   The Independent Regulatory Review Commission met publicly at 10:30 a.m., Thursday, September 7, 2006, and announced the following:

Department of Agriculture--Shellfish; Regulation No. 2-151

   On February 13, 2006, the Independent Regulatory Review Commission (Commission) received this proposed regulation from the Department of Agriculture (Department). This rulemaking amends 7 Pa. Code Chapter 49. The proposed regulation was published in the February 25, 2006 Pennsylvania Bulletin with a 30-day public comment period. The final-form regulation was submitted to the Commission on July 21, 2006.

   This regulation clarifies and updates existing provisions on the processing, transportation, storage and sale of shellfish. It adopts the National Shellfish Sanitation Program Model Ordinance which is developed and published by U.S. Food and Drug Administration in collaboration with the states, other nations and industry.

   We have determined this regulation is consistent with the statutory authority of the Department (31 P. S. §§ 20.13 and 20.14) and the intention of the General Assembly. Having considered all of the other criteria of the Regulatory Review Act, we find promulgation of this regulation is in the public interest.
