NUTRIENT MANAGEMENT PLANS RELATED TO APPLICATIONS FOR NPDES PERMITS FOR CAFOs

 The State Conservation Commission has taken the following actions on previously received applications for nutrient management plans under 3 Pa.C.S. Chapter 5, for agricultural operations that have or anticipate submitting applications for new, amended or renewed NPDES permits or NOIs for coverage under a general permit for CAFOs under 25 Pa. Code Chapter 92a. This notice is provided in accordance with 25 Pa. Code Chapter 92a and 40 CFR Part 122, implementing The Clean Streams Law and the Federal Clean Water Act.

 Persons aggrieved by an action may appeal under 3 Pa.C.S. § 517, section 4 of the Environmental Hearing Board Act and 2 Pa.C.S. §§ 501—508 and 701—704 to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, 400 Market Street, P. O. Plan Description: The Corrective Action Plan (CAP), submitted as a plan update revision to West Hazleton Borough's (Borough) Official Sewage Facilities Plan, proposes a systematic investigation that will identify and propose corrective measures for portions of the Borough's wastewater collection system that may be subject to excessive amounts of infiltration/inflow (I/I). The CAP is also intended to reduce hydraulic overloading at the Greater Hazleton Joint Sewer Authority's Wastewater Treatment Facility. The CAP also contains an implementation schedule for its investigative activities. The CAP is now to be considered an integral part of the Borough's Official Sewage Facilities Plan.

 Should conditions be encountered during the implementation of the CAP, which require the alteration of the approved CAP, the Borough shall contact the Department, in writing, and discuss the need to alter the CAP at the earliest possible time. Any additional wastewater-related improvements, additions, deletions or changes outside of those explicitly described in the CAP must be in compliance with the Department's regulations and be submitted to and approved by the Department in writing.

Plan Description: The approved plan provides for the subdivision plan submitted for the above referenced proposed Official Plan Revision consisting of a single family residence on a 2.82 acre tract.

 This project proposes a small flow treatment facility to repair a malfunctioning on-lot sewage disposal system, which currently serves the residence. The proposed treatment facility will include a 1,500 gallon, dual compartment treatment tank, an Orenco Advantex(r) AX-20N treatment unit, followed by an ultraviolet radiation disinfection unit. The discharge will be to a tributary of the West Branch Sobers Run, a tributary to the Bushkill Creek, which is designated as High Quality-Cold Water Fishes (HQ-CWF) in 25 PA Code § 93.9c. An existing private springhouse is located on the property.

 Since there is no environmentally sound and cost-effective nondischarge alternative available to correct the existing public health or pollution hazard at this site, the social or economic justification requirements in 25 PA Code § 93.4c(b)(1)(iii) for a discharge to high quality waters has been satisfied.

 The proposed development is located at 189 East Mountain Road, Bushkill Township, Northampton County.

Project Description: The approved plan provides for construction of approximately 1400 linear feet of small diameter low-pressure sewers with individual grinder pumps, serving an estimated 23 Equivalent Dwelling Units (EDU) or approximately 9200 gallons per day, from 35 connections of seasonal and full time residences.

 The project area includes sections of Christian Hollow Road, from the end of the existing collection line, which is approximately 1.25 miles southeast of the intersection of Christian Hollow Road and White Hollow Road and continuing southeast for approximately 1.4 miles. In addition, sections of Robbins Brook Road, from the existing pump station on West Valley Road and continuing west for approximately 0.78 miles, and Kandare Camp Lane from the existing force main (FM1) on West Valley Road and continuing west for approximately 0.66 miles will be sewered.

 The Department's review of the sewage facilities update revision has not identified any significant environmental impacts resulting from this proposal. Any required NPDES Permits or WQM Permits must be obtained in the name of Norwich Township.

Credits for phosphorus will be needed to comply with the Chesapeake Bay tributary strategy and the sewage plant will need to meet non-degrading limits established for the discharge to the receiving stream. The proposed motel is located on the east side of Lebanon Rd at Engle Lane. The DEP Code number is A3-36948-456-3 and the APS number is 722591. The Department's review of the sewage facilities update revision has not identified any significant environmental impacts resulting from this proposal. Any required NPDES Permits or WQM Permits must be obtained in the name of the owner as appropriate.

The proposed pump station will convey the effluent to an existing manhole in 700 Rd. It will then flow by gravity to the Berwick Township Sewage Treatment Plant. The name of the project is Glabview Acres and the DEP code # is A3-01917-159-3m. The Department's review of the sewage facilities update revision has not identified any significant environmental impacts resulting from this proposal. Any required NPDES Permits or WQM Permits must be obtained in the name of the municipality, authority or owner as appropriate.

Plan Description: The Department of Environmental Protection (Department) has reviewed the proposed Official Plan revision consisting of a 27 lot residential subdivision to generate a total of 6183 gallons of sewage per day each to be served by the Exeter Township Berks County Authority sewage treatment plant. This proposal also includes increasing the Antietam Creek Sewer trunk pipe size between Manhole 219 and Manhole 204 from 12 inches to 18 inches. The proposed development is located on Old Friedensburg Rd. in Exeter and Lower Alsace Townships, Berks County. The plan revision is entitled the Windy Willows Subdivision and the DEP numbers are A3-06809-024-3 and A3-06932-279-3. The Department's review of the sewage facilities update revision has not identified any significant environmental impacts resulting from this proposal. Any required NPDES Permits or WQM Permits must be obtained in the name of the municipality or authority as appropriate.

SEWAGE FACILITIES ACT PLAN DISAPPROVAL

Therefore, the planning module information does not adequately assess the impact of the proposed on-lot sewage disposal systems on the groundwater, as required by the Department's regulations. Potential pollution of the Waters of the Commonwealth is considered a nuisance and is prohibited as per the Clean Streams Law

LAND RECYCLING AND ENVIRONMENTAL REMEDIATION

UNDER ACT 2, 1995

PREAMBLE 2


The following plans and reports were submitted under the Land Recycling and Environmental Remediation Standards Act (35 P. S. §§ 6026.101—6026.907).

 Provisions of Sections 301—308 of the Land Recycling and Environmental Remediation Standards Act (act) (35 P. S. §§ 6026.301—6026.308) require the Department to publish in the Pennsylvania Bulletin a notice of submission of plans and reports. A final report is submitted to document cleanup of a release of a regulated substance at a site to one of the act's remediation standards. A final report provides a description of the site investigation to characterize the nature and extent of contaminants in environmental media, the basis for selecting the environmental media of concern, documentation supporting the selection of residential or nonresidential exposure factors, a description of the remediation performed and summaries of sampling analytical results which demonstrate that remediation has attained the cleanup standard selected. Submission of plans and reports, other than the final report, will also be published in the Pennsylvania Bulletin. These include the remedial investigation report, risk assessment report and cleanup plan for a site-specific standard remediation. A remedial investigation report includes conclusions from the site investigation; concentration of regulated substances in environmental media; benefits of reuse of the property; and, in some circumstances, a fate and transport analysis. If required, a risk assessment report describes potential adverse effects caused by the presence of regulated substances. If required, a cleanup plan evaluates the abilities of potential remedies to achieve remedy requirements.

 For further information concerning plans or reports, contact the environmental cleanup program manager in the Department regional office under which the notice of receipt of plans or reports appears. If information concerning plans or reports is required in an alternative form, contact the community relations coordinator at the appropriate regional office. Okula Property, E2 Deibert Drive, Jackson Township, Monroe County. James P. Gibson, Brinkerhoff Environmental Services, Inc., 133 Jackson Road, Suite D, Medford, NJ 08055 has submitted a Final Report (on behalf of his client, Anna Okula, E2 Deibert Drive, Stroudsburg, PA 18360), concerning the remediation of soil found to have been impacted by kerosene as a result of a release from a kerosene aboveground storage tank. The report was submitted to document attainment of the Residential Statewide Health Standard for soil. A public notice regarding the submission of the Final Report was published in The Pocono Record on January 1, 2011.

Pocono Quarry/Eureka Stone Quarry Property, 300 Keiser Road, Hamilton Township, Monroe County. Martin P. Gilgallon and Dean Cruciani, Pennsylvania Tectonics, Inc., 826 Main Street, Peckville, PA 18452 have submitted a Final Report (on behalf of their client, Eureka Stone Quarry, Inc., P. O. Box 249, Chalfont, PA 18914), concerning the remediation of soil found to have been impacted by diesel fuel as a result of a release due to a loose (partially open) shutoff valve on the fuel company's tanker, which occurred during fuel delivery to an aboveground storage tank. The report was submitted to document attainment of Residential Statewide Health Standard for soil. A public notice regarding the submission of the Final Report was published in The Pocono Record on February 9, 2011.

Pfizer, Inc., 8751 Paint Mill Road, Washington Township, Lehigh County. William B. Gilchrist, Roux Associates, Inc., 1222 Forest Parkway, Suite 190, West Deptford, NJ 08066 has submitted a Risk Assessment Report/Final Report (on behalf of his client, Pfizer, Inc., 100 Route 206 North, Peapack, NJ 07977), concerning the remediation of soil found to have been impacted by VOCs, Inorganics, and benzo(a)pyrene as a result of historical operations at this former chromium oxide and chromium hydrate pigment manufacturing facility. The report was submitted to document attainment of both the Statewide Health Standard for soil and the Site-Specific Standard for soil. A public notice regarding the submission of the Final Report was published in The Morning Call on February 25, 2011.

Rodney Gilbert Residence, 1542 Strauss Valley Drive, Mahoning Township, Carbon County. Christopher S. Green, AquAeTer, Inc., 215 Jamestown Park, Suite 100, Brentwood, TN 37027 has re-submitted a Final Report (on behalf of his client, Westfield Insurance Company, P. O. Box 5001, Westfield Center, OH 44251), concerning the remediation of soil and groundwater found to have been impacted by No. 2 fuel oil as a result of a spill from an aboveground storage tank. The report was submitted to document attainment of the Residential Statewide Health Standard.

Edward Toole Residence, Providence Township, Lancaster County. Brownfield Associates, Inc. 500 Coatesville Road West Grove, PA 19390, on behalf of PCS Chadaga, (dba, Heritage Estates) c/o Property Management, Inc., 1300 Market Street Lemoyne, PA 17043 and Edward Toole, 5 Ridgedale Avenue, New Providence, PA 17560, submitted a Final Report concerning remediation of site soils contaminated with No. 2 fuel oil. The report is intended to document remediation of the site to meet the Residential Statewide Health standard.

Ryan Hershberger Residence, Camp Hill Borough, Cumberland County. BL Companies, 4242 Carlisle Pike, Suite 260, Camp Hill, PA 17011, on behalf of Ryan Hershberger, 2074 Enfield Street, Camp Hill, PA 17011 and Allstate Insurance, 6945 Flank Drive, Suite 1000, Harrisburg, PA 17112, submitted a Final Report concerning remediation of site soils and groundwater contaminated with No. 2 fuel oil. The report is intended to document remediation of the site to meet the Residential Statewide Health standard.

Former UGI Harrisburg Maintenance Facility, City of Harrisburg, Dauphin County. EPSYS LLC, 1414 North Cameron Street, Harrisburg, PA 171033, on behalf of Journal Publications, Inc., 1500 Paxton Street, Harrisburg, PA 17104, submitted a Remedial Investigation Report, Risk Assessment Report, and Cleanup Plan concerning remediation of site soils and groundwater contaminated with chlorinated solvents from the operation of a maintenance facility. The reports are intended to document remediation to the Site Specific standard.

Former Kemp Foods Facility, City of Lancaster, Lancaster County. B & B Diversified Enterprises, Inc, PO Box 16, Barto, PA 19504, on behalf of HP Hood LLC, 6 Kimball Lane, Lynnfield, MA 01940, submitted a Remedial Investigation, Cleanup Plan, and Final Report concerning remediation of site groundwater contaminated with PCBs, PAHs, VOCs and SVOCs. These reports are intended to document remediation of the site to meet the Site Specific standard. This notice corrects the February 5, 2011 notice in which the reports were incorrectly identified.

LAND RECYCLING AND ENVIRONMENTAL REMEDIATION

The Department has taken action on the following plans and reports under the Land Recycling and Environmental Remediation Standards Act (35 P. S. §§ 6026.101—6026.907).

 Section 250.8 of 25 Pa. Code and administration of the Land Recycling and Environmental Remediation Standards Act (act) require the Department to publish in the Pennsylvania Bulletin a notice of its final actions on plans and reports. A final report is submitted to document cleanup of a release of a regulated substance at a site to one of the remediation standards of the act. A final report provides a description of the site investigation to characterize the nature and extent of contaminants in environmental media, the basis of selecting the environmental media of concern, documentation supporting the selection of residential or nonresidential exposure factors, a description of the remediation performed and summaries of sampling methodology and analytical results which demonstrate that the remediation has attained the cleanup standard selected. Plans and reports required by the act for compliance with selection of remediation to a site-specific standard, in addition to a final report, include a remedial investigation report, risk assessment report and cleanup plan. A remedial investigation report includes conclusions from the site investigation; concentration of regulated substances in environmental media; benefits of reuse of the property; and, in some circumstances, a fate and transport analysis. If required, a risk assessment report describes potential adverse effects caused by the presence of regulated substances. If required, a cleanup plan evaluates the abilities of potential remedies to achieve remedy requirements. A work plan for conducting a baseline remedial investigation is required by the act for compliance with selection of a special industrial area remediation. The baseline remedial investigation, based on the work plan, is compiled into the baseline environmental report to establish a reference point to show existing contamination, describe proposed remediation to be done and include a description of existing or potential public benefits of the use or reuse of the property. The Department may approve or disapprove plans and reports submitted. This notice provides the Department's decision and, if relevant, the basis for disapproval.

R. Hull 1H/2H Well Site, 46 RR 1, Springville Township, Susquehanna County. James Pinta, Jr. and David Testa, URS Corporation, 501 Holiday Drive, Foster Plaza 4, Suite 300, Pittsburgh, PA 15220 submitted a Final Report (on behalf of their client, Cabot Oil & Gas Corporation, 5 Penn Center West, Suite 401, Pittsburgh, PA 15276), concerning the remediation of soil found to have been impacted by drilling fluid constituents due to storage tank vandalism, which consisted of four drilling fluid storage tanks being opened during the night. The report documented attainment of the Statewide Health Standard for soil and documented attainment of the Background Standard for arsenic for soils and was approved on February 28, 2011. The report was originally submitted within 90 days of the release.

Pocono Quarry/Eureka Stone Quarry Property, 300 Keiser Road, Hamilton Township, Monroe County. Martin P. Gilgallon and Dean Cruciani, Pennsylvania Tectonics, Inc., 826 Main Street, Peckville, PA 18452 submitted a Final Report (on behalf of their client, Eureka Stone Quarry, Inc., P. O. Box 249, Chalfont, PA 18914), concerning the remediation of soil found to have been impacted by diesel fuel as a result of a release due to a loose (partially open) shutoff valve on the fuel company's tanker, which occurred during fuel delivery to an aboveground storage tank. The report documented attainment of Statewide Health Standard for soil and was approved on February 24, 2011.

Mountain Research, LLC, 825 25th Street, Altoona, PA 16601, on behalf of PA Real Estate Investment Trust, 200 South Broad Street, Philadelphia, PA 19102, submitted a Final Report concerning remediation of site soils and groundwater contaminated with BTEX, PAHs and lead. The Final Report demonstrated attainment of the Residential Statewide Health standard, and was approved by the Department on March 4, 2011.

Martin Limestone / Limeville Quarry, Salisbury Township, Lancaster County. Reliance Environmental, Inc., 130 East Chestnut Street, Lancaster, PA 17602, on behalf of Martin Limestone, Inc., PO Box 550, Blue Ball, PA 17506, submitted a Final Report concerning remediation of site soils and groundwater contaminated with lubricating oil. The Final Report demonstrated attainment of the Residential Statewide Health standard, and was approved by the Department on March 7, 2011.
