FEDERAL WATER POLLUTION CONTROL ACT, SECTION 401 The following permit applications, requests for Environmental Assessment approval and requests for 401 Water Quality Certification have been received by the Department of Environmental Protection (Department). Section 401 of the Federal Water Pollution Control Act (FWPCA) (33 U.S.C.A. § 1341) requires the State to certify that the involved projects will not violate the applicable provisions of sections 301--303, 306 and 307 of the FWPCA (33 U.S.C.A. §§ 1311--1313, 1316 and 1317) as well as relevant State requirements. Persons objecting to approval of a request for certification under section 401 of the FWPCA or to the issuance of a Dam Permit, Water Obstruction and Encroachment Permit or the approval of an Environmental Assessment must submit comments, suggestions or objections within 30 days of the date of this notice, as well as questions, to the regional office noted before the application. Comments should contain the name, address and telephone number of the person commenting, identification of the certification request to which the comments or objections are addressed and a concise statement of comments, objections or suggestions including the relevant facts upon which they are based.
The Department may conduct a fact-finding hearing or an informal conference in response to comments if deemed necessary. Individuals will be notified, in writing, of the time and place of a scheduled hearing or conference concerning the certification request to which the comment, objection or suggestion relates. Upper Perkiomen Interceptor Paralleling Project, LPVRSA--The project proposes to modify an existing sewage conveyance system which conveys sewage to Oaks Water Treatment Plant by constructing and maintaining pipeline parallel to and crossing the Perkiomen Creek (WWF-MF) and crossing several of its tributaries (TSF-MF) and adjacent wetlands (PFO, EM, SS) at 19 different locations. The works involve the following:
1. Construction of 19 utility line and wetland stream crossings of regulated waters of this Commonwealth.
2. Construction and maintenance of approximately 5,800 linear feet of 24-inch diameter sewage pipeline interceptor within the 100-year floodway and floodplain.
3. Construction and maintenance of approximately 4,100 linear feet of 30-inch diameter sewage pipeline interceptor within the 100-year floodway and floodplain.
4. Construction and maintenance of approximately 8,400 linear feet of 36-inch diameter sewage pipeline interceptor within the 100 year floodway and floodplain.
5. Construction and maintenance of seven concrete manholes and appurtenant metering works within close proximity of regulated waters of this Commonwealth associated with the connection of the different sized pipeline segments.
6. Modification and maintenance of nine existing manholes, which exist within regulated waters of this Commonwealth to accommodate the existing and new pipeline connection system and metering device.
The project proposes to temporarily affect approximately 18,300 linear feet and directly affect an approximate total of 17,000 linear feet of floodway, temporarily disturbing approximately 30 acres of floodway and approximately 5 acres of wetlands (PFO/EM/SS). The project is one of several phases of the LPVRSA paralleling project associated with the Oaks Sewage Treatment Facility upgrade. This phase is along the stretch of the Perkiomen starting approximately at 3,000 feet north of the Gratersford Road Bridge running south toward Germantown Pike and terminating approximately 1,460 feet south of where the Germantown Pike crosses Perkiomen Creek. 5. The crossing of five unnamed tributaries to the Perkiomen (TSF-MF) at five points to facilitate the pipe network construction.
The projects proposes to temporarily affect approximately 15,000 linear feet and directly affect an approximate total of 13,500 linear feet of floodway, 80 linear feet of unnamed tributaries and impact 0.30 acre wetlands (PFO) including one large vernal pool. The project is one of several phases of the LPVRSA paralleling project associated with the Oaks Sewage Treatment Facility upgrade. The project is along Chestnut Street, approximately 1,023 feet southwest from the intersection of Ohio River Boulevard (SR 65) and Chestnut Street and will impact 28.0 linear feet of stream channel.

The applicant proposed to remove the Autenreith Building over Dunlap Creek (WWF) for the purpose of improving public safety. The demolition of the building includes cutting left side piers below normal flow elevation and cutting the right side piers 2 feet below the streambed. During removal of the structure, a temporary causeway consisting of nine 24-inch diameter pipes and cofferdams will be constructed and maintained. The project is just downstream of High Street Bridge.

The applicant proposes to amend Permit E63-443 which authorized the construction and maintenance of a 525-foot long barge dock along the left bank of the Monongahela River (WWF) near River Mile 59.8. This amendment will reissue and extend the time on the original permit and authorize the excavation and expansion of an existing pond, the construction and maintenance of a 12-inch diameter discharge culvert for a distance of approximately 805 feet and the discharge culverts outfall to the Monongahela River. The total proposed stream impact is approximately 805 feet of a tributary to the Monongahela River.

The applicant proposed to remove the existing structure and to construct and maintain a 21.67-foot long, 24-foot wide by 5.33-foot high precast concrete arch (Crawford County Bridge No. 44) in Gravel Run (WWF, perennial) on T-658 (Leimbach Road), approximately 800 feet south of the intersection of Gravel Run Road and T-658 (Leimbach Road). The project include a direct impact (de minimis) of 0.014 acre of PEM and 0.02 acre of PSS wetland. The project proposes to directly affect a total of approximately 40 linear feet of stream channel and 0.034 acre of wetland (de minimis): 0.014 acre of PEM and 0.02 acre of PSS wetland.

2. To remove gravel deposits, repair stream bank scour, stabilize and maintain the following along a total reach of approximately 700 feet of the channel of Rhine Run extending upstream from the existing access road bridge adjacent to the no. 16 green:
a. Removal of a total of approximately 550 feet of 5 gravel bars.
b. Backfill of scoured bank area along both sides of the stream for approximately 500 feet, beginning approximately 300 feet upstream of the golf cart bridge and extending downstream.
c. Placement of rock riprap along approximately 650 feet of the right bank beginning 300 feet upstream of the golf cart bridge and extending downstream.
d. Placement of rock riprap along approximately 150 feet of the left bank downstream of the golf cart bridge.
e. Installation of approximately 180 feet of stone retaining wall along the left bank extending upstream from the golf cart bridge.
3. To remove debris from the channel and floodway area along a total reach of approximately 2,500 feet of Rhine Run beginning approximately 700 feet upstream of the access road bridge and extending upstream.

THE CLEAN STREAMS LAW AND THE FEDERAL CLEAN WATER ACT
FINAL ACTIONS TAKEN FOR NATIONAL POLLUTION DISCHARGE ELIMINATION SYSTEM (NPDES) PERMITS AND WATER QUALITY MANAGEMENT (WQM) PERMITS The Department of Environmental Protection (Department) has taken the following actions on previously received applications for new, amended and renewed NPDES and WQM permits, applications for permit waivers and Notices of Intent (NOI) for coverage under general permits. This notice is provided in accordance with 25 Pa. Code Chapters 91 and 92 and 40 CFR Part 122, implementing provisions of The Clean Streams Law (35 P. S. §§ 691.1--691.1001) and the Federal Clean Water Act.

The approval for coverage under general NPDES permits is subject to applicable effluent limitations, monitoring, reporting requirements and other conditions set forth in each general permit. The approval of coverage for land application of sewage sludge or residential septage under applicable general permit is subject to pollutant limitations, pathogen and vector attraction reduction requirements, operational standards, general requirements, management practices and other conditions set forth in the respective permit. Permits and related documents, effluent limitations, permitting requirements and other information are on file and may be inspected and arrangements made for copying at the contact office noted before the action.
Persons aggrieved by an action may appeal, under section 4 of the Environmental Hearing Board Act (35 P. S. § 7514) and 2 Pa.C.S. §§ 501--508 and 701--704 (relating to the Administrative Agency Law), to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, 400 Market Street, P. O. Box 8457, Harrisburg, PA 17105-8457, (717) 787-3483. TDD users should contact the Environmental Hearing Board (Board) through the Pennsylvania Relay Service, (800) 654-5984. Appeals must be filed with the Board within 30 days of publication of this notice in the Pennsylvania Bulletin, unless the appropriate statute provides a different time period. Copies of the appeal form and the Board's rules of practice and procedure may be obtained from the Board. The appeal form and the Board's rules of practice and procedure are also available in Braille or on audiotape from the Secretary of the Board at (717) 787-3483. This paragraph does not, in and of itself, create any right of appeal beyond that permitted by applicable statutes and decision law.
For individuals who wish to challenge an action, appeals must reach the Board within 30 days. A lawyer is not needed to file an appeal with the Board.
