Vegetable Marketing and Research Program Referendum

   Under 3 Pa.C.S. §§ 4501--4513 (relating to Agricultural Commodities Marketing Act), an assessment-related referendum was held from March 26 to April 9, 2007, to determine if the producers affected by the Pennsylvania Vegetable Marketing and Research Program (Program) desired to increase the program's assessment rate as described in the original ballot mailing to producers. To pass, a majority of eligible producers voting had to vote in favor of the increased rate and the representative acreage must be in the majority as well. An impartial Teller Committee met on April 13, 2007, to count the ballots. The following results were submitted by the Teller Committee: a total of 397 eligible votes were cast with 239 producers voting in favor of, and 158 producers voting against, the program's assessment rate increase. An additional three ballots were invalid because they were either incomplete or ineligible due to the acreage requirement. Eligible producers voting in favor of the Program's increased assessment rate represented 60.2% of the votes and 62.7% of production acreage. Producers voting against the assessment rate increase represented 39.8% of the votes and 37.3% of production acreage. Because a majority of the votes and represented acreage were cast in favor of the referendum, the Program assessment rate increase shall become effective immediately.
