Settlement of NPDES Permit Appeal under 25 Pa. Code § 92.61(g)

PPG Industries, Inc. v. Department of Environmental Protection; EHB Doc. No. 2004-076-R

   The previously captioned matter involved the appeal of the National Pollutant Discharge Elimination System Permit No. PA 0001198 (NPDES Permit) issued by the Department of Environmental Protection (Department) to PPG Industries, Inc. (PPG) for its facility in Springdale Borough, Allegheny County (Springdale Facility).

   The Department's final action to resolve this NPDES Permit appeal was a settlement as reflected by a July 1, 2005, Consent Order and Agreement entered into by the Department and PPG. The major provisions of the settlement require PPG to permanently cease the discharge of all boiler blowdown, filter backwash and wastewater sources generated in the Boiler Room and to convey these waters to the Allegheny Valley Joint Sewer Authority for treatment. The settlement also called for an amendment to the NPDES Permit to reflect the elimination of authorization for these flows to be discharged directly from the Springdale Facility. PPG also agreed to pay $9,000 in penalties for discharges of sources of wastewater that were not authorized by the NPDES Permit and for violations of the effluent limitations for pH at internal monitoring point 103. In addition, PPG agreed to withdraw its appeal before the Environmental Hearing Board (Board).

   Persons believing to be aggrieved by this Consent Order and Agreement have a right to appeal to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, 400 Market Street, P. O. Box 8457, Harrisburg, PA 17105-8457. Appeals must be filed within 30 days of this publication.
