Availability of Technical Guidance

   Technical guidance documents are available on the Department of Environmental Protection's (Department) web site at www.depweb.state.pa.us (DEP Keywords: ''Technical Guidance''). The ''Final Documents'' heading is the link to a menu of the various Department bureaus where each bureau's final technical guidance documents are posted. The ''Draft Technical Guidance'' heading is the link to the Department's draft technical guidance documents.

   The Department will continue to revise its nonregulatory documents, as necessary, throughout 2008.

Ordering Paper Copies of Department Technical Guidance

   The Department encourages the use of the Internet to view and download technical guidance documents. When this option is not available, persons can order a paper copy of any of the Department's draft or final technical guidance documents by contacting the Department at (717) 783-8727.

   In addition, bound copies of some of the Department's documents are available as Department publications. Check with the appropriate bureau for more information about the availability of a particular document as a publication.

Changes to Technical Guidance Documents

   Following is the current list of recent changes. Persons who have questions or comments about a particular document should call the contact person whose name and phone number is listed with each document.

Draft Technical Guidance

   DEP ID:  562-3900-402. Title: Citizens' Requests: Receiving, Tracking, Investigating, Appealing and Filing. Description: This document revises the procedures for the investigation of complaints relating to coal and industrial mineral mining activities and the use of explosives. The primary revision is to eliminate the informal review process. Under the existing guidance, citizens are provided with the opportunity to request that the Bureau of Mining and Reclamation review the investigations completed by the District Mining Offices. Based on reduced staffing levels, the Bureau of Mining and Reclamation is no longer able to conduct thorough informal reviews. Written Comments: The Department is seeking comments on the substantive revisions to draft technical guidance No. 562-3900-402. Interested persons may submit written comments on this draft technical guidance document by April 14, 2008. Comments submitted by facsimile will not be accepted. The Department will accept comments submitted by e-mail. A return name and address must be included in each e-mail transmission. Written comments should be submitted to William S. Final Technical Guidance:

   DEP ID:  383-3310-409. Title: Pennsylvania Drinking Water Information System (PADWIS) Violation and Enforcement User's Manual. Description: This manual provides uniform instructions and protocol for the use of the online Safe Drinking Water Program violation and enforcement information system that is a major subsystem of the PADWIS. Substantive revisions were made to the guidance to reflect changes in computer system technology, including system changes associated with the conversion from a text-based to a graphical user-interface system. The manual was also revised to include information on new violations associated with regulations that were implemented after the manual was last published in 2000. The new regulations addressed in the manual include the Consumer Confidence Report, Disinfectants/Disinfection By Products, Filter Backwash and Recycling, Interim Enhanced Surface Water Treatment, Long Term 1 Enhanced Surface Water Treatment, Radionuclides and Public Notice. Notice of the Draft Technical Guidance was published at 36 Pa.B. 5935 (September 23, 2006). During the 30-day public comment period, the Department did not receive any comments on the draft technical guidance. No additional changes were made to the document following the public comment period.    DEP ID:  253-0300-100. Title: Pennsylvania's Land Recycling Program Technical Guidance Manual--Section IV General Guidance. Description: Substantive revisions were proposed to Pennsylvania's Land Recycling Program Technical Guidance Manual--Section IV General Guidance and were advertised for public comment at 37 Pa.B. 4261 (August 4, 2007). The revisions included the addition of several regulated substances to the ''short list'' in Table IV-9 for several petroleum products and mineral insulating oils containing PCBs. It is these regulated substances or ''chemicals of concern'' identified in the ''short list'' that need to be tested for to demonstrate attainment under any of the Act 2 standards when there is a release of these petroleum products, uncontaminated by other sources. The Department felt the addition of new regulated substances to the short list would result in more extensive remediation for certain petroleum products. During the 30-day public comment period that concluded on September 4, 2007, the Department received comments on the document, which are addressed in a separate Comment and Response Document. As a result of comments received, the Department modified the final guidance document by amending the compounds and testing protocol found in Table IV-9. Additional changes were also made to the final guidance, including modifications to clarify the transition language between the current short list and the new short list.
