Appeal of Gooseberry Realty Corporation under the Storage Tank and Spill Prevention Act; Underground Storage Tank Indemnification Fund; USTIF File No. 06-0055(S); Doc. No. UT08-06-004

   The proceedings in this matter will be governed by 2 Pa.C.S. §§ 501--508 and 701--704 (relating to the Administrative Agency Law); 1 Pa. Code Part II (relating to General Rules of Administrative Practice and Procedure); and any other relevant procedure provisions of law.

   A hearing on the sole issue of the timeliness of the appeal in this case is scheduled for July 11, 2008, at 10 a.m., in the Administrative Hearings Office, Room 200, Capitol Associates Building, 901 North Seventh Street, Harrisburg, PA 17102.

   On or before July 3, 2008, each party must file with the Administrative Hearings Office a prehearing statement which shall contain: (1) names and address of witnesses to be called; and (2) a list of documents to be presented at the hearing.

   Both parties shall appear at the scheduled hearing prepared to offer all relevant testimony or other evidence. Each party must bring documents, photographs, drawings, claims, files, witnesses, and the like, necessary to support the party's case. A party intending to offer documents or photographs into evidence shall bring enough copies for the record and for each opposing party. All exhibits shall be premarked for identification purposes prior to the start of the hearing.
