THE CLEAN STREAMS LAW AND THE FEDERAL CLEAN WATER ACT

APPLICATIONS FOR NATIONAL POLLUTION DISCHARGE ELIMINATION SYSTEM (NPDES) PERMITS AND WATER QUALITY MANAGEMENT (WQM) PERMITS

   This notice provides information about persons who have applied for a new, amended or renewed NPDES or WQM permit, a permit waiver for certain stormwater discharges or submitted a Notice of Intent (NOI) for coverage under a general permit. The applications concern, but are not limited to, discharges related to industrial, animal or sewage waste, discharges to groundwater, discharges associated with municipal separate storm sewer systems (MS4), stormwater associated with construction activities or concentrated animal feeding operations (CAFOs). This notice is provided in accordance with 25 Pa. Code Chapters 91 and 92 and 40 CFR Part 122, implementing The Clean Streams Law (35 P. S. §§ 691.1--691.1001) and the Federal Clean Water Act.

   For NPDES renewal applications in Section I, the Department of Environmental Protection (Department) has made a tentative determination to reissue these permits for 5 years subject to effluent limitations and monitoring and reporting requirements in their current permits, with appropriate and necessary updated requirements to reflect new and changed regulations and other requirements.

   For applications for new NPDES permits and renewal applications with major changes in Section II, as well as applications for MS4 individual permits and individual stormwater construction permits in Sections IV and VI, the Department, based upon preliminary reviews, has made a tentative determination of proposed effluent limitations and other terms and conditions for the permit applications. These determinations are published as proposed actions for comments prior to taking final actions.

   Unless indicated otherwise, the EPA Region III Administrator has waived the right to review or object to proposed NPDES permit actions under the waiver provision in 40 CFR 123.24(d).

   Persons wishing to comment on an NPDES application are invited to submit a statement to the regional office noted before an application within 30 days from the date of this public notice. Persons wishing to comment on a WQM permit application are invited to submit a statement to the regional office noted before the application within 15 days from the date of this public notice. Comments received within the respective comment periods will be considered in the final determinations regarding the applications. Comments should include the name, address and telephone number of the writer and a concise statement to inform the Department of the exact basis of a comment and the relevant facts upon which it is based.

   The Department will also accept requests for a public hearing on applications. A public hearing may be held if the responsible office considers the public response significant. If a hearing is scheduled, a notice of the hearing will be published in the Pennsylvania Bulletin and a newspaper of general circulation within the relevant geographical area. The Department will postpone its final determination until after a public hearing is held.

   Southeast Region: Water Management Program Manager, 2 East Main Street, Norristown, PA 19401.

   PA0030571, Sewage, SIC 4952, New Life Youth and Family Services Sewage Treatment Plant (STP), 585 Freeman School Road, Schwenksville, PA 19473. This proposed facility is located in Lower Salford Township, Montgomery County.

   Description of Proposed Activity: This application is for an existing sewage treatment facility.

   The receiving stream, UNT to East Branch Perkiomen Creek, is in the State Water Plan Watershed 3E--Perkiomen and is classified for: TSF, aquatic life, water supply and recreation. The nearest downstream public water intake/supply is Pennsylvania American's Water Filtration Plant and is approximately 18 miles downstream on the Schuylkill River.

   The effluent limits for Outfall 001 are based on a design flow of 22,500 gpd.

   Description of Proposed Activity: Renewal of NPDES permit to discharge 0.045 mgd of treated effluent from the Valley Forge Crossing Mobile Home Park Wastewater Treatment Plant. The plant is located at 1311 Catfish Lane, Norristown, PA 19403.

   The receiving stream, a UNT to the Schuylkill River, is in the State Water Plan Watershed 3F and is classified for: WWF, aquatic life, water supply and recreation. The nearest downstream public water supply intake for Pennsylvania American--Norristown is located on the Schuylkill River and is approximately 4.5 miles below the point of discharge.

   The proposed effluent limits for Outfall 001 are based on a design flow of 0.045 mgd.

   Description of Activity: This is a renewal NPDES permit application is for an existing sewage treatment facility.

   The receiving waters, a UNT to Swamp Creek, is in the State Water Plan Watershed 3E--Perkiomen, and is classified for: TSF, aquatic life, water supply and recreation. The nearest downstream public water intake/supply is Pennsylvania American's Water Filtration Plant and is approximately 25 miles downstream on the Schuylkill River.

   The effluent limits for Outfall 001 are based on a design flow of 49,900 gpd.

   PA0023256, Sewage, SIC 59, Upper Gwynedd Township, P. O. Box 1, West Point, PA 19486. This proposed facility is located in Upper Gwynedd Township, Montgomery County.

   Description of Proposed Activity: Amendment of an NPDES permit to discharge treated sanitary sewage from a facility located at Township Line Road, West of Swedesford Road, Upper Gwynedd Township, Montgomery County.

   This permit amendment includes an accelerated expiration date of June 2009, and the following additional revisions:

   Effective December 2008, in lieu of a total phosphorus limit, the permit includes an ortho-phosphate limit of 3.64 mg/l, applicable seasonally from November to March. Effective April 2009, the permit includes an ortho-phosphate limit of 1.0 mg/l, applicable seasonally from April to October.

   The amended permit requires the submission of WET testing results for the species Ceriodaphnia dubia only. In conjunction with the permit renewal in June 2009, the permittee will be required to submit the results of four rounds of WET test results for both Pimephales promelas and Ceriodaphnia dubia.

   The receiving stream, Wissahickon Creek, is in the State Water Plan Watershed 3F (Lower Schuylkill) and is classified for TSF. The nearest downstream public water supply intake for City of Philadelphia--Queen Lane Intake is located on the Schuylkill River.

   The proposed effluent limits for Outfall 001, effective from permit amendment issuance through November 30, 2008, are based on a design flow of 4.5 mgd.

   The receiving stream, Schuylkill River, is in the State Water Plan Watershed 3F (Lower Schuylkill) and is classified for: WWF, aquatic life, water supply and recreation. The nearest downstream public water supply intake is for the Pennsylvania American Water Company--Norristown District located on the Schuylkill River.

   The proposed effluent limits for Outfall 002 are based on a design flow of 6.0 mgd.

   The receiving stream, Forest Hills Run, is in the State Water Plan Watershed 1E and is classified for HQ-CWF. The nearest downstream public water supply intake for East Stroudsburg is located on the Delaware River below the point of discharge.

   This application is for renewal of an NPDES permit to discharge treated process water, sewage and untreated stormwater from the Specialty Metals Products Division Plant in North Strabane Township, Washington County.

   The following effluent limitations are proposed for discharge to the receiving waters, Little Chartiers Creek and UNT to Little Chartiers Creek, classified as a HQ-WWF with existing and/or potential uses for aquatic life, water supply and recreation.
