Acceptance of Rulemaking Petition for Study

   On February 20, 2007, the Environmental Quality Board (Board) accepted a rulemaking petition for study under 25 Pa. Code Chapter 23 (relating to Environmental Quality Board Policy for processing petitions--statement of policy). The petition, submitted by the Delaware Riverkeeper Network, in partnership with Perkiomen Valley Trout Unlimited, Lehigh County Conservation District, Perkiomen Watershed Conservancy, Montgomery County Conservation District, and over 80 co-petitioners, requests the Board amend 25 Pa. Code § 93.9f (relating to drainage list F) to upgrade the Upper Perkiomen Watershed to Exceptional Value Waters (EV) and Macoby Creek to High Quality Waters (HQ). The petitioner's request also includes the redesignation of Hosensack Creek (Montgomery County) from Cold Water Fishes (CWF) to EV; Perkiomen Creek (Berks County) from HQ-CWF to EV; Perkiomen Creek (Montgomery County) from Trout Stocking (TSF) to EV; West Branch Perkiomen (Berks County) from CWF to EV; West Branch Perkiomen Creek (Montgomery County) from CWF to EV; and Macoby Creek (Montgomery County) from TSF to HQ.

   Under 25 Pa. Code § 93.4d(a) (relating to processing petitions, evaluations and assessments to change a designated use), the Department of Environmental Protection (Department) is required to publish a notice of intent to assess candidate waters before performing survey work. The Department's assessment notice for the Upper Perkiomen Watershed will appear in a future issue of the Pennsylvania Bulletin.

   The previously referenced petition submitted by the Delaware Riverkeeper Network, et al. is available to the public by contacting the Environmental Quality Board, P. O.
