Disclosure of Information Related to Persons on the Self-Exclusion List

   The Pennsylvania Gaming Control Board (Board), at its September 12, 2007, public meeting, adopted guidelines for the disclosure of information related to individuals on the Board's self-exclusion list. Section 1516(d) of the Pennsylvania Race Horse Development and Gaming Act, 4 Pa.C.S. § 1516(d) (relating to list of persons self excluded from gaming activities) provides that the Board's list of self-excluded persons may not be open to public inspection. However, since the creation of the Board's self-exclusion program, the Board has received a variety of requests for information relating to individuals who are or are not on the self-exclusion list. In an effort to provide reasonable transparency related to the self-exclusion list and to provide information regarding the efficacy of the self-exclusion program, the Board is adopting these guidelines as a statement of policy to provide guidance to the general public as to when information relating to individuals who are or are not on the self-exclusion list will be released. Consistent with its current practice, the Board will not disclose to the public the identity of individuals who are on the Board self-exclusion list.

Fiscal Impact

   This statement of policy provides guidance on when the Board will release information related to persons who are on the Board's list of self-excluded individuals. Since these guidelines do not impose any additional duties or responsibilities, they do not impose any costs on the general public, entities regulated by the Board or the Board.

CHAPTER 503b. DISCLOSURE OF INFORMATION RELATED TO PERSONS ON THE SELF-EXCLUSION LIST--STATEMENT OF POLICY

§ 503b.1. Disclosure of information related to persons on the self-exclusion list.

   (a)  The Board may periodically release to the public general data and demographics related to individuals on the self-exclusion list (such as the total number of individuals on the list, gender breakdown, age range, types of gambling engaged in, and the like).

   (b)  The Board may make selected data available, upon request, for the limited purpose of assisting in the proper administration of responsible gaming programs.

   (c)  The Board will not confirm or deny the existence of an individual's name or identity on the Board self-exclusion list.
