AIR QUALITY

PLAN APPROVAL AND OPERATING PERMIT APPLICATIONS

NEW SOURCES AND MODIFICATIONS

   The Department of Environmental Protection (Department) has developed an ''integrated'' plan approval, State operating permit and Title V operating permit program. This integrated approach is designed to make the permitting process more efficient for the Department, the regulated community and the public. This approach allows the owner or operator of a facility to complete and submit all the permitting documents relevant to its application one time, affords an opportunity for public input and provides for sequential issuance of the necessary permits.

   The Department has received applications for plan approvals and/or operating permits from the following facilities.

   Copies of the applications, subsequently prepared draft permits, review summaries and other support materials are available for review in the regional office identified in this notice. Persons interested in reviewing the application files should contact the appropriate regional office to schedule an appointment.

   Persons wishing to receive a copy of a proposed plan approval or operating permit must indicate their interest to the Department regional office within 30 days of the date of this notice and must file protests or comments on a proposed plan approval or operating permit within 30 days of the Department providing a copy of the proposed document to that person or within 30 days of its publication in the Pennsylvania Bulletin, whichever comes first. Interested persons may also request that a hearing be held concerning the proposed plan approval and operating permit. Comments or protests filed with the Department regional offices must include a concise statement of the objections to the issuance of the Plan approval or operating permit and relevant facts which serve as the basis for the objections. If the Department schedules a hearing, a notice will be published in the Pennsylvania Bulletin at least 30 days prior the date of the hearing.

   Persons with a disability who wish to comment and require an auxiliary aid, service or other accommodation to participate should contact the regional office identified before the application. TDD users may contact the Department through the Pennsylvania AT&T Relay Service at (800) 654-5984.

   Final plan approvals and operating permits will contain terms and conditions to ensure that the source is constructed and operating in compliance with applicable requirements in 25 Pa. Code Chapters 121--143, the Federal Clean Air Act (act) and regulations adopted under the act.

Intent to Issue Plan Approvals and Intent to Issue or Amend Operating Permits under the Air Pollution Control Act (35 P. S. §§  4001--4015) and 25 Pa. Code Chapter 127, Subchapter B. These actions may include the administrative amendments of an associated operating permit.

   15-0010A: ISG Plate, LLC (139 Modena Road, Coatesville, PA 19320) for modification of a 200` NAB Furnace (CHT) at their facility in the City of Coatesville, Chester County. This facility is a Title V facility. The 200` NAB Furnace (CHT) is identified in the facility's Title V Operating Permit as Source 146B. ISG Plate LLC proposes to install new high efficiency burners to replace older burners. To assure that PSD would not apply on a ''past actual to future potential'' basis, Source 146B will be subject to the following restrictions: 1) a limit of 30.6 tons of NOx per year, as a 12 month rolling sum (this is a reduction in the source's current potential to emit of 93.2 tons per year), 2) a fuel usage restriction for the 200` NAB Furnace (CHT), 3) a limitation to only burning natural gas, 4) the installation of a fuel usage meter, 5) a requirement to monitor and record fuel usage, and 6) a requirement to stack test the furnace to verify its NOx emission rate. The Plan Approval will contain monitoring and recordkeeping requirements designed to keep Source 146B operating within the allowable emissions and all applicable air quality requirements.

   55-399-005A: Professional Building Systems, Inc. (72 East Market Street, Middleburg, PA 17842) for construction of a modular home manufacturing facility in Middleburg Borough, Snyder County.

   The modular home manufacturing facility incorporates various manufacturing activities involving the use of adhesives, sealants, paints, cleaning solvents, and the like. The facility will emit up to 8.39 tons of volatile organic compounds and 1.11 tons of volatile hazardous air pollutants per year.

   The Department of Environmental Protection's (Department) review of the information provided by Professional Building Systems, Inc. indicates that the modular manufacturing facility will comply with all Air Quality requirements pertaining to air contamination sources and the emission of air contaminants, including the best available technology requirement of 25 Pa. Code §§ 127.1 and 127.12. Based on this finding, the Department proposes to issue plan approval for the construction of the modular home manufacturing facility.

   The following is a summary of the conditions that the Department proposes to place in the plan approval to be issued to ensure compliance with all applicable regulatory requirements:

   1.  This plan approval supersedes Plan Approval 55-399-005 in its entirety.

   2.  The total combined volatile organic compound emissions shall not exceed 8.39 tons in any 12 consecutive month period and the total combined volatile hazardous air pollutant emissions shall not exceed 1.11 tons in any 12 consecutive month period.

   3.  Only those specific adhesives, sealants, coatings (paints, stains, topcoats, and the like), cleaning solvents, and the like identified in the plan approval application (or an alternate material determined by the Department to have an equivalent, or lower, air contaminant emission potential) shall be used.

   4.  All materials listed below shall comply with the usage limitations identified as applying to that material:

   6.  The use of ''Foamseal 2100A,'' ''Foamseal 2100,'' ''Macroplast UR-8225BH,'' ''AD Firebarrier,'' ''Draft Stop'' and ''Everflux'' shall not result in the emission of any VOCs or VHAPs.

   7.  Only airless, air-assisted airless or HVLP spray technology shall be used to apply coatings other than those applied by brush or cloth.

   8.  All containers of VOC-containing and volatile hazardous air pollutant-containing materials shall be kept closed except when in active use. Any solvent flushed from spray lines shall be flushed in a solid stream into a container. Solvent may not be removed from spray lines by spraying into the air or by spraying an atomized spray into a container. All solvent-wet rags shall be stored in closed containers.

   9.  Appropriate records shall be kept to demonstrate compliance with all plan approval conditions. These records shall be submitted to the Department of Environmental Protection on a quarterly basis.

   16-136C: Glenn O. Hawbaker, Inc.--Plant No. 14--Clarion Asphalt Facility (State Route 3011, Clarion, PA 16214) to burn alternative fuels including No. 2, No. 5. No. 6, fuel oil or any combination of No. 2, No. 4, No. 6 and reprocessed/recycled oil in Beaver Township, Clarion County.

   In accordance with 25 Pa. Code §§ 127.44(b) and 127.424(b), the Department of Environmental Protection intends to issue a plan approval to: burn alternative fuels including No. 2, No. 5. No. 6, fuel oil or any combination of No. 2, No. 4, No. 6 and reprocessed/recycled oil in Beaver Township, Clarion County. This plan approval will, in accordance with 25 Pa. Code § 127.450, be incorporated into a State Only operating permit through an administrative amendment at a later date.

OPERATING PERMITS


Intent to Issue Title V Operating Permits under the Air Pollution Control Act (35 P. S. §§ 4001--4015) and 25 Pa. Code Chapter 127, Subchapter G.

   Northwest Region: Air Quality Program, 230 Chestnut Street, Meadville, PA 16335-3481, Eric Gustafson, Facilities Permitting Chief, (814) 332-6940.

   20-00040: Advanced Cast Products, Inc. (18700 Mill Street, Meadville, Pa 16335) for a Reissuance of the Title V Operating Permit. The facility is in the City of Meadville, Crawford County. The facility manufactures gray and ductile iron foundries casting products. The facility's major emission sources include preheating and charge, melting and transfer, pouring-cooling-shakeout, new grinding and goff, grinding and cleaning, core making and baking, sand handling, heat treating- austemper operation, painting operation, air-makeup units three, miscellaneous natural gas usage and two degreaser units. The facility is a major facility due to its potential to emit of particulate matter.

   V04-010: Arbill Industries, Inc. (2270 West Glenwood Avenue, Philadelphia, PA 19132) for operation of an industrial laundry and petroleum based dry-cleaning facility in the City of Philadelphia, Philadelphia County. The Title V facility's air emission sources include two 5.5 MMBtu/hr boilers, two heavy-duty petroleum solvent dry cleaning washer, ten textile dryers with built-in condensers, three vacuum stills for petroleum solvent recovery and 26 hampers used to convey textiles.

   The operating permit will be issued under the 25 Pa. Code, Philadelphia code title 3 and air management regulation xiii.    Persons wishing to file protest or comments on the above operating permit must submit the protest or comments within 30 days from the date of this notice. Any protests or comments filed with AMS must include a concise statement of the objections to the permit issuance and the relevant facts upon which the objections are based. Based upon the information received during the public comment period, AMS may modify the operating permit or schedule a public hearing. The hearing notice will be published in the Pennsylvania Bulletin and a local newspaper at least thirty days before the hearing.


Intent to Issue Operating Permits under the Air Pollution Control Act (35 P. S. §§  4001--4015) and 25 Pa. Code Chapter 127, Subchapter F.

   46-00245: Neptune Chemical Pump Co., Inc. (215 Keystone Drive, Montgomeryville, PA 18936) for operation of their facility in Lansdale, Montgomery County. The permit is for a non-Title V (State only) facility. The facility's primary emission sources are two spray paint booths and a Pressurized Drum. The permit will include monitoring, recordkeeping and reporting requirements designed to keep the facility operating within all applicable air quality requirements.

COAL AND NONCOAL MINING ACTIVITY APPLICATIONS


Applications under the Surface Mining Conservation and Reclamation Act (52 P. S. §§ 1396.1--1396.19a); the Noncoal Surface Mining Conservation and Reclamation Act (52 P. S. §§ 3301--3326); The Clean Streams Law (35 P. S. §§ 691.1--691.1001); the Coal Refuse Disposal Control Act (52 P. S. §§ 30.51--30.66); and The Bituminous Mine Subsidence and Land Conservation Act (52 P. S. §§ 1406.1--1406.21). Mining activity permits issued in response to applications will also address the applicable permitting requirements of the following statutes: the Air Pollution Control Act (35 P. S. §§ 4001--4015); the Dam Safety and Encroachments Act (32 P. S. §§ 693.1--693.27); and the Solid Waste Management Act (35 P. S. §§ 6018.101--6018.1003).

   The following permit applications to conduct mining activities have been received by the Department of Environmental Protection (Department). A copy of an application is available for inspection at the district mining office indicated before an application. Where a 401 Water Quality Certification is needed for any aspect of a particular proposed mining activity, the submittal of the permit application will serve as the request for certification.

   Written comments, objections or requests for informal conferences on applications may be submitted by any person or any officer or head of any Federal, State or local government agency or authority to the Department at the district mining office indicated before an application within 30 days of this publication, or within 30 days after the last publication of the applicant's newspaper advertisement, as provided by 25 Pa. Code §§ 77.121--77.123 and 86.31--86.34.

   Where any of the mining activities listed will have discharges of wastewater to streams, the Department will incorporate NPDES permits into the mining activity permits issued in response to these applications. NPDES permits will contain, at a minimum, technology-based effluent limitations as identified in this notice for the respective coal and noncoal applications. In addition, more restrictive effluent limitations, restrictions on discharge volume or restrictions on the extent of mining which may occur will be incorporated into a mining activity permit, when necessary, for compliance with water quality standards (in accordance with 25 Pa. Code Chapters 93 and 95). Persons or agencies who have requested review of NPDES permit requirements for a particular mining activity within the previously mentioned public comment period will be provided with a 30-day period to review and submit comments on the requirements.

   Written comments or objections should contain the name, address and telephone number of the person submitting comments or objections; the application number; and a statement of sufficient detail to inform the Department on the basis of comment or objection and relevant facts upon which it is based. Requests for an informal conference must contain the name, address and telephone number of requestor; the application number; a brief summary of the issues to be raised by the requestor at the conference; and a statement whether the requestor wishes to have the conference conducted in the locality of the proposed mining activities.

FEDERAL WATER POLLUTION CONTROL ACT, SECTION 401

   The following permit applications, requests for Environmental Assessment approval and requests for 401 Water Quality Certification have been received by the Department of Environmental Protection (Department). Section 401 of the Federal Water Pollution Control Act (FWPCA) (33 U.S.C.A. § 1341) requires the State to certify that the involved projects will not violate the applicable provisions of sections 301--303, 306 and 307 of the FWPCA (33 U.S.C.A. §§ 1311--1313, 1316 and 1317) as well as relevant State requirements. Persons objecting to approval of a request for certification under section 401 of the FWPCA or to the issuance of a Dam Permit, Water Obstruction and Encroachment Permit or the approval of an Environmental Assessment must submit comments, suggestions or objections within 30 days of the date of this notice, as well as questions, to the regional office noted before the application. Comments should contain the name, address and telephone number of the person commenting, identification of the certification request to which the comments or objections are addressed and a concise statement of comments, objections or suggestions including the relevant facts upon which they are based.

   The Department may conduct a fact-finding hearing or an informal conference in response to comments if deemed necessary.    E17-403. Karthaus Township, HC Box 6, 367 Market Street, Karthaus, PA 16845. T-748 Bridge Replacement, Karthaus Township, Clearfield County, ACOE Baltimore District (Karthaus, PA Quadrangle N:  21.6 inches; W:  15.2 inches).

   To remove an existing bridge superstructure and to construct, operate and maintain a single span concrete box beam bridge to carry T-748 (Oak Hill Road) across Mosquito Creek: a HQ-CWF. The bridge across Mosquito Creek shall be constructed with a minimum span of 82 feet, width of 43.5 feet and an underclearance of 16 feet. All construction and future repair work shall be completed during stream low flow. All in-stream structures shall be constructed in dry work conditions by dams and pumping or fluming stream flow around work areas. Construction of the bridge will permanently impact 75 feet of Mosquito Creek while temporarily impacting 828 square feet of wetland that is located along the northern right-of-way of SR 0879 approximately 60 feet west of T-748 and SR 0879 intersection. The 828 square feet of wetland impacts are deemed de minimus, as such the applicant will not be required to mitigate the impacts with replacement wetlands.

   E18-383. Renovo Borough, 128 Fifth Street, Renovo, PA 17764. Water Line Relocation, in Renovo Borough, Centre County, ACOE Baltimore District (Renovo East, PA Quadrangle N:  14.75 inches; W:  14.81 inches).

   To relocate and concrete encase an 8-inch diameter line 100 feet upstream from its current location next to a SR 120 bridge, due to the proposed replacement of the bridge. The water line will cross 78 feet of the channel bed. The project proposes to temporarily impact 30 linear feet of the run and permanently impact 5 linear feet of Paddy Run, which is classified as an Exceptional Value stream. The project will not impact any wetlands.

   E18-384. Western Clinton County Municipal Authority, P. O. Box 363, Renovo, PA 17764. State Route 0120, Section A01 Sanitary Sewer Line Relocation in Renovo Borough, Clinton County, ACOE Baltimore District (Renovo East, PA Quadrangle N:  14.59 inches; W:  14.15 inches).

   To relocate and concrete encase an existing PVC sanitary sewer line 100 feet upstream from its current location next to the SR 120 bridge, due to the proposed replacement of the bridge. The sewer line will cross 68 feet of the channel bed. The project proposes to temporarily impact 30 linear feet of Paddy Run and permanently impact 5 linear feet of Paddy Run that is classified as an Exceptional Value stream. The project will not impact any wetlands.

   E49-282. Milton Area Industrial Development Association, One South Arch Street, Milton, PA 17847. Standard Joint Water Obstruction and Encroachment Permit, in Milton Borough, Northumberland County, ACOE Susquehanna River Basin District (Milton, PA Quadrangle N:  18.1 inches; W:  14.1 inches). This application was mistakenly published as an action at 34 Pa.B. 6709 (December 18, 2004).

   To develop in accordance with the attached plans to develop Phase II of the Belford addition, which encompasses approximately 50 acres of land. The development will include new roadways, road reconstruction, and utility line extension. The project will permanently impact 1.15 acres of forested nontidal wetlands for the widening of Marsh Road and 0.49 acre of emergent nontidal wetlands for a new road (across wetland No. 14). The project will also disturb 138 linear feet of stream to place two 41-foot box culverts and a 42-foot arch culvert in UNTs; and temporarily impact 4,185 square feet of wetlands and 75 linear feet of stream for utility line crossings and placement of stormwater piping. The applicants stated purpose is to accommodate the growing needs of the local economy by providing developable lots to eliminate the current traffic patterns through he nearby town of Montandon, Milton Borough, Northumberland County.

   Southwest Region: Water Management Program Manager, 400 Waterfront Drive, Pittsburgh, PA 15222-4745.

   E02-1478. Jefferson Hills Borough, 925 Old Clairton Road, Jefferson Hills, PA 15025. To construct a culvert in Jefferson Hills Borough, Allegheny County, Pittsburgh ACOE District. (Glassport, PA Quadrangle N:  12.3 inches; W:  12.7 and Latitude:  40° 19` 4"--Longitude:  79° 57` 58"). The applicant proposes to construct and maintain a 8` x 8` concrete box culvert (depressed 1`) approximately 296 feet long within a tributary to Lick Run (TSF) for a proposed roadway to connect to two residential developments known as Jefferson Estates and Hunters Field. The new street will be known as Frank Street. The total stream impact from this project is approximately 296 feet to a tributary to Lick Run.

   E62-403, William T. Krahe, Echo Warren Associates, L. P., 701 Alpha Drive Pittsburgh, PA 15238. Warren County Retail Center, in Conewango Township, Warren County, ACOE Pittsburgh District (Russell, PA Quadrangle N:  1.0 inches; W:  3.5 inches).

   The applicant proposes to construct a commercial development consisting of a Wal-Mart (204,000 square feet), a home improvement center (111,000 square feet), 81,000 square feet of additional retail shops and associated parking immediately NW of the intersection of U. S. Route 62 (Market Street Extension) and SR 69 (Jackson Run Road) involving 1) to fill 0.62 acre of PEM wetland, 2) to restore 1.01 acres of wetland onsite and to enhance 0.56 acre of existing wetland onsite and 3) to construct and maintain a 3-foot diameter HDPE stormwater outfall discharging to Jackson Run. The project proposes to directly affect 0.62 acre of PEM wetlands and to restore 1.01 acres of wetland onsite and to enhance 0.56 acre of existing wetland onsite. Jackson Run is a perennial stream with a wild trout designation and classified as a CWF.
