NUTRIENT MANAGEMENT PLANS RELATED TO APPLICATIONS FOR NATIONAL POLLUTION DISCHARGE ELIMINATION SYSTEM (NPDES) PERMITS FOR CONCENTRATED ANIMAL FEEDING OPERATIONS (CAFO)

   The State Conservation Commission has taken the following actions on previously received applications for nutrient management plans under the act of July 6, 2005 (Act 38 of 2005, 3 Pa.C.S. §§ 501--522) (hereinafter referred to as Act 38), for agricultural operations that have or anticipate submitting applications for new, amended or renewed NPDES permits, or Notices of Intent for coverage under a general permit, for CAFOs, under 25 Pa. Code Chapter 92. This notice is provided in accordance with 25 Pa. Code Chapter 92 and 40 CFR Part 122, implementing The Clean Streams Law (35 P. S. §§ 691.1--691.1001) and the Federal Clean Water Act.

   Persons aggrieved by any action may appeal under section 517 of Act 38, section 4 of the Environmental Hearing Board Act (35 P. S. § 7514) and 2 Pa.C.S. §§ 501--508 and 701--704 (relating to Administrative Agency Law) to the Environmental Hearing Board, Second Floor, Rachael Carson State Office Building, 400 Market Street, P. O.    Plan Description: The approved plan provides for an existing three bedroom dwelling on a 0.7 acre tract with a malfunctioning cesspool. A small flow treatment facility with a discharge to the Delaware River is proposed to abate the malfunction to the cesspool disposal system. There are no suitable soils on the lot to support the use of an onlot sewage disposal system. The proposed 400 gpd of sewage flow will be treated by an Orenco Aerobic Treatment Tank with an effluent pump to an AdvanTex-AX 20 Filter followed by a SalCor UV Light unit prior to discharge to the Delaware River. A private well provides water for the lot. The proposed development is located at 3701 North Delaware Drive, Forks Township, Northampton County.    Plan Description: Approval of a revision to the Official Sewage Plan of North Middleton Township, Cumberland County. The approved plan provides for a Small Flow Treatment Facility of 400 gpd to serve the existing property owned by Tager Properties at 770 Conodoguinet Avenue Extended. The proposed SFTF is to repair a malfunctioning onlot sewage system with a treated discharge to the Conodoguinet Creek. The Department of Environmental Protection's review of the sewage facilities update revision has not identified any significant environmental impacts resulting from this proposal.

   Plan Description: The approved plan provides for a new relocated 1.5 mgd sewage treatment plant with a treated discharge to Killinger Creek serving North Londonderry Township and Palmyra Borough. The plan also provides for an expansion of the North Londonderry Township sewer service area and several new interceptors. Additionally, North Londonderry Township will implement an onlot disposal system (OLDS) management ordinance to address all OLDS in the municipality. The Department of Environmental Protection's review of the sewage facilities update revision has not identified any significant environmental impacts resulting from this proposal. Any required NPDES Permits or WQM Permits must be obtained in the name of the municipality or authority as appropriate.

LAND RECYCLING AND ENVIRONMENTAL REMEDIATION

UNDER ACT 2, 1995

PREAMBLE 2


The following plans and reports were submitted under the Land Recycling and Environmental Remediation Standards Act (35 P. S. §§ 6026.101--6026.908).

   Provisions of Chapter 3 of the Land Recycling and Environmental Remediation Standards Act (act) require the Department of Environmental Protection (Department) to publish in the Pennsylvania Bulletin a notice of submission of plans and reports. A final report is submitted to document cleanup of a release of a regulated substance at a site to one of the act's remediation standards. A final report provides a description of the site investigation to characterize the nature and extent of contaminants in environmental media, the basis for selecting the environmental media of concern, documentation supporting the selection of residential or nonresidential exposure factors, a description of the remediation performed and summaries of sampling analytical results which demonstrate that remediation has attained the cleanup standard selected. Submission of plans and reports, other than the final report, shall also be published in the Pennsylvania Bulletin. These include the remedial investigation report, risk assessment report and cleanup plan for a Site-Specific Standard remediation. A remedial investigation report includes conclusions from the site investigation, concentration of regulated substances in environmental media; benefits of refuse of the property and, in some circumstances, a fate and transport analysis. If required, a risk assessment report describes potential adverse effects caused by the presence of regulated substances. If required, a cleanup plan evaluates the abilities of potential remedies to achieve remedy requirements.

   For further information concerning plans or reports, contact the Environmental Cleanup Program manager in the Department regional office after which the notice of receipt of plans or reports appears. If information concerning plans or reports is required in an alternative form, contact the Community Relations Coordinator at the appropriate regional office. The report is intended to document remediation of the site to meet the Residential Statewide Health Standard.

   McCoy Electronics Facility, Mercersburg Borough, Franklin County. Weston Solutions, Inc., 1400 Weston Way, Suite 2653, West Chester, PA 19380, on behalf of Spirit Washers, 95 Fox Road, Mercersburg, PA 17236 and Corning, Inc., HP-ME-02-50, Corning, NY 14831, submitted a Final Report concerning remediation of site soils and groundwater contaminated with chlorinated solvents and cobalt. The report is intended to document remediation of the site to meet a combination of the Statewide Health and Site-Specific Standards.

Plans and reports required by provisions of the act for compliance with selection of remediation to a Site-Specific Standard, in addition to a final report, include a remedial investigation report, risk assessment report and cleanup plan. A remedial investigation report includes conclusions from the site investigation, concentration of regulated substances in environmental media, benefits of refuse of the property and, in some circumstances, a fate and transport analysis. If required, a risk assessment report describes potential adverse effects caused by the presence of regulated substances. If required, a cleanup plan evaluates the abilities of potential remedies to achieve remedy requirements. A work plan for conducting a baseline remedial investigation is required by provisions of the act for compliance with selection of a special industrial area remediation. The baseline remedial investigation, based on the work plan, is compiled into the baseline environmental report to establish a reference point to show existing contamination, describe proposed remediation to be done and include a description of existing or potential public benefits of the use or reuse of the property. The Department may approve or disapprove plans and reports submitted. This notice provides the Department's decision and, if relevant, the basis for disapproval.

FEDERAL WATER POLLUTION CONTROL ACT SECTION 401

   The Department of Environmental Protection (Department) has taken the following actions on previously received permit applications, requests for Environmental Assessment approval and requests for Water Quality Certification under section 401 of the Federal Water Pollution Control Act (FWPCA) (33 U.S.C.A. § 1341).

The bridge across Sandy Lick Creek shall be constructed as a single span structure having a minimum span of 125-feet, underclearance of 14.5-feet and width of 10-feet. The bridge across Reasinger Run shall be constructed as a single span structure having a minimum span of 60-feet, underclearance of 7.5-feet and width of 10-feet. The project is located along the eastern right-of-way of SR 0219 approximately 2,350-feet east of Park Avenue and SR 0219 intersection. This permit was issued under Section 105.13(e) ''Small Projects.'' This permit also includes 401 Water Quality Certification.

To place fill in wetlands to expand storage area in Indiana Township, Allegheny County, United States Army Corps of Engineers, Pittsburgh District (Glenshaw, PA Quadrangle N:  16.5 inches; W:  0.5 inch, Latitude: 40° 35` 25"; Longitude: 79° 52` 39"). To place fill in 0.095 acre of wetlands and along the right bank of Deer Creek (CWF) and the left bank of Cedar Creek (CWF) for the purpose of expanding applicants' landscaping business. The project is located just northeast from the intersection of Shafer Road and SR 910. To compensate for the wetland impacts, the applicant has made a contribution to the wetland replacement fund.

   E02-1586. McDonald's Corporation, 1000 Omega Drive, Pittsburgh, PA 15205. To construct bank protection in Shaler Township, Allegheny County, United States Army Corps of Engineers, Pittsburgh District (Glenshaw, PA Quadrangle N:  2.4 inches; W:  10.7 inches, Latitude: 40° 30` 48"; Longitude: 79° 57` 07"). To remove the existing structure (McDonald's Restaurant) and to construct and maintain a new structure (McDonald's Restaurant) on the left bank of Pine Creek (TSF), to remove the existing 12-inch diameter outfall structure and to construct and maintain a new 18-inch diameter outfall structure on the left bank of said stream and to regrade the left bank of said stream for a distance of approximately 78.0 linear feet for the purpose of renovating the existing McDonald's Restaurant. The project is located just west from the intersection of Pennview Street and SR 008 and will impact 186 linear feet of stream channel.

   E32-339 A2. Reliant Energy Northeast Management Company, 121 Champion Way, Suite 200, Canonsburg, PA 15317-5817. To amend permit E32-339 which authorized the construction of multiple arch culverts, relocate a channel and fill wetlands in West Wheatfield Township, Indiana County, United States Army Corps of Engineers, Pittsburgh District (New Florence, PA Quadrangle N:  2.4 inches; W:  9.3 inches, Latitude: 40° 23` 18"; Longitude: 70° 4` 0"). To amend permit E32-339 which authorized the construction and maintenance of 9-foot 6-inch by 6-foot 5-inch CMP arch culvert in a Tributary to the Conemaugh River (WWF) under railroad Spurs A and B. To relocate and maintain 160 LF of channel beginning at Spur B culvert inlet and to construct and maintain three 7-foot by 5-foot 1-inch CMP arch culverts under Spur A and two equal size culverts under Spur B for crossing of a wetland area. To place and maintain fill in 1.62 acres of wetlands. The impacts were part of the expansion of the existing Conemaugh Generating Station Units and the construction of the processing and storage building, material handling equipment, a railroad spur and access road located 500 feet east of SR 711 (New Florence, PA Quadrangle N:  2.4 inches; W:  9.9 inches) in West Wheatfield Township, Indiana County.

   The permit was amended on May 17, 2006 which authorized the placement and maintenance of fill in three wetlands for a total impact of 0.03 acre; the placement and maintenance of fill along the right bank floodway of the Conemaugh River for a total length of approximately 2,000 feet; the extension and maintenance of the height of an existing endwall by 1-foot on a UNT to the Conemaugh River (WWF); and the extension of the length of an existing culvert by 6-feet located on another UNT to the Conemaugh River (WWF). Both are located in a watershed with drainage areas under 100 acres. The amendment was for the construction of a new rail track to facilitate coal rail car operations at the Conemaugh Power Station (The project begins at New Florence, PA Quadrangle N:  2.2 inches; W:  8.1 inches, Latitude: 40° 23` 16"; Longitude: 79° 4` 24" and the Project ends at N:  1.9 inches; W:  9.5 inches, Latitude: 40° 23` 07"; Longitude: 79° 03` 27").

   This amendment authorizes the construction and maintenance of a retaining wall 70-foot long and 8-foot high located along the left bank of a UNT to the Conemaugh River (WWF), to stabilize the stream embankment located beneath the existing ''A'' Belt conveyor. The project is located near the Conemaugh Generating Station (New Florence, PA Quadrangle N:  2.4 inches; W:  9.3 inches, Latitude: 40° 23` 18"; Longitude: 70° 4` 0") in West Wheatfield Township, Indiana County.

   E63-606. Mountain V Oil and Gas, Inc., P. O. Box 470, Bridgeport, PA 26330. To construct a ford crossing in Somerset Township, Washington County, United States Army Corps of Engineers, Pittsburgh District (Hackett, PA Quadrangle: N:  6.8 inches; W:  8.5 inches, Latitude: 40° 9` 45"; Longitude: 80° 3` 39"). This project is associated with the larger, phased Turnpike Commission I76 reconstruction and improvement work with these encroachments starting approximately at the southeast end of the Irwin interchange in Hempfield Township, Westmoreland County, United States Army Corps of Engineers, Pittsburgh District, continuing approximately 7 miles southeast to the northeast end of the New Stanton interchange in New Stanton Borough and overlapping the encroachments authorized by E65-910 (beginning from Irwin, PA Quadrangle N:  10.3 inches; W:  6.9 inches, Latitude: 40° 18` 24"; Longitude: 79° 40` 28"; ending Mount Pleasant, PA Quadrangle N:  19.2 inches; W:  1.1 inches, Latitude: 40° 13` 51"; Longitude: 79° 30` 28").

   1.  A 1,223 ft. long relocation of Little Sewickley Creek (TSF) with a drainage area of 1.5 square miles.

   2.  Replacement of an existing 85 ft. long 5 ft. by 4 ft. box culvert on a UNT to Little Sewickley Creek with a drainage area of 134 acres by a 135 ft. long 60 inch diameter equivalent elliptical culvert depressed 1 ft. and paralleled by a 54 inch diameter equivalent elliptical culvert.

   3.  A 1,969 ft. long relocation of a UNT to Little Sewickley Creek with a drainage area of 1.5 square miles.

   4.  A 150 ft. long relocation of a UNT to Little Sewickley Creek and an associated 146 ft. long. 16 ft. by 6.5 box culvert replacement of a 78 ft. long bridge with a drainage area of 1.5 square miles.

   5.  A 630 ft. long relocation of a UNT to Little Sewickley Creek with a drainage area of 1.5 square miles.

   6.  A 410 ft. long relocation of a UNT to Little Sewickley Creek and associated replacement and extension of a 100 ft. long box culvert by 14 ft. by 10 ft. box culvert with a total length of 240 ft. and with a drainage area of 1.9 square miles.

   7.  A 115 ft. long extension to an existing 240 ft. long 48 inch diameter culvert in a UNT to Sewickley Creek (WWF) with a drainage area of 100 acres.

   8.  A 550 ft. long relocation and associated 50 ft. extension to an existing 115 ft. long 72 inch diameter culvert in a UNT to Sewickley Creek with a drainage area of 0.44 square mile.

   9.  A 241 ft. long relocation to a UNT to Sewickley Creek with a drainage area of 0.65 square mile.

   10.  A 374 ft. long relocation to a UNT to Sewickley Creek with a drainage area of 2.15 square miles.

   In addition, construct and maintain associated stormwater outfalls and temporary crossings; a total of 0.326 acre of PEM/PSS/PFO wetland will be filled and maintained; 0.6 acre of replacement wetland will be built at the Brush Run mitigation site; and, permanent stream impacts will be mitigated by breaching the Howell Dam.
