Availability of Technical Guidance

   Technical guidance documents are available on the Department of Environmental Protection's (Department) website at www.depweb.state.pa.us (DEP Keyword: Technical Guidance). The ''Final Documents'' heading is the link to a menu of the various Department bureaus where each bureau's final technical guidance documents are posted. The ''Draft Technical Guidance'' heading is the link to the Department's draft technical guidance documents.

   The Department will continue to revise its nonregulatory documents, as necessary, throughout 2006.

Ordering Paper Copies of Department Technical Guidance

   The Department encourages the use of the Internet to view and download technical guidance documents. When this option is not available, persons can order a paper copy of any of the Department's draft or final technical guidance documents by contacting the Department at (717) 783-8727.

   In addition, bound copies of some of the Department's documents are available as Department publications. Check with the appropriate bureau for more information about the availability of a particular document as a publication.

Changes to Technical Guidance Documents

   Following is the current list of recent changes. Persons who have questions or comments about a particular document should call the contact person whose name and phone number is listed with each document.

Draft Technical Guidance

   DEP ID: 363-0300-003. Title: Pennsylvania Model Stormwater Management Ordinance (Draft Ordinance). Description: The purpose of the Draft Ordinance is to combine and supersede previous model ordinances for stormwater management published by the Department in documents #392-0300-001: Stormwater Management Guidelines and Model Ordinances and #392-0300-003: Guidelines on MS4 Ordinance Provisions (In Relation to National Pollutant Discharge Elimination System (NPDES) Stormwater Discharges Permitting Requirements from Municipal Separate Storm Sewer Systems (MS4s). The proposed Model Ordinance will be used in the following ways: as a template for developing municipal stormwater management ordinances in watershed stormwater management plans prepared under the Storm Water Management Act (act) (32 P. S. §§ 680.1--680.17); as a model ordinance for enactment by municipalities designated as urbanized under the Federal NPDES Phase II rule (that is, MS4 Municipalities); and as a template by any other municipality engaged in the preparation and enactment of a stormwater management ordinance. Enactment of the Model Ordinance establishes municipal authority to administer, regulate and enforce proper implementation and maintenance of post-construction stormwater management Best Management Practices and design standards such as the ones presented in the draft Pennsylvania Stormwater Best Management Practices Manual (DEP ID #363-0300-002: Pennsylvania Stormwater Best Management Practices Manual) (see 36 Pa.B. 1797 (April 15, 2006)) (Draft Manual). The Draft Ordinance incorporates recent techniques for meeting the stormwater management goals established by the act while also meeting the requests of counties and municipalities to consolidate multiple model ordinances into one model ordinance that is more easily adapted, less difficult to administer and more protective of water resources. The Draft Ordinance and Control Guideline No. 2 in Chapter 3 of the Draft Manual are intended to be consistent.    Written Comments: Persons wishing to comment on the Draft Ordinance are invited to submit a written statement to the Chief, Stormwater Planning and Management, Department of Environmental Protection, Bureau of Watershed Management, Division of Waterways, Wetlands and Stormwater Management, Rachel Carson State Office Building, 10th Floor, P. O. Box 8775, Harrisburg, PA 17105-8775. Comments may also be sent by electronic mail to epstormwaterordinance@state.pa.us. Comments submitted by facsimile will not be accepted. Comments must be submitted by June 12, 2006. Comments received within this period will be considered in the formulation of the Final Notice of Availability of the Pennsylvania Model Stormwater Management Ordinance. Comments should include the name, address and telephone number of the writer and a concise statement to inform the Department of the exact basis of the comment and the relevant facts upon which it is based. Following the comment period, the Department will make a final determination regarding the Draft Ordinance. Notice of this determination will be published in the Pennsylvania Bulletin. Effective Date: Upon publication of notice as final in the Pennsylvania Bulletin.

Draft Technical Guidance--Substantive Revision

   DEP ID: 550-2501-101. Title: Guidelines for Submitting Oil and Gas Well Bonds. Description: This document provides instruction to bond applicants and financial guarantors for submitting proper documents and financial instruments for oil and gas well bonds. Changes were made to the document to reflect updates in the Oil and Gas Act (58 P. S. §§ 601.101--601.605), including the elimination of phased deposit bonds. Changes were also made concerning the submission of collateral from out-of-state financial institutions not registered to do business in this Commonwealth. For these specific financial institutions, letters of credit will be accepted if the institution consents in writing to jurisdiction and venue in this Commonwealth. Other changes were made to the guidance document to aid the users and financial institutions on proper completion of the bond forms.

   Written Comments: The Department is seeking comments on the substantive revisions to draft technical guidance #550-2501-101. Interested persons may submit written comments on this draft technical guidance document by June 12, 2006. Comments submitted by facsimile will not be accepted.
