 feet upstream and 45 feet downstream on West New Castle Street approximately 300 feet west of Broad Street (Butler, PA Quadrangle N:  20.35 inches; W:  3.9 inches).

SPECIAL NOTICES

Certified Emission Reduction Credits in the Commonwealth's ERC Registry

   Emission reduction credits (ERCs) are surplus, permanent, quantified and Federally enforceable emission reductions used to offset emission increases of NOx, VOCs and the following criteria pollutants: carbon monoxide (CO), lead (Pb), oxides of sulfur (SOx), particulate matter (PM), PM10 and PM10 precursors.

   The Department of Environmental Protection (Department) maintains an ERC registry in accordance with the requirements of 25 Pa. Code § 127.209. The ERC registry system provides for the tracking of the creation, transfer and use of ERCs. Prior to registration of the credits, ERC registry applications are reviewed and approved by the Department to confirm that the ERCs meet the requirements of 25 Pa. Code §§ 127.206--127.208. Registration of the credits in the ERC registry system constitutes certification that the ERCs satisfy applicable requirements and that the credits are available for use. The following registered and certified ERCs in the ERC Registry are currently available for use as follows:

   (1)  To satisfy new source review (NSR) emission offset ratio requirements.

   (2)  To ''net-out'' of NSR at ERC-generating facilities.

   (3)  To sell or trade the ERCs for use as emission offsets at new or modified facilities.

   The certified ERCs shown, expressed in tons per year (tpy), satisfy the applicable ERC requirements contained in 25 Pa. Code §§ 127.206--127.208. ERCs created from the curtailment or shutdown of a source or facility expires for use as offsets 10 years after the emission reduction occurs. ERCs generated by the overcontrol of emissions by an existing facility do not expire for use as offsets. However, credits in the registry which are not used in a plan approval will be discounted if new air quality requirements are adopted by the Department or the EPA.
