STATE CONTRACTS INFORMATION
DEPARTMENT OF GENERAL SERVICES

   Act 266 of 1982 provides for the payment of interest penalties on certain invoices of "qualified small business concerns". The penalties apply to invoices for goods or services when payments are not made by the required payment date or within a 15 day grace period thereafter.
   Act 1984-196 redefined a "qualified small business concern" as any independently owned and operated, for-profit business concern employing 100 or fewer employees. See 4 Pa.Code § 2.32. The business must include the following statement on every invoice submitted to the Commonwealth: "(name of business) is a qualified small business concern as defined in 4 Pa. Code 2.32."
   A business is eligible for payments when the required payment is the latest of:
      The payment date specified in the contract.
      30 days after the later of the receipt of a proper invoice or receipt of goods or services.
      The net payment date stated on the business' invoice.
   A 15-day grace period after the required payment date is provided to the Commonwealth by the Act.

The principal items of work and approximate quantities include Tipple Demolition, 3,550 square yards of Permanent Swale Lining, 410,438 cubic yards of Grading, 2,690 tons of Coal Recovery, 40 acres of Seeding, planting 35,250 Trees and Water Line Restoration that includes 220 linear feet of New Water Line Installation and 730 linear feet of Rock Underdrain with Perforated 4" PVC Pipe. This project issues on January 14, 2005 and bids will be opened on February 8, 2005 at 2:00 p.m. Payment in the amount of $10.00 must be received before bid documents will be sent. This project is financed by the Federal Government under the authority given it by P.L. 95-87 dated August 3, 1977, ''The Surface Mining Control and Reclamation Act of 1977,'' and is subject to that Law, and to the Federal Grant for this project.
