   The following temporary authority and/or permanent authority applications for the right to render service as a common carrier or contract carrier in this Commonwealth have been filed with the Pennsylvania Public Utility Commission. Formal protests and petitions to intervene must be filed in accordance with 52 Pa. Code (relating to public utilities). A protest shall indicate whether it applies to the temporary authority application, the permanent authority application, or both. Filings must be made with the Secretary, Pennsylvania Public Utility Commission, P. O. Box 3265, Harrisburg, PA 17105-3265, with a copy served on the applicant by October 29, 2007. Documents filed in support of the applications are available for inspection and copying at the Office of the Secretary between 8 a.m. and 4:30 p.m., Monday through Friday, and at the business address of the respective applicant.

Applications of the following for approval to begin operating as common carriers for transportation of persons as described under each application.

   A-00124105.    A-00102577, F4. Action Transit Enterprises, Inc. (4935 Verona Road, Verona, Allegheny County, PA 15147)--a corporation of the Commonwealth--in group and party service, using vehicles seating 15 passengers or less, including the driver, between points in the Counties of Armstrong, Beaver, Butler, Washington, Fayette and Westmoreland, and from points in the said counties, and the County of Allegheny, to points in Pennsylvania, and return.

Subject to the following conditions:
That no right, power or privilege is granted to provide service to and from the Borough of Mt. Pleasant and points on Route 931 to the Village of Carpentertown, thence by means of Township Road (Legislative Route 64145) and Township Road, through the Village of Mutual to the limits of the City of Greensburg, and points within an airline distance of 2 miles of said routes, provided, however, that service may be rendered to and from the City of Greensburg.
That no right, power or privilege is granted to provide service to or from points on U. S. Highway Route 119, and points within an airline distance of 2 statute miles of said route, between the City of Greensburg and the intersection of U. S. Highway Route 119 and State Highway Route 31, all in Westmoreland County, provided, however, that service may be rendered to and from the City of Greensburg.
That the applicant shall comply with the rules and regulations of the Commission as set forth at 52 Pa. Code §§ 29.353 and 29.354 (relating to method of operation in paratransit service and vehicle; and equipment requirements: paratransit service).
That the service authorized herein is limited to vehicles with a seating capacity of not more than 48 passengers.

   A-00103841, F.1. Pocono Limousine Service, Inc. (Route 611N, P. O. By the Commission

   On April 7, 2005, the Bureau of Transportation and Safety instituted a complaint against Travel With Comfort, Inc., respondent, alleging that respondent operated its vehicle while under suspension for failing to maintain evidence of insurance on each of its vehicles used in providing service authorized by this Commission, a violation of 66 Pa.C.S. § 501(c); failed to have the proper name or registered insignia and the proper number of the certificate of public convenience identification markings on each side of the vehicle, a violation of 52 Pa. Code § 29.71(a); failed to include in its advertisement, its proper name and certificate number issued by this Commission, a violation of 52 Pa. Code § 21.2; and offered service of a different nature than that authorized by this Commission, a violation of 66 Pa.C.S. § 1102(a)(1)(i).

   Respondent was duly notified that, if it failed to file an answer which admitted or failed to deny the allegations in the complaint, then the Bureau of Transportation and Safety would request the Commission to enter an order imposing a fine. The complaint and notice were sent by certified mail and returned ''Unknown'' on April 19, 2005. The complaint and notice were then published in the Pennsylvania Bulletin on September 24, 2005; and, to date, more than thirty days later, no response has been received by respondent.

   Respondent's certificate of public convenience at Docket No. A-00115561, F.3 was cancelled on May 25, 2005, for failure to maintain evidence of bodily injury and property damage insurance on file with this Commission.

Therefore, It Is Ordered:

   1.  That the allegations in the complaint are deemed to be admitted.

   2.  That the complaint is sustained.

   3.  That the respondent, within 20 days from the date of service of this order, pay a fine of $1,350, by certified check or money order payable to the Pennsylvania Public Utility Commission at P. O. Box 3265, Harrisburg, PA 17105-3265, as provided in the Public Utility Code, 66 Pa.C.S. § 3301 and 3315.

   4.  That the respondent cease and desist from further violations of the Public Utility Code, 66 Pa.C.S. §§ 101, et seq., and the Regulations of this Commission, 52 Pa. Code §§ 1.1, et seq.
