 Description of Proposed Activity: Amendment of an NPDES Permit for existing discharges of treated Industrial Waste, Groundwater and Stormwater. This amendment is providing an opportunity for the public and other interested parties, to comment on the site-specific ambient water quality criteria that are being proposed for the Bear Creek Area Chemical Site, as described as follows.

Site-Specific Water Quality Criteria

 Consideration of effluent limits and/or monitoring requirements in this permit for Benzene Metadisulfonic Acid (BDSA), Benzene Monosulfonic Acid (BSA), p-Phenol Sulfonic Acid (p-PSA), and Resorcinol were based onsite-specific criteria that were developed by AMEC Earth & Environmental (AMEC), a consultant to Beazer East, Inc. (Beazer East). The criteria have been developed with methodologies approved by the Department. The development of site-specific criteria for these substances was announced in the Pennsylvania Bulletin (39 Pa.B. 2594, May 23, 2009) as part of a request by the Department of Environmental Protection (Department) for analytical test methods, data and pertinent scientific information since there are no EPA-approved analytical methods for benzene metadisulfonic acid, benzene monosulfonic acid and p-phenol sulfonic acid (sulfonates).

 Documentation to support the request was submitted to the Department on April 11, 2008, by Babst, Calland, Clements, and Zomnir, on behalf of Beazer East. These criteria apply to the sites that are located within an area approximately 60 square miles in size and that has been designated by the Department under the Hazardous Sites Cleanup Act (HSCA) as the ''Bear Creek Area Chemical Site'' (BCACS).

 Because water quality criteria had not been developed for the sulfonates or resorcinol by either the Department or the U.S. EPA, AMEC used the U.S. EPA's national guidelines to develop aquatic life water quality criteria as stated in 25 Pa. Code § 16.22. In addition, the Department developed ambient water quality criteria for the protection of human health for resorcinol as stated in 25 Pa. Code § 16.32. The following documentation was used to support the resorcinol human health criterion: Resorcinol—Concise International Chemical Assessment Document 71, published under the United Nations Environment Programme, the International Labour Organization, and the World Health Organization 2006. The proposed ambient water quality criteria are in the following table:

 In the absence of an EPA approved analytical test method for the sulfonates and resorcinol, the Department is requiring that analytical laboratories apply for and obtain accreditation in accordance with 25 Pa. Code Chapter 252 prior to accepting and analyzing samples for analysis of these compounds. Therefore, the permittee may only rely on results received from a laboratory that has obtained accreditation for the sampling and analysis of sulfonates and resorcinol. Specific analytical requirements for the compounds are contained in the table as follows:

 Description of Proposed Action/Activity: Project involves construction of a new sewage treatment system which will include pretreatment tanks, effluent filters, aerobic secondary treatment by means of a recirculating sand filter, and a drip irrigation system.

Northcentral Region: Water Management Program Manager, 208 West Third Street, Williamsport, PA 17701.

WQM Permit No. 4910403, Sewerage, SIC 4952, P. O. Box 80, Dewart, PA 17730-0080. This proposed facility is located in Delaware Township and Watsontown Borough, Northumberland County.

 Description of Proposed Action/Activity: The project includes decommissioning the Delaware Township Municipal Authority (DTMA) WWTP and the Watsontown Borough WWTP and replacing them with new pump stations and force mains to convey wastewater to the Milton Regional Sewer Authority (MRSA) WWTP for treatment. The project also includes upgrades to the Elm/Canal Street Interceptor and the Matchin Street Interceptor in Watsontown Borough, and the construction of a new pump station on Frederick Drive in Delaware Township to serve a new sewer extension.

Southeast Region: Water Management Program Manager, 2 East Main Street, Norristown, PA 19401.

WQM Permit No. 0910201, Industrial, Philadelphia Park Casino & Racetrack, 3001 Street Road, Bensalem, PA 19020. This proposed facility is located in Bensalem Township, Bucks County.

 Description of Action/Activity: Construction of a manure storage structure.

Northwest Region: Water Management Program Manager, 230 Chestnut Street, Meadville, PA 16335-3481.

WQM Permit No. 6110401, Sewerage, Township of Cornplanter, 136 Petroleum Center Road, Oil City, PA 16301. This proposed facility is located in Cornplanter Township, Venango County.

 The proposed effluent limits for the operation/activity include: Except for the chronic or catastrophic rainfall events defined as over the 25-year/24-hour rain storms, the CAFO general permit is a nondischarge NPDES permit. Where applicable, compliance with 40 CFR Federal effluent limitation guidelines is required. The general permit requires no other numeric effluent limitations and compliance with the Pennsylvania Nutrient Management Act and the Clean Stream Law constitutes compliance with the state narrative water quality standards.

STATE CONSERVATION COMMISSION

NUTRIENT MANAGEMENT PLANS RELATED TO APPLICATIONS FOR NATIONAL POLLUTION DISCHARGE ELIMINATION SYSTEM (NPDES) PERMITS FOR CONCENTRATED ANIMAL FEEDING OPERATIONS (CAFO)

 The State Conservation Commission has taken the following actions on previously received applications for nutrient management plans under the act of July 6, 2005 (Act 38 of 2005, 3 Pa.C.S. §§ 501—522) (hereinafter referred to as Act 38), for agricultural operations that have or anticipate submitting applications for new, amended or renewed NPDES permits, or Notices of Intent for coverage under a general permit, for CAFOs, under 25 Pa. Code Chapter 92. This notice is provided in accordance with 25 Pa. Code Chapter 92 and 40 CFR Part 122, implementing The Clean Streams Law (35 P. S. §§ 691.1—691.1001) and the Federal Clean Water Act.

 Persons aggrieved by any action may appeal under section 517 of Act 38, section 4 of the Environmental Hearing Board Act (35 P. S. § 7514) and 2 Pa.C.S. §§ 501—508 and 701—704 (relating to Administrative Agency Law) to the Environmental Hearing Board, Second Floor, Rachael Carson State Office Building, 400 Market Street, P. O. Box 8457, Harrisburg, PA 17105-8457, (717) 787-3483. TDD users should contact the Environmental Hearing Board (Board) through the Pennsylvania AT&T Relay Service at (800) 654-5984. Appeals must be filed with the Board within 30 days of publication of this notice in the Pennsylvania Bulletin. This paragraph does not, in and of itself, create any right of appeal beyond that permitted by applicable statutes and decision law.

PUBLIC WATER SUPPLY (PWS) PERMIT

 Under the Pennsylvania Safe Drinking Water Act (35 P. S. §§ 721.1—721.17), the following parties have applied for a PWS permit to construct or substantially modify a public water system.

 Persons wishing to comment on a permit application are invited to submit a statement to the office listed before the application within 30 days of this public notice. Comments received within the 30-day comment period will be considered in the formulation of the final determinations regarding the application. Comments should include the name, address and telephone number of the writer and a concise statement to inform the Department of Environmental Protection (Department) of the exact basis of a comment and the relevant facts upon which it is based. A public hearing may be held after consideration of comments received during the 30-day public comment period.

 Following the comment period, the Department will make a final determination regarding the proposed permit. Notice of this final determination will be published in the Pennsylvania Bulletin at which time this determination may be appealed to the Environmental Hearing Board.
