LAND RECYCLING AND ENVIRONMENTAL REMEDIATION

UNDER ACT 2, 1995

PREAMBLE 2


The following plans and reports were submitted under the Land Recycling and Environmental Remediation Standards Act (35 P. S. §§ 6026.101--6026.908).

   Provisions of Chapter 3 of the Land Recycling and Environmental Remediation Standards Act (act) require the Department of Environmental Protection (Department) to publish in the Pennsylvania Bulletin a notice of submission of plans and reports. A final report is submitted to document cleanup of a release of a regulated substance at a site to one of the act's remediation standards. A final report provides a description of the site investigation to characterize the nature and extent of contaminants in environmental media, the basis for selecting the environmental media of concern, documentation supporting the selection of residential or nonresidential exposure factors, a description of the remediation performed and summaries of sampling analytical results which demonstrate that remediation has attained the cleanup standard selected. Submission of plans and reports, other than the final report, shall also be published in the Pennsylvania Bulletin. These include the remedial investigation report, risk assessment report and cleanup plan for a Site-Specific Standard remediation. A remedial investigation report includes conclusions from the site investigation, concentration of regulated substances in environmental media; benefits of refuse of the property and, in some circumstances, a fate and transport analysis. If required, a risk assessment report describes potential adverse effects caused by the presence of regulated substances. If required, a cleanup plan evaluates the abilities of potential remedies to achieve remedy requirements.

   For further information concerning plans or reports, contact the Environmental Cleanup Program manager in the Department regional office after which the notice of receipt of plans or reports appears. If information concerning plans or reports is required in an alternative form, contact the Community Relations Coordinator at the appropriate regional office. John Thatcher, BL Companies, Inc., 213 Market Street, 6th Floor, Harrisburg, PA 17101 on behalf of Robert Lerner, Rite Aid Corporation, 30 Hunter Lane, Harrisburg, PA 17011 has submitted a Remedial Investigation Report concerning remediation of site soil and groundwater contaminated with other organics and metals. The report is intended to document remediation of the site to meet the Site-Specific Standards.

   Southcentral Region: Environmental Cleanup Program Manager, 909 Elmerton Avenue, Harrisburg, PA 17110.

   Turkey Hill Dairy, Manor Township, Lancaster County. GemChem, Inc., 53 North Cedar Street, Lititz, PA 17543, on behalf of Turkey Hill Dairy, Inc., 2601 River Road, Conestoga, PA 17516, submitted a Final Report concerning remediation of site soils contaminated with diesel fuel which leaked from a faulty tractor trailer fuel tank. The property is a commercial facility and will remain the same in the future. The report is intended to document remediation of the site to the Statewide Health Standard and was submitted within 90 days of the spill which occurred on December 17, 2007.

   Union Tank Car, Altoona City, Blair County. Mountain Research, LLC, 825 25th Street, Altoona, PA 16601, on behalf of Union Tank Car, 175 West Jackson Boulevard, Chicago, IL 60604, submitted a combined Remedial Investigation and Final Report concerning remediation of site soils and groundwater contaminated with VOCs. The report is intended to document remediation of the site to a combination of the Statewide Health and Site-Specific Standards.

   Former Lehigh Valley Railroad Maintenance Facility, Sayre Borough, Bradford County, KU Resources, Inc., 22 South Linden Street, Duquesne, PA 15110 on behalf of Brian Driscoll, 1 Progress Plaza, Towanda, PA 18848 has submitted a Remedial Investigation Report concerning remediation of site soil and groundwater contaminated with organics (TCE) in groundwater, LNAPL contamination in a confined area (diesel fuel), metals (lead) in drainage swales. The report is intended to document remediation of the site to meet the Site-Specific Standard.

   Metzger Estate, Muncy Township, Lycoming County, Chambers Environmental Group, Inc., 620 East Rolling Ridge Drive, Bellefonte, PA 16823 on behalf of Andrea Bower, Attorney for Metzger Estate, 426 Broad Street, Montoursville, PA 17754 has submitted a Final Report concerning remediation of site soil and groundwater contaminated with petroleum. The report is intended to document remediation of the site to meet the Statewide Health Standard.

LAND RECYCLING AND ENVIRONMENTAL REMEDIATION

The Department has taken action on the following plans and reports under the Land Recycling and Environmental Remediation Standards Act (35 P. S. §§ 6026.101--6026.908).

   Provisions of 25 Pa. Code § 250.8, administration of the Land Recycling and Environmental Remediation Standards Act (act), require the Department of Environmental Protection (Department) to publish in the Pennsylvania Bulletin a notice of final actions on plans and reports. A final report is submitted to document cleanup of a release of a regulated substance at a site to one of the remediation standards of the act. A final report provides a description of the site investigation to characterize the nature and extent of contaminants in environmental media, the basis of selecting the environmental media of concern, documentation supporting the selection of residential or nonresidential exposure factors, a description of the remediation performed and summaries of sampling methodology and analytical results which demonstrate that the remediation has attained the cleanup standard selected. Plans and reports required by provisions of the act for compliance with selection of remediation to a Site-Specific Standard, in addition to a final report, include a remedial investigation report, risk assessment report and cleanup plan. A remedial investigation report includes conclusions from the site investigation, concentration of regulated substances in environmental media, benefits of refuse of the property and, in some circumstances, a fate and transport analysis. If required, a risk assessment report describes potential adverse effects caused by the presence of regulated substances. If required, a cleanup plan evaluates the abilities of potential remedies to achieve remedy requirements. A work plan for conducting a baseline remedial investigation is required by provisions of the act for compliance with selection of a special industrial area remediation. The baseline remedial investigation, based on the work plan, is compiled into the baseline environmental report to establish a reference point to show existing contamination, describe proposed remediation to be done and include a description of existing or potential public benefits of the use or reuse of the property. The Department may approve or disapprove plans and reports submitted. This notice provides the Department's decision and, if relevant, the basis for disapproval.

   For further information concerning the plans and reports, contact the Environmental Cleanup Program manager in the Department regional office before which the notice of the plan or report appears. If information concerning a final report is required in an alternative form, contact the Community Relations Coordinator at the appropriate regional office. The Remedial Investigation/Final Report was approved by the Department of Environmental Protection on February 5, 2008.

The final report demonstrated attainment of the Residential Statewide Health Standard and was approved by the Department of Environmental Protection on February 4, 2008.

   Vonda Kirchner Property, Lancaster City, Lancaster County. GemChem, Inc., 53 North Cedar Street, Lititz, PA 17543, on behalf of Vonda Kirchner, 517 Union Street, Lancaster, PA 17603-5239, submitted a Final Report concerning the remediation of site soils contaminated with motor oil. The final report demonstrated attainment of the Residential Statewide Health Standard and was approved by the Department of Environmental Protection on February 5, 2008.

   Dominion Transmission Ellisburg Compressor Station, Genesee Township, Potter County, URS Corporation, 140 Cypress Station Drive, Suite 140, Houston, TX 77090 on behalf of Dominion Resources Services, Inc., 501 Martindale Street, Suite 400, Pittsburgh, PA 15212-5817 has submitted a Final Report concerning remediation of site soil and groundwater contaminated with ethylene glycol. The Final Report demonstrated attainment of the Statewide Health Standard and was approved by the Department of Environmental Protection on February 6, 2008.

   Dominion Transmission Inc., Harrison Compressor Station, Harrison Township, Potter County, Dominion Resource Services, Inc., 501 Martindale Street, Suite 400, DL Clark Building, Pittsburgh, PA 15212-5817 has submitted a Final Report concerning remediation of site soil contaminated with ethylene glycol. The Final Report demonstrated attainment of the Statewide Health Standard and was approved or by the Department of Environmental Protection on February 6, 2008.

   Wellington Development--WVDT, LLC has secured 144 tpy of VOC, 1,663 tpy of NOx and 1,238 tpy of SOx ERC from LTV Steel Company, Inc. for use for offsetting purposes. The Department of Environmental Protection (Department) has modified Plan Approval No. 30-00150A to indicate the Department's approval of ERC transfer and use by the addition of the following special condition:

   E1109-001. Greater Johnstown Water Authority, 640 Franklin Street, Johnstown, PA 15901. Abandoned Mine Drainage Treatment Project, in Jackson Township, Cambria County, Pittsburgh ACOE District.

   The applicant proposes to construct an access road with a permanent stream crossing in order to access an abandoned mine drainage treatment facility to be constructed by the Bureau of Abandoned Mine Reclamation. The project will include the filling of 0.048 acre of PF wetland, the installation of a culvert on an intermittent stream channel, the fill and reconstruction of 162` of intermittent stream channel and the construction of a permanent stream crossing across Salt Lick Run. An existing stream ford will be used as a temporary crossing during construction. Stream and wetland impacts total 0.143 acre (Nanty Glo Quadrangle N:  5.3 inches; W:  10.3 inches).

   E12-167. Vincent F. Gavlik, 433 Cherry Blossom Drive, Belle Vernon, PA 15012. Gavlik Storage Shed, in Grove Township, Cameron County, ACOE Baltimore District (Sinnemahoning, PA Quadrangle N:  41° 21` 51"; W:  78° 03` 22").

   Construct and maintain a 12 by 20 feet storage shed in the floodway of First Fork Sinnemahoning Creek. The structure will be placed on three 8 by 8 inch beams and is located approximately 13 feet from the top of the bank. This project proposes no permanent impact to First Fork Sinnemahoning Creek, which is designated a HQ-CWF and does not propose to impact any jurisdictional wetlands. This permit was issued under Section 105.13(e) ''Small Projects.''

   E17-439. Clearfield Creek Watershed Association, 216 Bedlin Hollow Road, Ashville, PA 16613. Morgan Run No. 8 Acid Mine Drainage Treatment Project in Decatur Township, Clearfield County, ACOE Baltimore District (Wallaceton, PA Quadrangle Latitude: 40° 54` 5.04"; Longitude: 78° 21` 40.43").

   The permittee shall construct, operate and maintain a passive acid mine drainage treatment system; two rock flow diversions; two rock outfalls; and two minor road crossings in and along a UNT to Morgan Run and wetlands associated to the same UNT for the abatement of acid mine drainage pollution. The project is located along the northern right-of-way of SR 2012 approximately 3,500-feet north of the point where Morgan Run crosses beneath SR 2012. Construction of the Morgan Run No. 8 Acid Mine Drainage Treatment Project permanently impacts 500-feet of stream channel, for which the Department of Environmental Protection has deemed the operation and maintenance of the acid mine drainage treatment facility as adequate mitigation.

   E59-483. Walter F. Grabowski Partnership, P. O. Box 741, Wellsboro, PA 16901. Water Obstruction and Encroachment Joint Permit in Tioga Township, Tioga County, ACOE Susquehanna River Basin District (Jackson Summit, PA Quadrangle N:  41° 54` 24"; W:  77° 7` 1.4").

   To construct and maintain a culvert crossing on a skew of 90° in Bentley Creek (WWF). The project is located along Park Hill Road, approximately 1.9 miles east of intersection with SR 0287, in Tioga Township, Tioga County. This project does not propose to impact any jurisdictional wetlands. This permit was issued under Section 105.13(e) ''Small Projects.'' This permit also includes 401 Water Quality Certification.

Bureau of Mine Safety, Request for Variance

   The Department of Environmental Protection (Department), Bureau of Mine Safety (Bureau), has received a request for variance from AMFIRE Mining Company. The following notification contains a summary of this request. A complete copy of the variance request may be obtained from Cathy Dunn by calling (724) 439-7469 or from the BMS web site at www.depweb.state.pa.us/deepminesafety/site/default.asp.

   The Department is publishing a summary of the request in order to solicit comments from affected parties on the proposed variance request. Comments may be used by the Bureau to assist in its investigation of the variance request. Comments will be accepted for 30 days following the publication of this notice.    Section 702 of the Bituminous Coal Mine Act (act) (52 P. S. §§ 701-101--701-706), provides a mechanism for operators to obtain variances from specific requirements of the act to accommodate the adoption of new machinery, equipment, tools, supplies, methods or processes.

   Section 319 states that all electrical equipment not covered elsewhere in this act and except room hoists and gathering pumps, which will remain in the same location for a period of 1 year or more, shall be completely housed in an incombustible structure built of tile, brick, stone, concrete or of grounded steel plates not less than 1/8 inch in thickness, securely joined.

   Summary of the Request: AMFIRE Mining requests a variance that pertains specifically to the permanent pumping facility located along the intake just outby the B Main--2 Right Intersection at the Madison Mine.

   Beneficial Use of Fly Ash (CMT Energy Inc., GFCC No. 14-04-01, Snow Shoe Township, Centre County (Beech Creek Watershed)): The Department of Environmental Protection has received an application for a general permit from CMT Energy, Inc., proposing to beneficially use coal refuse ash as a soil amendment and fill material to establish positive drainage at the Poorman Side site located in Snow Shoe Township, Centre County. A copy of the application is available for review at the Moshannon District Office. Interested persons or municipalities may submit comments within 60-days recommending revisions to, approval of or disapproval of the application.
